WHEREAS, Peninsula Behavioral Health has constructed all storm drainage facilities for the Peninsula Behavioral
Health - Employee Parking Lot and
WHEREAS, Peninsula Behavioral Health is required, pursuant to Section 13,63.270 of tile City ot'Port Angeles
Municipal Code(Maintenance Covenant Required for Privately Maintained Drainage Facilities), to operate and
maintain all storm drainage facilities located Outside designated City ot'Pork Angeles' Rights of'Way and Fasenlents
for the Peninsula Behavioral Health - Employee Parking Lot project; and
WIll"REAS, the City is required to operate and maintain all storm drainage facilities associated with the Peninsula
Behavioral Health - Employee Parking Lot located within dedicated City ole Pork Angeles' Rights of Way and
Easements, Subject to the requirements of Section 13.63,290 of the City ol'Port Angeles Municipal Code;and
WHI-.RE.,,AS, the City arid the Peninsula Behavioral Health are mutually desirous of providing assurances I'm-the
future continued maintenance, repair and operation of'storm drainage facilities for the Peninsula Behavioral Health -
Fmployce Parking Lot.
NOW,THEREFORE,EREFORE, in consideration of the agreements herein provided and other good and valuable
consideration, the parties agree as follows:
I. Peninsula Behavioral Health warrants and represents that it has sole and exclusive authority and sole and
exclusive right, title and interest in the suf�Ject property situated in the City of Port Angeles, Clallam County,
Washington, legally described as:
Lots 17 and 18, in Block 268, of the Townsite of Port Angeles.
Situate in Clallam County, State of Washington,
2. Peninsula Behavioral Health for themselves and their successors and assigns,covenant and agree to
maintain, repair and replace any and all storm drainage infrastructure in accordance with the maintenance
standards in Appendix A -Operation and iMaintenance Manual within the Peninsula Behavioral Health -
Employee Parking Lot. Such maintenance activities shall be performed as described in the Stormwater
Facility Operation and Maintenance Manual tier the Peninsula Behavioral Health - Employee Parking Lot;
and that in the event it is contacted by the City of Port Angeles Public Works and Utilities [department, it will
perform any and all maintenance, repair or replacement as indicated by the Public Works and Utilities
Department. Peninsula Behavioral Health shall perform all such work within the time frame set forth in the.
Maintenance Timeline established in the Stormwater Facility Operations and Maintenance Manual,
completed to the satisfaction of tile City.
3, The City shall not,and it does not,serve as a guarantor of tile performance of Peninsula Behavioral
Health, nor does the City make any representations or warranties with regard to the design or capability of
storm drainage facilities,The City may, but is not required, in its sole discretion to elect to repair, replace
or maintain storm drainage facilities if in the sole opinion of the City, Peninsula Behavioral Health has
failed to do so within the time frame set forth in the Maintenance Timeline established in the Stormwater
Facility Operation and Maintenance Manual. All such charges associated with such work, including
administrative costs and professional f'ccs, shall be charged to the Peninsula Behavioral Health and
payable forthwith. Any such charges shall be subject to being enforced and collected by all legal means.
4, This Agreement shall be binding upon the heirs, successors and assigns of the Peninsula Behavioral health.
5. This Agreement may only be modified in writing by a document executed by the Peninsula Behavioral
Health and the City.

PURPOSE
The purpose of this manual is to provide the stormwater facility operations and maintenance
protocols for the stormwater facilities at the Peninsula Behavioral Health Employee Parking Lot
in Port Angeles, WA. This manual provides background information for the development,
identifies all stormwater facilities to be maintained, names the entity legally responsible for
maintenance, grants City of Port Angeles personnel access for annual inspections, details
requirements for maintaining records and provides a maintenance checklist and log.
BACKGROUND
The total area of the parcel(s) being developed is 0,32 acres. The parcel(s) previously contained
a single family residence and associated outbuildings which have since been removed. This
project will consist of construction of a new 38 space paved employee parking area and
associated stormwater utilities. The project site is located at the NW corner of the intersection
9th Street and Lincoln Street in Port Angeles, WA: parcel numbers 06-30-00-026890 and 06-30-
00-026885.
STORMWATER FACILITIES
List of facilities to be maintained:
• (1) Type 1 Catch Basin
• (4) Type 2 Catch Basins
• (6) Access Risers
0 (1) Outlet Structure
0 (1) Kristar Concrete Catch Basin Perk Filter
0 (1) Detention Structure
Refer to the Stormwater Maintenance Plan on page 7 to see layout of storm facilities.
MAINTENANCE RESPONSIBILITY
The two parties involved in the continual operation, maintenance, and repair of stormwater
facilities associated with the Peninsula Behavioral Health Employee Parking Lot are Peninsula
Behavioral Health and the City of Port Angeles. Refer to page 7 to clearly see which storm
drain facilities are to be maintained by which entity.
In General, all storm drain facilities located on the Peninsula Behavioral Health property will
remain private with the former being the entity legally responsible for the continual operation,
maintenance, and repair,
In General, storm drain facilities that are located offsite and in the City Right of Way will be
conveyed to the City at the conclusion of the project, The City of Port Angeles will be the entity
legally responsible for the continual operation, maintenance and repair of those facilities.

CITY INSPECTIONS
The City of Port Angeles shall be allowed access to the site for an annual inspection of all
permitted stormwater facilities, The City will charge an annual inspection fee per PAMC
3.70.110. Follow up inspections may be required and additional fees may be charged.
RETENTION OF RECORDS
The person legally responsible for the facilities shall maintain all records of maintenance
inspections, repairs, warning letters, and notices of violations. These records shall be made
available for viewing to the City of Port Angeles within 7 days of request.
MAINTENANCE
Proper maintenance is vital for adequate functioning of the stormwater facilities. The City of Port
Angeles will require a maintenance bond for all new construction per Urban Services Standards
and Guidelines, Section 1A.130. All flow control and water quality treatment facilities must be
inspected every six months for a period of two years following project approval. The stormwater
facilities thereafter will have annual inspections unless otherwise required, See Table on pages
4 and 5 for an inspection checklist. Make photocopies of the checklist as necessary keeping the
attached sheets as a clean original copy. All maintenance standards for stormwater facilities
shall conform to the Department of Ecology 2005 Stormwater Management Manual for Western
Washington.
MAINTENANCE AND REPAIR LOG
Record any required maintenance or repair on the log sheet on page 6. Make photocopies of
the log sheet as necessary keeping the attached sheet as a clean original copy.
A copy of the completed Annual Maintenance Inspection Checklist and Maintenance Log shall
be submitted to the City of Port Angeles Public Works Department by January 31 st for the
previous year.
MAINTENANCE TIMELINE
This covenant requires that when defects to the stormwater system are found during the annual
inspection the needed repair shall be completed within the timeline defined below:
• Within 6 months for catch basins, treatment vaults, detention pipe, pipe inlets and pipe
outlets.
• Within I year for typical maintenance on wet pool facilities, flow control structures, and
retention and detention ponds,
• Within 2 years for maintenance that requires capital construction of less than $25,000-
• Within 9 months for maintenance requiring re-vegetation.

Pipes should be securely grouted to catch basin wall without cracks or
holes. Regrout pipes to catch basin wall to eliminate all cracks and holes.
Remove lid and inspect sumps.
Remove excess silt, debris and vegetation.
-Look for any evidence of oil, gasoline, contaminates or pollutants.
Coordinate removal/cleanup with local water quality response agency.
Inspect orifice holes.
Outlet -Remove any sediment, vegetation, or debris that is or could soon block flow
Control through orifice holes.
Structures Inspect structure for any defects.
-Repair any defects that could allow water in or out of control structure.
Significant damage may require control structure to be replaced-
Check inlet and outlet pipes,
-Pipes should be securely connected to structure. If, by visual inspection, it
can be seen that the pipes aren't connected properly than the pipes will need
to be reconnected to the bell fittings and sealed with grout or joint sealant.
Remove lid and inspect vault.
-Employ vacuum truck to remove standing water, excess silt, debris and
vegetation.
Treatment -Look for any evidence of oil, gasoline, contaminates or pollutants.
Structures/ ---Coordinate removal/cleanup with local water quality response agency.
Inspect vault or pipe for any defects.
Detention Repair any defects that could allow water in or out of vault or pipe in any

Pipe Inlet -Inspect area around end of pipe to see if erosion of 2 inches deep or greater
Outlet exists at pipe. If so, install 5 square foot by 1 foot deep rock pad at inlet or
outlet to dissipate the waters energy.

-Examine exposed pipe for any structural damage that could impede flow.

oil and grease, discoloration, turbidity and odor in stormwater discharges.
