AN ORDINANCE of the City of Port Angeles, Washington amending Chapters
2.18 Hearing Examiner, 2.36 Planning Commission and repealing
Ordinance 1796, Chapter 2.52, Board of Adjustment of the Port Angeles
Municipal Code.
THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO HEREBY ORDAIN
AS FOLLOWS:
Section 1. Ordinance 3536 as amended, and Chapter 2.18 of the Port Angeles
Municipal Code relating to Hearing Examiner are hereby amended to read as follows:
2.18.060- Functions, issues and jurisdiction of the Hearing Examiner.

The Hearing Examiner is hereby authorized and directed to hear and decide the following
matters:

B. Appeal Procedure
As to all of the foregoing issues and matters, the decision of the Hearing Examiner shall be the
final decision of the City. The decision of the bearing Examiner in these cases may be appealed
to Superior Court. Appeals must be filed within 15 days of the notice of decision.

Development.
A. Review Authority
The Director of Community and Economic Development,referred to as"Director"in this section
is hereby authorized and directed to hear and decide the following matters:

B. Appeal Procedure
As to all of the foregoing issues and matters, the decision of the Director shall be an
administrative decision. Such decision may be appealed to the Hearing Examiner, provided that
the appeal must be filed with the City within 15 days after the :Director issues the decision,
provided that if longer appeal period is established by state law,the longer period shall control.
If an appeal is not filed within the applicable period, the decision of the Directors is the final
decision of the City. if a matter is appealed, the deeision of the Hearing Examiner is the fina
decision of the City. in those eases the deeision of the Hearing Examiner may be appealed to
Superiof Couft The appeal to Superior-GouA must be filed within 15 days of the date the Hearing

Section 2. Ordinance 11.23 as amended, and Chapter 2.36 of the Port Angeles
Municipal Code relating to Planning Commission are hereby amended by repealing Section
2.36.120 as follows.

Section 3. Chapter 2.52 of PAMC and(.ordinance 1.796 is repealed in its entirety.
CHAPTER 2.52 BOARD OF ADjUSTMENT
2.52.010 Establislunent Member-ship.
A Beafd of Adjustment is established.The word "Bear-d" when used her-ein shall mean the Board
of Adjustment. The Board "I eonsist of five members.

Section 4 - Corrections. The City Clerk and the codifiers of this ordinance
are authorized to make necessary corrections to this ordinance including, but not limited
to, the correction of the scrivener's/clerical errors, references, ordinance numbering,
section/subsection numbers and any references thereto.
Section 5-Severability. If any provisions of this Ordinance,or its application to any
person or circumstances„ are held invalid, the remainder of the Ordinance, or application of the
provisions of the Ordinance to other persons or circumstances, is not affected.
Section 6 - Effective Date. This Ordinance, being an exercise of a power specifically
delegated to the City legislative body, is not subject to referendum. This ordinance shall take
effect five(5)days after passage and publication of an approved summary thereof consisting
of the title.
PASSED by the City Council of the City of Port Angeles at a regular meeting of
said Council held on the 21 st day of March,2017.
