This letter is in response to your letter of inquiry regardmg the above referenced
property. Based on information contained in the Building Division files, the manufactured
home was placed on the property in 2000. The RS-7 zone requires a minimum 13-foot side
yard setback.
First, let me say that it is not the City's responsibility to verify property lines when
building inspections are performed. With that said, from topographical information -
available to the City it is apparent that the foundation was constructed with lIttle to no side
yard setback along West 6th Street. Inspections were performed by the City and the activity
was finaled by the City's Building OfficIal Lou Haehnlen. No notations were identified on
the permit that would indicate concerns/corrections with the foundation placement.
. . Although in review, placement ofthe structure is clearly out ofline with other development
in the area, there is no reason to believe that the action was an intentional misrepresentation
on the part of the property owner, and the City does not intend to pursue a violation action in
this matter. However, all future development on the site must be done in conformance with
development standards of the RS-7 zone.
