To Whom It may concern.
I am requestmg that the CIty grant a "RIght of Way Use Penmt" to allow our landscapmg
to remam m the nght-of-way at 221 East WhIdby Ave It IS described and pIctured on
your InspectIOn Report dated 7/1/98 (copy attached)
Please see the mspectIOn report and pIcture attached. The report seems accurate In the
pIcture It appears that there IS a sidewalk passmg from the home east (229) of us and into
our landscaped area. It IS now dIrt but IS the locatIon and WIdth of what was the eXIstmg
sIdewalk passmg through our yards. That sIdewalk passed three homes m the mIddle of
the north sIde of the 200 block of East WhIdby (229,221, and 215). It drops qUIckly mto
a yard on the west end and would drop (If not blocked by laurel bushes) on the east end.
We have lIved at thIS address for over twelve years and have always wanted to replace
the unsafe SIdewalk and re-Iandscape the front yard. From the curb there was about three
feet on "parkmg stnp" whIch rose 4 mches to a SIdewalk that was three feet WIde and m
very poor condItIon. Removal of the SIdewalk revealed another, at a lower grade, below
the eXIstmg one ThIS IS conSIstent WIth what neIghbors told US, WhIdby street was a
narrow dIrt street, then was WIdened WhICh forced homeowners on the south SIde to add
more bulkhead (the grade became lower) and on the north SIde raIse yards and SIdewalks
to compensate for the hIgher grade After street WIdemng the homes on the north SIde
became much lower than theIr ongmal appearance because the street "got hIgher"
I dIscussed WIth the buildmg department on vanous occaSIOns what my optIOns were
Once a representatIve of the CIty (about two years ago) came on-SIte We wanted to
create off street parkIng and possibly a carport. I was told our setbacks were not
adequate for off street parkIng. I also understood that I could have a Sidewalk or not. If!
bUIlt the SIdewalk It must be to CIty standards but I could landscape nght up to the curb,
however I would like, With no penmts.
When our new neIghbors to the west began extenSIve remodelIng they asked If we
conSidered removing the SIdewalks. They, like US, were concerned that It was unsafe,
unSIghtly, and m overall poor condItIOn. At that time all three homeowners With eXlstmg
Sidewalks agreed to remove the Sidewalks. The homeowner to the east (229) deCided It
was too expenSIve to replace the Sidewalk and felt It had lImited purpose She has off
street parkmg and the sidewalk Just lead pedestnans into a dropoffblocked by laurel
bushes. We were unsure, because we were gomg to totally re-Iandscape the front yard
and we waited until the yard was cleared to develop a plan.
My wife and I, like our neighbors on both sides of the street, have worned that the
"appearance" of a sidewalk (on our side) presents a danger to pedestnans and chIldren on
bikes or skates. At one time my son rode mto the laurels, cuttmg his face, and almost
damaging an eye. The sidewalk to the east still, with no warnmg, drops off mto the yard
at 213 E. Whidby With no sidewalk on our side It will "force" pedestnans seekmg to get
off the street to move to the south, a much safer side of the street.
So we deCided to use "temporary" landscape blocks and pavers on our yard. When we
saw the pavers downtown I felt like "If they are good enough for downtown traffic they
certamly should work m our yard" We wanted to make walkways from vehicles parked
m front of our house (we were told we couldn't develop off street parkmg), through and
opemng m the fence, and then to the east and west sides of our home Common bncks
seemed unstable and the unchamfered edges create multiple tnppmg hazards. After
walkmg on the downtown pavers we deCided to copy them. We found that we could buy
the exact same pavers and also show a bit of"PA pnde"!
In our plan we purposely have placed the fence at seven feet from the curb to allow for a
Sidewalk and one row ofbncks when (It) Sidewalks are constructed on our entire block. I
would suggest that Sidewalks will never be placed on our Side of Whidby street. The
filhng and levelmg reqUired would create steep and unacceptable dropoffs to some of the
houses, makmg a bad SituatIOn even worse
I feel the problems on Whidby street, speCifically the 200 block, were made when the
street was set and then Widened many years ago We have mhented a problem that forces
us to be more creative to mamtam a safe and attractive neighborhood.
As I walk the streets of my neighborhood (Vashon, Whidby, Lopez, Orcas) I see that the
vast maJonty of the homes have no formal sidewalks. Homeowners have used concrete
of vanous Widths, gravel, bark, grass and mud. Even the new library at Peabody and
Orcas (for the first few hundred feet) has no Sidewalk on the south and a "parkmg strip"
of grass on the north. Although our landscapmg does not mclude a formal Sidewalk, It IS
consistent With what you find m thiS area, at thiS time
UntIl the north Side, of the 200 block, of East Whidby street gets contmuous and safe
Sidewalks I would hke permiSSion for my landscapmg to remam m place. I feel the
pavers Will proVide safe footmg for travel from parked vehicles to our front door and
around the front of our home Without the appearance of a "Sidewalk" which Will lure
pedestnans, nders, and skaters mto an unsafe area.
