RIGHT-OF-WAY USE AGREEMENT
This Agreement is made between the City of Port Angeles,hereafter the"City",and Carol
Yearout, a single woman,hereafter known as the"Owner"and who resides at 1363 Thompson Road,
Sequim,WA 98382.
Parties recite and agree to the following:
I. The owner holds fee title to and controls the property at 1014/1022 South Peabody
Street within the City of Port Angeles,legally described as Lot 18,Block 330,Townste
of Port Angeles,Clallam County,'Washington,hereafter known as the"Property"
2. The Owner purchased the"Property"with the expectation of improving the building
addressed as 1014 South Peabody Street,hereafter known as the"Building,"to allow for
residential occupancy purposes.
3. The building addressed as 1014 South Peabody Street is located within alley right-of-
way.
4. The City is authorizing partial use of alley right-of-way.
5. In return:,the Owner agrees to fully comply with the following terms and conditions
a. The Owner will indemnify and save harmless the City and its successors and assign,
from any claim, action, liability, loss, damage or suit,arising from the location or use
of the Building near the alley right-of-way at the Property.
b. Should the City at any time determine the encroachment in the alley right-of-way
should be removed,the City shall give the Owner 90 days notice to vacate said
Building and to remove the encroaching portion of the Building. The Owner agrees
to cease use of said Building upon said notice.A permit to move the Building to a
conforming location on the property shall not be unreasonably withheld from the
Owner under such circumstances.

6. This Agreement sl ill be in effect until the encroachment is removed from the alley right-
of-way and the property is brought into compliance with all City codes and regulations.
7. If the Property is sold,this agreement shall carry forward with future ownership.
8. This Agreement shall be recorded in the records of the Auditor of Clallam County
