WHEREAS We, the undersigned owners in fee simple of the following described property'

do hereby acknowledge that private improvements have been or will be constructed in the next 1..00 days by us within the
adjoining public street or roadway described as
encroaching private improvements including, but not limited to,
and associated appurtenances shall be expeditiously demolished,
removed, mo ed, rebuilt or restor at the undersign d owner's expense within sixty (60) days of receipt of written notice
from the City Engineer with work to be done in accordance with the requirements and conditions deemed necessary by the City
Engineer or his designee at such time as the City finds that it is necessary to modify the use thereof If the required work is not
done in a timely fashion and/or if the work does not meet the requirements and conditions set forth, the City is authorized to
have the work done and the cost thereof including reasonable overhead and attorneys fees shall become a civil debt of the
property owners and shall be a lien against the property
We do also hereby agree that the City Engineer may, without notice, remove the private improvements as necessary to repair
utilities or other public facilities and that the City has no obligation to reconstruct or replace such private improvements
The property owners agree to indemnify, hold harmless and defend the City, its employees, agents and assigns from and
against all claims or lawsuits as alleging injury or damage to persons or property as a result of the construction and location of
the private improvements as provided herein.
It is agreed that this agreement shall run with the land and shall be binding on the undersigned owners, their heirs, devisees,

Sewer Lateral and sidewalk installlation!
Dear Rick,
I talked to Gary Kenworthy today at around 3pm and he
assured me the City would relocate the water line and
the cable tv and telephone would be relocated by those
companies The only hold up is the relocation of the
sewer lateral which Trinia had told me would also be
relocated at City expense Gary told me he would have
an answer for me Monday afternoon when Trinia gets
back. It sounds to me like Gary is trying to make a
very good faith effort on our behalf
Thanks for the pictures today! The finished grade on
the side of the garage looks good from what I can tell
by your pictures

said it was the problem of the offending utility
division or company if these were in the way They
are required to be a certain depth and this would
preclude them being in the way If they are in the
way they will pay to relocate them I would contact
Trinia and find out what the procedure is for
locating I know they will not sign off for occupancy
until the sidewalk is in

i spoke with our fireld inspector (Wayne Groff) he has indicated that the san sewer lateral connection was
approximately 4' south of the curb and approximately 4' in depth Go ahead and schedule the sidewalk
excavation, and if any of the utilities need adjusting the city will deal with it. Just keep us informed as to
when, Wayne will be the inspector, notify me at 417-4807 Trenia

I took a look at this area, our 2" water main is in the street and if need be, we can lower the water
service/meter box which is at the south/west area of his lot on Blue Water View Do we have a date/time
commitment to accomplish this activity??

Thank you for forwarding the e-mail I have discussed this with Trenia and our utility supervisor Our
standard policy for City owned utilities has been to lower water services when they conflict with sidewalk
construction since the service line from the water main to the meter is maintained by the City
Maintenance of sewer laterals from the main on are the resposability of the property owers Any other
utilities (i e power or telephone) would be required to move at their cost for sidewalk construction Hope
this clears up Trenia did not recall any committment for the City to lower the sewer lateral Please call me
if you have further questions

Hi Rick,
Did you say there was a problem with the utilities
being in the sidewalk area? Trinia, who is in the
construction division of the utilities department,
said it was the problem of the offending utility
division or company if these were in the way They
are required to be a certain depth and this would
preclude them being in the way If they are in the
way they will pay to relocate them I would contact

Trinia and find out what the procedure is for
locating I know they will not sign off for occupancy
until the sidewalk is in

Subject: sidewalk installation
This e-mail is in regards to the installation of the sidewalk at 501 Blue Water View This afternoon the contractor doing the
excavation for the sidewalk apparently came in contact with the san. sewer lateral. The city has a crew on site repairing the
lateral, but it has been brought to our attention that the san sewer lateral and the city's water main doesn't have but a few
inches of separation, therefore here's the plan. Next week (Monday or Tuesday) the water division will adjust the water main
to get the appropriate separation. I will find out first thing Monday morning as to the time frame. Please hold off on the
sidewalk installation until we get the utilities in the proper location. I can be reached at 417-4807 if you have questions.

I spoke with our fireld inspector (Wayne Groff) he has indicated that the san sewer lateral connection was
approximately 4' south of the curb and approximately 4' in depth Go ahead and schedule the sidewalk
excavation, and if any of the utilities need adjusting the city will deal with it. Just keep us informed as to
when, Wayne will be the inspector, notify me at 417-4807 Trenia

Thank you for the heads up I knew this was going to
happen Thats why I was encouraging everyone to get
started over a month ago when the driveway was being
put in I was to take possession of this home on July
9th Looks like it will be another week at least.
