Amendment to Memorandum of Understanding
This Amendment servesto extend the Memorandum of Understanding, expiring on October 31,
2007, to October 31; 2010, by and between the State of Washington, Department of Ecology and
local jurisdictional participants entering into this agreement.
This Amendment to the Memorandum of Understanding shall become effective upon signature
by all parties.

Memorandum of Understanding
This Memorandum of Understanding is entered into this 15th day of November, 2004, by and
between the State of Washington, Department of Ecology, hereinafter referred to as Ecology, and
local jurisdictional participants entering into this agreement, hereinafter referred to as
jurisdictional participants.
The purpose of this Memorandum of Understanding is to outline the roles and responsibilities of
Ecology and jurisdictional participants related to the 2good2toss website.
2good2toss .com is Washington's online exchange for reusable building materials and household
items. The objective of the site is to facilitate the recycling and repurposing of materials and
items that would otherwise be disposed at Washington state landfills and waste to energy
facilities, in addition to promoting an important environmental ethic.
This function is in keeping with Ecology's mission, as set forth in chapter 70.95 RCW, to reduce
the volume of solid waste placed in the state's landfills and waste to energy facilities through
w'aste reduction, source separation, recycling, and diversion. To the extent the practices of the
jurisdictional participants differ from this intended function in the way they maintain and
administer their individual web sites, and in the types of items they allow to be listed, the
counties shall be responsible for, and shall assume any. liability resulting from such practices.
Ecology contracted with i-WasteNot Systems and has served in a coordination role, in addition
to providing funding and supporting the development of the site, marketing plan, and
promotional materials (contract # C0300268). This contract ended October 31,2004. After this
date, jurisdictional participants may elect to continue services provided by i- W asteNot by paying
the annual invoice amount directly to i-WasteNot. Please contact them for any questions
concerning the Service Invoice.
Jurisdictional participants agree that as of November 1,2004, Ecology shall not be responsible
for nor have any liability resulti~g from administration or operation of the 2good2toss web site.
The gateway web page is located at http://www.2good2toss.com. However, each jurisdictional
participant has and will administer their own customized exchange.
Ecology Role and Responsibilities:
Effective November 1,2004, Ecology will no longer be party to any contract with i-
WasteNot Systems. Ecology will continue to renew and pay the necessary fees to maintain
the domain name 2good2toss.com. The current Internet host is Network Solutions
Ecology will commit to provide a portion of staff time (Ecology Project Coordinator) from
November 1, 2004 through October 2007. The Project Coordinator will:
· Assist with coordination between the various jurisdictional participants
· Encourage new communities to join
· Facilitate communication on key issues

i- WasteNot Systems Role and Responsibilities:
i-WasteNot is the developer of the system. During the term of August, 2003, through
October, 2004, they were under state contract (#C0300268) to develop, host, operate, and
provide customer service to 2good2toss jurisdictional participants. i-WasteNot agreed to
host and operate the site for free the first year for counties and cities that joined prior to
November 7,2003. In return, they worked with jurisdi'ctional participants to improve the
site using,their feedback and suggestions.
i-WasteNot will continue to host, operate, and provide customer service annually, charging a
membership fee negotiated between i-WasteNot and local participating jurisdictions.
i-WasteNot will provide a forum to facilitate communication among all partners.
Jurisdictional Participant Role and Responsibilities:
Jurisdictional participants are local governments who become partners in the statewide
2good2toss exchange, coordinating with Ecology and other participants to maintain an
overall connection to the statewide effort. Each jurisdictional participant must maintain,
administer, and promote its own site, at its own expense. After October 31, 2004,
jurisdictional participants must pay the annual subscription fee directly to i-WasteNot to
continue service.
How decisions are made:
2good2toss is a partnership between local participating jurisdictions. Issues that arise that
may affect members of 2good2toss, such as a change in or questions about rule interpretation,
shall follow these steps for resolution:
1. Post iD.formation about the relevant issue on the discussion forum provided by i-WasteNot
and request feedback from members.
2. If there is no clear consensus, a decision committee made up of jurisdictional participants
will be formed to evaluate the issue and provide recommendations.
3. Committee recommendations will be posted on the discussion forum and members will be
polled. NOTE: Each jurisdictional participant will have one vote. If there are county/city
or county/county partnerships, each county and city have one vote each.
4. Resolution will be decided by Majority rule.
Rules of2good2toss Web Site:
Although flexibility is built in to certain aspects of the site, it is important that there is a level
of consistency within 2good2toss. Below are specific rules administrators shall follow when
making decisions about appropriate listings.

Site Rules:
1. Monitoring Individual Sites: It is the administrator's role in each participating
jurisdiction to monitor their site for inappropriate listings.
· Site administrators reserve the right to refuse listing a material, edit information
provided by the listing party, or delete any listing or user from the site.
· Any decision to remove a listing must be consistent with the rules stated below.
Local participants may add additional requirements and guidelines, as necessary.
· It is the responsibility of the site administrator to determine the maximum amount (if
any) individuals may charge for an item and to monitor compliance.
2. Acceptable Items: The 2good2toss web site shall be limited to the exchange of
reusable building materials and household items.
3. Unacceptable Items - the following shall NOT be allowed (but is not limited to)
· Items that are NOT reusable building materials or household items
· Live animals
· Products whose use or possession is illegal in Washington state
· Sexually explicit materials or materials that contain threatening language
· Alcohol or drug related material
· Potentially hazardous products such as chemicals or weapons. ,Note: Ecology and
participating jurisdictions are not responsible or liable for determination of what may
constitute a hazardous substance or create a hazardous situation.
4. Buyer Beware: 2good2toss sponsors provide listing services only. Goods should be
fully inspected by individuals before acceptance. Sellers are advised to accept cash, or
. receive adequate assurances that payment terms will be completed as agreed upon by both
parties. Site sponsors take no responsibility for transactions or quality of goods received.
5. Statement of Non-Liability: Information provided through 2good2toss is supplied by
the listing party. Neither Ecology, nor participating jurisdictions, their contractors, nor
any advisor, agent, or employee thereof is liable for any information, error or
representation, nor any warranty, expressed or implied, as to the accuracy of the

6. User Eligibility amltResponsibility:
· To be eligible to post items, users must reside in participating Washington state
counties or cities, or obtain permission from the local site administrator.

· There is no charge for listing qualifying items on the 2good2toss site. The maximum
amount individuals may charge per item shall be decided by each local site
administrator. Ads that attempt to bypass this price limit (where and if it exists) by
stating a higher price in the text of the listing, may be deleted and the poster barred
from future use of the site.
· The intent of the site is to provide an avenue for exchanging reusable materials that
might otherwise be disposed or thrown away. It shall not be used for the sale of retail
products or services by for-profit individuals or businesses. The site is intended for
not-for-profit users with surplus materials.
· 2good2toss exists as an informational forum to foster the lawful exchange, reuse, and
recycling of otherwise waste materials. It is the responsibility of 2good2toss users to
be familiar with any legal limitations that may exist for the exchange of listed
materials.
Ecology and participating jurisdictions shall have no responsibility for, nor liability resulting
from operation or administration of the web site, or for harm or damages caused by, or resulting
from items listed on the web site.
This Memorandum of Understanding shall become effective upon signature by all parties.
