Cellular Telephone Agreement to Withhold Funds
THIS AGREEEMENT is made and entered into this 25
day of April 2005 , by and between the Port Angeles Fire
Department, acting through its Chief, herein referred to as the Department, and
Kei th Boques , herein after referred to as the employee.
WHEREAS, the Department has determined that the use of cellular telephones is
necessary to more efficiently conduct routine business as well as improve
communications at emergency scenes.
WHEREAS, one of the Department's two chief officers are required to be
accessible to various agencies, 24-hours a day/7 days a week.
WHEREAS, allowing personal use of the City-owned cellular telephone will
provide the Department the ability to require "key" staff to carry cellular telephones and
be available at all times.
WHEREAS, the parties acknowledge that the Department is responsible for fees
for "base" contract fees for Department accounts and the employee has the responsibility
to pay the total cost of calls that exceed the "base" contract rate, with the Department
becoming obligated to make such payments should the employee fail to do so; and
WHEREAS, it is necessary that the employee give permission to the Department
to deduct from his/her paycheck any amount which the Department becomes obligated to
pay to the service provider due to the employees failure to make the above payment;
IT IS HEREBY AGREED BETWEEN THE PARTIES;
1. The Agreement shall begin on -z. S t1 f1~ l "'2.DD S and shall
automatically renew unless terminated according to the provisions herein.
2. The Department will pay the Department-issued cellular telephone monthly
base contract rate, and in the event that the monthly charges exceed the base
rate, the Department will pay for all costs for use of the phone for authorized
Departmental business and the employee agrees to pay the remainder of the
_~)(~~~~~arges within 30 days of the employees receipt of the cellular
--- telephone detailed invoice.
The employee grants his/her consent to the Department to withhold from any
paycheck due to them any amount that the Department is obligated to pay the
service provider on account of the employee's failure to make timely
payments for the amount that exceeds the base contract rate

3. The employee shall fully indemnify, release and hold harmless, the
Department from any monetary costs or claims of any nature arising out of the
personal use of a City-owned cellular telephone.
4. Upon mutual agreement, either party may terminate this agreement
immediately with written notice to the other party.
IN WITNESS whereof, the parties hereto have cause this Agreement to be
executed the day and year first written.
