INTERLOCAL COOPERATION
AND MUTUAL AID AGREEMENT
This agreement is made and entered into this /.51' day of A,/'/2 J / ,2003,
by and between the City of Port Angeles (City) and the Washington State Department
of Labor and Industries (L&I).
WHEREAS, the City and the L&I recognize the importance of working together in
times of emergencies and jointly making electrical inspectors available during routine
conditions to best serve the residents and, businesses of the greater Port Angeles area.
Both entities also recognize that a mutual aid agreement (MAA) is necessary in order to
provide the highest level of reliability and responsiveness. This MAA will provide the
basis for both entities to provide or receive assistance in a coordinated manner.
WHEREAS mutual aid is voluntary on the part of the City and the L&I and
inspectors may be recalled by the assisting entity at any time.
NOW, THEREFORE, in consideration of the mutual covenants and promises
contained herein, the parties agree as follows:
1. Loan of manpower: Upon request from either party to the other, the
assisting party agrees to perform inspections within the requesting party's
operations area, subject to the assisting party reserving the right to deny or
approve each request in consideration of availability of personnel.
2. Requesting party's duties: The requesting party shall:
a. Insure a safe working environment.
b. Establish a primary contact person for disseminating information to
assisting personnel.
c. If needed and required, arrange for meals and/or any equipment or
supplies needed to perform the inspection.
d. Respect the assisting parties right to schedule inspections to
coincide with their workload.
3. Assisting party's duties: The assisting party agrees to loan the
requesting party:
a. An electrical inspector certified by the State of Washington to
perform electrical inspections on residential and commercial installations.
b. A vehicle for the inspector to use.
c. Any supplies or equipment, unique to the job, required to perform
electric inspections if requested to do so.

4. Reimbursement: The requesting party agrees to reimburse the assisting
party for the costs of the work performed based upon labor and vehicle fees as
established in WAC 296-46A-91 0, (11 )(a). The requesting party agrees to
reimburse the assisting party for any supplies or unique equipment usage
supplied by the assisting party. The assisting party will invoice the requesting
party upon completion of the work, and payment will be made within thirty days
of receipt of such invoice. Each party agrees to keep records of all costs
incurred under this agreement and reserves the right to inspect the records of
the other party if disagreement arises over the amounts invoiced.
5. Right of entry: The parties hereby grant to each other the right of entry
upon all land in which the parties have an interest as necessary to accomplish
inspections requested under this agreement, provided that such right of entry
shall be subject to legal requirements.
6. Emergency call back: The requesting party further agrees that should an
emergency arise during the period of work, which in the opinion of the assisting
party requires the return of personnel, the requesting party shall render all
reasonable assistance in furtherance .of returning personnel as soon as
possible.
7. Indemnification and hold harmless: The requesting party shall protect,
defend, hold harmless, and indemnify the assisting party from any and all claims,
suits, costs, damages of any nature, or causes of action, including the cost of
defense and attorney fees, occurring, arising, or resulting from the assisting
party's performance of work requested under this agreement.
8. Termination: This agreement will remain in effect until cancelled by either
party upon thirty days written notice to the other party.
9. Annual review: Each party will assign an individual to annually review the
effectiveness of the MAA over the last year and make any recommendations
necessary to modify the MAA.
IN WITNESS WHEREOF, THE PARTIES HAVE CAUSED THIS
agreement to be executed by the undersigned duly authorized officials.
