This Agreement is made between the City of Port Angeles, hereafter the "City", and
Bonnie Purvis, a single woman, hereafter the "Owner
1 The Owner holds fee title to and controls the property at 516 S Peabody Street
within the City of Port Angeles, legally described as North half of Lots 17 and. 18
Block 199 TPA, Clallam County
The Owner purchased the property at 516 S Peabody Street with the expectation
of improving the garage \outbuilding (the Building) to allow for commercial
occupancy purposes.
3 The Owner's application for a building permit was denied because the Building is
in a non conforming location on the property, the Owner's proposed use was an
illegal non conforming use, and encroaches upon the City's nght -of -way
4 The dispute was referred to the City Attorney's office for legal action, and
subsequently the parties have agreed to resolve this dispute on the terms and
conditions set out below
5 For its part, the City will grant to the Owner a permit for an electrical upgrade of
the Building, and upon satisfactory inspection an occupancy permit.
6 In return, the Owner agrees to fully comply with the following terms and
conditions
a. The Owner will mdemmfy and save harmless the City and its successors
and assigns, from any claim, action, liability, loss, damage or suit, ansing
from the location or use of the Building near the right -of -way at 516 S
Peabody Street.
b Should the City at any time determine the encroachment on the nght -of-
way should be removed, the City shall give Owner 90 days notice to
vacate said garage /outbuilding and to remove the encroaching portion of
the structure. The Owner agrees to .cease use of said Building upon said
notice. A permit to move the Building to a conforming location on the
property shall not be unreasonably withheld from Owner under such
circumstances.
c. The Owner agrees to compensate the City for use of the right -of -way the
annual sum of $70 00, with the first payment due March 7, 2005 and. due
on the same date annually thereafter
d. Prior to any occupancy of the Building, the Owner shall construct an
intenor partition wall that separates the portion of the Building that
encroaches on the nght -of -way The wall shall be constructed so that it
could support the Building in the event of an impact to the portion of the
Building that encroaches on the nght -of -way Use of the separated portion
which encroaches into the right -of -way may be for storage or other non
habitable uses only The Owner shall obtain a building permit. No
occupancy of the Building is allowed until the wall is constructed and
approved.
7 Neither party will seek costs, expenses, or damages of any type from the other

9 If the property is sold, the property shall be brought into .compliance with all City

10 This Agreement is intended to be the full, final and complete s ettlement of all
pending claims or claims that could have been raised or made resulting from this
dispute.
11 This Agreement is expressly limited to the facts of this case. It is not intended to
establish precedent or to have any effect on the interpretation of the City's code or
regulations outside the facts of this particular case.
12. This writing states the entire agreement of the parties relating to the subject matter
hereof. This incorporates and supersedes all pnor discussions, negotiations and
agreements. There are no other agreements, written or oral, that relate to the
subject matter hereof that are separate from this agreement.
13 This Agreement shall be recorded in the records of the Auditor of Clallam
County

The Department is forwarding the attached letter to you for a response, per your discussion
with Director Collins. We have had several conversations both with Ms Purvis and her
contractor Rick Bradley but apparently have not made the City's position clear
The property at 516 S Peabody was purchased by Mr and Mrs. Drysdale and substantially
remodeled two years ago During that time the Drysdales were told, when they asked, that
because the garage unit's value was minimal, its nonconforming location on the site, and that
it encroaches into the City's nght -of -way, it could not be improved to be used for anything
but storage purposes. The Drysdales cosmetically improved the dilapidated structure but
were never issued any permits to do more than reroof the structure and then sold the property
to Len Rasmussen. A recent site visit indicated that the structure has been entirely rebuilt
without the benefit of anything more than a roofing permit drywall, flooring, electrical
wiring. The unfortunate circumstance is that the seller, Mr Rasmussen, did not pass
information along to the new purchaser that the garage couldn't be occupied.
Ms. Purvis purchased the property expecting to further improve the garage and to allow
occupancy of the unit for commercial purposes. When she came in to obtain a building
permit for electrical upgrade of the garage she was told that she could not occupy the unit and
she became very upset.
I contacted Mr Rasmussen, who told me that he was told by the Drysdales that the garage
could not be occupied but he admitted that he did not so inform Ms. Purvis because he felt
that she would do her own due diligence and discover the information on her own. So we
find ourselves in the very uncomfortable position of having to respond to Ms. Purvis that she
must understand that we still cannot allow occupancy of the structure under the current
regulations. Although ignorance is no excuse is an adage that I deplore, it may be very true
in this case. We held firm on the Drysdales and without setting a dangerous precedent as to
the use of nonconforming (and encroaching) structures, I don't see how we can now relent
because Mr Rasmussen didn't inform the purchasers and they didn't ask.
I think that you have previously been sent background on this issue. If not, please let me
know what further information you need in order to forward the City's response to this issue
to Ms. Purvis.

Thank you for considenng the use of the additional building located at 516 Peabody
Street, Port Angeles, Washington for my business.
I had ongmally purchased the property with the understanding that the garage was usable
space for my business. I had intended to put my tanmng business into this space, as this is
a crucial part of my business and the services I offer the public. As I do not have the
finances available to move the building, It is important to me to try and reach some kind
of an agreement with the City of Port Angeles that will allow me to use the space, while
mdemmfymg the city of any responsibility
I understand that the City of Port Angeles is concerned regarding the fact the garage is
located near a city right-of-way In order to elmmnate any potential hability for the City
and to allow for completion of the remodeling on the property, I agree to indemnify and
save harmless the City of Port Angeles and their successors and assigns, from any claim,
action, liability, loss, damage or suit, arising from the use of the adjacent building near
the right-of-way at 516 Peabody
I also will agree if in the future the City of Port Angeles should need this bldg. (garage)
moved for any reason because of future building plans I will then promptly cease my use
of the space upon reasonable notice.
Also, if the City of Port Angeles might find it necessary I would agree to compensate the
City in a reasonable amount yearly for the use of the right -of -way I am willing to pay
$50 00 dollars a year for the use of the space adjacent to the nght -of -way at 516 Peabody
This proposal shall be effective until the adjoining property is no longer being used for
commercial purposes.

8. This Agreement shall be in effect until the encroachment is removed from the
right -of -way and the property is brought into compliance with all City codes and
regulations.
9. If the property is sold, the property shall be brought into compliance with all City
codes and regulations.

10. This Agreement is intended to be the full, final and complete settlement of all
pending claims or claims that could have been raised or made resulting from this
dispute.
11. This Agreement is expressly limited to the facts of this case. It is not intended to
establish precedent or to have any effect on the interpretation of the City's code or
regulations outside the facts of this particular case.
12. This writing states the entire agreement of the parties relatmg to the subject matter
hereof. This incorporates and supersedes all prior discussions, negotiations and
agreements. There are no other agreements, written or oral, that relate to the
subject matter hereof that are separate from this agreement.
13. This Agreement shall be recorded in the records of the Auditor of Clallam

After checking the crawl space 1 found the following liana should be corrected.
1) A small amount of wood rot was found in the NW comer of the crawl space
area, located above the new rim joist. Wood rot was also found in the sub-
floor materials, located on the NE comer of the crawl area. These areas of
wood rot should be removed and replaced.
2) A section of wood rot was found in the sub flooring, located on the South side
of the ballroom, loaded above the new floor joist. All of the wood rot found
in this area should be removed and replaced.
3) Beetle damage was found in one floor joist, located on the SW side of the
crawl space area. Pert of this joist has been removed and re- supported. I would
recommcnd that all of the damaged wood be removed and replace.
4) All of the cellulose debris should be r moved from the crawl space area.
