A Resolution Of The City Council Of The City Of Port Anglese, Washington,
Authorizing The City Manager To Direct The City Attorney To Request
Leave From The Washington State Supreme Court To File An Amicus Curaie
Brief In The Case Of S. Michael Kunath, Et Al, V. City Of Seattle, Et Al., in
support of the exercise of broad Home Rule authority granted to certain cities
in Washington State, as well as the motion to file such a brief.
WHEREAS, the State of Washington in some instances has failed to recognize the broad Home
Rule authority granted to certain cities in Washington State; and
WHEREAS, the City of Seattle, exercising the authority derived from Home Rule, passed an
ordinance imposing a municipal tax; and
WHEREAS, the King County Superior Court in November 2017 ruled against Seattle's
ordinance; and
WHEREAS, the City of Seattle is appealing the King County Superior Court ruling and has
petitioned for direct review by the Washington State Supreme Court; and
WHEREAS, greater recognition of the broad Home Rule authority granted to certain cities in
Washington State, including the City of Port Angeles, will further the City of Port Angeles
objectives of responsible municipal government, budgeting, and provision of necessary services
to the community.
Now, Therefore, The Port Angeles City Council Does Hereby Resolve As
Follows:
Section 1. The City of Port Angeles declares that greater recognition of the broad Home Rule
authority granted to certain cities in Washington State, including the City of Port Angeles, will
further the City of Port Angeles objectives of responsible municipal government, budgeting, and
provision of necessary services to the community.
Section 2. That the City Manager is hereby authorized to direct the City Attorney to join the City
of Port Angeles in the City of Olympia's amicus curiae brief in the case of S. Michael Kunath,et
al. v. City of Seattle, et al., Supreme Court Cause No. 95295-7, in support of the exercise of broad
Home Rule authority granted to certain cities in Washington State, as well as the motion to file
such a brief.
