RECOMMENDATION: The Planning Division recommends that the Planning
Commission approve CUP 07-03 with 2 conditions, citing 11 findings and 3 conclusions in
support of that action as listed in Attachment A.
EXISTING CONDITIONS IN AREA:
The subject property is located at 1007 South Oak Street, which is the southeast conger of
the intersection of Oak and 10°i Street. Lots in the block measure a standard 50 by 140 feet. The
Queen of Angeles School occupies six lots on the south side of the street (10"' Street), and -uses
an additional four lots on the north side of the street (10°i Street) as an athletic field. The portion
of the site proposed for the new portable classroom is 41,978 square feet in size; the site contains
three structures. The site is accessed from Oak Street and 10`x' Street, both of which are improved
local access streets, and from the 10/11 Alley. The site is generally level and is entirely covered
with impervious surface. No enviromnentally sensitive areas exist on the site. The application
and site maps are attached as Attachment B.
Development in the area is primarily single family residential, with the Queen of Angeles
Church located west of Oak Street and a bed and breakfast located south of 11`" Street as the
exceptions to single family uses in the area. The site exists two blocks north of the 8`" Street
commercial corridor.

City Departments reviewed the proposal and provided the following comments:

The Fire Department has reviewed the application and has no objections to the placement of the
building with the following condition:
The fire alarm system currently installed in the school must be extended to provide
notif cation devices in the portable building. Occupants of the portable building must be notified
in the event of a fire alarm activation in the school building.
The Public Works and Utilities Department commented that the applicant will be required to
provide additional detail regarding utility hook-ups before specific costs determine can be
determined.
The Building Division of DCED: A building permit is required for the construction.
Construction will be per IBC requirements.
PUBLIC COMMENT:
Notification of the proposed action was placed in the Peninsula Daily News on March 11,
2007, posted on the site on March 16, 2007, and mailed to property owners within 300 feet of the
subject property on March 16, 2007.
DEPARTMENT OF COMMUNITY DEVELOPMENT ANALYSIS:
The City's Comprehensive Plan and Land Use Map identify the area as being located in
the North Central Planning Area and the site is designated as Low Density Residential. The site
is zoned Single Family Residential RS -7. Private schools are allowed by conditional use pennit
in the RS -7 zone. Area requirements for private schools are listed in Table A of Section
17.10.050(C) PAMC. Private schools of more than 100 students require a site of 5 acres plus 1
acre for every 100 students. The Queen of Angeles School has an enrollment of over 100
students and occupies a total of 70,000 square feet on two separate parcels, and therefore is non-
conforming to the lot size requirement for a private school. The school use was permitted under
CUP 95 (02) 02.
Table A of PAMC 17.10.050(C) indicates that a 40 -foot setback from all property lines is
required for private school buildings. The site plan identifies the proposed building location as
meeting the 40 -foot required setbacks for school buildings in residentially zoned areas.
Currently none of the existing buildings meet the setback requirements of Table A, and two
buildings currently exist with no setback to the 10/11 Alley. The applicant has stated a
preference to reduce the required 40 -foot setback from the alley for more efficient use of the play
area and better visibility of students using the play area. The portion of the site not occupied by
buildings is used for a playground, and placing the proposed portable classroom 40 feet from
property lines would place the structure in the center of the playground thus disrupting the use of
the area as a playground. Meeting the setback requirement would also create a situation where
supervision of students on the playground would become more difficult. It is not unreasonable to
consider a setback reduction as a condition of approval.
The submitted plan indicates that the portable classroom is 28 feet by 64 feet for an
additional area of 1,792 square feet. Total lot coverage will increase to 19% with the addition of
the proposed portable classroom. The entire site is paved with an impervious surface so the
proposal will not increase the amount of impervious surface. The proposed use is an expansion

of a previously permitted conditional use. No new public services are needed to provide for the
addition to the school use.
PAMC 14.40 requires one parking space for each classroom for elementary schools. The
Queen of Angeles School faculty and visitors use a joint parking area that is shared with the
Queen of Angeles Church. The existing parking is adequate for the existing use with the
addition of the portable classroom. No additional parking is required.
In consideration of a conditional use permit application, the Planning Connnission may
impose whatever restrictions or conditions are considered to be essential to protect the public
health, safety, and welfare, and to prevent depreciation of neighboring property. The same
applies for an amendment to such a pen -nit. Uses developed by conditional use pennit must
remain in continual compliance with the conditions of approval or the use may be revoked. The
development standards for conditional uses are provided in Table "A" of the Zoning Code which
increases the minimum setbacks and lot size for schools in residential zones.
STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW:
A Determination of Non -Significance was issued by the City's Responsible Official on
April 6, 2007, with regard to the proposal. This satisfies the City's responsibility under the State
Environmental Policy Act (SEPA).

ATTACHMENT A
RECOMMENDED CONDITIONS, FINDINGS, AND CONCLUSIONS
The Planning Division recommends the Plam-iing Commission approve Conditional Use
Permit CUP 07-03 subject to 2 conditions and based on the following 11 findings and 3
conclusions in support of the action:
Conditions:
All conditions applied to CUP 95(02)02 shall remain in effect. Those conditions include:
1. The new construction shall comply with state and local building Codes.
2. The new construction shall comply with state and local fire codes.
3. One parking space shall be provided per Section 14.40.050 K of the Port
Angeles Municipal Code. Prior to occupancy, the applicant shall
demonstrate to the satisfaction of the Planning Director that the parking
requirement has been satisfied.
2. The applicant shall secure all required city permits from Public Works and Utilities
Department and Building Division of Community and Economic Development
Department prior to placement of the portable school structure.
Findings:
Based on the information provided in the Community and Economic Development Staff
Report for CUP 07-03 dated April 11, 2007, including all information in the public record file,
comments and testimony presented during the public hearing, the Planning Commission
discussion and deliberation, and the above listed conditions of approval, the City of Port Angeles
Plamling Conunission hereby finds that:
1. The Queen of Angeles School submitted Conditional Use Pen -nit application CUP 07-03
to add a portable classroom to the school site at l Ot" and Oak Streets on March 2, 2007.
The private school use was previously permitted by Conditional Use Permit CUP
95(02)02 in 1995 with conditions.
2. The proposed site includes Lots 5 through 10, Block 327, Townsite of Port Angeles.
3. The site is zoned RS -7 Residential Single Family. Private school uses are allowed by
conditional use permit per Section 17.10.040(L) PAMC. Section 17.10.050(C) Table "A "
of the PAMC provides development standards for conditional uses in the RS -7 zone.
Private Schools of more than 100 students require a minimum lot area of S acres plus I
acre for each 100 students in the RS -7 and 40 foot setbacks firom all property lines.
Queen of Angeles School is inconsistent with both the required lot area and the required
setbacks for private schools in the RS -7 zone.
4. Placing the portable classroom in compliance with required 40-:f6ot setbacks will locate
the building in the center of the playground area. The applicant has stated that this
location standard will create complications for providing adequate and efficient
playground space and for proper supervision of children using the playground area. The
applicant has asked that a waiver of the setbacks be made in allowing placement of the

unit. Such a request would need to be considered by the City's Board of Adjustment that
is authorized to adjust development standards when the facts warrant such an adjustment.
5. The Comprehensive Plan designates the site as Low Density Residential. Adjacent
designations are also Low Density Residential. The site is located in the City's North
Central Planning Area. The subject site is located on the southeast corner of 1011' and Oak
Streets. Development in the neighborhood includes primarily single family residential
uses, with scattered churches and bed and breakfasts. A commercial area lies two blocks
to the north and a public school is located three blocks to the southeast.
6. Per 17.96.050 PAMC, the Planning Commission shall consider applications for
conditional use permit uses as specified in the applicable Chapter of the Zoning
Regulations. The Planning Commission may grant said permits which are consistent and
compatible with the purpose of the zone in which the use is located, consistent with the
Comprehensive Plan, and not contrary to the public use and interest. In each application
the Plamung Commission may impose whatever restrictions or conditions are considered
essential to protect the public health, safety, welfare, and to prevent depreciation of
neighboring property. The Planning Commission may refuse to issue a conditional use
permit if the characteristics of the intended use would defeat the purpose of the City's
zoning regulations.
7. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land
Use Element Goal A and Policy A.2; Goal C and Policy C.1; Transportation Element
Policy B.14 and B.16; and Conservation Element Policies B.3 were found to be most
relevant to the proposal.
8. A development that is approved through the conditional use permit process must remain
in continual compliance with specific conditions of approval or may be revoked.
9. Reviewing City Departments commented on the application. Those comments were
included in review of the application.
10. Notification of the proposed action and conditional use pernlit application was placed in
the Peninsula Daily News on March 11, 2007, Public notice was mailed to property
owners within 300 feet of the subject property on March 16, 2007, and posted on the site
on March 11, 2007.
11. A Detennination of Non -Significance was issued for this proposed action on April 6,
2007.
12. The P1amling Commission conducted a public hearing on the proposal at the April 11,
2007, regular meeting.
Conclusions:
Based on the information provided in the Department of Community Development Staff
Report for CUP 07-03 dated April 11, 2007, including all of the information in the public record
file, comments, and testimony presented during the public hearing, the Planning Commission's
discussion and deliberation, and the above listed conditions of approval and listed findings, the
City of Port Angeles Planning Commission hereby concludes that:
As conditioned, the proposal is consistent with the intent of the Comprehensive Plan,
specifically with Land Use Element Goal A and Policy A.2; Land Use Element Goal C,

2. The proposal is consistent with requirements for approval of a conditional use permit as

ATTACHMENT C
COMPREHENSIVE PLAN
The City's Comprehensive Plan establishes the long range goals and policies of the City.
Any project proposed in the City must be consistent with the goals and policies of the
Comprehensive Plan. The site is located in the City's East Planning Area. The Plan was
reviewed in its entirety with regard to the proposed application and several goals and policies
were found to be relevant to the proposal. An analysis of compliance with those policies is as
follows:
Laud Use Element Residential Goal A: "To guide current and future development within.
the City in a manner that provides certainty to its citizens about future land use and the
flexibility necessaiy to meet the challenges and opportunities of the future. "
Policy A.2 "All land use decisions and approvals made by the City Council and/or any of
its appointed Commissions, Boards or Committees should be consistent with the Comprehensive
Plan and its land use map. "
Land Use Element Residential Goal C. "To have a community of viable districts and
neighborhoods with a variety of residential opportunities for personal interaction, fulfilbnent
and enjoyment, attractive to people of all ages, characteristics and interests. "
Policy C-1 "Residential land should be developed on the district and neighborhood
concept. Although such districts may be composed primarily of residential uses of a uniform
density, a healthy, viable district should be composed of residential uses of varying densities
which may be augmented by subordinate and compatible uses. Single family and multi family
homes, parks and open spaces, schools, churches, day care and residential services, home
occupations, and district shopping areas are all legitimate components of district development
and enhancement. A neighborhood should be primarily composed of low, medium, or high
density housing. "
Transportation Element Policy B.14 - "Off-street parking should be sufficient and
accessible within business and residential areas to ensure that the traffic flow of the street is not
impaired. "
Transportation Element Policy B.16 — "Parking requirements should make allowances
for shared parking facilities. "
Conservation Element Policy B.3 - "The City should protect and enhance the
characteristics of its unique residential neighborhoods. "
ZONING ORDINANCE
The Zoning Ordinance is the primary implementing ordinance for the Comprehensive
Plan. The Ordinance establishes what types of uses are permitted and where they may be located
in the City. It also establishes definitions and minima ni design standards for such uses. Any
project proposed in the City must be consistent with specific regulations of the zone in which it
is located.
The Zoning Map identifies the subject property and adjacent properties as Residential
Single Family (RS -7). The purpose and intent of this zone is:

"This is a low density residential zone Intended to create and preserve urban single
family residential neighborhoods consisting ofpredominantly single family homes on.
standard Townsite-size lots. Uses which are compatible with and functionally related
to a single family residential environment may also be located in this zone. "
Section 17.10.050 PAMC Area and Dimensional Requirements Table "A" requires that
private schools of more than 100 students provide a site of 5 acres plus 1 acre for every 100
students in the RS -7 zone. Such development is subject to design and dimensional requirements
as set forth under PAMC 17.10.050(C) Table "A" which includes setbacks of 40 feet from all
property lines. The proposed development shall comply with development standards set forth by
the Zoning Code and can therefore be deemed consistent with the Zoning Code.
The purpose of a conditional use pennit is defined as;
"A Conditional Use Permit shall be to assure that the maximum degree of
compatibility between uses shall be attained. The purpose of these regulations shall
be maintained with respect to the particular use of the particular site and in
consideration of other existing and potential uses within the general area in which
such use is to be located."
PAMC 17.96.050 specifies procedures for the review and processing of conditional use
applications, as follows:
17.96.050 Conditional Use Permit
A. The Planning Commission shall consider applications for Conditional Use
Permits of uses as specified in the applicable Chapter of the Zoning Regulations. The Planning
Commission may grant said permits which are consistent and compatible with the purpose of the
zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the
public use and interest. The Planning Commission may refuse to issue a Conditional Use Permit
if the characteristics of the intended use as related to the specific proposed site are such as
would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental,
or hazardous conditions.
B. In each application, the Planning Commission may impose whatever restrictions
or conditions they consider essential to protect the public health, safety, and welfare, and to
prevent depreciation of neighboring property.
PARKING ORDINANCE
PAMC 14.40 Table A requires 1 off-street parking space per each classroom. The
development provides adequate parking spaces through a parking agreement with Queen of
Angeles Church.

As you know, following a public hearing conducted on April 11, 2007, the City Planning
Commission approved an amendment to Conditional Use Permit CUP 95(02)02 to allow the
placement of a portable classroom unit in the RS -7 Residential Single Family zone in.'
association with a private school use at that location. The private school use was originally
approved in 1995 with five conditions. Your preferred placement of the temporary unit
would not be in compliance with the City's standards for. private. school structures in
residential zones, and you have applied to the City's Board of Adjustment for a variance to
those standards. Until such a variance is approved, if placed, the unit must observe a 40'
setback from all property lines. Placement of the unit will require a building permit. .
The Board of Adjustment will meet on the alternate site proposal on May 7,' 2007. " Until that

CONDITIONAL USE PERMIT - CUP 07-03 - QUEEN OF ANGELS CHURCH -
1007 South Oak Street: Request to amend a conditional use permit to allow a private school
in the RS -7 Residential Single Family zone by placement of a portable classroom unit on
site.
Associate Planner Scott Johns reviewed the Department Report recommending approval
of the amendment but noted that placement of the classroom structure must comply with the setbacks
required for a school use in a residential zone (40' from property lines) unless a variance is allowed
from the City's Board of Adjustment.
Commissioner Johnson indicated that, as a member of the Queen of Angeles Church, he
would not be participating in the application review. Chair Beier opened the public hearing.
Debra Brines, Principal of Queen of Angeles School, 2662 Dan Kelly Road, and Mary
Ellen Winborn, 846 Key Road, were present for questions. Testimony was provided that the
proposed pre fabricated structure would serve as a library/computer/office area. School enrollment
has been as high as 200 students but is currently 130 students.
Ms. Brines and Mrs. Winborn responded to questions regarding use of school property
areas, and indicated that the preferred location of the portable unit, 10' from the alley, will allow full
use of the site for parking during non school hours, and will allow for needed visibility of the entire
site during school activities. If a variance of the specified setback for school structures in residential
zones is not reduced, the portable unit would not be located in a good location and could affect
parking uses during non school hours.
Commissioner Kidd noted that she is a resident in the area and stated that on street residential
parking is a big cause of congestion in the neighborhood.
In response to further questions regarding the impact of parking to the neighborhood as a
result of the school use, Ms. Brines explained the location of church properties and how they are
being utilized for school activities. The school serves students from pre school to 8`" Grade.
There being no further questions or testimony, Chair Beier closed the public hearing.
Following brief discussion, Commissioner Kidd moved to approve the conditional use
permit. In making the motion, Commissioner Kidd noted that she hoped the Board ofAdjustment
would find circumstances were present to allow'a variance in order for placement of the portable
classroom unit. The motion was made with the following conditions, findings, and conclusions:

use and interest. In each application the Planning Commission may impose
whatever restrictions or conditions are considered essential to protect the public
health, safety, welfare, and to prevent depreciation of neighboring property. The

EXISTING CONDITIONS IN AREA:
The subject property is located at 1007 South Oak Street, which is the southeast corner of
the intersection of Oak and 10`h Street. Lots in the block measure a standard 50 by 140 feet. The
Queen of Angeles School occupies six lots on the south side of the street (10`h Street), and uses
an additional four lots on the north side of the street (10`h Street) as an athletic field. The portion
of the site proposed for the new portable classroom is 41,978 square feet in size; the site contains
three structures. The site is accessed from Oak Street and 10th Street, both of which are improved
local access streets, and from the 10/11 Alley. The site is generally level and is entirely covered
with impervious surface. No environmentally sensitive areas exist on the site. The application
and site maps are attached as Attachment B.
Development in the area is primarily single family residential, with the Queen of Angeles
Church located west of Oak Street and a bed and breakfast located south of 11`h Street as the
exceptions to single family uses in the area. The site exists two blocks north of the 8th Street
commercial corridor.

DEPARTMENT COMMENTS:
City Departments reviewed the proposal and provided the following comments:
The Fire Department has reviewed the application and has no objections to the placement of the
building with the following condition:
The fire alarm system currently installed in the school must be extended to provide
notification devices in the portable building. Occupants of the portable building must be notified
in the event of a fire alarm activation in the school building.
The Public Works and Utilities Department commented that the applicant will be required to
provide additional detail regarding utility hook-ups before specific costs determine can be
determined.
The Building Division of DCED: 'A building permit is required for the construction.
Construction will be per IBC requirements.
PUBLIC COMMENT:
Notification of the proposed action was placed in the Peninsula Daily News on March 11,
2007, posted on the site on March 16, 2007, and mailed to property owners within 300 feet of the
subject property on March 16, 2007.
DEPARTMENT OF COMMUNITY DEVELOPMENT ANALYSIS:
The City's Comprehensive Plan and Land Use Map identify the area as being located in
the North Central Planning Area and the site is designated as Low Density Residential. The site
is zoned Single Family Residential RS -7. Private schools are allowed by conditional use permit
in the RS -7 zone. Area requirements for private schools are listed in Table A of Section
17.10.050(C) PAMC. Private schools of more than 100 students require a site of 5 acres plus 1
acre for every 100 students. The Queen of Angeles School has an enrollment of over 100
students and occupies a total of 70,000 square feet on two separate parcels, and therefore is non-
conforming to the lot size requirement for a private school. The school use was permitted under
CUP 95 (02) 02.
Table A of PAMC 17.10.050(C) indicates that a 40 -foot setback from all property lines is
required for private school buildings. The site plan identifies the proposed building location as
meeting the 40 -foot required setbacks for school buildings in residentially zoned areas.
Currently none of the existing buildings meet the setback requirements of Table A, and two
buildings currently exist with no setback to the 10/11 Alley. The applicant has stated a
preference to reduce the required 40 -foot setback from the alley for more efficient use of the play
area and better visibility of students using the play area. The portion of the site not occupied by
buildings is used for a playground, and placing the proposed portable classroom 40 feet from
property lines would place the structure in the center of the playground thus disrupting the use of
the area as a playground. Meeting the setback requirement would also create a situation where
supervision of students on the playground would become more difficult. It is not unreasonable to
consider a setback reduction as a condition of approval.
The submitted plan indicates that the portable classroom is 28 feet by 64 feet for an
additional area of 1,792 square feet. Total lot coverage will increase to 19% with the addition of
the proposed portable classroom. The entire site is paved with an impervious surface so the
proposal will not increase the amount of impervious surface. The proposed use is an expansion

of a previously permitted conditional use. No new public services are needed to provide for the
addition to the school use.
PAMC 14.40 requires one parking space for each classroom for elementary schools. The
Queen of Angeles School faculty and visitors use a joint parking area that is shared with the
Queen of Angeles Church. The existing parking is adequate for the existing use with the
addition of the portable classroom. No additional parking is required.
In consideration of a conditional use permit application, the Planning Commission may
impose whatever restrictions or conditions are considered to be essential to protect the public
health, safety, and welfare, and to prevent depreciation of neighboring property. The same
applies for an amendment to such a permit. Uses developed by conditional use permit must
remain in continual compliance with the conditions of approval or the use may be revoked. The
development standards for conditional uses are provided in Table "A" of the Zoning Code which
increases the minimum setbacks and lot size for schools in residential zones.
STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW:
A Determination of Non -Significance was issued by the City's Responsible Official on
April 6, 2007, with regard to the proposal. This satisfies the City's responsibility under the State
Environmental Policy Act (SEPA).

RECOMMENDED CONDITIONS, FINDINGS, AND CONCLUSIONS
The Planning Division recommends the Planning Commission approve Conditional Use
Permit CUP 07-03 subject to 2 conditions and based on the following 11 findings and 3
conclusions in support of the action:
Conditions:
All conditions applied to CUP 95(02)02 shall remain in effect. Those conditions include:
1. The new construction shall comply with state and local building Codes.
2. The new construction shall comply with state and local fire codes
3. One parking space shall be provided per Section 14.40.050 K of the Port
Angeles Municipal Code. Prior to occupancy, the applicant shall
demonstrate to the satisfaction of the Planning Director that the parking
requirement has been satisfied.
2. The applicant shall secure all required city permits from Public Works and Utilities
Department and Building Division of Community and Economic Development
Department prior to placement of the portable school structure.
Findings:
Based on the information provided in the Community and Economic Development Staff
Report for CUP 07-03 dated April 11, 2007, including all information in the public record file,
comments and testimony presented during the public hearing, the Planning Commission
discussion and deliberation, and the above listed conditions of approval, the City of Port Angeles
Planning Commission hereby finds that:
1. The Queen of Angeles School submitted Conditional Use Permit application CUP 07-03
to add a portable classroom to the school site at l Ot" and Oak Streets on March 2, 2007.
The private school use was previously permitted by Conditional Use Permit CUP
95(02)02 in 1995 with conditions.
2. The proposed site includes Lots 5 through 10, Block 327, Townsite of Port Angeles.
The site is zoned RS -7 Residential Single Family. Private school uses are allowed by
conditional use permit per Section 17.10.040(L) PAMC. Section 17.10.050(C) Table "A"
of the PAMC provides development standards for conditional uses in the RS -7 zone.
Private Schools of more than 100 students require a minimum lot area of 5 acres plus 1
acre for each 100 students in the RS -7 and 40 foot setbacks from all property lines.
Queen of Angeles School is inconsistent with both the required lot area and the required
setbacks for private schools in the RS -7 zone.
4. Placing the portable classroom in compliance with required 40 -foot setbacks will locate
the building in the center of the playground area. The applicant has stated that this
location standard will create complications for providing adequate and efficient
playground space and for proper supervision of children using the playground area. The
applicant has asked that a waiver of the setbacks be made in allowing placement of the

ATTACHMENT C
COMPREHENSIVE PLAN
The City's Comprehensive Plan establishes the long range goals and policies of the City.
Any project proposed in the City must be consistent with the goals and policies of the
Comprehensive Plan. The site is located in the City's East Planning Area. The Plan was
reviewed in its entirety with regard to the proposed application and several goals and policies
were found to be relevant to the proposal. An analysis of compliance with those policies is as
follows:
Land Use Element Residential Goal A: "To guide current and future development within
the City in a manner that provides certainty to its citizens about future land use and the
flexibility necessary to meet the challenges and opportunities of the future. "
Policy A.2 "All land use decisions and approvals made by the City Council and/or any of
its appointed Commissions, Boards or Committees should be consistent with the Comprehensive
Plan and its land use map. "
Land Use Element Residential Goal C. "To have a community of viable districts and
neighborhoods with a variety of residential opportunities for personal interaction, fulfillment
and enjoyment, attractive to people of all ages, characteristics and interests. "
Policy C-1 "Residential land should be developed on the district and neighborhood
concept. Although such districts may be composed primarily of residential uses of a uniform
density, a healthy, viable district should be composed of residential uses of varying densities
which may be augmented by subordinate and compatible uses. Single family and multi family
homes, parks and open spaces, schools, churches, day care and residential services, home
occupations, and district shopping areas are all legitimate components of district development
and enhancement. A neighborhood should be primarily composed of low, medium, or high
density housing. "
Transportation Element Policy B.14 - "Off-street parking should be sufficient and
accessible within business and residential areas to ensure that the traffic flow of the street is not
impaired. "
Transportation Element Policy B.16 — "Parking requirements should make allowances
for shared parking facilities. "
Conservation Element Policy B.3 - "The City should protect and enhance the
characteristics of its unique residential neighborhoods. "
ZONING ORDINANCE
The Zoning Ordinance is the primary implementing ordinance for the Comprehensive
Plan. The Ordinance establishes what types of uses are permitted and where they may be located
in the City. It also establishes definitions and minimum design standards for such uses. Any
project proposed in the City must be consistent with specific regulations of the zone in which it
is located.
The Zoning Map identifies the subject property and adjacent properties as Residential
Single Family (RS -7). The purpose and intent of this zone is:

"This is a low density residential zone intended to create and preserve urban single
family residential neighborhoods consisting of predominantly single family homes on
standard Townsite-size lots. Uses which are compatible with and functionally related
to a single family residential environment may also be located in this zone. "
Section 17.10.050 PAMC Area and Dimensional Requirements Table "A" requires that
private schools of more than 100 students provide a site of 5 acres plus 1 acre for every 100
students in the RS -7 zone. Such development is subject to design and dimensional requirements
as set forth under PAMC 17.10.050(C) Table "A" which includes setbacks of 40 feet from all
property lines. The proposed development shall comply with development standards set forth by
the Zoning Code and can therefore be deemed consistent with the Zoning Code.
The purpose of a conditional use permit is defined as;
"A Conditional Use Permit shall be to assure that the maximum degree of
compatibility between uses shall be attained. The purpose of these regulations shall
be maintained with respect to the particular use of the particular site and in
consideration of other existing and potential uses within the general area in which
such use is to be located."
PAMC 17.96.050 specifies procedures for the review and processing of conditional use
applications, as follows:
17.96.050 Conditional Use Permit
A. The Planning Commission shall consider applications for Conditional Use
Permits of uses as specified in the applicable Chapter of the Zoning Regulations. The Planning
Commission may grant said permits which are consistent and compatible with the purpose of the
zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the
public use and interest. The Planning Commission may refuse to issue a Conditional Use Permit
if the characteristics of the intended use as related to the specific proposed site are such as
would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental,
or hazardous conditions.
B. In each application, the Planning Commission may impose whatever restrictions
or conditions they consider essential to protect the public health, safety, and welfare, and to
prevent depreciation of neighboring property.
PARKING ORDINANCE
PAMC 14.40 Table A requires 1 off-street parking space per each classroom. The
development provides adequate parking spaces through a parking agreement with Queen of

classroom in association with. a private school in the RS -7 Residential Single Family
zone. The application materials and environmental checklist are being forwarded to you
for review under the WAC 197-11-355 optional review process. The City will not issue
a threshold determination until after the comment period which will end on April 2,
2007. This may be your only opportunity to comment on potential impacts of the
application.
Written comments must be received by the City Department of Community & Economic
Development, P.O. Box 1150, Port Angeles, Washington, 98362, no later than March

The Fire Department has reviewed CUP 07-03 for the portable classroom at Queen of Angels. We have no objection to the
placement of the building, with the following condition - the fire alarm system currently installed in the school must be
extended to provide notification devices in the portable building. In other words, occupants of the portable building must
be notified automatically in the event of a fire alarm activation in the school building.
A 2A -1013C or larger fire extinguisher must be mounted in the portable.
If the portable is addressed separately from the existing school, it must be provided with address numbers.
