Dear Mr. Stone:
As you know, following a public comment"period ending October 28`'', 2016,the City's Director of
i Community and Economic Development approved your request for a Conditional Use Permit to
allow an accessory residential unit at 1115 East 3rd Street on November 3rd, 2016. The decision of

the Director is final unless appealed within 14 days to the PortAngeles Hearing Examiner.
Prior to occupancy, the following.seven(7) conditions on the permit must be fulfilled:
1. The ARU and primary residence must have separate electrical and water meters.
Addressing shall be clearly identified as 1115 '/ E. 3`d Street. Address numbers must be six
(6) inches in height, visible from the street, and of a color contrasting their background.
2. Separate electrical meters are required for each dwelling unit. '
3. Addressing for each dwelling unit shall be clearly identified as 1115 and 1115 '/z East 3`d
Street. Address numbers must be at least six('6) inches in height and readily visible from
the street and of contrasting color from their background..
4. Two (2) off-street parking.spaces are required for each residential dwelling unit for a total
{ of four(4) spaces. Parking spaces shall be constructed to Public Works and Utilities
Department standards.
5. Driveway and site access shall be constructed to"Urban Service Standards and
Guidelines".
6. All utility improvements including water meter, water line, sanitary sewer, storm drainage
and electrical are to be completed to the satisfaction of the-Public Works and Utilities
Department.
7. A permit is required for new sewer connection,water meter, water line, and electrical
f work. A Right of Way use permit is required for new sewer tap on main or any other work
in.the city Right of Way

Endangered Species Act (ESA)

agencies identify when a project needs further analysis regarding potential
adverse effects on Endangered Species as required by the Endangered Species
Act (ESA). For our purposes, "ESA listed species" are any species listed as
endangered, threatened, or being considered for listing.
This supplemental checklist is for all development within ESA Potential Impact
Areas, which include the following locations:

and/or floodway areas;
Riparian Buffer Zones (RBZ) as described by the Dept of Natural
Resources 2007 stream typing system and WDFW's 1997 stream buffer
guidelines; and/or
® Channel Migration Zones (CMZ) plus 50' as identified according to Dept
of Ecology 2003).
If ESA listed species are present or ever were present within the ESA Potential
Impact Area where your project will be located, your project has the potential for
affecting them, and you must comply with the ESA. The questions in this

The Port Angeles regional watershed is an area where several
endangered species have historically been present. Please answer the

RECOMMENATION:
The Planning Technician recommends that the Director Approve CUP 16-05 with 7 conditions,citing 14
findings,and 5 conclusions in support of that action as listed in Attachment A to this staff report.
EXISTING CONDITIONS IN AREA:
The subject property, located at 1115 E. 31 Street, is between Chambers Street and Jones Street in the
Civic Neighborhood District.The area is zoned as RS-7,Residential Single Family per Section 17.10 of
the Port Angeles Municipal Code. Property is on a single lot parcel,with 140' lot depth and 50' lot width,
and approximately 7,000 square feet in area.This lot size meets the minimum standards for RS-7 Zoning
requirements.The front, facing Southwest on 3'd street, is accessible by pedestrians only,with on-street
parking available. The rear of the property is accessed by the 2nd/31 alley,a paved alley, rated as being in
"poor"condition. Rear access is accessible to motor vehicles,with approximately availability of six(6)
vehicle parking spaces,and an additional two vehicles within the existing separated garage.No
environmentally sensitive areas exist on the property.

The primary residence is approximately 1,399 square feet, with approximately 1,038 square feet on the
first level, and a 361 square foot finished basement. The primary residence occupies approximately 14.8%
of the total lot coverage. The garage at the rear of the property is 24' by 28', or 672 square feet,
occupying another 9.6%of the property, for a total lot coverage of 24.4%.
The application, site plan, vicinity maps, and site visit photos are attached as Attachment C.
Development in the area consists of mostly single household residences with the occasional accessory
residential unit. The RS-7 zone is primarily a single household residential zone. Accessory Residential
Units are allowable as a conditional use in RS-7 zone.
DEPARTMENT COMMENTS:
City departments reviewed the proposal and provided the following comments:

The Police Department has made no comment regarding this development application.
The Building Division of Community& Economic Development
"This location above the garage has been a game room with a bar and a ''/z bath, previously. Currently, it
has been made into a one bedroom apartment with a full bath, kitchen and plumbing added in garage for
washer and dryer without permits. The result of the ARU process was due to the illegal construction and
will ultimately require all permits and inspections once ARU is approved.
Please note that the applicant was not responsible for the work done at this location, but has purchased the
property and is willing to follow the steps to bring the new construction into compliance."

The public works and utilities department has also provided an invoice for water service, sanitary sewer,
and street alley restoration. A Right of Way Construction Permit will be required for any construction that
occurs in or occupies the public Right of Way.
PUBLIC COMMENT:
Notification of the proposed action was placed in the Peninsula Daily News on October 13, 2016, posted
on site on October 11 th, 2016, and mailed to property owners within 300 feet of the subject property on
October 12th, 2016. One(1) written comment was received during the public comment period that ended
on October 28"', 2016.
The commenter was voicing their concern for the effect the proposed ARU will have on the privacy of
adjacent property owners. This included the potential for the proposed ARU to expand the outdoor living
space that would further deteriorate the privacy of adjacent homeowners. The commenter also mentioned
the increase in vehicular traffic in the 2°d/3' street alley, and the impact on parking availability. A
negative effect on property values was also noted as a place of concern for the neighborhood.
The RS-7, Residential Single Family Zone allows for Accessory Residential Units through the
Conditional Use Permitting process per PANIC 17.10.040(A). The site is an existing structure with
previous usage similar to the proposed ARU and therefore does not propose significant change to the
atmosphere of the neighborhood. The proposed ARU cannot exceed a space more than 50% of the
primary residence. The proposed ARU is currently 48%the size of the primary residence, which limits
potential for future expansion. The parcel has an adequate number of off-street, vehicular parking spaces
available for the primary residential unit and the ARU per PAMC 14.40 Table 1.

Accessory Residential Unit- Size Requirements
Per PAMC 17.10.040 (A) An Accessory Residential Unit(ARU) is permitted under conditional uses for
the RS-7, residential single family, zone.
Per PAMC 17.08.010(B) requires than an Accessory Residential Unit"is incidental to a detached primary
single-family residence, is 50 percent or less space than the primary residential use, and is located on the
same zoning lot as the single-family residence. An accessory residential unit is served by water and
electrical service that is separate from the primary residential service and has a separate address."
As evidence in Table 1.2, the primary residence is a single story, with finished basement, structure has a
total square foot area of 1,399 square feet. The proposed ARU is a preexisting space above a garage, with
a total square foot area of 672 square feet. Therefore, the ARU living space is 48% the size of the primary
residential unit, meeting the code requirement of being less than 50%of the size of the primary single
household residence.

Parking Requirements
PAMC 14.40.060 requires each residential unit to be considered separately when calculating the
appropriate amount of vehicle parking spaces. According to PAMC Section 14.40 Table A,two (2) off-
street parking spaces is required for each residential unit, for a total of 4 off street parking spaces.
The property currently has available the adequate number of parking spaces per the requirements. There
exist enough room for four(4) vehicles to be parked on the rear of the'property, accessed by the 2°a/3"d
alley, and an additional two (2) vehicle spaces in the detached garage. Additional parking is available on-
street, however this will not count towards the parking required by code.
The proposal is consistent with the relevant sections of the Port Angeles Municipal Code and the
Comprehensive Plan.
ZONING CODE AND COMPREHENSIVE PLAN LAND USE MAP:

The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. It
establishes what types of uses are permitted in specific zones, definitions of uses, and minimum design
standards for such uses. Like the Comprehensive Plan, any project proposed in the City must be
consistent with the regulations of the zone in which it is located. The Zoning Map identifies the subject
property as RS-7 Residential Single Family. Surrounding properties are also zoned RS-7 Residential
Single Family. Specific sections applicable to accessory residential development in the RS-7 are listed
below for reference.
Port Angeles Municipal Code (PAMC) Section 17.10.010 states the purpose of the RS-7 Zone as "a
low density residential zone intended to create and preserve urban single household residential
neighborhoods consisting of predominantly single household homes on standard townsite-size lots. Uses
which are compatible with and functionally related to a single household residential environment may
also be located in this zone..."
Port Angeles Municipal Code (PAMC) Section 17.08.040(A) establishes that accessory residential
units are permitted in the RS-7 zone by a conditional use permit.
PAMC Section 17.08.010(B) defines an accessory residential unit as"A habitable unit added to, created
within, or detached from a primary single-family residential dwelling that provides basic requirements for
living, sleeping, eating, cooking, and sanitation as outlined by the International Residential Building
Code. An accessory residential unit(ARU) is incidental to a detached primary single-family residence, is
50 percent or less space than the primary residential use, and is located on the same zoning lot as the
single-family residence. An accessory residential unit is served by water and electrical service that is
separate from the primary residential service and has a separate address."
PAMC Section 17.08.025(L) defines a dwelling unit as "one or more rooms which are arranged,
designed, or used as living quarters for one family only. Complete single kitchen facilities,permanently
installed, shall always be included for each dwelling unit."
The Comprehensive Plan establishes the long range goals and policies of the City. Any project
proposed in the City must be consistent with the goals and policies of the Comprehensive Plan. The
Comprehensive Plan Land Use Map identifies the site as being in the East Planning Area and designates
the site as being Low Density Residential. The Comprehensive Plan's policies have been reviewed with
regard to the proposed application and the policies identified in Attachment B to this staff report are
found to be the most relevant to the proposal.
Single household and multi-household residences are legitimate components of district development. The
proposal would allow for a density that is in compliance with low density residential areas.
STATE ENVIRONMENTAL POLICE'ACT (SEPA) REVIEW:
A Determination of Non-Significance was issued by the City's Responsible Official on October 3151
2016, for the regard to the proposal. This satisfies the City's responsibility under the State Environmental
Policy Act (SEPA).

CONDIrTIONS, FINDINGS, AND CONCLUSIONS
FINDINGS:
Based on the information provided in the Community and Economic Development Staff Report for CUP
16-04 dated August 2, 2016, including all information in the public record file and the above listed
conditions of approval,the City of Port Angeles Community and Economic Development hereby finds
that:
1. Robert W. Stone submitted a conditional use permit application for an accessory residential unit
on October 6th, 2016, after code enforcement informed his the use of the existing space is not in
compliance.
2. 17.080.010(B) PAMC defines an Accessory Residential Unit (ARU)as"A habitable unit added
to, created within, or detached from a primary single-family residential dwelling that provides
basic requirements for living, sleeping, eating, cooking, and sanitation as outlined by the
International Residential Building Code. An accessory residential unit (ARU)is incidental to a
detached primary single-family residence, is 50 percent or less space than the primary residential
use, and is located on the same zoning lot as the single-family residence. An accessory residential
unit is served by water and electrical service that is separate from the primary residential service
and has a separate address."
3. Section 17.10.040(A)PAMC provides that accessory residential units are allowed as a
conditional use in the RS-7, Single Family Residential zone.
4. 17.10.050(H) states that"Density shall not exceed one dwelling unit for every 7,000 square feet
of lot area(6.22 units/gross acre), except that an 'accessory residential unit' and conditionally
approved duplexes shall be exempt from density limitations."
5. The proposed site is legally described as Lot 13, Block 111 EC Bakers Subdivision of Lot 19 V 1
of Plats P7 in Port Angeles. The site is addressed as 1115 East 3`d Street and was developed with
one residential unit and a two story, detached garage, of which the 2"level was converted into a
non-conforming living space.
6. No additional lot coverage will be result from the conditional use permit because the structure is
an existing two level garage.
7. The primary residential unit contains 1,399 square feet of area, while the proposed ARU has 672
square feet of area, making the ARU 48%of the size of the primary residence. This conforms to
size requirements from Section 17.080.010(B) from the PAMC.
8. The lot is approximately 7,000 square feet, with 24.4% lot coverage. The area and dimension of
the lot, primary residence, and detached garage conform to requirements under PAMC 17.10.050.
9. The lot is zoned RS-7, Residential Single Family.
10. The site is located on the north side of 3`d street between Chambers and Jones Streets, which is in
the City's East Planning Area and in the Civic neighborhood. Development in the area consists of
mostly single household residences with the occasional accessory residential unit. The
comprehensive plans designates the site as a low density residential, one block south of a
commercial area.

11. PAMC 14.40.060 requires each residential unit to be considered separately when calculating the
appropriate amount of vehicle parking spaces. According to PAMC Section 14.40 Table A, two
(2) off- street parking spaces is required for each residential unit, for a total of 4 off street parking
spaces.
12. Per 2.18.065(1) (B) of the PANIC, the Director of Community and Economic Development is
authorized and directed to hear and decide the on conditional use permits for accessory residential
units. A development that is approved through the conditional use permit process must remain in
continual compliance with specific conditions of approval or may be revoked.
13. Site access must comply with Public Works and Utilities Standards located in the Urban Service
Standards and Guidelines Manual. Access to the site is via 11t" Street and the 10"'/11"'Alley.
Access to the primary use is via the 10"'/11"Alley. Both access points are improved rights-of-
way.
14. Notification of the proposed action was posted in the Peninsula Daily News on October 13"',
2016, posted on site on October 11"', 2016, and mailed to property owners within 300 feet of the
subject property on October 11t", 2016. The public comment period for the proposed conditional
use permit was from October 13", 2016 to October 28", 2016.
CONDI'T'IONS:
1. The ARU and primary residence must have separate electrical and water meters. Addressing shall
be clearly identified as 1115 I/2 E. 3' Street. Address numbers must be six (6) inches in height,
visible from the street, and of a color contrasting their background.
2. Separate electrical meters are required for each dwelling unit.
3. Addressing for each dwelling unit shall be clearly identified as 1115 and 1115 %2 East Yd Street.
Address numbers must be at least six (6) inches in height and readily visible from the street and
of contrasting color from their background.
4. Two(2) off-street parking spaces are required for each residential dwelling unit for a total of four
(4) spaces. Parking spaces shall be constructed to Public Works and Utilities Department
standards.
5. Driveway and site access shall be constructed to "Urban Service Standards and Guidelines".
6. All utility improvements including water meter, water line, sanitary sewer, storm drainage and
electrical are to be completed to the satisfaction of the Public Works and Utilities Department.

REVIEW OF PORT ANGELES PLANS & ZONING
COMPREHENSIVE PIAN REVIEW:
The following policies appear to be the most relevant to the proposed project:
Land Use Element
Goal A: To guide current and future development within the City in a manner that provides certainty to
its citizens about future land use and the flexibility necessary to meet the challenges and opportunities of
the future.
Policy A.2: All land use decision and approval made by the City Council and/or any of its appointed
Commissions, Boards or Committees should be consistent with the Comprehensive Plan and its land use
map.
Goal C: To have a community of viable districts and neighborhoods with a variety of residential
opportunities for personal interaction, fulfillment and enjoyment, attractive to people of all ages,
characteristics and interests.
Policy CA: Residential land should be developed on the district and neighborhood concept. Although
such districts may be composed primarily of residential uses of a uniform density, a healthy, viable
district should be composed of residential uses of varying densities which may be augmented by
subordinate and compatible uses. Single household and multi-household homes, parks and open-spaces,
schools, churches, day care and residential services, home occupations, and district shopping areas are all

PORT ANGELES MUNICIPAL CODE REVIEW:
The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. It establishes
what types of uses are permitted and where they may be located in the City. It also establishes definitions
of uses, and minimum design standards for such uses. Like the Comprehensive Plan, any project
proposed in the City must be consistent with the regulations of the zone in which it is located. The
Zoning Map identifies the subject property as Residential Single Family(RS-7).
PANIC 2.18.065 defines those functions, issues and jurisdiction of the director, in which 2.18.065(1) (B)
specifies accessory residential units.

PANIC 17.10.010 defines the purpose and intent of the RS-7 zone is as follows:
"This is a low density residential zone intended to create and preserve urban single-family residential
neighborhoods consisting of predominantly single-family homes on standard townsite-size lots. Uses
which are compatible with and functionally related to a single-family residential environment may also be
located in this zone. Because of land use impacts associated with nonresidential uses, few nonresidential
uses are allowed in this zone and then only conditionally...''
PAMVIC 17.96.050 specifies procedures for the review and processing of conditional use permit
applications, as follows:
PANIC 17.96.050 Conditional Use Permit
"A. The Hearing Examiner shall consider applications for conditional use permits of uses as specified in
the applicable chapter of the zoning regulations. The Hearing Examiner may grant said permits that are
consistent and compatible with the purpose of the zone in which the use is located, consistent with the
Comprehensive Plan, and not contrary to the public use and interest. The Hearing Examiner may refuse to
issue a conditional use permit if the characteristics of the intended use as related to the specific proposed
site are such as would defeat the purpose of these zoning regulations by introducing incompatible,
detrimental or hazardous conditions.
B. In each application the Hearing Examiner may impose whatever restrictions or conditions they
consider essential to protect the public health, safety and welfare, and to prevent depreciation of
neighboring property.
C. Purpose of a conditional use permit: the purpose of a conditional use permit shall be to assure that the
maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall
be maintained with respect to the particular use of the particular site and in consideration of other existing
and potential uses within the general area in which such use is to be located."

Reform Act, Chapter 347, Laws of 1995,by consolidating development application and review with the

that development applications be reviewed for consistency with the Comprehensive Plan and

Thank you for contacting me about the proposed zoning application on 1115 E. 3rd st. I did not know I
could do anything to stop this change I have watched take place. I appreciate you considering my opinion.
I do not think this accessory residential unit should be approved.
When I bought my home 10 plus years ago one of my top priorities was in city privacy. This home was
perfect once I fenced my back yard. Since then I have spent a lot of time and money improving my home and
property. The structure mentioned in the zoning application was there when I moved in, but it was just a garage
at the time. If approved, this accessory unit could be used as a long-term rental or VRBO that looks not only

directly into my back yard (the 2nd floor of the garage has been converted), but into a few of my neighbors
homes and yards as well. I will lose all of the privacy that I value so much. After spending my days working in
the hospital, taking care of ill patients, my home is my sanctuary. If these residences are separated, there is
potential for the owners to build on even more, like a larger deck for more people to look down into my yard and
the yards and homes of my neighbors.
This will also increase traffic in our already busy alley, and exacerbate existing issues with limited
parking.
I also feel this will depreciate my home value.
I hope you hear my voice and can understand my point of view. I do not think this development should
be approved because of how many others within close proximity will be affected. I understand there is a
difference in houses and lot sizes between 2nd and 3rd streets, but to put two"houses"on a already small lot is
only benefiting one person, the new home owner.

This location above the garage has been a game room with a bar and a %2 bath, previously. Currently, it has been made
into a one bedroom apartment with a full bath, kitchen and plumbing added in garage for washer and dryer without
permits.The result of the ARU process was due to the illegal construction and will ultimately require all permits and
inspections once ARU is approved. Please note that the applicant was not responsible for the work done at this location,

adverse effects on Endangered Species as required by the Endangered Species
Act (ESA). For our purposes, "ESA listed species" are any species listed as
endangered, threatened,or being considered for listing.
This supplemental checklist is for all development within ESA Potential Impact
Areas, which include the following locations:
• Federal Emergency Management Act (FEMA) designated floodplain
and/or floodway areas;
• Riparian Buffer Zones (RBZ) as described by the Dept of Natural
Resources 2007 stream typing system and WDFW's 1997 stream buffer
guidelines; and/or
• Channel Migration Zones (CMZ) plus 50' as identified according to Dept
of Ecology 2003).
If ESA listed species are present or ever were present within the ESA Potential
Impact Area where your project will be located, your project has the potential for
affecting them, and you must comply with the ESA. The questions in this

The Port Angeles regional watershed is an area where several
endangered species have historically been present. Please answer the
