RECOMMENDATION: The Planning Division recommends that the Planning
Commission approve CUP 09-01 with 3 conditions, citing 10 findings and 2 conclusions in
support of that action as listed in Attachment A.
EXISTING CONDITIONS IN AREA:
The subj ect property is located at 23 5 8 Highway 10 1 with its sole access from Highway
10 1. The site is 107,3 3 3 square feet in size which equals a total site area of 2.46 acres. The
property is level, developed with three large structures, and surfaced with either asphalt or
gravel. The property contains no environmentally sensitive areas. The application and site maps
are attached as Attachment B.
Development in the area is generally rural, with several industrial uses scattered along the
Highway 10 1 frontage. Zoning in the area is Industrial Heavy on the south side of Highway 10 1,
with the zoning being Clallam County Manufacturing on the north side of Highway 10 1.
DEPARTMENT COMMENTS:
City Departments reviewed the proposal and provided the following comments:
The Fire Departinent commented:
1. The tank is allo,,N,,e,-1 only for the temporary time clIctermined to be just prior to the
closing of the Hood Canal Bridge and until just after it is reopened.

2. Weeds, grass and brush must be kept 10' away from the tank.
3. "NO SMOKING" signs shall be posted within 25' of the tank in all directions.
4. Concrete blocks shall be used to protect from vehicular damage. (Ecology Block
or Jersey Barriers)
The Public Works and Utilities Department commented that compliance with fire
protection and safety as addressed by the Fire Marshall is required. There are no right-of-way
issues.
The Building Division of DCD had no comments.
STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW:
A Determination of NonSignificance was issued for this proposed action on march.3 1,
2009, per WAC 197-11-355.
PUBLIC COMMENT:
Notification of the proposed action was placed in the Peninsula Daily News on March 13,
2009, posted on the subject property on March 10, 2009, and mailed to property owners within
300 feet of the subject property on March 10, 2009. The public Comment period closed on
March 30, 2009. One comment letter was received during the public comment period. The letter
writer was concerned that the propane tank would be used for some purpose that would generate
noise, and seemed unsure as to the location the tank would occupy. The handwritten letter (and a
transcribed copy) are attached.
DEPARTMENT OF COMMUNITY and ECONOMIC DEVELOPMENT ANALYSIS:
The entire Comprehensive Plan and Port Angeles Municipal Code were reviewed with
regard to the proposal, and the references listed in Attachment C were found to be the most
relevant to the proposal. In addition to the Comprehensive Plan goals and policies, development
regulations in the Industrial Heavy zone are also included in Attachment C to this staff report.
The City's Comprehensive Plan and Land Use Map identify the area as being located in
the Southwest Planning Area with the site designated as Industrial on the Comprehensive Plan
Land Use Map.
The site is zoned Industrial Heavy (11-1). The storage of gas for illuminating and heating
purpose is allowed by conditional use permit in the IH zone, PAMC 17.34.040(D). No minimum
lot size requirement is listed as a condition of approval. The site plan identifies the proposed
storage tank, location as the southeast comer of the site. The proposed use will not increase the
impervious surface coverage at the site, as the tank will occupy an area currently paved with
gravel. As the bulk of the area is paved with asphalt or gravel, adequate area for parking and
operations of the facility currently exist and no additional parking is required.
The proposed use is temporary in nature as typically Propane Northwest delivers propane
from an area where access to the Olympic Peninsula relies on the Hood Canal bridge. During the
anticipated closure of that bridge, delivery of propane to the peninsula would become more
difficult, resulting M increased costs to the ultimate customer. Once the bridge is reopened, the
temporary tank will be removed and service will return to the condition currently in place.

In consideration of a conditional use permit application, the Planning Commission may
impose whatever restrictions or conditions are considered to be essential to protect the public
health, safety, and welfare, and to prevent depreciation of neighboring property. Uses developed
by conditional use permit must remain in continual compliance with the conditions of approval
or the use may be revoked. A similar use exists at 704 Marine Drive in the same zone.
Consideration is also given to the impacts on traffic patterns, the physical circumstances
of the subject property, other uses in the neighborhood, schools, and needed public
improvements.

ATTACHMENT A
RECOMMENDED CONDITIONS, FINDINGS, AND CONCLUSIONS
The Planning Division recommends the Planning Commission approve Conditional Use
Permit CUP 09-01 subject to 3 conditions and based on the following 10 findings and 2
conclusions in support of the action:
Conditions:
I. The proposed tank shall be removed from the site by July 1, 2009. If additional time at
the location is required, an amendment to CUP 09-01 shall be submitted and approved.
Also, if the applicant wishes to make the use more permanent at the subject location, a
new Conditional Use Permit requesting such action shall be submitted for review by the
City.
2. The applicant shall meet all of the Fire Department conditions prior to gaining final
approval of the use at the site.
3. Use of the propane tank, shall cease within 2 weeks of the reopening of the Hood Canal
- Bridge.
Findings:
Based on the information provided in the Community Development Staff Report for CUP
09-01 dated April 8, 2009, including all information in the public record file, comments and
testimony presented during the public hearing, the Planning Commission discussion and
deliberation, and the above listed conditions of approval, the City of Port Angeles Planning
Commission hereby finds that:
I. Propane Northwest submitted Conditional Use Permit application CUP 09-01 to locate a
12,000 gallon propane storage tank on the site at 23 5 8 Highway 10 1, parcel number
063007340225, for a period of 6 to 8 weeks, during the time the Hood Canal Bridge will
be closed for construction.
2. The site is zoned Industrial Heavy.
3. The Comprehensive Plan designates the site as Industrial... Adjacent designations are
also Industrial. The site is located in the City's Southwest Planning Area. Development
in the surrounding area includes other industrial uses, agriculture, large lot residential,
and some commercial.
4. Per 17.96.050 PAMC, the Planning Commission shall consider applications for
conditional use permit uses as specified in the applicable Chapter of the Zoning
Regulations. The Planning Commission may grant said permits which are consistent and
compatible with the purpose of the zone in which the use is located, consistent with the
Comprehensive Plan, and not contrary to the public use and interest. In each application
the Planning Conii-nission may impose whatever restrictions or conditions are considered
essential to protect the public health, safety, welfare, and to prevent depreciation of
neighboring property. Conditional uises shall be evaluated to detern-.);ne if the
characteristics of the intended use as related to the specific proposed site woLdd defeat the
purpose of the City's Zoning Regulations by introducing incoropatible, detrimental, or

permit if the characteristics of the intended use would defeat the purpose of the City's
zoning regulations.
5. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land
Use Element Industrial Goal H, Policy HA, and Policy H.5 were found to be most relevant to
the proposal.
6. A development that is approved through the conditional use permit process must remain
in continual compliance with specific conditions of approval or may be revoked.
7. Reviewing City Departmental comments were considered in the review of this
application.
8. Notification of the proposed action and conditional use permit application was placed in
the Peninsula Daily News on March 13, 2009. Public notice was mailed to property
owners within 300 feet of the subject property on March 10, 2009. Notice of the proposal
was posted on the site on March 10, 2009. One public comment was received.
9. A Determination of Non-Significance was issued for this proposed action on March 3 1,
2009.
10. The Planning Commission opened a public hearing on the proposal at the April 8, 2009,
regular meeting.
Conclusions.-
Based on the information provided in the Department of Community Development Staff
Report for CUP 09-01 dated April 8, 2009, including all of the information in the public record
file, comments, and testimony presented during the public hearing, the Planning Commission's
discussion and deliberation, and the above listed conditions of approval and listed findings, the
City of Port Angeles Planning Commission hereby,concludes that:
I. The proposal is consistent with requirements for approvAl of a conditional use permit as
specified in PAMC 17.96.050, of the Port Angeles Municipal Code and, as conditioned,
the proposal is consistent with development standards for a conditional use in the 114
Zone per 17.34.040(D).
2. The proposal is consistent with PAMC Chapter 14.40 (Parking Ordinance).

ATTACHMENT D
COMPREHENSIVE PLAN GOALS, POLICIES, AND OBJECTIVES OF CUP 09-01:
Comprehensive Plan
The City's Comprehensive Plan establishes the long range goals and policies of the City, Any
project proposed in the City must be consistent with the goals and policies of the Comprehensive Plan.
The site is located in the City's East Planning Area. Tile Plan was reviewed in its entirety with regard to
the proposed application and several goals and policies were found to be relevant to the proposal. An
analysis of compliance with those policies is as follows:
The Comprehensive Plan Land Use Map designates the site as Industrial
Land Use Element Industrial Goal H. "To provide opportunitiesfor industrial development in a
manner, which efficiently uses the community's various attributes and natural resources, has minimal
impact on the environment, contributes to the City's quality of life, and is compatible with the desired
urban design of the City."
Policy H.4- "Industrial activity should be located in,three major areas.- adjacent to the harbor,
around the airport, and along Hwy 101 west of Benson Road."
Policy H.5— "Because they are hazardous to the community and detrimental to the general
environment of the area petroleum refineries, liquefied natural gas and liquefiedpetroleum gasfacilities,
energyfacilities, energy plants and their associatedfacilities and associated transmission facilities, as
defined in Chapter 80.50 RCW, should not be permitted outside the heavy industrial use area and without
conditional use review.
Zoning Ordinance
The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. The
Ordinance establishes what types of uses are permitted and where they may be located in the City. It also
establishes definitions and minimum design standards for such uses. Any project proposed in the City
must be consistent with specific regulations of the zone in which it is located.
The Zoning Map identifies the subject property and adjacent properties as Industrial Heavy(IH).
The purpose and intent of this zone is: "This is the least restrictive industrial zone intended to be the area
in which heavy industry could develop causing the least impact on other land uses. Significant adverse
impacts can be expectedftom permitted industrial uses tha't involve hazardous materials, noise, air and
water pollution, shift work around the clock, entertainment businesses with adult-only activities, and
outside storage yards and inanufacturing activities. This zone provides the basic urban land use pattern
for heavy industrial uses with direct access to major transportation facilities, design standardsfor
greater truck traffic, and buffersfor nonindustrial uses unless deemed impractical. "
The purpose of a conditional use permit is defined as "A Conditional Use Permit shall be to
assure that the maximum degreeOfCO177patibility between uses shall be attained The purpose of these
regulations shall be inaintained with respect to the particular us(,of the particular site and in
consideration of other existing andpolential uses within the general area in which such use is to be
located."
PAMC 17.96.050 specifies procedures forthe review and processing of conditional USC
applications, as follows:

17.96 050 Conditional Use Permit
A. The Planning Commission shall consider applicationsfor Conditional Use Permits of
uses as specilied in the applicable Chapter of the Zoning Regulations. The Planning Commission n7ay

located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The
Planning Commission inay refuse to issue a Conditional Use Permit if the characteristics of the intended
use as related to the specific proposed site are such as would defeat the purpose of these Zoning
Regulations by introducing incompatible, detrimental, or hazardous conditions.

As you know, following a public hearing conducted by the Port Angeles Planning Commission
on April 8, 2009, a conditional use permit was approved to enable the location of a 12,000 gallon
propane storage tank in the Industrial Heavy zone at 23 5 8 Highway 10 1 West. The conditional
use permit is approved with the following conditions:

DETERMINATION OF NON SIGNIFICANCE
Description of Proposal: The installation of a 12,000 gallon propane tank to be used on a
temporary basis during the 6 to 8 weeks of the Hood Canal Bridge closure. The project is
located in an area zoned Industrial Heavy. A 32,000 GVW 2-axle truck will also be
intermittently stored on the site.
Location of Proposal (including street address, if any): The project is located at 2358 W.
Highway 10 1, Port Angeles, WA. The site is on the south side of the highway, and is zoned
Industrial Heavy.

The lead agency for this proposal has determined that it does not have a probable significant
adverse impact on the environment. An environmental impact statement (EIS) is not required
under RCW 43.21C.030(2)(c). This decision was made after review of a completed
environmental checklist and other information on file with the lead agency. This information is
available to the public on request.
This DNS is issued under WAC 197-11-340(2); the lead agency will not act on this
proposal for 14 days from the date of issuance. Comments must be submitted by_at

a period of 6 to 8 weeks in the Industrial Heavy zone.
Associate Planner Scott Johns reviewed the Department Report recommending approval
of the conditional use permit with conditions, and identified the site location through the use of a
Power Point presentation.
Don Hutt P. 0. Box 949, Kingston WA, represented Propane Northwest and described
the compan's operations on the Olympic Peninsula and that they will use the tank to service
customers during closure of the Hood Canal Bridge during May and early June, 2009. No earth
disturbing activities or vegetation removal would occur on site and the operation as proposed
would not produce significant noise issues.
There being no further testimony, Chair Mathews closed the public hearing.
Following brief discussion, Commissioner Beier moved to approve conditional use
permit CUP 09-01 with thefollowing conditions,findings, and conclusions:
Conditions:
1. The proposed tank shall be removed from the site by July 1, 2009. If additional time at
the location is required, an amendment to CUP 09-01 shall be submitted and approved.

RECOMMENDATION: The Planning Division recommends that the Planning
Commission approve CUP 09-01 with 3 conditions, citing 10 findings and 2 conclusions in
support of that action as listed in Attachment A.
EXISTING CONDITIONS IN AREA:
The subj ect property is located at 23 5 8 Highway 10 1 with its sole access from Highway
10 1. The site is 107,3 3 3 square feet in size which equals a total site area of 2.46 acres. The
property is level, developed with three large structures, and surfaced with either asphalt or
gravel. The property contains no environmentally sensitive areas. The application and site maps
are attached as Attachment B.
Development in the area is generally rural, with several industrial uses scattered along the
Highway 10 1 frontage. Zoning in the area is Industrial Heavy on the south side of Highway 10 1,
with the zoning being Clallam County Manufacturing on the north side of Highway 10 1.
DEPARTMENT COMMENTS:
City Departments reviewed the proposal and provided the following comments:
The Fire Department commented:
1. The tank is allowed only for the temporary time determined to be just prior to the
closing of the Hood Canal Bridge and until just after it is reopened.

2. Weeds, grass and brush must be kept 10' away from the tank.
3. "NO SMOKING" signs shall be posted within 25' of the tank in all directions.
4. Concrete blocks shall be used to protect from vehicular damage. (Ecology Block
or Jersey Barriers)
The Public Works and Utilities Department commented that compliance with fire
protection and safety as addressed by the Fire Marshall is required. There are no right-of-way
issues.
The Building Division of DCD had no comments.
STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW:
A Determination of NonSignificance was issued for this proposed action on march.3 1,
2009, per WAC 197-11-355.
PUBLIC COMMENT:
Notification of the proposed action was placed in the Peninsula Daily News on March 13,
2009, posted on the subject property on March 10, 2009, and mailed to property owners within
300 feet of the subject property on March 10, 2009. The public Comment period closed on
March 30, 2009. One comment letter was received during the public comment period. The letter
writer was concerned that the propane tank would be used for some purpose that would generate
noise, and seemed unsure as to the location the tank would occupy. The handwritten letter (and a
transcribed copy) are attached.
DEPARTMENT OF COMMUNITY and ECONOMIC DEVELOPMENT ANALYSIS:
The entire Comprehensive Plan and Port Angeles Municipal Code were reviewed with
regard to the proposal, and the references listed in Attachment C were found to be the most
relevant to the proposal. In addition to the Comprehensive Plan goals and policies, development
regulations in the Industrial Heavy zone are also included in Attachment C to this staff report.
The City's Comprehensive Plan and Land Use Map identify the area as being located in
the Southwest Planning Area with the site designated as Industrial on the Comprehensive Plan
Land Use Map.
The site is zoned Industrial Heavy (11-1). The storage of gas for illuminating and heating
purpose is allowed by conditional use permit in the IH zone, PAMC 17.34.040(D). No minimum
lot size requirement is listed as a condition of approval. The site plan identifies the proposed
storage tank location as the southeast comer of the site. The proposed use will not increase the
impervious surface coverage at the site, as the tank will occupy an area currently paved with
gravel. As the bulk of the area is paved with asphalt or gravel, adequate area for parking and
operations of the facility currently exist and no additional parking is required.
The proposed use is temporary in nature as typically Propane Northwest delivers propane
from an area where access to the Olympic Peninsula relies on the Hood Canal bridge. During the
anticipated closure of that bridge, delivery of propane to the peninsula would become more
difficult, resulting in increased costs to the ultimate customer. Once the bridge is reopened, the
temporary tank will be removed and service will return to the condition currently in place.

In consideration of a conditional use permit application, the Planning Commission may
impose whatever restrictions or conditions are considered to be essential to protect the public
health, safety, and welfare, and to prevent depreciation of neighboring property. Uses developed
by conditional use permit must remain in continual compliance with the conditions of approval
or the use may be revoked. A similar use exists at 704 Marine Drive in the same zone.
Consideration is also given to the impacts on traffic patterns, the physical circumstances
of the subject property, other uses in the neighborhood, schools, and needed public
improvements.

RECOMMENDED CONDITIONS, FINDINGS, AND CONCLUSIONS
The Planning Division recommends the Planning Commission approve Conditional Use
Per,mit CUP 09-01 subject to 3 conditions and based on the following 10 findings and 2
conclusions in support of the action:
Conditions:
I. The proposed tank shall be removed from the site by July 1, 2009. If additional time at
the location is required, an amendment to CUP 09-01 shall be submitted and approved.
Also, if the applicant wishes to make the use more permanent at the subject location, a
new Conditional Use Permit requesting such action shall be submitted for review by the
City.
2. The applicant shall meet all of the Fire Department conditions prior to gaining final
approval of the use at the site.
3. Use of the propane tank shall cease within 2 weeks of the reopening of the Hood Canal
Bridge.
Findings:
Based on the information provided in the Community Development Staff Report for CUP
09-01 dated April 8, 2009, including all information in the public record file, comments and
testimony presented during the public hearing, the Planning Commission discussion and
deliberation, and the above listed conditions of approval, the City of Port Angeles Planning
Commission hereby finds that:
I. Propane Northwest submitted Conditional Use Permit application CUP 09-01 to locate a
12,000 gallon propane storage tank on the site at 23 5 8 Highway 10 1, parcel number
063007340225, for a period of 6 to 8 weeks, during the time the Hood Canal Bridge will
be closed for construction.
2. The site is zoned Industrial Heavy.
3. The Comprehensive Plan designates the site as Industrial... Adjacent designations are
also Industrial. The site is located in the City's Southwest Planning Area. Development
in the surrounding area includes other industrial uses, agriculture, large lot residential,
and some commercial.
4. Per 17.96.050 PAMC, the Planning Commission shall consider applications for
conditional use permit uses as specified in the applicable Chapter of the Zoning
Regulations. The Planning Commission may grant said permits which are consistent and
compatible with the purpose of the zone in which the use is located, consistent with the
Comprehensive Plan, and not contrary to the public use and interest. In each application
the Planning Commission may impose whatever restrictions or conditions are considered
essential to protect the public health, safety, welfare, and to prevent depreciation of
neighboring property. Conditional uses shall be evaluated to determine if the
characteristics of the intended use as related to the specific proposed site would defeat the
purpose of the City's Zoning Regulations by introducing incompatible, detrimental, or
hazardous conditions. The Planning Commission may refuse to issue a conditional use

permit if the characteristics of the intended use would defeat the purpose of the City's
zoning regulations.
5. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land
Use Element Industrial Goal H, Policy H.4, and Policy H.5 were found to be most relevant to
the proposal.
6. A development that is approved through the conditional use permit process must remain
in continual compliance with specific conditions of approval or may be revoked.
7. Reviewing City Departmental comments were considered in the review of this
application.
8. Notification of the proposed action and conditional use permit application was placed in
the Peninsula Daily News on March 13, 2009. Public notice was mailed to property
owners within 300 feet of the subject property on March 10, 2009. Notice of the proposal
was posted on the site on March 10, 2009. One public comment was received.
9. A Determination of Non-Significance was issued for this proposed action on March 3 1,
2009.
10. The Planning Commission opened a public hearing on the proposal at the April 8, 2009,
regular meeting.
Conclusions:
Based on the information provided in the Department of Community Development Staff

COMPREHENSIVE PLAN GOALS, POLICIES,AND OBJECTIVES OF CUP 09-01:
Comprehensive Plan
The City's Comprehensive Plan establishes the long range goals and policies of the City. Any
project proposed in the City must be consistent with the goals and policies of the Comprehensive Plan.
The site is located in the City's East Planning Area. The Plan was reviewed in its entirety with regard to
the proposed application and several goals and policies were found to be relevant to the proposal. An
analysis of compliance with those policies is as follows:
The Comprehensive Plan Land Use Map designates the site as Industrial
Land Use Element Industrial Goal H. "To provide opportunities for industrial development in a
manner, which efficiently uses the community's various attributes and natural resources, has minimal
impact on the environment, contributes to the City's quality of life, and is compatible with the desired
urban design of the City."
Policy H.4- "Industrial activity should be located in,three major areas: adjacent to the harbor,
around the airport, and along Hwy 101 west of Benson Road."
Policy H.5— "Because they are hazardous to the community and detrimental to the general
environment of the area petroleum refineries, liquefied natural gas and liquefiedpetroleum gasfacilities,
energyfacilities, energy plants and their associatedfacilities and associated transmission facilities, as
defined in Chapter 80.50 RCW, should not be permitted outside the heavy industrial use area and without
conditional use review."
Zoning Ordinance
The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. The
Ordinance establishes what types of uses are permitted and where they may be located in the City. It also
establishes definitions and minimum design standards for such uses. Any project proposed in the City
must be consistent with specific regulations of the zone in which it is located.
The Zoning Map identifies the subject property and adjacent properties as Industrial Heavy(IH).
The purpose and intent of this zone is: "This is the least restrictive industrial zone intended to be the area
in which heavy industry could develop causing the least impact on other land uses. Significant adverse
impacts can be expectedftom permitted industrial uses that involve hazardous materials, noise, air and
water pollution, shift work around the clock entertainment businesses with adult-only activities, and
outside storage yards and manufacturing activities. This zone provides the basic urban land use pattern
for heavy industrial uses with direct access to major transportation facilities, design standardsfor
greater truck traffic, and buffersfor nonindustrial uses unless deemed impractical. "
The purpose of a conditional use permit is defined as "A Conditional Use Permit shall be to
assure that the maximum degree of compatibility between uses shall be attained. The purpose of these
regulations shall be maintained with respect to the particular use of the particular site and in
consideration of other existing andpotential uses within the general area in which such use is to be
located."
PAMC 17.96.050 specifies procedures for the review and processing of conditional use
applications, as follows:
