ENVIRONMENTAL CHECKLIST
Purpose of Checklist:
Chapter 43.21C RCW the State Environmental Policy Act (SEPA) requires all governmental
agencies to consider the environmental impacts of a proposal before making decisions. The purpose of
this review is to provide information to help you and the reviewing agency identify impacts that may result
from your proposal and to identify methods to reduce or avoid impacts from the proposal if they exist.
The review will help the agency decide whether further information is necessary or whether an
environmental impact statement (EIS) is necessary.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your proposal.
Answer each question to the best of your knowledge with the most precise information known. Provide
the best descriptions you can. In most cases you should be able to answer the questions from your own
observations or project plans without the need to hire experts. If you do not know the answer, or if a
question does not apply to your proposal, write "do not know" or "does not apply (N/A). Complete
answers to the questions will avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems please ask the City Department
of Community & Economic Development employees to assist you.
The checklist questions apply to all parts of your proposal, even if you plan to phase them over a
period of time or on different parcels of land. If phasing is proposed, please provide that information in
Item 11, the description section. Attach any additional information that will help describe your proposal or
its environmental effects and include a site map.

4. The applicant is responsible for obtaining all required local, state, and federal
pen-nits required to conduct the proposed wrecking and recycling operation. Copies of.
said permits shall be submitted to the Department of Community& Economic
Development.
5. A minimum of ten (10)parking spaces shall be provided at the front of the site.
6. Sewer must be extended to the site unless an on-site septic system is approved per
Section 13.61.090(B) PAMC. If a private on site potable water source is available, such
information shall be submitted to the City's Public Works and Utilities Department for
review and approval prior to occupancy of the site. Use of a private potable water source
must be approved by the Clallam County Department of Health and Human Services.
7. Site development shall include adherence to all Fire Department standards that
includes a fire extinguisher in the office area.
8. The vehicle crushing activity shall observe Best Management Practices as
prescribed by the State of Washington Department of Ecology and shall, at minimum,
include an impervious surface area where any tear down, draining of fluids, and crushing
of vehicles will occur. This area should be covered to prevent stormwater contamination
and set up so that any spills are recovered. Any stormwater that is discharged from this
area shall flow through an oil/water separator before discharge to surface or ground
waters.
9. If power is needed at the site, such will be extended at the property owner's
expense.
The use for which the conditional use permit has been approved must be commenced within one
year from the date of approval or the conditional use permit will become invalid. If you have

CONDITIONAL USE PERMIT — BRASTER — CUP 08-05 — 426 Fields Drive:
A conditional use permit to establish a wrecking yard and recycling facility in the
Industrial Heavy zone. The proposal includes a request to allow 24-hour occupancy
for a site manager/security use.
Associate Planner Scott Johns reviewed the Department's report recommending approval of the
conditional use permit with conditions and responded to questions about utilities available to the
site: water , power, and sewer. Mr. Johns responded that the applicant will need to either extend
City utilities to the site. Through use of a Power Point display, he identified where utilities exist
that could be extended to the site by the applicant. A lengthy discussion of fencing requirements
then took place along with an examination of surrounding use characteristics. In response to
Commissioner Reiss, Mr. Johns responded that operation of a junk yard facility where the
possibility of site contamination exists or could occur as a result of a proposed future use would
be under the oversight of both the State Department of Ecology and the local Department of
Health. Soil erosion potential and oversight of proposed fill would fall within the City's Public
Works and Utility Department jurisdiction.
Chair Matthews reviewed the quasi judicial public hearing guidelines and qualifying
statements. All Commissioners-responded that they did not have any appearance of fairness or
conflict of interest issues with regard to the pending application. Chair Matthews opened the
public hearing.
Margie Braster, 317 South Jones Street, stated that she wants to run a clean, neat,
attractive, environmentally safe, wrecking yard use. She would like to fill a short ravine area to
consolidate the site, fence the property along the property lines, install a septic system, and
extend City water and power to the site. She does not intend to store vehicles on the premises
without reason. Her plan is to get vehicles in, and get them out in an acceptable, legal manner.
Her desire is to ensure the safety of the site and ensure that neighbors are safe. Proposed site
development will result in the elimination of illegal, random dumping of materials on the
property and allow appropriate management of the site. Mrs. Braster realized the logistics of the
extension of water and power to the site, and hoped that she would qualify to be able to install a
septic system rather than extend the City's sewer to the site.
Planning Manager Sue Roberds distributed site photos for the Commission's
information.
Kevin Rodman, 4065 Eden Valley Road, is the immediately adjacent property owner to
the east. He agreed that random dumping does occur on the site, and on his own property, due to
its remote location. He expressed concern over devaluation of his property, site security, soil
contamination, and fencing. He had no objection to the proposal, and believes that, as proposed,
Mrs. Braster's operation should alleviate many of his concerns.
There being no further testimony, Chair Matthews closed the public hearing.
The Commission further discussed proposed site development. It was determined that
occupancy of the security building should be restricted to security purposes, by security
personnel, not as a typical residential use. Commissioner Boyle moved to a rove the
conditional use permit subject to thefollowing conditions,findings, and conclusions:

Findings
Based on the information provided in the Community and Economic Development Staff Report
for CUP 08-05 dated January 14, 2009, including all information in the public record file,
comments and testimony presented during the public hearing, the Planning Commission
discussion and deliberation, and the above listed conditions of approval, the City of Port Angeles
Planning Commission hereby finds that:
1 Property owner Margie Braster submitted Conditional Use Permit application CUP 08-05
to allow a wrecking yard and materials recycling yard to be located in the IH zone on
November 26, 2008. The site is located at 426 Fields Drive in the Eclipse Industrial area.
The application also requests that an on-site office and security residence be permitted.
2. Modem society living results in the creation of waste materials that must be disposed of
in an appropriate manner. The City adopted PAMC 17.35.040 to ensure that junk yards
and recycling facilities are developed in an appropriate manner. A junk yard, per Chapter
17.35 PAMC, is required to contain a minimum of 3 acres, and shall be established by
conditional use permit. The subject site is 4.8 acres inarea.
3. The site is zoned Industrial Heavy. Adjacent properties are also zoned Industrial Heavy.
Development in the surrounding area includes an asphalt plant, lumber mills, materials
storage, a construction yard, and another junk yard.
4. The site is located in the City's Southwest Planning Area and is designated as Industrial
on the City's Comprehensive Plan Land Use Map. The City's Comprehensive Plan was
reviewed for consistency with the proposal. Growth Management Element Goal A,
policy 9; Land Use Element Goal A, policy 2, Goal G, and goal H, Policies 1, 3, & 4;
Conservation Element Goal A and Policy A.1, Goal B and Policies B.1, 2, 11, 12, 13, 14,
19, 20, and Objectives B.3, and 4; Economic Development Element Goal A, and Policies
2, 3, and 4; were found to be most relevant to the proposal.
5. Per 17.96.050 PAMC, the Planning Commission shall consider applications for
conditional use permits as specified in the applicable Chapter of the Zoning Regulations.
The Planning Commission may grant said permits which are consistent and compatible
with the purpose of the zone in which the use is located, consistent with the
Comprehensive Plan, and not contrary to the public use and interest. In each application
the Planning Commission may impose whatever restrictions or conditions are considered
essential to protect the public health, safety, welfare, and to prevent depreciation of
neighboring property. The Planning Commission may refuse to issue a conditional use
permit if the characteristics of the intended use would defeat the purpose of the City's
zoning regulations. A development that is approved through the conditional use permit
process must remain in continual compliance with specific conditions of approval or said
permit may be revoked.
6. PAMC Section 14.40 (Parking Ordinance) does not specifically require off-street parking
spaces for junk yards, wrecking yards, or recycling facilities. However' PAMC Section
17.035.050 (Zoning Ordinance) requires that junk yards provide a minimum of 10
vehicular parking spaces.

7. On-site septic systems may only be permitted within the City limits per the criteria listed
in Section 13.61.090(B) PAMC. When contacted during the application review period,
the Clallam County Department of Health reported that there is no record of an on site
septic system for the subject property.
8. City sewer and water utilities are located approximately 2,000 feet east of the subject
property along the Eclipse Industrial Parkway. The City's Public Works and Utilities
Department does not have information regarding a potable water source available to the
subject property or that electric service has been extended to the site. Information must
be submitted indicating that an approved, on site, potable water source is available to the
site prior to occupancy of the site. In lieu of a private potable water source, the applicant
would need to extend water from the Eclipse Industrial Parkway westerly to the subject
property. If power is desired, the applicant must extend to the site. Any needed utility
extensions will be borne by the developer of the property.
9. Reviewing City Department comments and comments from Clallam County Department
of Health and Human Services, and State of Washington Department of Ecology's
Hazardous Waste & Toxics Reduction Division and Solid Waste and Financial
Assistance Division were considered in review of this application.
11. Per the State of Washington Department of Ecology's Hazardous Waste & Toxics
Reduction Division, auto wrecking facilities have a long history of contamination of
soils, surface, and ground water. The development of proper best business practices
(BMP) during the construction phase goes a long way to protecting the states
environment. Most contamination occurs in the vehicle tear down area where fluids are
drained and parts removed. The other area of concern is where the vehicles are crushed
for shipment. Measures to protect waters of the state are recommended during permit
review.
12. Notification of the proposed action and conditional use permit application was placed in
the Peninsula Daily News on December 7, 2008. Public notice was mailed to property
owners within 300 feet of the subject property and the site was legally posted on
December 5, 2008.
13. A Mitigated Determination of Non-Significance was issued for the proposed action on
January 6, 2009, and mailed to agencies with jurisdiction under WAC 197-11-340(2).
This satisfies the City's responsibility with regard to the State Environmental Policy Act
review.
14. Section 17.35.030 PAMC requires that, unless otherwise specified by the Planning
Commission, a solid, site-obscuring fence, which may include vegetation or landform, at
least seven (7) feet or more in height shall be constructed on or within five (5) feet of the
rear and side property lines and the front yard setback line, which shall be a distance of
fifty (50) feet from all street rights-of-way. No storage or display of any junk, appliance,
article, merchandise, or vehicle shall be permitted outside of said required fence.
15. The Planning Commission conducted a public hearing on the proposal at the January 14,
2009, regular meeting.

Conclusions
Based on the information provided in the Department of Community and Economic
Development Staff Report for CUP 08-05 dated January 14, 2009, including all of the
information in the public record file, comments, and testimony presented during the public
hearing, the Planning Commission's discussion and deliberation, and the above listed conditions
of approval and listed findings,the City of Port Angeles Planning Commission hereby concludes
that:
I The proposal is consistent with the procedural requirements for approval of a conditional
use permit as specified in PAMC 17.96.050, and, as conditioned, the proposed activity is
in compliance with requirements of PAMC Chapter 17.35 Junk Yard Conditional Use
Permit. The use as conditioned is therefore in compliance with the City's Zoning
Ordinance, specifically Chapter 17.35 PAMC.
2. The use is in compliance with the City's Comprehensive Plan and Land Use Map.
3. City services are available in the area but have not been extended to the site. As
conditioned, the use as proposed requires that the applicant provide proof of the ability to
provide adequate on site sanitary facilities to support occupancy and use of the site, or
shall extend public utilities to the site to adequately serve the site prior to continued
occupancy of the site. As such, the proposed use addresses the public safety, health, and
welfare issues of occupancy.
4. Given the site size, location within a heavy industrial area, surrounding uses, and site and
surrounding topography, it is likely that a solid site-obscuring fence is not needed for
separation purposes. It is likely that a fence is needed for security purposes, and in fact,
such has been suggested during the public comment period. Section 17.35.030 PAMC
provides that other methods of site containment may be considered by the Planning
Commission in review of an application for a junk yard use. Reasonableness should be
used to determine if strict application of the rules should apply with regard to fencing,
and it has been determined given the circumstances and testimony that alternative fencing
requirements will accomplish the intended result of securing the site and discouraging
unauthorized use.
5. Junk vehicle and materials recycling is a product of modem society. The applicant
provides a necessary service and is required to operate under rules established largely by
the State of Washington and the Department of Health and Human Services. As
conditioned, the applicant shall obtain all necessary permits and shall provide proof of
those actions prior to operation of the junk yard/recycling use in the Industrial Heavy
zone.

RECOMMENDATION:
The Planning Division recommends that the Planning Commission approve CUP 08-05
with 9 conditions, citing 15 findings, and 5 conclusions in support of that action as listed in
Attachment A.
SITE AND EXISTING CONDITIONS IN AREA
The subject property is approximately 5 acres in area and is located at 426 Fields Drive in
the Eclipse Industrial area. The site is zoned Industrial Heavy. Lots in the area average 5 acres
or larger. The property is relatively undeveloped; however, the dumping of auto bodies, tires,
appliances, wood waste, and other materials has been occurring on the site for a period of years.
Access to the site is from Highway 10 1 to Eclipse Drive, to Fields Drive. Highway 10 1 is an
improved state highway, Eclipse Drive is a partially improved, private local access street, and
Fields Drive is not improved. The site is generally level. A ravine (geographic feature) crosses
the site from east to west that is approximately 25 feet deep and 160 feet in width The
application includes a Clearing and Grading permit application to fill the ravine area over time,
resulting in a nearly level, entirely usable site. The.application and site maps are attached as
Attachment B.
Development in the area is industrial. The adjacent sites have been used for auto and
appliance recycling and as a construction yard. However, adjacent site use is nonconforming as
it pre exists annexation of the area. The area was annexed to the City in 2005. In 2000, aerial

photographs identify that adjacent property to the west was undeveloped while the adjacent
property to the east was possibly a construction yard.
No environinentally sensitive areas exist on the subject site. The ravine area lacks
steepness, depth, and soil type to be considered environmentally sensitive. City water and sewer
lines do not extend to the site. Both utilities exist less than 1,500 feet from the northeast corner
of the site, however, the logical route to lay a sewer line places the length of line at
approximately 2,000 feet from the site. A proposed 8" sewer line is indicated to be installed by a
nearby property owner approximately 375 feet to the east of the site. That line has yet to be
installed and, although should not be considered to be available to the subject site at this time,
may be available in the future.
CITY DEPARTMENT COMMENTS:
City Departments reviewed the proposal and provided the following comments:
The Fire Department will require a fire extinguisher and that address numbers be placed
on the site. No other comments or objections were noted.
The Public Works and Utilities Department provided the following comments:
I. Both water and sanitary sewer utilities are located approximately 2,000 feet east
of the subject property along the Eclipse Industrial Parkway.
2. Public Works and Utilities Department does not have information regarding on-
site septic waste water available to the property. Verification of an approved
septic system from Clallarn County Environmental Health Department will be
required.
_3 Public Works and Utilities Department does not have information regarding a
potable water source available to the subject property. Construction of an eight
inch (minimum) water main extending from the Eclipse Industrial Parkway
westerly to the subject property may be required for domestic water service and or
fire protection as required by the Fire Department. Any requirements for main
extensions will be at the expense of the developer of the property.
4. Any activity involving clearing, grading, and/or diverting surface water (drainage
culverts) on the subject property will require additional permitting and approval.
5. An Industrial Storm Water Permit may be required.
6. The existing access road consists of a gravel surface. The roadway is currently
under private ownership and is not maintained by City forces. The minimum
requirement for an all weather street width is twenty feet.
7. The City's electrical facilities do not serve the subject property. Any extension of
electrical facilities to service the property will be at the owner's expense.

the Washington State Industrial Stormwater General Permit.

Stormwater General Permit.

3. Auto wrecking facilities have a long history of contamination of soils, surface and
ground water. The development of proper best business practices (BMP) during the
construction phase goes a long way to protecting the state's environment. Most
contamination occurs in the vehicle tear down area where fluids are drained and parts
removed. The other area of concern is where the vehicles are crushed for shipment.
The crusher's fluid recovery tanks and BMPs are not adequate to stop all releases to
the environment resulting in fluid discharge from the vehicles in the teardown area.
To protect waters of the state, at minimum, an impervious area should be developed
where the vehicles can be torn down,fluids drained, and crushed. This area should be
designed to capture and contain all spills that will occur during the crushing operation
and should be covered to prevent stormwater contamination. Any stormwater that is
discharged from this area should flow through an oil and water separator before
discharge to surface or ground waters.
Hazardous Waste & Toxics Reduction Division commented:
The applicant must comply with the Dangerous Waste Regulations, Chapter 173-303
WAC.
Solid Waste and Financial Assistance Division commented:
The activities described require a Solid Waste Facility Handling Permit in accordance
with WAC 173-350. In order to obtain the permit, the applicant must contact Jennifer
Garcelon, Clallam County Health and Human Services.
Clallam County Health and Human Services commented:
I. A notice of intent to operate a recycling facility was received by DOE on March
18, 2008. Ecology denied an exemption and will require a Solid Waste permit for
the activities.
2. WAC 173-350-350 requires a solid waste pen-nit if more than 800 tires will be
stored on the site at any time. If the site stores less than 800 tires, a regular
monitoring of the number of tires on site shall be required by Clallarn County
Health and Human Services.
3. Clean fill shall not include yard waste, tires, wood waste. Those items constitute
solid waste and require a solid waste pen-nit before using as fill.
Clallam County found no records indicating that a sanitary septic system exists on the
site.
PUBLIC COMMENT:
Notification of the proposed action was placed in the Peninsula Daily News on December
7, 2008, and mailed to property owners within 300 feet of the subject property and posted on the
site on December 5, 2008. One written comment letter was received during the public comment
period for the proposal. The letter writer expressed concerns regarding theft of materials from
the subject site and surrounding properties, illegal dumping on the site, and the need for sewer
and water in the area. Due to the isolation of the site, lack of security fencing, and the difficult
economic times, theft from the site and surrounding sites has occurred at an increased rate,
according to the letter writer. Those same conditions have resulted in illegal dumping at the site.
The letter writer is a neighboring property owner and has concerns that the illegal activities could
spill over to his property.

The entire Comprehensive Plan and Port Angeles Municipal Code were reviewed with
regard to the proposal, and the references listed in Attachment C were found to be the most
relevant to the proposal. In addition to the Comprehensive Plan goals and policies, development
regulations in the Industrial Heavy zone are also included in Attachment C to this staff report.
The City's Comprehensive Plan and Land Use Map identify the area as being located in
the Southwest Planning Area. The site is designated in the Comprehensive Plan as Industrial.
A wrecking yard (also referred to as a junk yard) is a conditional use in the Industrial
Heavy zone, subject to PAMC 17.35. The proposed wrecking yard/recycle facility will include a
manufactured home to be used for an on-site manager/night security person, a covered structure
for disassembly/crushing of vehicles, and a fluids storage facility. The application materials and
site plan identify proposed buildings and structures as being adjacent to the south property line.
Proposed lot coverage is less than I% of the site.
Per 17.96.050 PAMC, the Planning Commission may impose whatever restrictions or
conditions are considered to be essential to protect the public health, safety, and welfare, and to
prevent depreciation of neighboring property in consideration of a conditional use permit
application. Uses developed by conditional use permit must remain in continual compliance
with the conditions of approval or the use may be revoked.
Development standards for ajunk yard are contained in Section 17.35 (Zoning) PAMC.
Junk, yard uses are required to be located on a minimum 3' acre site, provide a minimum of ten
(10) parking spaces on-site, and unless specified, be screened from adjacent properties through a
solid, site-obscuring fence, a minimum of seven(7) feet in height, placed on or within five (5)
feet of the rear and side property lines and no closer than 50 feet from the front setback line.
Although a site-obscuring fence may not provide absolute security, the site's security can be
enhanced through use of the fence and modifications can improve security. In addition, the
applicant has proposed that a manufactured home be placed on the site to provide
accommodations for a security person. These measures will also address the concerns received
during the written public comment period from an adjacent property owner.
When reviewing conditional use permit applications, consideration is given to the
impacts on traffic patterns, physical circumstances of the subject property, other uses in the
neighborhood, schools, and needed public improvements. The proposed use will not cause
adverse impacts to the surrounding neighborhood, existing traffic patterns, local schools, or other
local improvements. The site is located within a functioning industrial park where such uses are
expected.
STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW:
A Determination of NonSignificance was issued for this proposed action on January 6,
2009, per WAC 197-11-355. City Department comments and letters received from Clallam
County Health and Human Services and the Washington State Department of Ecology were
referenced in formulating that determination. Comment letters are included in the fi-le-.

ATTACHMENT A
RECOMMENDED CONDITIONS, FINDINGS, AND CONCLUSIONS
The Planning Division recommends the Planning Commission approve Conditional Use
Permit CUP 08-05 subject to 8 conditions and based on the following 15 findings and 5
conclusions in support of the action:
Conditions:
1 A junk yard/recycling use is hereby approved for Margie Braster to operate at 43 6
Fields Drive, Port Angeles, Washington, per application CUP 08-05. Such use
may include a small office/residence to ensure site security as proposed in said
application. All permits shall be obtained for use of the structure as a residential
use. Residential use of the structure must operate in association with the junk
yard activity and shall not be expanded or used separately from the junk
yard/recycling use.
2. With the exception of an office, security structure, and visitor parking, the entire
site shall be screened by site-obscuring fencing. Such screening may include
fencing, vegetation, and landforms as long as the required height is achieved and
maintained for the life of the use. Solid fencing across the front of the site shall
be established that is no closer than 50 feet from the front property line and within
five (5) feet of the side property lines. Other site obscuring fencing shall be
extended along the sides and rear property lines of the use area as it is defined.
Areas where filling is occurring prior to use do not need to be screened until they
are combined with the junk yard/recycling use.
All structures involved in the dismantling, crushing, and/or separating of vehicle
parts, other recyclables, or scrap materials shall be located within the fenced area
of the site. No storage or display of any site materials including but not limited to
junk, appliance, article, merchandise, or vehicle shall be permitted outside of the
required fencing or screening area.
4. The applicant is responsible for obtaining all required local, state, and federal
permits required to conduct the proposed wrecking and recycling operation.
Copies of said permits shall be submitted to the Department of Community &
Economic Development.
5. A minimum of ten (10) parking spaces shall be provided at the front of the site.
6. Sewer must be extended to the site unless an on-site septic system is approved per
Section 13.61.090(B) PAMC. If a private on site potable water source is
available, such information shall be submitted to the City's Public Works and
Utilities Department for review and approval prior to occupancy of the site. Use
of a private potable water source must be approved by the Clallarn County
Department of Health and Human Services.
7. Site development shall include adherence to all Fire Department standards that
includes a fire extinguisher in the office area.
8. The vehicle crushing activity shall observe Best Management Practices as
prescribed by the State of Washington Department of Ecology and shall, at

minimum, include an impervious surface area where any tear down, draining of
fluids, and crushing of vehicles will occur. This area should be covered to
prevent stormwater contamination and set up so that any spills are recovered.
Any stormwater that is discharged from this area shall flow through an oil/water
separator before discharge to surface or ground waters.
9. If electric use is needed at the site, such will be extended at the property owner's
expense.
Findings:
Based on the information provided in the Community and Economic Development Staff
Report for CUP 08-05 dated January 14, 2008, including all information in the public record file,
comments and testimony presented during the public hearing, the Planning Commission
discussion and deliberation, and the above listed conditions of approval, the City of Port Angeles
Planning Commission hereby finds that:
I Property owner Margie Braster submitted Conditional Use Permit application
CUP 08-05 to allow a wrecking yard and materials recycling yard to be located in
the IH zone on November 26, 2008. The site is located at 426 Fields Drive in the
Eclipse Industrial area. The application also requests that an on-site office and
security residence be permitted.
2. Modem society living results in the creation of waste materials that must be
disposed of in an appropriate manner. The City adopted PAMC 17.35.040 to
ensure that junk yards and recycling facilities are developed in an appropriate
manner. A junk yard, per Chapter 17.3 5 PAMC, is required to contain a
minimum of 3) acres, and shall be established by conditional use permit. The
subject site is 4.8 acres in area.
I The site is zoned Industrial Heavy. Adjacent properties are also zoned Industrial
Heavy. Development in the surrounding area includes an asphalt plant, lumber
mills, materials storage, a construction yard, and another junk yard.
4. The site is located in the City's Southwest Planning Area and is designated as
Industrial on the City's Comprehensive Plan Land Use Map. The City's
Comprehensive Plan was reviewed for consistency with the proposal. Growth
Management Element Goal A,policy 9; Land Use Element Goal A,policy 2, Goal
G, and goal H, Policies 1, 3, & 4; Conservation Element Goal A and Policy A.1,
Goal.B and Policies B.1, 2, 11, 12, 13, 14, 19, 20, and Objectives B.3, and 4;
Economic Development Element Goal A, and Policies 2, 3, and 4; were found to
be most relevant to the proposal.
5. Per 17.96.050 PAMC, the Planning Commission shall consider applications for
conditional use permits as specified in the applicable Chapter of the Zoning
Regulations. The Planning Commission may grant said permits which are
consistent and compatible with the purpose of the zone in which the use is
located, consistent with the Comprehensive Plan, and not contrary to the public
use and interest. In each application the Planning Commission may impose
whatever restrictions or conditions are considered essential to protect the public
health, safety, welfare, and to prevent depreciation of neighboring property. The
Planning Commission may refuse to issue a conditional use permit if the
characteristics of the intended use would defeat the purpose of the City's zoning

regulations. A development that is approved through the conditional use permit
process must remain in continual compliance with specific conditions of approval
or said permit may be revoked.
6. PAMC Section 14.40 (Parking Ordinance) does not specifically require off-street
parking spaces for junk yards, wrecking yards, or recycling facilities. However,
PAMC Section 17.03)5.050 (Zoning Ordinance) requires that junk yards provide a
minimum of 10 vehicular parking spaces.
8. On-site septic systems may only be permitted within the City limits per the
criteria listed in Section 13.61.090(B) PAMC. When contacted during the
application review period, the Clallam County Department of Health reported that
there is no record of an on site septic system for the subject property.
9. City sewer and water utilities are located approximately 2,000 feet east of the
subject property along the Eclipse Industrial Parkway. The City's Public Works
and Utilities Department does not have information regarding a potable water
source available to the subject property or that electric service has been extended
to the site. Information must be submitted indicating that an approved, on site,
potable water source is available to the site prior to occupancy of the site. In lieu
of a private potable water source, the applicant would need to extend water from
the Eclipse Industrial Parkway westerly to the subject property. If power is
desired, the applicant must extend to the site. Any needed utility extensions will
be borne by the developer of the property.
10. Reviewing City Department comments and comments from Clallam County
Department of Health and Human Services, and State of Washington Department
of Ecology's Hazardous Waste & Toxics Reduction Division and Solid Waste and
Financial Assistance Division were considered in review of this application.
11. Per the State of Washington Department of Ecology's Hazardous Waste & Toxics
Reduction Division, auto wrecking facilities have a long history of contamination
of soils, surface, and ground water. The development of proper best business
practices (BMP) during the construction phase goes a long way to protecting the
states environment. Most contamination occurs in the vehicle tear down area
where fluids are drained and parts removed. The other area of concern is where
the vehicles are crushed for shipment. Measures to protect waters of the state are
recommended during permit review.
12. Notification of the proposed action and conditional use permit application was
placed in the Peninsula Daily News on December 7, 2008. Public notice was
mailed to property owners within 300 feet of the subject property and the site was
legally posted on December 5, 2008.
13. A Mitigated Determination of Non-Significance was issued for the proposed
action on January 6, 2009, and mailed to agencies with jurisdiction under WAC
197-11-340(2). This satisfies the City's responsibility with regard to the State
Environmental Policy Act review.

14. Section 17.35.030 PAMC requires that, unless otherwise specified by the
Planning Commission, a solid, site-obscuring fence, which may include
vegetation or landform, at least seven(7) feet or more in height shall be
constructed on or within five (5) feet of the rear and side property lines and the
front yard setback line, which shall be a distance of fifty (50) feet from all street
rights-of-way. No storage or display of any junk, appliance, article, merchandise
or vehicle shall be pen-nitted outside of said required fence.
15. The Planning Commission conducted a public hearing on the proposal at the
January 14, 2008, regular meeting.
Conclusions.-
Based on the information provided in the Department of Community and Economic
Development Staff Report for CUP 08-05 dated January 14, 2009, including all of the
infori-nation in the public record file, comments, and testimony presented during the public
hearing, the Planning Commission's discussion and deliberation, and the above listed conditions
of approval and listed findings, the City of Port Angeles Planning Commission hereby concludes
that:
I. The proposal is consistent with the procedural requirements for approval of a
conditional use permit as specified in PAMC 17.96.050, and, as conditioned, the
proposed activity is in compliance with requirements of PAMC Chapter 17.35
Junk Yard Conditional Use Permit. The use as conditioned is therefore in
compliance with the City's Zoning Ordinance, specifically Chapter 17.35 PAMC.
2. The use is in compliance with the City's Comprehensive Plan and Land Use Map.
City services are available in the area but have not been extended to the site. As
conditioned, the use as proposed requires that the applicant provide proof of the
ability to provide adequate on site sanitary facilities to support occupancy and use
of the site, or shall extend public utilities to the site to adequately serve the site
prior to continued occupancy of the site. As such, the proposed use addresses the
public safety, health, and welfare issues of occupancy.
4. Given the site size, location within a heavy industrial area, surrounding uses, and
site and surrounding topography, it is likely that a solid site-obscuring fence is not
needed for separation purposes. It is likely that a fence is needed for security
purposes, and in fact, such has been suggested during the public comment period.
Section 17.35.030 PAMC provides that other methods of site containment may be
considered by the Planning Commission in review of an application for a junk
yard use. Reasonableness should be used to determine if strict application of the
rules should apply with regard to fencing, and it has been determined given the
circumstances and testimony that alternative fencing requirements will
accomplish the intended result of securing the site and discouraging unauthorized
use.

5. Junk vehicle and materials recycling is a product of modern society. The
applicant provides a necessary service and is required to operate under rules
established largely by the State of Washington and the Department of Health and
Human Services. As conditioned, the applicant shall obtain all necessary permits

yard/recycling use in the Industrial Heavy zone.

Jen: We do NOT have a septic permit of record, however that doesn't
necessarily mean there is no septic system on the property. There could
be a septic system that's old (before 1968) or just not properly
permitted, misfiled, a number of reasons. I checked the central file and
the only thing inside is your letter of 11/8/07, regarding log yard
debris/yard waste.
Since this property is in the City Limits, you could check with the City
Building Permit Office to see if they have any building permit. The
building permit MAY state the means of sewage disposal.
This is typical of those properties where the tax.assessor shows a
structure but we don't have any septic records. We will be developing a
protocol for investigating these types of records. It will be our septic
"ground truthing project."
In the meantime I don't know what to do besides contact them, ask what
their sewage system is. If a septic-ask that they have a locate done
by a professional. Olympic Sewer& Drain or OMI can locate the system
and produce a sketch. They will also spray paint the ground with the
drainfield location.

In looking at the proposal, I have comments regarding solid waste in
three areas, recycling, tires, and clean fill.
Recycling
WAC 173-350 allows recycling operations to be exempt from a permit as
long as they meet performance standards and do not pollute air, water,
or soil, they submit proper paperwork (notice of intent to operate and
annual reports), and they allow inspections by local health and Ecology.
Ecology received a notice of intent to operate a recycling operation
from the Brasters on March 18, 2008. The paperwork stated the site was
enclosed and there was no outside storage of material, but on our field
visit October 30, 2007, there were no facilities or buildings, so I
believe A] Salvi with Ecology sent them a letter stating Ecology could
not support a solid waste permit exemption in this case and they should
get a solid waste permit for their activities. Contact A] Salvi for

Tires
WAC 173-350-350 requires a solid waste permit for tires if they store
more than 800 tires on site, so we need to know the amount they plan to
store. If it's less than 800 tires at a time, how are they monitoring
that?
Clean Fill
Depending on what they describe as clean fill, a solid waste permit may
be required. In 2007, they were accepting yard waste and wood waste and
filling in the gulch. I sent them a letter stating they must stop
filling it with yard waste, tires, and wood waste because a solid waste
permit was required.
I have also attached a document with the WAC language I stated above

(i) Meet the performance standards of WAC 173-350-040;
(ii)Accept only source separated solid waste for the purpose of recycling;
(iii)Allow inspections by the department or jurisdictional health department at reasonable times;
(iv) Notify the department and jurisdictional health department,thirty days prior to operation, or ninety
days from the effective date of the rule for existing recycling operations, of the intent to conduct recycling in
accordance with this section. Notification shall be in writing, and shall include:
(A) Contact information for the person conducting the recycling activity;
(B)A general description of the recycling activity;
(C)A description of the types of solid waste being recycled; and
(D)An explanation of the recycling processes and methods;
(v) Prepare and submit an annual report to the department and the jurisdictional health department by
April 1st on forms supplied by the department.The annual report shall detail recycling activities during the
previous calendar year and shall include the following information:
(A) Name and address of the recycling operation;
(B)Calendar year covered by the report;
(C)Annual quantities and types of waste received, recycled and disposed, in tons,for purposes of
determining progress towards achieving the goals of waste reduction,waste recycling, and treatment in
accordance with RCW 70.95.010(4); and
(D)Any additional information required by written notification of the department.

Dear Scott,
Here are a few comments from an adjacent landowner concerning the application for the
conditional use permit for the proposed wrecking/recycling yard to be located at 426 Fields Drive.
Firs4 we do agree that the zoning certainly allows for this type of activity on this property, In fact,
the applicants have been using the property already for a junkyard for metal recycling. The issue we
would be concerned about the proposed/cur=t use,is the attraction of crime. With the recent huge
increases in recycled metal prices,there has been a proportional increase in thievery from this property,
and the adjoining prop" to the west that is also being used as a storage area for metals, cars, trucks,
equipment, etc. There is no fencing, security, or maintenance on these properties; just a natural
attraction for "druggies" looking for something easy to steal. This, of course, leads to undesirables
hanging around the area and compromising our ow security in the area.
Second is our concern about all the illegal dumping that has occurred on this property for at least
the lost five years.We have personally observed truddoads of tires,roofing,trash of all Jdnds,etc. being
used for landfill on this property. To comply with today's environmental requirements,-would an this
have to be removed in order to have a property that is able to meet the potential requirements that seek
to avoid the very contamination that this kind of future use is prone to cause? As neighbors in this
industtial zone,we value a good environment,and a dean and healthy place to conduct business.
Third and lastly, there is currently no sewer or water extended to this property Will the= be a
requirement for fire protection and 3anitation? There has already been a major fire that started in the
landfill on this property- The city apparently incurred the full cost of fighting this fire at -a Major
expense to all of us taxpayers.Where is the accountability?

I am Ecology's Industrial Stormwater Inspector for Clallam County. I want to make comments of the
Conditional Use Permit CUP 08-05 for Margie Braster-426 Field Drive (KB Auto Wrecking & Recycling
LLC).
1. Before they start operation, this facility is required to seek and receive coverage
under the Washington State Industrial Stormwater General Permit.
2. If more than one acre of land is disturbed during the construction phase, before
construction states the facility is required to seek coverage-under the Construction Stormwater General
Permit.
3. Auto wrecking facilities have a long history of contamination of soils, surface and
ground water. The development of proper Best Business Practices (BMP) during the construction phase
goes a long way to protecting the states environment. Most of the contamination occurs in the vehicle tear
down area where fluids are drained and parts removed. The other area of concern is where the vehicles
are crushed for shipment. Fluids are discharged from the vehicles because not all the fluids are
recoverable in the teardown area. To protect waters of the state, they should at a minimum be required
to:
1. Develop an area with impervious surfaces where the
vehicles can be torn down and fluids drained. This area should be covered to prevent stormwater
contamination, and set up so any spills are recovered. Any stormwater that is discharged from this area
should flow through a oil and water separator before discharge to surface or ground waters.
2. Develop an area with impervious surfaces where the
vehicles are crushed. The crushers fluid recovery tanks and BMPs on are not adequate to stop all
releases to the environment. This area should be able to capture and contain all spills that will occur
during the crushing operation. Also, this area should have an oil and water seperator to treat any
stormwater discharges to surface or ground waters.

Dear Mrs.Braster:
On Tuesday,October 30,2007,Clallam County Environmental Health responded to the tire fire in the
ravine at 9999 Fields Drive,Port Angeles,WA 98363. The focus of the site visit was to obtain soil
samples at the location of the tire fire. I took two soil samples and had them tested for eight metals and
polyaromatic hydrocarbons. The sample results have been received. There were no exceedances above
the Model Toxics Control Act Method A cleanup level. Therefore,I have recommended to Washington
State Department of Ecology(Ecology)that no further cleanup is needed from the tire fire. I have
enclosed a copy of the test results for Your information.
When I conducted my site visit,I spoke to Mr.Hagerman and Mr.Braster about the other activities at the
property such as the log yard and wood waste piles and the auto and metal recycling. As I stated in my
November 8,2007,letter,no log yard debris,wood waste,or yard debris can be accepted without a solid
waste permit.
Regarding the auto and metal that is recycled,including appliances,you must submit a notification to
Ecology that you recycle metal and vehicles;otherwise a solid waste permit may be required. By
completing the fonn,you acknowledge you will meet standards in law to comply with local and state
solid waste laws,to ensure the facility does not pose a threat to human health or the environment,that
you will comply with water pollution and air laws,and that you will comply with other applicable local,
state,and federal regulations. By completing the form,you also agree to allow inspections by the health
department and you agree to submit an annual report with recycling infon-nation. I have enclosed a copy
of Ecology's Form 040-153,"Recycling...Notice of hitent to Operate..." Please fill out the form and
submit it to Ecology at Solid Waste and Financial Assurance Program,Department of Ecology,PO Box
47600,Olympia,WA 98504-7600.
I have also enclosed a copy of an Ecology publication 97-433,"Vehicle Recycling Manual,A Guide for
Vehicle Recyclers,You Auto Recycle,The Key to a Better Environment." Please review the manual for
additional regulatory information and best management practices.

Dear Mr.and Mrs.Braster.
On Tuesday,October 30,2007,Clallarn.County Environmental Health responded to the tire fire in the
ravine at 9999 Fields Drive,Port Angeles,WA 98363. The focus of the site visit was to obtain soil
samples at the location of the tire fire. I took two soil samples. I should receive the soil test results in
about four weeks.
During my visit I saw a significant amount of log yard debris along the south side of thetavine. It
appears it may have been used to fill part of the ravine. The ravine is approximately 25 feet in elevation
to the bottom of a Type 5 stream. Additionally,there were a few piles of yard debris near the road that
runs from Fields Drive to the ravine.
It is a violation of Clallam County Code 41.10.070 for any person to dump or deposit or permit the
dumping or depositing of any solid waste onto or under the surface of the ground or into the waters of the
state. Storing or filling log yard debris or yard waste requires a solid waste permit. The facility must
stop accepting log yard debris and yard waste. I would encourage you to install a gate or barrier near
the road to the ravine to prohibit illegal dumping on your property.
With regards to the tires on the property,if you accumulate more than 800 tires,you must obtain a solid
waste permit. Ensure you are handling the tires on.the property appropriately.

WAC 173-350-210 Recycling
(2) Recycling-Permit exemption and notification.
(a) In accordance with RCW 70.95.305, recycling of solid waste is subject solely to the requirements of
(b) of this subsection and is exempt from solid waste handling permitting. Any person engaged in recycling
that does not comply with the terms and conditions of(b)of this subsection is required to obtain a permit
from the jurisdictional health department in accordance with the requirements of WAC 173-350-490. In
addition,violations of the terms and conditions of(b)of this subsection may be subject to the penalty
provisions of RCW 70.95.315.
(b) Recycling shall be conducted in conformance with the following terms and conditions in order to
maintain permit exempt status:
(i) Meet the performance standards of WAC 173-350-040;
(ii)Accept only source separated solid waste for the purpose of recycling;
iii)Allow inspections by the department or jurisdictional health department at reasonable times;
(iv) Notify the department and jurisdictional health department,thirty days prior to operation, or ninety
days from the effective date of the rule for existing recycling operations, of the intent to conduct recycling in
accordance with this section. Notification shall be in writing, and shall include:
(A) Contact information for the person conducting the recycling activity;
(B)A general description of the recycling activity;
(C)A description of the types of solid waste being recycled; and
(D)An explanation of the recycling processes and methods;
(v) Prepare and submit an annual report to the department and the jurisdictional health department by
April 1st on forms supplied by the department.The annual report shall detail recycling activities during the
previous calendar year and shall include the following information:
(A) Name and address of the recycling operation;
(B)Calendar year covered by the report;
(C)Annual quantities and types of waste received, recycled and disposed, in tons, for purposes of
determining progress towards achieving the goals of waste reduction, waste recycling,and treatment in
accordance with RCW 70.95.010(4); and
(D)Any additional information required by written notification of the department.
WAC 173-350-040 Performance Standards
The owner or operator of all solid waste facilities subject to this chapter shall:
(1) Design, construct, operate, and close all facilities in a manner that does not pose a threat to human
health or the environment;
(2) Comply with chapter 90.48 RCW,Water pollution control and implementing regulations, including
chapter 173-200 WAC,Water quality standards for ground waters of the state of Washington;
(3) Conform to the approved local comprehensive solid waste management plan prepared in accordance
with chapter 70.95 RCW, Solid waste management-- Feduction and recycling, and/or the local hazardous
waste management plan prepared in accordance with chapter 70.105 RCW, Hazardous waste
management;
(4) Not cause any violation of emission standards c: ambient air quality standards at the property
boundary of any facility and comply with chapter 70.94 RCW,Washington Clean Air Act; and
(5) Comply with all other applicable local, state, and federal laws and regulations.
