PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on October 1, 2015, the CITY OF PORT ANGELES
DEPARTMENT OF COMMUNITY & ECONOMIC DEVELOPMENT received an application to permit
the creation of a duplex by combining two existing parcels and two existing structures in the Residential
Single Family RS-7 zone. The application was determined to be complete on October 1, 2015. Interested
parties are encouraged to cornment on the proposal and to attend the public hearing that will be conducted
on OCTOBER 28, 2015, at 1:00 PM, City Hall, 321 East Fifth Street, Port Angeles, Washington. Written
comment must be submitted no later than OCTOBER 20, 2015., to be included in the staff report on this
matter. Verbal testimony will be taken during the public hearing. Information may be reviewed at the
City Department of Community & Economic Development, City Hall, P.O. Box 1150, 321 East Fifth

Purpose of Checklist:
Chapter 43.21C RCW the State Environmental Policy Act (SEPA) requires all
governmental agencies to consider the environmental impacts of a proposal before making
decisions. The purpose of this review is to provide information to help you and the reviewing
agency identify impacts that may result from your proposal and to identify methods to reduce or
avoid impacts from the proposal if they exist. The review will help the agency decide whether
further information is necessary or whether an environmental impact statement (EIS) is
necessary.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your
proposal. Answer each question to the best of your knowledge with the most precise
information known. Provide the best descriptions you can. In most cases you should be able to
answer the questions from your own observations or project plans without the need to hire
experts. If you do not know the answer, or if a question does not apply to your proposal, write
"do not know" or "does not apply (N/A). Complete answers to the questions will avoid
unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and
landmark designations. Answer these questions if you can. If you have problems please ask
the City Department of Community & Economic Development employees to assist you.

Endangered Species Act (ESA)

Answer to the best of your knowledge.
This checklist was developed to help project proponents and government
agencies identify when a project needs further analysis regar'ding potential
adverse effects on Endangered Species as required by the Endangered Species
Act (ESA). For our purposes, "ESA listed species" are any species listed as
endangered, threatened, or being considered for listing.
This supplemental checklist is for all development within ESA Potential Impact
Areas, which include the following locations:
• Federal Emergency Management Act (FEMA) designated floodplain
and/or floodway areas;
• Riparian Buffer Zones (RBZ) as described by the Dept of Natural
Resources 2007 stream typing system and WDFW's 1997 stream buffer
guidelines; and/or
• Channel Migration Zones (CMZ) plus 50' as identified according to Dept
of Ecology 2003).
If ESA listed species are present or ever were present within the ESA Potential
Impact Area where your project will be located, your project has the potential for
affecting them, and you must comply with the ESA. The questions in this
section will help determine if your proposed project could have an impact.
The Port Angeles regional watershed is an area where several
endangered species have historically been present. Please answer the
following questions to the best of your knowledge to assist the city in
determining if your project will have adverse impacts to ESA species or
their habitats.
Port Angeles Community and Economic Development Department staff can
provide technical assistance in answering the following questions in this
checklist. If necessary, the Washington Department of Fish and Wildlife
(WDFW) regional office can also provide information to help you answer these
questions.

FINDINGS OF FACT
I. The applicant is seeking to combine two adjacent lots and connect two currently
existing stmetures in order to create a duplex.
2. The subject properties are located at 512 and 514 West 9 th Street in Port Angeles
Washington, and are legally described as Lots 3 and V2of Lot 4, Block 296,
Townsite of Port Angeles. The properties are zoned Residential Single Family
(RS-7). The properties are located in the North Central Planning Area of the City
of Port Anaeles' Comprehensive Plan. The Plan desionates the site as residential.

3. The surrounding area is also zoned RS-7.
4. Duplexes are listed as a conditional use in the RS-7 zone.
5. Notice of the application and public hearing was published in the Peninsula Daily
News on October 4, 2015, and was posted on the property on October 2, 2015. On
October 7, 2015, notice of the application and public hearing was mailed to all

property owners located within 300 feet of the subject proper-ties.
6. On October 28, 2015 an open record public hearing was held.
7. The City of Por-t Angeles received no written comments regarding the proposal.
8. No members of the public testified at the hearing.
9. The RS-7 zone requires lots to be a minimum of 7,000 square feet.
10. The lot located at"514 West 9 th" is 3500 square feet in size and is non-
conforming. The structure located on this lot is also non-conforming in that the
east side of the structure has no set back from the property line. The lot located at
"512 West 9"' is 7000 square feet in size; the structure located on the lot is
conforming.
11. Combincy the two lots creates a new lot 10,500 square feet in size, which is the

minimum lot size required for a duplex.
12. The subject property is not located within a floodplain and no environmentally
sensitive areas exist on or near the Subject property.

13. On October 22, 2015, a Determination of Non-Significance was issued by the
SEPA responsible Official.
14. No additional parking will be required by this proposal.
15. The proposal will not adversely impact the neighborhood character, traffic
patterns, school attendance or other conditions of the neighborhood.
16. Copies of the proposal was circulated to City Departments and the following
comments were provided:
The Fire Department had no objection to the proposal based upon compliance
with applicable building and fire codes.
'-fhe Public Works Department did not comment.
The Building Department commented:
This action will help resolve the majority of issues with non conforming
structures on lots with fire separation and set back issues, as this case presents.
The building code shall require a fire separation of I hour—tested in
accordance with ASTM E 119 or UL 263 with exposure from both sides
When alterations, repairs or additions requiring a permit occur, or when one
or more sleeping rooms are added or created in existing dwellings, the
individual dwelling unit shall be equipped with smoke and carbon monoxide
alarms located as required for new dwellings.
Means of egress shall not be impeded by any new construction and it is highly
advised that upgrades , if needed, to assure safe passage in the event of a
hazardous condition.
Also, please verif� any electrical or public works permits and upgrades that
may be required.
Alteralions, repairs or additions shall require a building permit as per the
current adopted codes of the City of Port Angeles.
CONCLUSIONS OF LAW
1. The Hearing Examiner has jurisdiction to hear this matter.

3. Pursuant to PANIC 17.96.050, conditional use permits may granted if consistent
and compatible with the purpose and the zone in which the use is located,
consistent with the Comprehensive Plan and not contrary to the public use and
interest.
4. In applying the law the to facts of the application herein, the undersigned
concludes the proposal is consistent and compatible with the purpose of the zone
in which it is located. The purpose of the RS-7 zone is to create and preserve
single family residential neighborhoods; uses compatible with and functionally
related to single family residential environments may be located in this zone. The
proposed duplex is compatible with, and functionally related to a single family
residential neighborhood. In fact the proposal helps preserve the neighborhood by
eliminating the non-conforming lot size of the smaller parcel, and allows for re-
newel and redevelopment of two currently existing structures.
5. In applying the law to the facts of the application herein,the undersigned
concludes the proposal is consistent with the Comprehensive Plan. One of the
goals of the Comprehensive Plan is "to provide certainty to its citizens about
future land use and the flexibility necessary to meet the challenges of the future.
The proposal herein supports the goal of being flexible to meet the challenge of
providing updated housing stock, and provides certainty by eliminating a
currently existing non-conforming parcel. The proposal also adheres to the Plan's
policy of promoting a variety of housing types and sizes.
6. There is nothing to indicate the proposal is in any way contrary to the public use
and interest.
DECISION
Based upon the foregoing Findings of Fact and Conclusions of Law, the application for a
zoning conditional use permit application(CUP 15-04) is APPROVED, sub,j ect to the

I am requesting with this document that we are able to get a variance on the property located at 512
and 514 West Ninth Street. The two small homes have always been used as a single property and the
complication of the property line proposes a difficulty in being able to sell it easily.
In the attached proposal,we have line out the reasoning in our opinion,of why we should be able to join
the two units and call it a duplex.
Please consider the proposal as the owner has recently lost her husband and is aging and not doing well
herself and she needs to try to get this off her plate. We have a buyer who would like to buy the home,
but is running in to barriers with her bank.

Problem: I have listed and am currently trying to sell the property at 512 and 514 W. 9th. I have been
told, that due to the parcels of each they must sell separately, yet they have always been looked upon
as 1 property and 1 family has owned them historically. The homes were built there in 1915 and have
always been owned by the same family. The granddaughter of the original owners is now very elderly,
has lost her husband already and is living in an assisted living unit with failing health. Her family needs
to sell these homes. The parcels have an added layer of complication since 514 is non-conforming
because of how small the parcel is and could not rebuilt if it burned or partially destroyed. I have an
offer on the property and should we make the buyer get 2 separate loans all of her fess go up and the
bank might not even loan on the smaller one at all. Since this property would be grandfathered in the
current state and has been there since 1915 it seems overkill to not allow it to sell as a duplex and let us
remove the lot line. It seems in the city's best interest since a 25" lot does not even accommodate this
house. We have the square footage to call it a duplex with some sort of manipulation in the structure.
This is in an RS7 zoning area, but has always been used as a multi-unit property. They were not changed
to be two units; they have always been two units since the time of the construction. The problem has
developed because of the code changes over time.
Definition of a duplex: 2 joining units that have separate entrance and separate living spaces, but are
joined in such a manner as to be 1 building due to construction.
Proposal: I am proposing that these two structures be joined by an awning, a common breezeway,
decking or some addition as to allow us to call the property a duplex so that we might be able to remove
the lot line and make this one lot. I would ask your imput as to how we might do this to meet the
current needs of the elderly owner.
There are many of these such cases in Port Angeles, as we manage and have managed over the years.
There must be a way to transfer title of these units so that those who hold title can sell them and not
pay the penalty of having to remove one of the structures.
I respectfully ask that you help us through this process so that this family is not penalized for the
environment of the municipal codes and the rules, but are able to sell their family property in a way that
is not harming or changing of any of the current uses, but meet the variance requirements that you
might need to allow us proceed. I would hope that it would someh6w be grandfathered in to be a
legitimate use of the structures that are present and have been since the early 1900s.
We realize if any structure is removed it could not be put back with the current setbacks, but we are not
proposing that. The value is in what is there currently and many of the neighbor's property also does
not meet current codes and setbacks. It would seem that would not object to the property remaining
the same as it has always has been with a lot line adjustment.
