Dear Mr. Lawson:
Staff have reviewed the paperwork that you provided regarding the intent to create an
individual building site for the residence identified as 1004 E. Park Avenue. The site is
located in the City's RS -9 Residential Single Family zone. The submitted information
included a 1960's preliminary survey that was not filed_ a 1963 quit claim deed, and the
2006 survey filed by the abutting property owner. While the early documentation
indicates the intent to create an independent building site, a survey was not recorded to
formalize such an action.
The property was annexed into the City in 1961. The previously referenced quit claim
deed was filed in 1963. While the City did not adopt formal subdivision regulations until
1967, land use regulations for lot areas of less than 5 acres were in place state wide prior
to that time. The City's regulations dictate minimum lot dimensions and area for new
building sites and requires surveys to be filed to create new building sites. Although a
survey was not filed with the 1963 quit claim deed, the building site contains the required
minimum lot area to be approved under the City's development standards as a building
site but the lot width does not meet the development standards for the RS -9 zone.
Structures on the site are conforming to RS -9 development standards but lot width will
remain nonconforming.
A preponderance of evidence indicates that the quit claim deed intended to transfer
ownership of the area identified by the quit claim deed as an independent building site
prior to adoption of formal subdivision regulations by the City is present. Given this
evidence, the City will acknowledge the nonconforming building site with the following
condition:

L A survey shall he tiled that depicts the lot created by the Statutory Warranty Deed
tiled by Tony and Hazel Sofie on October 25, 1963. The survey should contain a
reference to the 1963 quit claim action that it supports to establish validity of the
action for future reference.

The survey will formalize the lot creation that was intended by the 1963 quit claim action
and allow an individual parcel number to be created.

THIS CONTRACT, made this 25th day of October, 1963 between
Tony J. Sof ie and Hazel Sofie, his wife hereinafter called the "seller" and
Dan N. Childers and Roberta M. Childers,
here natter called the "purchaser,"
WITNESSETH: The seller agrees to sell to the purchaser, and the purchaser agrees to purchase of the
seller the following described real estate with the appurtenances, situate in Clailam County,
Washington:
The North 165 feet of Lot 9 in Block 1, EXCEPT the East 100
feet thereof; and the East 32.03 feet of the North 165 feet of Lot
10 in Block 1; all being in Highland View Acre Tracts, as per plat
thereof recorded in Volume 4 of Plats, page 15, records of Clailam
County, Washington.
Free of incumbrances, except None
On the following terms and conditions: The purchase price is FIFTY EIGHT HUNDRED DOLLARS-
5800.(}1 dollars, of which
EIGHT HUNDRED DOLLARS ($600.00 dollars
has been paid, the receipt whereof is hereby acknowledged, and the purchaser agrees to pay the balance of said
purchase price as follows:
The sum of $60.00 or more, including interest, on December
1963 and the sure of $60.00 or more, including interest, on the 6th
day of each month thereafter until the balance of said purchase price
has been paid in full, together with interest on deferred payments
at the rate of 6 per cent per annum from date until paid.
All payments made hereunder shall be applied first to accrued
interest and the remainder applied to the balance due on the purchase
price.
The purchaser agrees to assume all risk of damage to any improvements upon the premises, or of the
taking of any part of the property for public use; that no such damage or taking shall constitute a failure of
consideration, but in case of such damage or taking, all moneys received by the seller by reason thereof shall
he applied as a payment on account of the purchase price of the property, less any sums of money which the
seller may be required to expend in procuring such money, or at the election of the seller, to the rebuilding or
restoration of such improvements.

PLAN CHECK FEE. IF a plan check fee is due it must be submitted at the time the building permit application and construction plans are
submitted. All other permit fees are due at the time of permit issuance.
EXPIRATION OF PLAN REVIEW If no permit is issued within 180 days of the date of application, the application will expire. The
Building Official can extend the time for action by the applicant up to 180 days upon written request by the applicant (see Section R105.3.2
of the International Building/Residential Code, 2003). No application can be extended more than once.

EXPIRATION OF PLAN REVIEW If no permit is issued within 180 days of the date of application, the application will expire. The
Building Official can extend the time for action by the applicant up to 180 days upon written request by the applicant (see Section
RI05.3.2 of International Building/Residential Code, 2003). No application can be extended more than once.
