As you know this firm represents Marginal Properties LLC Marginal Properties is the
holder of property located at 722 S Lincoln Street, in Port Angeles Washington (the
Property")
Recent environmental investigations have revealed the presence of total petroleum
hydrocarbons as gasoline and BTEX in soil and groundwater on the Property and In the
adjacent right-of-ways
Marginal Properties has engaged Kane Environmental Inc (Kane') to perform an
interim remedial action on the Property The objective of the interim action is to clean
up soil and groundwater with concentrations of petroleum hydrocarbons above MTCA
Method A levels Kane plans to excavate soil contaminated by petroleum hydrocarbons
at five locations on the Property Extraction of groundwater at or near the areas of
identified contamination will also be performed as part of the interim action Following
source removal activities RegenOx and Oxygen Release Compound (ORC)Advanced
commonly used bioremediation products will be placed in the excavations which will
then be filled with clean material Compliance groundwater monitoring will commence
following the interim remedial action

Sorry for the delay in getting back to you. I've been out since last Thursday.
The Site you are looking for information on is no longer in the Voluntary Cleanup Program. It was terminated from the
program due to a change in ownership/development plans.
A lot of the impacted soils have been excavated and removed from the Site; however, due to the depth of the
contamination (and required side slopes) there is still impacted soil on the Site as well as in the roadway. There is also
groundwater contamination on the Site and down Lincoln Street.
I don't think the presence of the remaining contamination is a risk to users of the lot; however, there are still some areas
to investigate prior to Ecology considering the Site suitable for a no further action letter,

Dear Rick—I know this is not in your area of permitting, but I need help in finding information regarding an (open) remediation site
in Port Angeles(DOE#63427274). The site is vacant but I believe has monitoring wells on it and currently has an unpermitted
fireworks stand setting up. I don't believe the site has been cleared for use by DOE. Given the difficulty we have in this City getting
folks to quickly comply with regulations, I'd like to make certain we are on firm ground with telling the proponents that they need
DOE clearance to use the property. The property is owned by an out of town bank that doesn't appear to know much about the
property. Who should we contact in DOE in this matter?

I spoke with Shane Coleman @ Bruch and Bruch this afternoon and I called Rob Ames and left a voice mail. He has not
returned my call. This is what I know at this point. If I have left anything out, fill in the blanks. I will send this to Rob
when it is more detailed.
Permit R/W Use 09-01
Installation of fence for enclosing proposed Round the Clock (722 S Lincoln St) building demolition and contaminated soil
removal.
Construction contractor (Bruch & Bruch) Shane Coleman contact party.
Public Works will issue a R/W permit for a temporary - partial sidewalk closure during the demolition of the Round the
Clock Deli with the following conditions:
1. Install construction fence in such a manner as to allow a minimum of 48" of clear unobstructed pedestrian passage
way between curb and construction fence.
2. The construction fence is to be placed in such a manner as to provide access to the signal pole for pedestrian access.
3. The fire hydrant shall remain operational. If absolutely necessary the fire hydrant could be shut down due to excavation
issues, but only for a period of time as approved by the Fire Marshall.
4. Construction signs indicating restricted pedestrian access will be required.
OR
If the contractor so chooses to request for a total sidewalk closure, a closure plan is to be submitted for approval to the
City Public Works & Utilities and WSDOT.
Waste Disposal Application (WDA 09-01)
Building demolition debris from the Round the Clock Deli is proposed to be disposed of at the City's transfer station. Per
Shane @ Bruch & Bruch no concrete material will go to the transfer station. If permitted two underground petroleum
storage tanks will be cut up into scrape metal and transported to the City's transfer station. (recycled?) Verification e-mail
to Tom McCabe.
Contaminated soil will be excavated and removed from the construction site and transported by Bruch & Bruch to Olympic
View Transfer Station, Port Orchard WA Profile # 101484WA (Permit to dispose of non-hazardous material) issued by Waste
Management. Proposed amount of contaminated soil is 2000 tons transported from the (Round the Clock) demolition
construction site.
Proposed disposal & storage of groundwater will be subject to the Industrial Wastewater Acceptance permit and DOE.
Information submitted is under review. The contractor (Bruch & Bruch) propose to have a 18,000-20,000 storage tank on
site. More information needed on this.
The contractor will be responsible for maintaining a clean construction entrance - exit. Due to the closure of the 8th Street
bridges, traffic is less congested along the 8th Street side of the project site. Depending on truck traffic to and from the
construction site a traffic control person may be required for continued safe ingress/egress.
Issuance of the building demolition permit for 722 South Lincoln Street will be subject to the approval of WDA 09-01.
Copies of the WDA and approval letter will need to travel with the truck hauling debris to the City's transfer station. The
right of way use application RWU 09-01 is subject to relocating the fence to allow for the 48" pedestrian passage way and
signal access, or total sidewalk closure upon approval by PW&U and WSDOT.

The Demo permit will be reviewed this afternoon. It gets routed around to the various divisions for their comments. The
waste disposal permit is part of the demo application. I'm working on the letter, so as soon as the building division gets

The fee is $75.00. It can be picked up at the building permit counter.

I am waiting on comments from Annette regarding the WDA, but I don't
see any thing to hold it up once I talk with her. As long as the ground
water is pumped into a contained facility while test results are

appropriate analytical requirements for waste characterization. Ecology Publication #91-30
(Revised April 1994) "Guidance for Remediation of Petroleum Contaminated Soils" shall also

1.0 SCOPE OF WORK AND SUMMARY OF FINDINGS
An investigative survey for asbestos containing materials (ACM) and lead-based paint was
conducted on the subject property in Port Angeles, Washington.
Cyrus Gorman of Kane Environmental, an AHERA certified building inspector (#1024788),
conducted the inspection on May 31 and June 1, 2007. The inspection was performed at the
request of RHL Design Group.
The Property contained six businesses and occupied half of a city block in downtown Port
Angeles, Washington. The businesses included the Olympic Iyengal Yoga Studio, Round the
Clock Deli, Simply Flowers,Rocket Burger, Blue Dolphin Car Wash, an office building and a
parking lot.
The purpose of the inspection was to identify asbestos containing materials and lead-based
paint that would be impacted by the planned demolition of the structure.
ACM was not detected in any of the suspect building materials samples.
Lead-based paint was detected in both interior and exterior paint coatings.
Per Rite Aid sampling protocols, the roof of each of the six buildings was inspected,
however no samples were collected. Observations are as follows:
1.) 710 S. Uncoln- The roof was observed to contain an asphalt surface with a silver
paint coating. Based on professional experience, the paint and potentially the
roof contain ACM.

portion of the building, could not be inspected.
3.) 121 E. Eighth- The roof appeared to be constructed of asphalt shingle. They have
a low potential to contain ACM, except for unknown material beneath the
shingles.
4.) 117 E.Eighth- The roof contained a sheet metal cap around the perimeter of the
building and an asphaltic surface on top of the building. Based on the
construction date of the building in the early 1990's there is a low potential for
the roof to contain ACM.
5.) 111/115 E. Eighth. The roof was composed of sheet metal and most likely does
not contain ACM.
6.) 107 E. Eiahth- Mr. Ken Price, owner of the building stated that the roof was
replaced three years ago. The old roof was completely removed down to the
plywood. Based on the reported age the new roof, it is unlikely to contain ACM.
The asbestos survey section is written to comply with the AHERA asbestos sampling procedure
as stated in 40 CFR 763.86. The National Emission Standards for Hazardous Air Pollutants
(NESHAP), 40 CFR Part 61 requires a survey by an accredite.d asbestos inspector prior to
demolition of a structure.
The hazardous waste test for Jeadis the Toxic Characteristics Leaching Procedure (TGLP).
While disruption of lead containing paint always requires worker safety precautions, it mayor

may not be classified as a regulated waste for disposal purposes. The TelP sample is a
composite of all demolition debris that is representative of a single waste stream. Debris with
lead leaching greater than 5.0 parts per million using TelP analysis is classified as hazardous
waste under EP A code of Federal Regulations 40 CFR Part 261. If the results of the TCLP
analysis are less than 5.0 milligrams per liter (mg/l) the debris may be disposed as general
construction debris.
A TClP sample was collected and the analytical result was less than 0.4 mg/l. below the
federal regulatory level. .

2. 0 SURVEY METHOD
Asbestos Survey Method
A walk-through inspection of all accessible areas of the structure was performed to identify
potential asbestos-containing materials. The walk-through inspection included a review of the
internal and external aspects of the structures. The locations and types of potential asbestos
containing materials were noted. Sufficient bulk samples of building materials (flooring, roofing,
wall materials, etc.) were obtained of each material to satisfy the requirements of the Asbestos
Hazard Emergency Response Act (AHERA) rules and regulations. These samples were placed
into plastic sample bags, numbered and recorded.
Homogeneous Materials
Homogeneous materials are defined as an area of Asbestos-Containing Material (ACM) or
Presumed Asbestos-Containing Material (PACM). which appears similar throughout in terms of
color, texture, and date of material application. If found, the report listing for homogenous
materials will appear as follows:

Under OSHA Guidelines, a minimum of three negative analysis of a single suspect
homogeneous asbestos containing material is required to prove a negative result for surfacing
materials and thermal system insulation. One sample of other types of materials can be used
to identify ACM.
Lead Survey Method
A walk through inspection of accessible areas of the Property structures was performed to
identify potential lead-containing paint coatings. The walk-through inspection included a review
of the suspect surface coatings. The locations and types of potential lead-containing paint
coatings were noted. Sufficient bulk samples were obtained of paint coatings to analyze under
the National Environmental Lead Laboratory (EPA) Protocols. These samples were placed into
plastic sample bags, numbered and recorded.
The objective of this sampling was to determine the locations of coatings that are lead-
containing and the percentage of lead in these coatings. Protective equipment (respirator and
dust-impermeable clothing) and environmental safeguards (e.g. plastic drop cloths, wet
methods) were employed as needed.

3. 0 LABORATORY INFORMATION
laboratory Analysis - Asbestos
Samples were analyzed at NVl laboratories, Inc., located in Seattle, Washington, using
polarized light microscopy (PLM) with dispersion staining. If samples are not homogeneous,
then subsamples of the components were analyzed separately. All Bulk samples are analyzed
using EPA Method 600/R-93/116 with the following measurement uncertainties for reported %
Asbestos (1%=0-3%, 5%=>1-9%, 10%=5-15%. 20%=10-30%, 50%=40--60%). For samples
containing more than one separable layer of materials, the report will include findings for each
layer (labeled Layer: 1 r Layer: 2, etc.). The asbestos concentration in the sample is determined
by visual estimation.
Laboratory Analysis - Lead (Pb)
Paint samples were analyzed for the presence of inorganic lead (Pb) using atomic absorption
spectrophotometry (MS) in accordance with EPA SW 846, method 7420 as revised 1986. This
method reports results in milligrams per kilogram (mg/kg) or its equivalent, parts per million
(ppm).

The Property contained a yoga studio, deli, flower shop, burger restaurant, car wash and an
office building.
Primary external components:
Sheet metal, wood siding, concrete cinder block and brick.
Type of foundation:
The foundations appeared to be concrete slab-on grade.
Roofing materials:
Roof materials appeared to be asphalt, asphalt shingles and sheet metal.
Window types:
Window frames were a mix of metal and wood.
Flooring:
The flooring surfaces consisted of a mix of bare concrete floors, ceramic tile, linoleum and
carpet.
Thermal systems w/insulation types:
Kane Environmental did not observe any thermal insulatlon systems.

6.0 CONCLUSIONS AND RECOMMENDATIONS
ASBESTOS
ACM was not detected in any of the samples collected at any of the Property buildings. Per
Rite Aid sampling protocols, the roof was inspected however it was not sampled. Observations
for the roofs are listed below:
1.) 710 S. Lincoln- The roof was observed to contain an asphalt surface with a silver
paint coating. Based on professional experience, the paint and potentially the
roof contain ACM.
2.) 722 S. Lincoln- The roof was predominately constructed of sheet metal, including
the former fuel island canopies. A smaUportion of the roof, on the northern
portion of the building, could not be inspected.
3.) 121 E. Eiahth.. The roof appeared to be constructed of asphalt shingle. They have
a Jow potential to contain ACM, except for unknown material beneath the
shingles.
4.) 117 E. Eiahth.. The roof contained a sheet metal cap around the perimeter of the
building and an asphaltic surface on top of the building. Based on the
construction date of the building in the early 1990's there is a low potential for
the roof to contain ACM. -

This report cannot be used for bid specifications. only ,to identify the presence of ACM at the
subject property.
Hidden wall and ceiling cavities that are not accessible during the time of surveying can
sometimes conceal ACM. Thus, Kane recommends that an AHERA inspector/project manager
be on site at the time of renovation/demolition to ensure that any potentially asbestos-
containing materials uncovered during the process of renovation/demolition be dealt with
properly.
If discovered, all ACM that will be disturbed as part of renovation/demolition activities is required
to be removed and disposed of in accordance with Washington State Regulations. The
Washington Department of Environmental requires that the abatement be performed using
Certified Asbestos Workers under the direct on-site supervision of a Certified Asbestos
Supervisor.

LEAD
Lead based paint was detected ;n interior and exterior paint finishes. The highest lead
concentrations were detected at 722 S. Lincoln from the green paint covering the canopy.
White interior paint coatings from the Deli also contained lead.
Lead Worker Exposure Regulations
The federal Occupational Safety and Health Administration (OSHA) Interim lead safety
standard (29 CFR 1926 59) for the construction industry became effective on June 3. 1993.
Lead exposure in construction is regulated in by the Washington State WAC 296-155-176.
These regulations protect workers disturbing building surfaces with lead containing paints.
Paint uany detectable level" of lead is classified as a lead containing paint by Federal and State
Regulations and the applicable safety guidelines must be implemented.

federal regulatory level.

7.0 LIMITATIONS OF SURVEY
The sole purpose of this survey report was to document the presence or absence of asbestos~
containing materials and lead-based paint discovered in the survey of suspect materials by
Kane Environmental personnel at 710 & 722 S. Lincoln; 107-121 E. Eighth Sf. and 717 S.
Laurel S1. in Port Angeles, Washington.
This site visit consisted of a thorough visual walk~through of the ,building for the purpose of
viewing and sampling potential ACMs and lead-based paint. As hazardous material surveys are
non-comprehensive by nature, Kane Environmental, Inc., cannot be held liable for materials
which require destructive means to access, materials which are hidden from sight (e.g.
materials hidden behind walls or ceilings) materials which cannot be found due to their obscure
nature, or which otherwise cannot be discovered with reasonable diligence.

As you know, this firm represents Marginal Properties, LLC. Marginal Properties is the
holder of property located at 722 S. Lincoln Street, in Port Angeles, Washington (the
"Property").
Recent environmental investigations have revealed the presence of total petroleum
hydrocarbons as gasoline and BTEX in sOil and groundwater on the Property and in the
adjacent nght-of-ways.
Marginal Properties has engaged Kane Environmental, Inc ("Kane") to perform an
interim remedial action on the Property. The objective of the interim action is to clean
up soil and groundwater with concentrations of petroleum hydrocarbons above MTCA
Method A levels. Kane plans to excavate soil contaminated by petroleum hydrocarbons
at five locations on the Property. Extraction of groundwater at or near the areas of
identified contamination will also be performed as part of the interim action. Following
source removal activities, RegenOx and Oxygen Release Compound (ORC) Advanced,
commonly used bioremediation products, will be placed in the excavations, which will
then be filled with clean material. Compliance groundwater monitoring will commence
following the interim remedial action.

Dear Mr. Gorman,
At your request, NVL Laboratories conducted analysis of your sample to determine the
asbestos concentration using point count procedures.
The sample was analyzed for the presence of asbestos fibers using polarized light
microscopy (PLM) with dispersion staining in accordance with U.S. EPA method 600/R
-93/116.
Eight slides of thoroughly homogenized material are prepared for any given sample that
requires point counting. In order to be counted as a point, thecrosshairs of the
microscope must center on either a fiber or a particle. The analyst counts at least 50
points per slide preparation: A minimum of 400 non-empty points are counted, then the
number of counted asbestos fibers are divided by the total number of points counted to
arrive at the percentage of asbestos in the sample.

Examination of these samples was conducted using analytical instruments in accordance
to U.S. EPA, NIOSH, OSHA and other ASTM methods.
For matrix materials submitted as paint, dust wipe, soil or TCLP samples, analysis for the
presence of total metals is conducted using published U.S. EPA Methods. Paint and soil
results are usually expressed in mg/Kg which is equivalent to parts per million (ppm).
Lead (Pb) in paint is usually expressed in mg/Kg (ppm) , Percent (%) or mg/cm2 by area.
Dust wipe sample results are usually expressed in ug/wipe and ugJfe. TCLP samples are
reported in mg/L (ppm). For air filter samples, analyses are conducted using NIOSH and
OSHA Methods. Results are expressed in ug/filter and ug/m3. Other matrix materials are
analyzed accordingly using published methods or specified by client. The reported test
results pertain only to items tested. Lead test results are not blank corrected.

Enclosed please find the test results for samples submitted to our laboratory for analysis.
Examination of these samples was conducted using analytical instruments in accordance
to U.S. EPA, NIOSH, OSHA and other ASTM methods.
For matrix materials submitted as paint, dust wipe, soil or TCLP samples, analysis for the
presence of total metals is conducted using published U.S. EPA Methods. Paint and soil
results are usually expressed in mg/Kg which is equivalent to parts per million (ppm).
Lead (Pb) in paint is usually expressed in mg/Kg (ppm) , Percent (%) or mg/cm2 by area.
Dust wipe sample results are usually expressed in ug/wipe and ug/ft2. TCLP samples are
reported in mg/L (ppm). For air filter samples, analyses are conducted using NIOSH and
OSHA Methods. Results are expressed in ug/filter and ug/m3. Other matrix materials are
analyzed accordingly using published methods or specified by client. The reported test
results pertain only to items tested. Lead test results are not blank corrected.
For recent regulation updates pertaining to current regulatory levels or permissible
exposure levels, please call your local regulatory agencies for more details.
This report is considered highly confidential and will not be released without your approval.
Samples are archived for two weeks following analysis. Samples that are not retrieved by
the client are discarded after two weeks.
