The applicant is requesting a DECREASE in the side yard setback from 7' to 3' to allow an addition to
a single family residence in the RS-7, Residential Single Family zone. Please review the proposal for
those issues that relate to your departmental concerns and respond to the Planning Department no
later than September 21. 2001.

of Adjustment's decision will be based on the information contained in this application, and, if approved, will be limited
to the proposal as presented and potentially conditioned. Changes to the application or erroneous information may
result in the delay of your project re~iew.

As you know, following a continued public heating conducted on October 8, 2001, the City's
Board of Adjustment approved a reduction of the north side property line from 7' to 3'6" per
your request, to, allow an addition to your existing residence which will follow the lines of the
existing residential structure located at 1207 South Peabody Street.

I~IINOR DEVIATION DECISION

PROPOSAL:
Ms. Sara Barrett has requested an increase in the maximum lot coverage from 30% to 32% to allow an
addition to a nonconforming single-family residential structure in the RS-7, Residential Single Family
zone.
DECISION:
The minor deviation is hereby approved with one condition:
Condition:
1. The proposed 130 square foot addition shall follow the north line of the existing structure
as required by the Board of Adjustment during deliberation in approval of Variance VAR
01-09 on October 10, 2001.
This decision is supported by the following findings and conclusions:
Findings:
1. Ms. Sara Barrett applied for a minor deviation of the City's maximum lot coverage standard on
October 10, 2001. The request is to allow an increase from 30% to 32% in the RS-7, Residential
Single Family zone to allow a minor expansion to a nonconforming single family structure.
2. Section 17.94.180 of the City's Municipal Code allows that the Planning Director may approve
a minor deviation fi'om front, side, and rear yard setbacks, lot coverage, and height requirements
if the following findings are made:

A. A minor deviation may be granted if all of the following findings are made:
a. The granting of the minor deviation is consistent with the purpose of the
zone in which the property is located and the project is otherwise consistent
with the requirements of said zone.
b. Because of special circumstance, the strict application of the zoning ordinance
results in an undue hardship upon the applicant.
c. The minor deviation will not be materially detrimental to the public welfare or
injurious to property or improvements in the vicinity and zone in which the
subject property is located; and
d. The minor deviation is not greater than 10% of the requirement being deviated
from.
e. The site has been posted and adjacent property owners notified fifteen (15) days
prior to approval of the minor deviation.
3. Documentation was submitted in applying for a variance (VAR 01-09) requesting a reduction
of the required north property line to allow an addition at 1207 South Peabody Street, that th e
current structure was built in 1930. The undersized lot is therefore considered to be pre-
existing as it became a lot of record prior to 1967.
4. Existing lot development consists of a single story structure and garage equaling a total of
1194 square feet located on a 4130 square foot building site. The proposed addition would
result in a lot coverage increase from 29 to 32 %.
5. Surrounding property owners were notified by U.S. Mail and the site was posted on October
12, 2001 per 17.94.180 PAMC. No comments were received.
Conclusions:
A. The minor deviation is consistent with the purpose of the RS-7 zone and with other
development in the neighborhood in which the site is located.
B. Strict application of the standards of the RS-7 zone would create a hardship upon the
applicant.
C. The minor deviation is not materially detrimental to the public welfare or injurious to property
or improvements in the vicinity.

This decision may be appealed to the Board of Adjustment per Port Angeles Municipal Code Section
17.96.080. An appeal shall be submitted to the City Department of Community Development in writing
within fourteen (14) days following the date of the decision.
