The Mayor may determine the order of business for a particular City Council meeting. The agenda should be arranged to best serve
the needs and/or convenience of the Council and the public. The Mayor will determine time of break. Hearing devices are available
for those needing assistance. The items of business for regular Council meetings may include the following:

Comment period and shall be concluded not later than 9:45 p.m. for the second Public Comment period. Individuals may speak
for three minutes or less, depending on the number of people wishing to speak. If more than 20 people are signed up to speak,
each speaker may be allocated two minutes (Council Rules of Procedure Section 12).

CALL TO ORDER SPECIALMEETING
Mayor Dextercalled the specialmeeting of the Port Angeles City Council to order at 5:00p.m.
Members Present: Mayor Dexter, Deputy Mayor Carr, Council MembersFrench, Meyer, McCaughan, and Schromen-
Wawrin.
Members Absent: Council Member Suggs
Staff Present: City Manager West, Attorney Bloor, Clerk Martinez-Bailey.
EXECUTIVE SESSION
Based on input from Attorney Bloor, Mayor Dexterannounced the need for aclosed Executive Session to be held
under authority RCW 42.30.110(1)(i) to discuss potential litigation with legal counsel.Attorney Bloor provided the
new Council members with guidelines the City must follow for Executive Sessionmeetings.Mayor Dexter noted
Council Member Suggs had recused herself fromthe executive session due to a potential conflict of interest with the
Lower Elwha Klallam Tribe. Council moved to the Jack Pittis Conference Room for Executive Session for
approximately 25minutes.The Executive Session convened at 5:04p.m.
The Council moved to open sessionat 5:34p.m.
OPEN SESSION
Members Present: Mayor Dexter, Deputy Mayor Carr, Council MembersFrench, Meyer, McCaughan, Suggs,
Schromen-Wawrinand Suggs.
Members Absent: None
Staff Present: City Manager West, Attorney Bloor, Clerk Martinez-Bailey.
City Attorney Bloor shared a PowerPoint presentation on the Roles and Responsibilities of Council and discussed
specifically, ethics and conflicts of interests.

PUBLIC COMMENT
Jeff Brietbach, city resident, asked about the Transportation Benefit District and hoped that Council would offer an
update on where and how funds were spent.
Jack Carlson, residing outside city limits, spoke about fluoridated drinking water.
Ingrid Carmean, city resident, spoke about her experiences at The Answer for Youth.
Lisa Hough, homeless, spoke about her experiences being homeless and the need for homeless shelters.
Ben Stanley, city resident, chair of Planning Commission and Climate Action Sub-Committee. He provided Council
anupdate onthe itemsthe sub-committee has been working on.
Artur Wojnowski, city resident, invited a member of the Council to attend Peninsula Area Public Access Board
meetings.
OTHER CONSIDERATIONS
1.Integral Consulting / Presentation on the Harbor
City Manager Nathan West introduced Linda Bakerfrom Integral Consulting who shared a PowerPoint presentation
ontheRemedial Investigation Feasibility Study of the Port Angeles Harbor. Council Member Suggs shared her
employertheKlallam Tribehas a role inthe investigationthat results in a conflict of interest. Due to
the presentation being open to the public she would stay for the public presentation butwould refrain from
participating in anyconversations on the matter.
LATE ITEMS TO BE PLACED ON THIS OR FUTURE AGENDAS as determined by City Manager
or Councilmember-None.
ManagerWest pulled item G-1and shared the item would be brought back before the Council in February.
Manager West added the Multi-Agency Reciprocal Maintenance Agreement to the agenda as itemI-6.
Council member Suggs asked that Council considera discussion regardingsnow removal for pedestriansas an agenda
item.
It was moved by Suggs and seconded by Frenchto:
Consider snow removal for pedestrians.
Motion carried 7-0.
Mayor Dexter stated the item would be moved to a future work session.
CONSENT AGENDA
The Mayor added item I-4 to the Consent Agenda.
It was moved by Frenchand seconded by Suggsto approve the Consent Agenda to include:
1.City Council Minutes of January 7, 2020 / Approve
2.Expenditure Report: From January 1, 2020 to January 10, 2020 in the amount of $832,708.39 / Approve
3.House Bill 1923 Grant for Increasing Residential Building / Approve and authorize the City Manager to
sign the FY 2019-2021 E2SHB 1923interagency agreementin the amount of $50,000 for increasing
residential building capacity with theWashington State Department of Commerce, and to make any
subsequent amendments or minormodifications to the agreement, if necessary
4.Department of Ecology Air Monitoring Agreement / Authorize the City Manager to sign the attached site
rental agreement renewal with Department of Ecology

5.Utility Wooden Pole Testing Final Acceptance / Accept the Pole Testing-2019 project by TK Contractors,
LLC as complete and authorize staff to proceed with project closeout upon receipt of all required
clearances
6.Utility Wooden Power Poles Material Purchase / Award a contract with Stella-Jones Corporation of
Tacoma, WA for 30, 40-foot, Class 3 wooden poles at a price of $25,240.14 including sales tax and
authorize the City Manager to sign to make minor modifications to the contract as necessary
7.Undergrounding Cable Replacement Final Acceptance / Accept the 2019 Underground Cable
Replacement project as complete and authorize staff to proceedwith project closeout and release the
retainage in the amount of $7,931.23 upon receipt of all required clearances
8.Public Safety Advisory Board Appointment / Approve the appointment of Alan Oman to the Public Safety
Advisory Board
9.Item Moved from Section I-4 Clallam Transit System / Board Composition Discussion / Appoint
Schromen-Wawrin to the Board
Motion carried 7-0.
ORDINANCES NOT REQUIRING COUNCIL PUBLIC HEARINGS
1.Authorization of Tax Credit Supporting Affordable Housing (House Bill 1406)
Manager West presented the agenda item and said the City has beenworking closely with other jurisdictionsin order
to take advantage of the house bill credit.
Mayor Dexter conducted a first reading of the ordinance by title, entitled,
ORDINANCE NO. ____
AN ORDINANCE of the City of Port Angeles, Washington, imposing the Local Sales and Use Tax authorized under
Laws of 2019, Ch. 338 (House Bill 1406) to be used for the affordable housing and providing for other matters properly
relating thereto.
Council discussion followed.
The Mayor continued the matter to the February 4 meeting.
RESOLUTIONS NOT REQUIRING PUBLIC HEARINGS
1.Resolution Ratifying a Declaration of Emergency Lincoln Street Sanitary Main Repair
Director of Public Works and Utilities Thomas Hunterintroduced the agenda item and provided background on the
resolution.
Mayor Dexterread the resolution by title, entitled,

A RESOLUTION of the City Council of the City of Port Angeles, Washington, affirming and ratifying the
Declaration of Emergency issued by the City Manager on December 11, 2019
It was moved by Schromen-Wawrinand seconded by Frenchto:
Pass the resolution as read.
Motion carried 7-0.
OTHER CONSIDERATIONSCONTINUED
2.Hazard Mitigation / Presentation by Fire Chief Ken Dubuc
Fire Chief Ken Dubuc provided background on his agenda item, saying the plan is a federal requirement madeby
FEMA. He said the State encourages organizations to do the right thing by participating in the plan, adding that
participation affects future grant opportunities. Council discussion followed.
3.Strategic Plan Discussion / Select Alternative
Manager Westprovided background on the development -2020 Strategic Plan, saying that balance
was very important during the development process. Hesaid he would like to know if there is a desire by the new
Council to make significant changes and shared threeoptions and timelinesfor different approaches to the current
Strategic Plan. He shared a copy of the updated plan that was presented at the December 17, 2019meeting. Manager

West stressed the importance to balance workloads oneach departmentand shared a fall retreat would be scheduled
to plan the 2021-2022 Strategic Plan.Council discussion followed
It was moved by Suggsand seconded by McCaughanto:
Choose option 2 as identified in the Council packet that wouldinclude minor modificationsto the Strategic Plan,
and staff will accomplish this through aplanned February Work Session with Council.
Motion carried 7-0.
4.Boards, Commission and Committee Council Appointments / Approve Appointments
Mayor Dexterprovided background on the process of the development of the appointments.The Mayor asked for
interest from the Council to participate on the Peninsula Area Public Access Board. Council member Meyer
volunteered to participateas the primary appointmentand Council member McCaughanasthealternate.
It was moved by Schromen-Wawrinand seconded by Frenchto:
Approve committee assignments for 2020-2021, as presentedin the Council packet, with the addition, to appoint a
Council member to Peninsula Area Public Access Board with Council memberMeyeras the representativeand
McCaughanas alternate.
Motion carried 7-0.
6.Multi-Agency Reciprocal Maintenance Agreement
Parks and Recreation Director Corey Delikat provided information on the late item.He noted the agenda itemis to
approveemergency repairandduring the Capital Facilities Planprocess,it will be an opportunity to consider long
term care of the trail. Hesaid the trail is an ongoing maintenance concern and would encourage future discussions on
the matter. Council discussion followed.
It was moved by Frenchand seconded by Meyerto:
Approve and authorize the City Manager to sign a Work Task Request with Clallam County as part of the Multi-
Agency Reciprocal Maintenance Agreement and Make minor modifications to the agreement if necessary.
Motion carried 7-0.
CONTRACTS & PURCHASING
1.Light Operations Temporary Building Lease Extension
Director Hunter provided background on the itemand shared a brief update on the project.Council discussion
followed.
It was moved by Schromen-Wawrin and seconded by French to:
Approve a 24-month lease extension for the Atlas Trucking compound, for a total amount of $184,000; and
authorize the City Manager to sign and execute a lease extension and make minor modifications to the lease if
necessary.
Motion carried 7-0.
2.Laurel Substation Electrical Switchgear Upgrade Contract Award
Director Hunterprovided background on the agenda item, saying it is one of 5 substations that needs to be upgraded.
Finance Director Sarina Carrizosa shared the fiscal savings information would be evaluated during the Capital
Facilities Planprocess. Council discussion followed.
It was moved by French and seconded by Suggsto:
Award a contract with Dutton Electric Company, Inc of Lynwood, WA to upgradethe Laurel Substation Electrical
Switchgear in the amount not to exceed $278,054.60, including taxes,and authorize the City Manager to make
minor modifications as necessary.
Motion carried 7-0.
CITY COUNCIL REPORTS
Council memberMeyer recognized the Public Works department for their workduring the storm relative to snow
plowing.

Council member McCaughan shared his experience at a recent Charter Review Commission meeting and that he
attendedthe recentEDC Gala.
Deputy Mayor Carr thanked the City teams that worked during the storm to keep the streets clear.
Council member Schromen-Wawrinspoke about a stream walk he participated in along Ennis Cree
response to the recent snowfall. He provided background to the Council on the publictransit benefit area. He spoke
about recent meetings he attended, a memorial for Port Angeles resident LeayHart, and the values and beliefs of
Martin Luther KingJr.
Council member Frenchshared heattended anOlympic Peninsula Tourism Commission meeting, an EDC meeting,
and the recent Chamber Community Awards gala.
Council member Suggs shared she attended a Habitat for Humanity ribbon cutting eventand said she would bemeeting
with Chief Smith toget a tour of the Port Angeles Police Department.
Council member Dexter spoke about the recent snow fall.
No other reports were given.
INFORMATION
Manager Westspoke regarding the building report in the packetand the2020 Legislative Prioritiesdocument. He
congratulated the Finance department on receiving the Certificate of Achievement for Excellence in Financial
Reporting award by the Government Finance Officers Association.

Recommendation: Accept the Marine Drive Channel Bridge Improvements Construction Contract
CON-2018-32 as complete, authorize staff to proceed with project closeout, and release the contract bond
upon receipt of all required clearances.
Background / Analysis: The Federal Surface Transportation Program (STP) awarded the City a grant
in the amount of $510,000. The grant was accepted by City Council on May 15, 2018. The project
addressed failing sheet pile walls by installing new bridge approach spans. In addition, the project
provided new water and sewer main crossings, traffic barriers and an overlay of Marine Drive near the
McKinley mill.
Bids were opened on July 10, 2018, six bids were received with Neptune Marine LLC of Anacortes, WA
as the lowest responsible bidder with a bid amount of $641,372.61, including all applicable taxes. The
project was successfully completed August 1, 2019.

Background / Analysis:The Washington State Transportation Improvement Board (TIB) awarded the
City a high-priority arterial pavement preservation grant of up to $580,800. The grantwas accepted by
City Council on December 18, 2018 for use in preserving the Lauridsen Boulevardbetween Lincoln
Street and Lauridsen Court.
The project replaced worn asphalt surfacing on Lauridsen Boulevard and the approach to VineStreet and
catch basins which had reached their end of life. The projectalsoincreased trafficandpedestrian safety
and accessibility by installing:
Traffic calming choker islands,
Dedicated turn lanes at Peabody Street,
ADAcompliantsidewalk ramps,and
Pedestrian refuge islands.
Bids were opened on June 25, 2019, one bid was received with Lakeside Industries, Inc. of Port Angeles,
WA as the lowest responsible bidder with a bid amount of $933,105.00, including all applicable taxes.
The project was successfully completed November 12, 2019.

Summary:At its January 21, 2020 meeting, Council conducted the first reading of the attached ordinance,
which authorizes a levy, under SubstituteHouse Bill 1406, of a sales taxcredit to address affordable
housing needs in the City.The ordinance is presented tonight for second reading.
Funding:Funds will be available to the City in the estimated amount of $58,000annuallyto be used to
address affordable housing needs in the City.
Recommendation:1) Conduct the secondreading of the attached ordinance and 2) adopt the ordinance.
Background / Analysis:
In 2019, Washington State enacted Substitute House Bill 1406 ("HB 1406"), a revenue sharing program
intended to provide additional funds to local governments for purposes ofaffordable and/or supportive
housing.It is important to note that the revenue that comes to the City from HB 1406 is a credit against the
State portion of sales and uses taxes already collected within the city limits. Thus, levying a tax under HB
1406 does not increase the sales and use tax rates within the city limits. On July 16, 2019, Council adopted
a resolution declaring its intention to claim the credit available under HB 1406

eligible to receive the higher amount of tax credit available under HB 1406. To obtain that credit, the City
must adopt an ordinance authorizing levy of the tax credit available under HB 1406. The City must do so
by July 28, 2020 or it losesthe opportunity to do so.
The attached ordinance authorizes the maximum tax credit available under HB 1406.

ORDINANCE NO. __________
AN ORDINANCE of the City of Port Angeles, imposing the Local
Sales and Use Tax authorized under Laws of 2019, Ch. 338 (House
Bill 1406) to be used for the affordable housing and providing for
other matters properly relating thereto.
WHEREAS, in the 2019 Regular Session, the Washington State Legislature approved, and
the Governor signed, Substitute House Bill 1406 (chapter 338, Laws of 2019) ("SHB 1406"); and
WHEREAS, SHB 1406 authorizes the governing body of a city with a population of
l00,000 or less to impose a local sales and use tax for the acquisition, construction or
rehabilitation of affordable housing or facilities providing supportive housing, operations and
maintenance costs of affordable or supportive housing, or rental assistance to tenants; and
WHEREAS, the tax will be credited against existing state sales taxes collected within the
City and therefore, will not result in higher sales and use taxes within the City but will provide
additional funding to address affordable housing needs in the City; and
WHEREAS, the City has identified a housing affordability crisis, in that many people are
paying more than 50 or 60 percent of income on rent;
WHEREAS, people are living in places that are not meant to be housing, such as cars or
streets, and others are on the verge of homelessness;
WHEREAS, the additional revenue will benefit most people who need it the most;
WHEREAS, based on the facts recited above, Council has determined that imposing the
sales and use tax to address affordable housing will benefit the citizens of Port Angeles; and
WHEREAS, the City Council previously adopted a resolution of intent to authorize the
maximum capacity of the tax,
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO HEREBY ORDAIN AS
FOLLOWS:
Section 1. Findings. The City Council ( "Council") of the City of Port Angeles,
Washington (the "City''), makes the following findings and determinations:

1.1SHB 1406 authorizes cities to impose a sales and use tax increase of 0.0146% (the
"State-Shared Affordable Housing Sales and Use Tax"), provided that the revenues are
dedicated to the affordable housing purposes as defined in that statute. Upon imposition of the
increase, the tax imposed will be deducted from the amount of State sales and use tax to be
collected within the City, subject to the annual cap described in that statute.
1.2 On July 16, 2019 Council passed Resolution 14-19 indicating its intention to impose
the sales tax credit at its maximum capacity, which constitutes the resolution of intent required by
SHB 1406.
1.3 On July 16, 2019 Council passed Resolution 14-19, authorizing the submission of a
proposition to the qualified electors of the City asking whether the City should impose a qualifying
local tax of 0.1 percent pursuant to RCW 82.14.530.
1.4 On September 3, 2019, the Council adopted a resolution declaring how the funds
from HB 1406 and from RCW 82.14.530 would be applied.
1.5 On November 5, 2019 a majority of qualified electors of the City approved the
proposition imposing a qualifying local tax of 0.1 percent pursuant to RCW 82.14.530.
1.6 This qualifying local tax will be imposed starting on April 1, 2020.
1.7 The Council finds that the City has satisfied all prerequisites to imposing the State-
Shared Affordable Housing Sales and Use Tax at a rate of 0.0146%, including having imposed a
Qualifying Local Tax, and finds it in the City' s best interest to begin imposing the tax.
Section 2. Affordable Housing Sales and Use Tax Imposed.
2.1 Tax Imposed; Effective Date. As authorized by SHB 1406, the City hereby imposes
a State-Shared Affordable Housing Sales and Use Tax at a rate of 0.0146% of the selling price in
the case of a sales tax, or value of the article used, in the case of a use tax. The tax shall become
effective as of April 1, 2020 or the earliest practicable date consistent with RCW 82.1 4.055,
whichever is sooner.
2.2. Tax Imposed, Expiration Date. The tax imposed by this Ordinance expires twenty
years after the date on which the tax is first imposed.
Section 3.Administration.The City Clerk is directed to cause a certified copy of this
ordinance to be delivered to the State of Washington Department of Revenue and any other public
officers or agencies required by law. The City Finance Director and other appropriate officers are

authorized and directed to enter into such contracts with and provide such notices to the State
Department of Revenue and other appropriate state or local agencies for the collection and
distribution ofthe tax imposed by this ordinance as may be necessary or convenient consistent with
chapter 82.14 RCW and other applicable law.
Section 4.Non-Codification. This Ordinance shall not be codified in the Port Angeles
Municipal Code.
Section 5.Ratification. All actions taken in furtherance of and not inconsistent with
this ordinance are ratified and confirmed in all rspects.
Section 6.Severability. If any provisions of this Ordinance, or its application to any
person or circumstances, are held invalid, the remainder of the Ordinance, or application of the
provisions of the Ordinance to other persons or circumstances, is not affected.
Section 7. Corrections. The City Clerk and the codifiers of this ordinance are
authorized to make necessary corrections to this ordinance including, but not limited to, the
correction of the scrivener’s/clerical errors, references to other local, state, or federal laws, codes,
rules or regulations, or ordinance numbering, section/subsection numbers and any references
thereto.
Section 8. Effective Date. This Ordinance, being an exercise of a power specifically
delegated to the City legislative body, is not subject to referendum. This ordinance shall takeeffect
five (5) days after passage and publication of an approved summary thereof consisting of the title.

Summary:The Federal Government, through the Washington State Emergency Management Division
(WA EMD) and Federal Emergency Management Agency (FEMA), requires that jurisdictions develop a
isks, vulnerabilities and
mitigation strategies. Clallam County Emergency Management has taken the lead and has worked with
stakeholders to develop a Multi-jurisdictional HMP that includes a section for the City of Port Angeles.
Once completed, the HMP wassubmitted to WA EMD and FEMA for approval.The plan has been
approved, and nowmust be adopted by each participatingjurisdiction throughresolution.
Funding:There are no costs associated with this resolution, however adoption of the HMP enables the
City to apply for future hazard mitigation funding opportunities.
Recommendation:Approve the attached resolution adopting the Clallam County Multi-jurisdictional
Hazard Mitigation Plan.
Background / Analysis:44 CFR §201.6(c)(5) requires that jurisdictions develop a Hazard Mitigation
strategies. This federal requirement is administered through the Washington State Emergency
Management Division (WA EMD) and Federal Emergency Management Agency (FEMA). The HMP is
required to be updatedregularly.Jurisdictions are required to have an adopted HMP in order to be
eligible for any potential FEMA mitigation funding that may become available.
The City and the County have had a multi-jurisdictional HMP in place for decades and it has been
updated regularly, with the last update completed in late 2010and approved by Council in 2011.
In order to prepare the latest HMP update, Clallam County Emergency Management hired a consultant
andformed a Mitigation Planning Team (MTP) made up of staff stakeholders from all of the various
jurisdictions in the Countyincluding the City of Port Angeles.Over the past twelve months,the MTP has
worked with stakeholdersduring numerous meetingsand has sponsored five formal community
workshops to develop a Multi-jurisdictional HMP.All of the community workshops were noticed and
advertised in local media, during the County Fair and during the annual Home Show. There was
considerable public involvement, especially during the workshop held in Port Angeles.
The result of this effort is a 411-page HMP that includesa section detailingthe specific needs of the City
of Port Angeles. In that section, a number of projects have been identified for mitigation consideration if
federal funding becomes available. It should be noted that if federal mitigation funding does in fact
become available, the City is not obligated by the HMP to address projects in any specific order, nor is
the City unable to address new projects that may have been identified after the HMP is adopted.

The City of Port Angeles specific section is attached.
The HMP was completed in December of 2019 and was submitted to WA EMD and FEMA for approval.
The plan has been approved, and now must be adopted by each participating jurisdiction through
resolution.
Management will be hosting planning meetings during 2020 when suggested modifications/additions or
deletions to the plan may be made.
The HMPis a mitigation plan, not an emergency response plan. If federal mitigation dollars do not
become available, the plan is not used. From the response perspective, the City has a Comprehensive
Emergency Management Plan (CEMP) and a Continuity of Operations (COOP) plan. These are the plans
usedfor the actual response to, and recovery from, disasters and large-scale events. An update of the
CEMP is on the Fire Department work plan for 2020.

RESOLUTION NO.
A RESOLUTION of the City Council of the City of Port Angeles,
Washington, adopting the Clallam CountyMultijurisdictional Hazard
Mitigation Plan update.
WHEREAS, themost recent Multijurisdictional Hazard Mitigation Plan adopted by
Clallam County expired in 2016; and
WHEREAS,work to revise and update the plan began in September of 2018 and continued
throughout 2019; and
WHEREAS,the revision process included input from Cityof Port Angelesstakeholders,
multiple jurisdictions from throughout Clallam County and from the public during advertised
meetings held throughout Clallam County;and
WHEREAS, the completed and revised plan was submitted in December, 2019 to both
the Washington State Department of Emergency Management (DEM) and the Federal Emergency
Management Agency (FEMA) Region X for their review and approval;and
WHEREAS, DEM and FEMA approved the Clallam County Multijurisdictional Hazard
Mitigation Plan update in January, 2020.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of Port Angeles, in
consideration of the above findings of fact, adopts the Clallam County Multijurisdictional Hazard
Mitigation Plan, Revision 1, 2020.

Background / Analysis:
There are several open positions on various City advisory committees. Staff are recommending Council
appoint members to anad hoc committee(s)in order to review applications and make recommendations to
the full Councilon appointments.On September 5, 2017, the City Council adopted Ordinance 3588,
amending chapter 2.40, 2.68, and establishing a new Chapter 2.25 which outlined the process of
appointments and terms. In addition, Council adopted Ordinance 3638 amending portions of Chapter 2.70
of the Port Angeles Municipal Code relating to the Lodging Tax Advisory Committee term and term
limits.
The process of appointment varies from committee to committee. Members from advisory boards,
including the Public Safety Advisory Board and the Parks, Recreation and Beautification Committee,
have their own process for reviewingapplications for potential members. Once their board and
committee members have made a decisiononappointment,theyforward theirrecommendationfor
appointment to the full Council.However, Planning Commission and Lodging Tax Advisory Committee
applications should be reviewed by a Council ad hoc committee for appointment recommendation.
