Supporting narrative:
Using a local general contractor and local subcontractors, we built our fIrst
new home at 2025 W: 4th St. in Port Angeles. Construction began in
October, 2000 and our fmal City of Port Angeles inspection occurred in
April, 2001. During the fmal inspection, the inspector informed us that the
storage shed we built (not built by the general contractor) was in violation of
the side setback zoning requirements.
Prior to deciding the placement of the storage shed, we had discussions with
our general contractor, the concrete subcontractor, and numerous other
individuals regarding the city requirements. We were told that since our
planned shed would be 6' X 8', it was well under the 120 sq. ft. limit for a
building permit and that there were no other applicable regulations.
We then discussed placement of the shed with the neighbors on the East side
of our house since they could potentially be affected. We told them we
would make every effort to preserve their view of the Straits of Juan de
Fuca. We showed them the proposed placement and they agreed with the
location. Placing the shed further North or West could have affected the
view of neighbors on both the East and West sides.
Other considerations for storage shed placement were the fact that the
technical back one-third of the lot is over the bluff and therefore, not
useable. The current location of the storage shed is located on the back one-
third of the useable lot - perhaps the 3 ft. setback requirement could apply in
this situation.
In conclusion, we are applying for a side setback variance since we placed
the shed in its current location after we considered the limitations of the
environmental requirements, the rear one-third of the lot is unuseable, and
sensitivity to the neighbors. The current location seemed to be the most/only
logical placement.
