HOLD HARMLESS AGREEMENT
LEGACY HOMES, N.W., INC. and SCOTT J. MORRIS, personally, for and in fulfillment
of a condition for approval of the subdivision known as "Walker Estates", do hereby covenant and
agree to:
RELEASE, INDEMNIFY, acquit, and forever discharge the City of Port Angeles, and its
officials, agents and employees from any and all actions, causes of action, claims, rights of
contribution or indemnification, demands, damages, costs, and any and all known and
unknown personal injuries, including mental anguish, emotional distress, discomfort, and
inconvenience, resulting from or in any way related to the approval of said "Walker Estates"
subdivision.
DEFEND, INDEMNIFY, AND HOLD the City, its officers, officials, employees and
volunteers harmless from any and all claims, injuries, damages, losses, or suits including
attorney fees, arising out of or in connection with approval of the Walker Estates subdivision,
except for injuries and damages caused by the sole negligence of the City.
The terms of this HOLD HARMLESS AGREEMENT are fully understood and voluntarily
ac~epted; and this RELEASE OF ALL CLAIMS is executed by the undersigned on
knowledge of the facts and is not made in reliance upon any statement of any person, except
as contained herein.
IN WITNESS WHEREOF this RELEASE AND INDEMNIFICATION AGREEMENT has
been executed by the undersigned this /g of September, 2007.
