During the permit review process.for Building Permit 10 -404, a couple otissues
have come up that need to be addressed in advance of issuance of a buildingpermit at
630/535 East Front. Street.
The first issue is that the certificate of insurance for the Right of Way Use Permit
issued to you in.2007 (07 -15) for' landscaping in the right of way is no longer valid. The
insurance.-must remain valid for the life-of the use The City'.s Engineering Division
needs to receive an updated insurance-coverage notice each year to retain the
landscaping.
A site inspection indicates that wheel stops have not been placed along exterior
parking stalls abutting Eumce Street (per 14 40 120 Port Angeles Municipal Code) This
requirement was discussed during the 2007 remodel project. Additionally, the broken
curb ramp and sidewalk along Eumce Street north of the First/Front Alley to dust north of
the Eunice Street entry driveway needs to be replaced (per 8.30.045(P)(2) Port Angeles
Municipal Code) as the driveway is no longer used and, in fact, conflicts with on site
parking spaces. This letter is intended to serve as notice that you will need to either
to work the items into your current site improvements, or perform the work before the
building permit is issued. With the exception of installing the wheel stops, work in the
right of way will require a Right of Way Construction Permit prior to commencement of
such work.
It appears that you are doing well in your busmess, and we.are happy to work with
you on yet another remodel project. Please let us know your intent in this matter at.-the
earliest opportunity

Sue,
Per 11.12.040 and 11 12.090(H), permits for the obstruction of unopened streets and sidewalk cafes are the only ones that require
annual renewal. In this case, the requirement for maintaining insurance for the obstruction was a condition of the permit.
Maintaining insurance in force for landscaping is not typically required per 11.12.140(6), but is required for other obstructions. I
agree that a mechanism needs to be in place to ensure that, when required, the insurance is kept current. I will see if this is
something that our current system can do for us.
Regarding the repair of the sidewalk and the removal of the abandoned driveway these are required per the Code and it would
seem timely to address these issues as a part of the building permit process. .Eric

When a semi permanent ROW Use Permit is to be issued, I thought a mechanism was set up to bill the property owner each year
If a mechanism isn't in place to check the insurance status prior to renewal, sounds like there is a problem there. The renewal fee
could be billed and paid, but the insurance likely would expire. I well remember that the matter of closing the curb has been
discussed numerous times and that in the latest instance it was determined that the matter would be brought up 'later' If this
building permit had not been submitted however how would that have been accomplished? The matter of wheel stops is one we
can certainly deal with under the building permit review without fear of a challenge that we are bringing up old issues without
cause. The wheel stops should have been taken care of for public safety reasons long ago regardless of other concerns. I worry a
bit about the closure of the curb being tied to the building permit because, once the wheel stops are placed, the public safety
matter relative to use of the building goes away However I will send a letter informing Jaime that all of the items need to be
worked into his building plan. I fully expect to hear from his Attorney Will let you know how it goes.

I have assembled the following comments related to the subject permit application:
The certificate of insurance for Right of Way Use Permit 07 15 is expired. This was the permit for the planting and rockery
along Eunice Street. A new certificate of insurance must be submitted.
Install wheel stops in the parking stalls adjacent to the sidewalk along Eunice Street per 14 40.120 PAMC.
The remainder of the comments will require issuance of a Right of Way Construction Permit to a licensed and bonded
contractor to perform the work prior to or in conjunction with issuance of a Building Permit:
Remove the abandoned driveway from the east parking lot to Eunice Street and restore the curb to full height per
11.08.150 PAMC.
Remove and replace the broken curb ramp and sidewalk along Eunice Street north of the First/Front alley to just north of
the driveway to Eunice Street (approx. 60 linear feet) per 8.30.045(P)2 PAMC.
