Dear Mr. Ritchie,
This letter 'is in reference to a referral submitted by the Fire
Depar~men~ as a result of a recent life safety fire inspection conducted
at 314 West 1st Street.
The fire inspectors observed storage in the basement at the
aforementioned address without appropriate exits or a required fire
resistive separation to the apartments located above. During the follow-
up inspection conducted by Dan McKeen, City Fire Marshal, and myself, the
following deficiencies were noted requiring corrective action:
1. The basement is currently used for excessive storage of combustible
materials which includes election signs, paper files, and gas
containers. Section 311 of the Uniform Building Code requires a one-
hour fire resistive separation between the storage area (basement)
and the first floor above (apartments) for storage of low hazard
(non-combustible) materials, and a three-hour fire resistive
separation for the storage of moderate hazard (combustible)
materials.~ The election signs, files, gas containers and
miscellaneous items shall be removed unless an appropriate
separation is provided.
2. The basement, is not provided with a single approved exit. If the
basement is to be used for storage, two separate approved exits
shall be provided.2 The exits shall be provided with illuminated

exit signs with battery back up to allow safe exiting from the
basement in the event of a power failure.~
3. The exit sig~s at both ends of the first floor corridor shall be
self illuminating with battery back up to allow safe exiting for
apartment occupants in the event of a power failure.3
4. The second floor rear emergency exit was found with a wood handle
blocking the panic hardware. NO obstruction shall be placed on the
door or its hardware which could impede access from the door.~
5. All exit lights should be checked, with burned out bulbs replaced
to provide adequate illLm%ination.5
6. The rear exit stairs had areas in which the planks had rot. Replace
those planks to ensure a safe stairway.
The above deficiencies should be corrected immediately, with a follow-up
inspection to be conducted by the Building and Fire Departments in
approximately 30 days to ensure compliance. If.you have any questions or

On Aug. 21, while cleaning out drain lines in the basement, I was approached by the
city and fire department. They asked if any decision had been made regarding the
future use of the basement. I informed him that I had talked to Craig and had been
informed that 2 of you were going to pay for drywalling to implement file storage an&
the rest would have to remove your stuff. He felt that since it has been 2 years since
change had been asked for, he would give you 30 days to clear out the basement. I
felt that that was not enough and talked him into 60 days. I suggest YOU GET
BUSY, or look forward to citations and/or possible condemnation.
Randy Collier, did well for about 2 months and seemed to just shut down. for about 4
months, Rent was only being collected from one apartment and bills were not being
paid. The door of apartment # 4 had been kicked in by police and the occupant is
now serving life, apartment # 3 rented by a Mr. Gregory and sponsored by John
Hayden and Parent line who assured me, we would have no problem with rent is 4
months behind and has gone in the Army. apartment # 5 is again in arrears and has
been evicted. Apartment # 6 was in arrears due to lose of employment, she has
jumped right in and has been helping with apartment refurbishment and the renting
out of same. She will be taking over the duties of manager with my assistance.
Randy Collier in apartment # 1 has been asked to pay rent for the last 4 months due
to his not fulfilling his obligation as manager. Apartment #2 has BEEN PAYING
RENT.
As of the writing of this document, all apartments have been refurbished with only
one not rented as of the 1 st of Sept. I will stay involved until we are sure things are
under control and will remain that way.

Dear Craig,
Today I walked through the building located at 314 West 1st Street. I was accompanied by Ken
Dubuc, the Port Angeles Fire Marshal. Ken and I were in the building in response to a referral
that was forwarded by a Fire Department inspector.
There are a number of Uniform Building Code and Uniform Fire Code issues that need to be
dealt with in this building. Several of these issues are quite serious and they have prompted me
t9 take immediate corrective action.
As of today, July 26, 2001, the top two floors of this structure are declared to be unsafe and
may not be occupied for any reason. I have placed "No Occupancy" signs at the front and
rear doors that lead to the upper floors of the structure.
This declaration is based upon the following findings:
(For reasons of clarity, this building is considered to be four stories in height.)
The wooden stairs at the south end of the building are in disrepair. The stair treads are in poor
condition, the railings are not stable and the overall structural integrity is questionable. Exterior
exit stairways must be of noncombustible construction or of wood with not less than 2" nominal
thickness.
The exits on the third floor serve an assembly occupancy. Exit doors from assembly occupancies
may not be provided with a lock or latch unless itis panic hardware. The exception is the street
level door which may be fitted with key locking hardware ifa readily visible sign is placed at
the door which reads, "THIS DOOR TO REMAIN UNLOCKED DURING BUSINESS
HOURS." The letters shall be not less than 1' high and of contrasting color. The third floor exits
are currently fitted with deadbolts.
Several of the lighted exit signs are not functioning. All lighted exit signs throughout the
building must be repaired.
The fourth floor is served by only one exit. Uniform Building Code section 1004.2.3.2 states,
"Every occupant in basements and on stories other than the first story shall access to not less
than two exits. The fourth (top) floor of this structure may not be occupied for any reason unless
an approved second exit is provided. The fourth floor access must be secured in an approved
manner to prevent entry.

There is a significant combustible load in the first floor area. Under-floor areas used for the storage
of combustible materials shall be protected on the storage side as required for one-hour fire-resistive
construction. It is clear that this process has been started, however it must be completed, or the
combustible items in this area must be removed. The installation of an approved automatic sprinkler
system would also satisfy this requirement. The requirement for a fire-resistive separation for this
area was first brought forward in a letter dated August 24, 1998.
This is a large building with multiple uses. The bottom floor is used for storage, there are persons
living on the second floor and there is a large assembly room on the third floor. We would strongly
recommend the installation of a fire alarm System in this building. A fully functional fire alarm
system would provide early warning for building occupants and firefighters.
A follow-up inspection will be conducted on Tuesday, September 4, 2001.

Thank you for arranging to allow City Building Inspector Roger Vess and myself to meet with you
at the above-referenced premises on February 28, 2003. I also appreciate receiving Brian's
information regarding the "reasonable accommodation" issue as it relates to,employers with less
than 15 employees. While I do not believe that the number of employees is directly applicable to
how the Building Code accessibility requirements apply to your building, it may be a factor along
with others that allows for flexibility in this situation.
Based on viewing the premises and what it would take to achieve full compliance with the
accessibility requirements, the following approach is a reasonable compromise and still meets the
intent of the law:
1. A ramp meeting the slope and other requirements stated in the Building Code will
be installed at either the front or rear entrance to the building.
2. A written agreement will be executed that will allow for shared access to the
handicap-accessible restroom in the adjacent building that is under the same
ownership as the premises in question.
3. No modifications to the restroom in the above-referenced premises ~vill be required,
provided that the written agreement is executed as set forth in #2 above. However,
the restroom must be made handicap-accessible at such time as the ownership of the
adjacent building is separated or if the use of the subject building changes so that an
on-premise handicap-accessible restroom is needed.

We have checked this plan and find that it conforms to the requirements of our codes and
ordinances, with the following comments:
I) Port Angeles Municipal Code (P AMC) 14.23.050 (G) states that residential occupancies be
protected throughout by an approved, addressable automatic fire detection system. Please
provide separate fire alarm system plans for review.
2) It is STRONGLY recommended that a fire sprinkler system be provided for this building. A
fire sprinkler system would significantly enhance the safety of the residents of the building. A
fire sprinkler system would also increase the potential for full utilization of the structure.
3) Storage on the ground floor of this building is limited to those areas where fire-resistive
protection has been provided between the storage and the floor above.
4) The plans do not indicate any proposed use ofthe floors above the street level. Occupancy of
these floors by the public is subject to approval. Occupancy ofthese floors as an assembly will
at least necessitate approval of the exit system that is currently in place.
NOTE:
Prior to the issuance of a Certificate of Occupancy, compliance with the above
conditions must be met.

Thank you for responding about our concern regarding the evident encroachment on our property. Your
e-mail of Nov. 29, 2005 indicates that you had a discussion with the City of PA, Builiding Inspector, Jim
Lierly. You stated: "You are correct in that it appears the access wells (to the lOaF building) are located
across the property line." (Le.on our property, Tax ID# GAGE3000).
As you suggested, we would appreciate Jim Lierly addressing this issue with the owner of the lOaF.
Given his role as Building Inspector, it would be appropriate for him to require the removal of those access
wells from our land. We request verification that the evident encroachment is resolved (completely
removed and soil replaced) before he signs-off on the final inspection of the lOaF building.
It does not seem necessary, to us, that you would be discussing our conversations with Maureen Hope-
Wall. Since, as building inspector, Mr. Lierly could resolve the concern by following basic property rights of
all property owners.
For the record, we do not sanction the access wells to the lOaF from/on our land.
In keeping with our desire to maintain good relations with our neighbors in the City of PA, while protecting
our property rights, we are confident that the officials of the City of PA can address this issue in a nutural
fashion... assuring us when the situation is resolved.

Dear Mr. Tuttle,
Thank you for taking the time to meet with the Fire Marshal, Ken Dubuc, on Friday,
November 22,2002 at the Odd Fellows Building located at 314 West 1st Street. We would
like to start by thanking you for your efforts to date to keep the exterior of the building clean.
We realize that this is an ongoing endeavor and appreciate what you have been able to
accomplish.
Weare writing in order to bring the basement situation to your attention.
There is a considerable accumulation of combustible storage in the basement of this building.
Section 1103.3.2.5 of the Uniform Fire Code (UFC) clearly states, nAttie, under-floor and
concealed spaces used for the storage of combustible materials shall be protected on the
storage side as required for one-hour fire-resistive construction. "
The Uniform Building Code (UFC) goes on to stipulate that the required separation
between a reSidential occupancy apartment house and an area for the storage of
combustible materials shall be 3-hour fire resistive construction.
"Fire-resistive construction" can generally be accomplished through the application of 5/8"
Type X gypsum wallboard (sheetrock) on the walls and ceilings of the room. It is obvious
that sheet rock has been installed on the east side of the building, however this installation is
still not completed. The west side of the building does not have any protection whatsoever
and there is a huge combustible fuel load present.
This situation was first brought to the attention of the responsible parties in a letter dated
August 24, 1998, and with an additional letter dated July 26, 2001 (see attached). Since that
time, some progress has been made, however the combustible storage situation in the
basement appears to have gotten substantially worse.
This situation is particularly hazardous because there are people living directly above the
area in question. A fire in the basement area would expose the residents of the building
to an extreme and unacceptable risk.

We understand that the mitigation of this situation is a significant undertaking that will require
substantial resources. We also understand that there are a number of persons who are collectively
involved in the decision-making process for this building. Those points notwithstanding, this is a
situation that has existed for at least 4 years without a satisfactory solution and we feel
compelled to act.
Weare requiring that a written plan of action for the remediation of this situation be provided to
the City of Port Angeles Fire Department within 14 days of the receipt of this letter. We will be
happy to work with you or any of the other concerned parties to develop this plan. This plan
shall contain specific steps for mitigation as well as a proposed time line. In any case, all of the
combustibles must be immediately removed from the unprotected portions of the basement until
such time as adequate protection can be provided.
Please do not hesitate to contact us if you require assistance with the development of a
mitigation plan or if you would like to discuss any of the issues that are contained in this letter.
It is not our intent to place an unreasonable burden upon you or the other concerned parties
involved with this building. It is our intent to rectify a hazardous situation that has gone
unresolved for a number of years. Our primary concern is for the safety of the persons living in
and using the building, as well as for firefighters who may be called upon to fight a fire in the
building.

mutual benefits, grant(s) to the City of Port Angeles, municipal corporation (hereinafter referred to as the
"City"), a temporary construction easement over and along the full width and length of the premises situated in
Clallam County, Washington, and described as follows:

The temporary construction easement hereby granted shall include the right, privilege and authority, to
said City and its contractor( s), of ingress and egress to and over said described premises during the
construction of water main, sidewalk, fire sprinkler piping, and related facilities as part of the Downtown
Water Main Project, Phase III.
The City or its contractor shall, upon completion of said facilities: restore the premises of the
Grantor(s), which are disturbed by the City or its contractor, to as good condition as they were in prior to any
such construction offacilities. The City and its contractor shall indemnifY the Grantor(s) against, and hold the
Grantor(s) harmless from, all claims, damages, and lawsuits related to the construction of said facilities.
In consideration of the City's construction of fire sprinkler piping for the benefit of the Grantor(s),
which the City is undertaking in the interest of public safety and to take advantage of the cost effective
opportunity made available by the Downtown Water Main Project, the Grantor(s) hereby agree that the City
shall have no legal responsibility or liability for the fire sprinkler piping constructed pursuant to this easement
