Dear Gary:
I'm writing on the behalf of my clients, Kate and Emma Hollingsworth, who have contracted with
Reed Design & Construction, Inc. to construct their new home located at 2101 West 10th. My
clients have been asked to construct a curb and sidewalk in ~ont of their new home. We are
requesting permission to delay the construction of this curb and sidewalk for the following
reasons:
1. Tenth Street has dips in it and is not level. When the City constructs the
rest of the curbs and sidewalks along it, the street will need to be
leveled. If ifs leveled after the construction of the Hollingsworths' curb and
sidewalk, there is a good chance theirs' won't be at the correct heighth.
2. At this time there are no other curbs and sidewalks within blocks of their
home.
The Hollingsworths are willing to sign a "no protest" LID and give the City a $1000 deposit
towards future construction of the curb and sidewalk in l~ont of their home. In that way, the
City is assured that they will be agreeable to contribute to the cost of this upgrade and the
Hollingsworths will be assured that their curb and sidewalk will be uniformly consistent with those
of their neighbors.
As a builder, I have never protested the construction of curbs and sidewalks in ~ont of my
projects but am this time for I feel this is a unique situation. I would appreciate your
consideration of our appeal.

I have reviewed the referenced property in response to your correspondence of
December 10, 2002 You are correct in that there are currently no sidewalks in the area
There are curbs one lot to the west of your clients property
The property is located on an arterial which is a designated school walking route
The City's Municipal Code PAMC 18 08 040 D states "Development that creates
pedestrian traffic on any arterial streets and any other streets identified in the City's
transportation plan as school walking routes shall include pedestrian sidewalks" The
intent is to provide for eventual completion of a sidewalk system along arterial streets
and school walking routes We currently do not have in place a system to accept a non-
protest LID agreement and/or partial deposits in lieu of construction It may not help
with this development, but I would support establishment of a fund to accept
contributions for future development in lieu of construction The contribution would need
to be the estimated constructed cost of the all improvements required for the sidewalk
based on recent bid prices for similar quantities
All sidewalks have to start somewhere The City can assist in the construction by
providing alignment and grades for the curb and sidewalk. This will help to assure future
uniformity with adjacent properties as they develop
The PAMC provides for appeals to the City Manager should you chose to pursue this
further
