Thank you for your letter dated October 22, 2007 affirming that there have been no
permits for the "Conditional Use" of, or an "Accessory Residential Unit" as it pertains to
the use of our property located at 1131 East 5 Street, Port Angeles, WA. Had there been
any permits obtained for such a change, we would certainly have followed protocol in
complying with all required inspections.

Dear Mr. Crowson:
I am writing you in response to a letter the City received from US Senator Patty Murray
regarding your dispute with the Clallam County Assessor pertaining to a property tax
exemption for Senior Citizen and Disabled Persons. As I understand your concern, it
revolves around whether or not the property is a rental unit.
City staff reviewed our files relative to your property. The City does not retain
construction blueprints for residential properties. From the site plan sketch provided
when a building pen for a residential remodel was issued by the City in 1992, it is not
possible to determine whether a rental unit was created at that time or not. We have no
record of application for a Conditional Use Permit (CUP) or for an Accessory Residential
Unit (ARU) for the subject property. The City's building inspector has previously been
denied access to your property to verify (or not) the existence of a second residential unit.
At this time the City is unable to make any statement either affirming or denying the
presence of a second residential unit, nor can we offer any opinion as to rental status.

Mark Madsen Mark, the pertinent facts of my investigation into the background of the attached
City Manager letter, as you requested, are contained herein. As you will see, the issue cannot be
417 -4804 resolved without a site inspection. Please let me know if you need anything further.
Nathan West A building permit was issued to Mr. Crowson in 1992 to allow the remodel of an

417 -4750 original residential structure. The remodel extended the existing footprint and did not
include demolition. Building records do not indicate that the existing kitchen was

417-4750 appears today is that there is a really nice small residence at the rear of the site

Associate Planner records indicate one power and one water meter. The site appearance is definitely two
417 -4752 residences. Very nice setup actually. Perfect for an ARU! But no CUP. The
Assessor's Office cruised the area when the remodel was originally completed and
Jim Lierly spoke to the renter, noting that person's name and details. The Assessor also noted

417 -4816 recent IRS information where Mr. Crowson claimed a rental unit on his property.
Patrick Bartholick Jim Lierly visited the site a couple of years ago when a complaint was made by a
Code Compliance neighbor regarding rental of the original residence. (An enforcement file was not

started so no date.) Jim said that cars were parked in the rear parking area and it
Linda Pangrle appeared that both residences were being occupied at the time of his visit. Mr.
Permit Technician Crowson confronted Jim as to his business on the property at that time. When Jim
417 -4815 asked to verify (or not) the second residential use by a look inside, Mr. Crowson
became very confrontive and swore at him to leave. Jim said that shortly thereafter
it "appeared" the original residence was unoccupied.
The Assessor's Office informed Mr. Crowson that he cannot claim a special tax credit
if he has a rental unit on his property. They suggested that a site visit would clear up
any issues. Mr. Crowson said that he would absolutely not allow a site inspection.

Mr. Crowson,
This letter is in response to your 10/11/2007 telephone message to me in which you stated you will
not talk to me and that all communications with our office are to be in writing. This is unfortunate
because I still feel that if you will simply meet with us at the Assessor's Office, we can discuss the
issues at hand concerning your disability exemption and resolve them. Since this is not to be, here
are the things that need addressed in order for you to continue participation in this program.
1. Verification that your home is a single family dwelling and no longer separated into units
that can be rented. This verification must be done by either a City of Port Angeles or a
Clallam County agency, and it must be documented in writing.
2. Confirmation of the date when your home was converted back into a single family dwelling.
3. Income verifications for the years 2004, 2005, and 2006, to include IRS form 1040's and all
supporting documentation as necessary. (Request forms for copies of IRS information are
enclosed for your use if needed.)
4. Sale information on the rental property sold in 2003, including seller contract and monthly
payment amounts.
It is the Assessor's responsibility to administer this program and to investigate reports of possible
noncompliance issues. You are being audited this year because we received taxpayer reports of
"new construction" in your existing garage and of rental units at your residence at 1131 East 5
Street, P.A. Since both of these reported activities may affect your exemption status, we are
required to look into the matter.
As stated in previous letters to you, we reviewed your 2003 and 2004 applications (as a result of
these reports). These showed that in 2003 you reported on your IRS form 1040 receiving rental
income from two rental units within your home, and the sale of a rental property. You reported your
home as a single family residence on one application (this was omitted on the other one) and this
rental information was not listed on either of your applications, nor were the sale of the rental
property or the monthly payments you've received from the sales contract. In other words, the
information you provided on your exemption applications is in conflict with the information you
reported to the IRS in 2003.

Further, a review of your property records shows the back of your house was described as an
"apartment" by an appraiser during a previous inspection —and it was noted during our cyclical
physical inspection this year that on 04/18/2007 there was still a mail box on the alley access to
your home with the address "1131 %2" on it. (This mailbox has since been removed.)
Because of the discrepancies on your applications and IRS forms, and what our records show from
physical inspections of your home, it appears that the reports about your home may have merit. We
simply cannot ignore them. Consequently, these matters need resolved in order for you to continue
participation in this program. An audit is the best way to confirm that your home and your income
are actually in compliance with the laws that govern this program.
To be clear on this, you will need to provide evidence to our office for the items stated in #1
through #4 above. This is your responsibility. You need to show us that your home has not been
used as a multi -unit dwelling from 2004 through to the present and that it is not still divided into
separate "apartments Since you will not allow our office to make an inspection of your home (per
your letter to Ms Kreider on 05/19/2007), you need to make arrangements for a city (or county)
building inspector to confirm that the (IRS reported) rental units no longer exist and have been
converted back into single family dwelling. You need to provide IRS income data from 2004 to the
present. And we need to see the contract for the sale of the rental property including monthly
payment information.
You have 30 days from the date on this letter to supply our office with the information requested. If
we have not received it by then, you will be removed from the Senior/Disabled Exemption Program
for the years of 2004, 2005, and 2006. Meanwhile, a request to the Treasurer's Office will be
submitted for recalculation of back taxes owed for these years.
I am sorry that this matter has progressed to this point and that it is causing hardship on you. I
thought that if we met, and with a little cooperation, we could have already taken care of this and
resolved these concerns. But as mentioned before, it is our job and our responsibility to confirm
compliance in this program, so we must follow through on it.

Dear Senator Patty Murray,
We received the enclosed copy of the letter from Ms. Kreider informing us that our home
is some kind of rental unit, apartment, and as such makes us ineligible for the disability
exemption that we currently have. This is the second such letter we have received from
her regarding this erroneous assumption on her part, and the second time we have refuted
her claim. We talked to the building department of our city and they said that this house
is neither zoned for, or has any variance been applied for or approved for such activity
regarding the use of the dwelling located and known as 1131 East 5 Street Port Angeles,
WA. Our home is zoned RS7 for single family residential use, and can only be used as
such. I will also add that this house was built in 1992 and no building permit for any
changes, additions, or alterations have ever been applied for, or approved for the purpose
of turning the structure into a multifamily complex. My wife, my daughter, and I are the
only ones living in or on the property of 1131 East 5 Street Port Angeles, WA.
According to the city of Port Angeles, we cannot legally rent or use any part of this
property as a multifamily dwelling; so I ask, why should the county be allowed to take
away our exemption for something that we cannot legally do with this home; does this
seem right or fair?
I am a permanently disabled veteran and also suffer from severe chronic depression. This
situation puts my family in danger and jeopardy of homelessness; in addition to greatly
aggravating my health conditions. This course of action by Ms. Kreider perpetrates an
unconscionable act of selective taxation based on the whim of an aggressive, uncaring
bureaucrat striving to advance her career by the misuse of her power.
This injustice is being applied to a family who meets every criterion, and is dependent
upon this good program of the State of Washington; with no financial means to hire legal
assistance, if this travesty is allowed to continue we will be forced to sell or loose our
home. We plead with you Senator Murray, to help right this wrong and save our home.

the property tax exemption for Senior Citizens and Disabled Persons are specific in
application of rental areas and income. The definition of a family dwelling unit
explicitly excludes boarding homes or rooming houses (RCW 84.36.383(1)).
After conferring with the State of Washington Department of Revenue, we do not
have adequate information required to grant the exemption on this parcel.
You may petition the Board of Equalization within 30 days of this notice if you
believe this decision had been made in error,

I received a comment from a member of the public that the above referenced house appears to ce
exceed the 30% lot coverage. Upon inspecting the site, it appears to me the house is larger than I-
t he house shown on the plot plan from your files (copy attached). The plot plan shows a 43 foot N w
front yard setback. On my site visit, the actual setback looks 20 -23 feet. The rear setback W
appears to conform with the plot plan. T am concerned with this discrepency, especially since o
construction on the house is nearly complete. I would appreciate receiving a ropy of the a plot W
plan which shows the actual building footprint and lot coverage calculations. E I-
