We have completed our review of the Sexton House for compliance
with the Environmentally Sensitive Areas Protection Ordinance and
have found it meets the criteria setforth for development in
previously altered environmentally sensitive areas. Attached is
a copy of our findings for your information. The project may not
be changed in any manner which results in the project not meeting
the requirements of the ordinance.
The conservation easement and /or deed restriction does not need to
be completed before issuance of building permit, but should be
completed before construction progresses too far. We would like to
review the language of the easement /restriction.
ENVIRONMENTAL SENSITIVE AREAS
PROJECT REVIEW
DATE: July 28, 1992
PROJECT: Sexton House
LOCATION: Lot -15, Block 129, Townsite of Port Angeles
PROPOSAL: Construction of a single family home on the top of
a marine bluff.
DEVELOPMENT STANDARDS: Section 15.20.070(B)(2) requires a
minimum undisturbed buffer of 50 feet from the top of the
bluff. Section 15.20.080(A)(5) allows for exceptions for
areas that have been previously altered from its natural state
if the criteria contained therein are met.
Criteria a:
The environmentally sensitive area was lawfully altered in
accordance with the provisions of this Chapter and any state
and federal laws at the time the alteration occurred.
Response: The environmentally sensitive area has been filled
in the past, which has created a new top of bluff. According
to Polaris Engineering, the fill depth ranges from 6 to 10
feet and extends a horizontal distance of about 25 feet. New
vegetation on the side of the fill consists of ground cover
and dense shrubs including blackberry bushes. Since the City
has no permitting requirements for grading and filling, we do
not know precisely when the site was filled. According to Ken
Ridout in Public Works, the fill was placed on site probably
in the late 1980's and that the applicant has not added to the
fill or extended the building site into the environmentally
sensitive area. Thus the alteration was likely altered prior
to the adoption of the Environmentally Sensitive Areas
Protection Ordinance. It is not known to having been done so
in violation of any State and Federal laws in force at the
time of the alteration.
North of the site the ESA and buffer was altered much earlier
than the site. A two car garage and a 20 foot wide paved
alley were constructed and still exist.
Criteria b:
The alteration significantly disrupted the natural functions
of the environmentally sensitive area.
Response: The alteration changed the 40% slope to a nearly
level slope and covered any natural vegetation that may have
existed. While the sides of the fill have since revegetated
with ground cover and shrubbery, the top of the site contains
little vegetation thus exposing the soils to accelerated
levels of erosion.
Criteria c:
The proposal utilizes to the maximum extent possible the best
available construction, design and development techniques
which result in the least adverse impact on the
environmentally sensitive area.
Response: The City Engineer has reviewed the development and
drainage plans and has noted that he is not aware of any
additional techniques available for minimizing impacts to the
bluff. He has reviewed and approved a drainage plan which
direct nearly all of the storm water away from the bluff
thereby minimizing erosion and slide potential. The portions
of the house nearest the bluff incorporate piers rather than
full foundations thus reducing the amount of excavation and
site disturbance that may otherwise occur. The Building
Official has reviewed the plans and found the existing hill
can support the house with the proposed foundations.
A keystone retaining wall of about 2.5 feet will provide a
more decorative structure than would a concrete or rock
retaining wall.
The Environmentally Sensitive Areas Protection Ordinance
contains a reasonable use section for single family homes
(15.20.080(A)(1) which contains a requirement that no more
than 5,000 s.f. of the ESA buffer be disturbed. Although this
criteria does not directly apply to the reasonable use
exception for previously altered areas, the site disturbance
of the buffer meets this criteria anyway. Plans submitted by
the architect show that 4091 s.f. of the site and an
additional 518 s.f. of alley right -of -way will be disturbed.
Further, the property owner will be required to place a deed
restriction and/ or conservation easement on the remaining
2300 s.f. of site within the buffer.
Criteria d:
The proposal incorporates the development standards of Section
15.20.070.
Response: Consistent with the provisions contained in
15.20.080, the proposal involves a reduction of the buffer
setback.
Criteria e:
The proposal is consistent with the purpose and intent of this
Chapter.
Response: Discussed above are measures that have been
incorporated which help to protect the environmentally
sensitive area.
CONCLUSION:
The proposal meets the requirements for a reasonable use
exception for environmentally sensitive areas that are
previously disturbed. A building permit may be granted with
the understanding that the project remains in compliance with
the criteria discussed above.

Block 129 TPA, Adjacent to Fifth Street at Highland Drive
ISSUE: Should the City surplus and sell property to the owner of
Lot 15, Block 129, TPA, for expansion of their building lot?
BACKGROUND /ANALYSIS: The owner of Lot 15 in Block 129 has
requested that the City sell an unused portion of city -owned
property to increase their lot coverage to allow construction of a
single- family residence. In May, 1982, the City sold a portion of
unused Highland Drive right -of -way to the previous owner of Lot 15,
Block 129. In doing so, the City reserved a 300 square foot
portion along the top of the bluff for public purposes. That sale
allowed for building on the lot, although it was slightly sub-
standard at 6700 square feet. The single family standard is 7000
square feet. The building plan submitted by the new lot owner
exceeds the 30 percent lot coverage allowed for a single family
residence and the owner is requesting approximately 2000 square
feet of additional area.
The request was presented to the Real Estate Committee. The
Committee concurred with the proposed sale and recommended a sale
price of $2.00 per square foot.
We reviewed the request with the property owner who has changed the
configuration of the building site and requested that the City
reconsider the sale price. The proponent has requested the City
accept a sale price of $1.00 per square foot for the following
reasons:
The City will restrict the use of the property to be used
for landscaping only. The area to be planted, watered
and maintained by the owner at the owner's expense. No
structures or hard surfacing will be allowed.

The landscaped area will be an enhancement to the City
and will reduce maintenance costs to the City for
cutting the existing grass and weeds on city -owned
property and right -of -way.
The area is an uneconomic remnant with limited value
except to the adjacent owner.
Proponent will submit a sketch of the building site in time to be
presented at the Council meeting.
•RECOMMENDATION: Based on the property owner's reasoning of the
restrictions that the City will place on the use of the property,
we recommend that the City Council declare the property surplus
because the property is considered an uneconomic remnant to all
except the adjacent owner, and authorize the sale of the property
to thq owner of Lot 15 for $1.00 per square foot, or $2,000.00.
Action by motion of the City Council to declare the property
surplus is appropriate

We are in the process of reviewing the Sexton House for compliance
with the Environmentally Sensitive Areas Protection Ordinance. In
reference to Section 15.20.080(C) PAMC, a single- family dwelling
located in an ESA must utilize to "the maximum extent possible and
best available construction, design and development techniques
which result in the least adverse impact on the environmentally
sensitive area
Mr. Haley has noted that the bluff is protected with the proposed
drainage and runoff plans and by placing the majority of the
structure on elevetaed platforms. In addition to erosion control
facilities that you are requiring, can you recommend any other
design or construction techniques that would further minimize the
impact the bluff? Are you aware of any aspect of the current
design that may be detrimental to the bluff?

Dear Mr. Jimerson:
_,.The attached calculation sheet is drawn on the map drawn by the
Engineering office. Although we have expressed a concern on the
placement of this line, at this point to expedite the approval
of this information, we have based our information on this map.
It shows a 4210 Square Foot impact into the buffer zone of the 50
ft. setback off the bluff. We have explored other solutions to
the residence, and due to the placement of the line and the
setback we have found no reasonable alternative. As you can see
from the map, if we place all the proposed setbacks on the site
(zoning environmental), that 800 square feet of area remains.
This is not a buildable site under this arrangement.
As indicated in our drawings for the construction, the residence
uses the best construction techniques, which results in the least
amount of impact on the ravine. We have demonstrated this by
involving a soils engineer from the beginning; developed drainage
plans and runoff plans in excess of the City standards; and our
structural system lies in the buffer and not in the ravine,
although the lot extends into the buffer. The building design
respects the site by placing the majority of it's structure on
elevated platforms, allowing major landscaping to be planted on
the site.
We do not cause an adverse impact on the stability of the
ravine. In fact due to our focused runoff plan we protect the
ravine from the current uncontrolled runoff. The construction
only removes the wild grass and weeds in the area of the
construction, the ravine is left undisturbed. New landscaping
will be placed in the area of construction, it will be native
plants and consistent with the types of soils present.
Concerning the AREA of the lot, according to a letter dated
August 16, 1991 from Ken Ridout to Pioneer Title and subsequent
conversations since then, the small portion of the property
retained by the City for future trail needs, can be used for

requirements of City Zoning codes. This includes lot coverage.
With this small parcel the lot is a full city lot or 7000 square
fee

Dear Tim:
The purpose of this letter is to follow up my June 16th letter to you on the Sexton House with
some additional comments pertaining to zoning and environmentally sensitive area ordinance
(ESA) requirements.
In reference to the site plan dated 6/2/92 which contains lot coverage calculations, please be
advised that only that property on the building lot itself can be used in determining allowable
lot coverage. I understand you are working with Ken Ridout to determine if it is possible to
obtain the 1920 s.f. to the west. If title is obtained and the 1920 s.f. is merged with the lot,
then that area can be included in the lot coverage. I do not understand the reference to the
7,000 s.f. original property. Only property that is currently within the lot can be used toward
lot coverage calculations. Please clarify for us how the lot coverage requirements are met.
Note that the location of the top of bluff on the 6/2/92 site plan is inconsistent with the location
identified by the City Engineer on a recent survey. The official location is the one identified
by the City Engineer.
In addition to those items discussed in my June 16th letter, we need for you to supply evidence
as to how the proposal meets the criterium contained in 15.20.080(A)(1)b of the ESA
ordinance. This criterium requires the applicant to demonstrate that there is no other reasonable
alternative to develop the buffer. Reasonable alternatives in this case may include building a
smaller house and locating the house as close to the street, away from the bluff, as permitted
in the RS -7 zone.

Dear Tim:
We are in the process of reviewing the Sexton House proposal for compliance with the
Environmentally Sensitive Areas Protection Ordinance. As you are aware, the site is located
within an environmentally sensitive area and its associated buffer. Section 15.20.080(A)(1)
allows development of a single family home in a buffer if the criteria listed on the ordinance are
met.
One of the criterium requires that the disturbed buffer area not exceed 5,000 square feet. Please
submit to us a site plan which shows the property lines, the top of bluff as determined by the
City Engineer, the 50 foot buffer from the top of bluff and the disturbed area. Also provide the
calculations showing that less than 5,000 s.f. of the buffer will not be disturbed. You also need
to let us know how the bluff and the undisturbed portions of the buffer will be protected from
disturbance.
We are still in the process of reviewing the proposal with respect to the criterium contained in
15.20.080(A)(1)(c) to ensure the construction will not have a detrimental effect on the bluff.
We will let you know if any other concerns arise during our review.

Dear Mr. Sexton:
On August 8, 1991, I observed the excavation of backhoe test pits
on the referenced property. The purpose of the review was to
determine if any unsuitable fill had been placed on the property
and, if so, the extent and nature of the fill. A total of four
pits were completed; a sketch indicating the location of the test
pits is attached hereto for your information.
It was found that a substantial amount of unsuitable fill had been
placed on the property, in the area of the steep bank running along
the northeast portion of the site. Test pit #1 had approximately
10 feet of debris and organic fill over very compact gravelly fine
sand (till). Test pit #2 had 7 feet of debris and organic fill
over compact sand and gravel. Test pit #3 consisted of native
gravelly sandy loam topsoil over slightly compact gravelly sand.
Test pit #4 had 4 feet of fill over compact sand and gravel.
Based on the excavations and the site conditions observed, I
estimate that the fill area extends approximately 25 feet westerly
from the edge of the bank and ranges from 10 feet in depth at the
edge of the bank to 6 feet at the west edge of the fill. The
material below the fill is substantial, compact sands and gravels,
suitable for dwelling construction.
-Two methods,of site development are appropriate in the fill area.
The unsuitable material may be removed and replaced with structural
fill or caisson type footings may be installed. If caissons are
used, the recommended bearing pressure is 2000 psf, the recommended
lateral bearing is 400 psf, and frictional resistance is allowed
and may be combined with bearing resistance as set forth in Section
2908(j) of the UBC. Increases for depth below the plane of the
native material is permitted as set forth in Table 29 -B of the UBC.

ATTACHMENT TO ENVIRONMENTALLY SENSITIVE AREAS APPLICATION
1. a. The Single Family residence will be placed to the South of
the man -made cut created by the vacated right of way for the
street called "Highland Drive The footings for the home are to
be•_drilled caissons. The closest footing to the cut will be 30
feet from the natural ravine line. The location of the structure
will not increase the erosion or landslide area.
Precautions have been taken, such as a trench 4 -5' deep along the
West side of the site for collection of water run -off; all roof
drains will be taken by tight line to fifth street for
distribution into the storm sewer. All concrete and asphalt
areas will have catch basins for collection of run off to avoid
run off on to the bank area.
b. The residence has been designed to meet all requirements of
the UNBC for seismic loading. As well the site was tested for
footing depths by Polaris Engineering.
c. As indicated in a. above the surface drainage has been
addressed.
Subsurface water was not discovered as apart of the earlier
testing. The tests were done during the FALL of the year. As a
precaution however we have included in the plans a 4 -5' trench
drain at the West side of the site for collection of the
potential surface and subsurface water, prior to it getting to
the ravine.
d. This is not a flood prone area.
e. The existing vegetation on the HILL SIDE will not be tampered
with. The Contractor has been given strict instructions not to
impact the edge of the bluff with any over burden and not to
clean anything off of the hill except for the immediate top.
f. The owner purchased this piece of property for it's view. One
of it's views is down the ravine. There is no intention to
disturb the ravine.
g. The structure is to the South of the slope. We will not
impact the slope.

In response to your request, we have reviewed the background
information concerning Lot 15, Block 129 of the Townsite of Port or
Angeles. We find that when the City sold the right-of-way
the lot in 1982, we considered it a buildable lot of record. This
was approved by the Planning Commission and accepted by the City
Council. A copy of the Planning Commission minutes is attached for
your use.
The City has retained a small portion of the property for future
trail needs. This retained portion would not affect the building
site because it lies within the area that would normally be used
a for setbacks.
The lot is a buildable lot of record, with the understanding that
the owner will be required to provide soils analysis and foundation
design for the residence because of the proximity to the ravine.
The portion of the property the City retained can be utilized to
meet the setback requirements for the residence; however, no
structure of any kind may be placed on the City -owned portion.
