Dear Mr. and Mrs. Haley:
As you know, following a public hearing conducted on August 6, 2001, the City's Board of
Adjustment denied your application for a reduction of the side and rear yard setbacks in the RS- --
7, Residential Single Family zone. The findings and conclusions in support of the denial are ~'~
attached for your information.
The decision of the Board is final unless appealed within 21 days to Superior Court.

this application in its entirety and understand that my submittal will be reviewed for completeness and, iffound

This variance is being requested to change the side setback requirement from 13 feet to 6
feet and the rear setback requirement from 10 feet to 4 feet.
1. These changes are requested to allow replacement of our garage in the most
site functional and cost effective location.
2. Our own block has an existing non-conforming garage and adjoining blocks
have non-conforming garages and other structures.
3. Locating the garage at proposed site increases rear setback by 10' and side
setback by 6' from original garage site.
4. Locating the garage at proposed location preserves openness of site.
5. Locating the garage closer to the house would not leave direct walking
access to Vine street (parking) without going around south end of garage.
6. Locating the garage closer to the house would block free access to the
electrical panel.
7. Locating the garage to another location would necessitate a new curb cut for
driveway.
8. Locating the garage further to the East would necessitate relocating the water
main to house.
9. Locating the garage further to the East would necessitate 3 to 4 feet of fill.
10. Locating the garage further to the East may interfere with a major power pole.
