W. 9'h Street. The work had been done without a permit and had been seen by the
Sue Roberds Building Inspector.

On December 22,2010, Permit Technician Linda Pangrle left a phone message with the
permit holder's daughter and resident of the residence(Nicole Colfax) inquiring as to the
status of the building permit. No response.

417-4752 On January 20,2011, a second phone call brought no response.

Assistant Planner On March 15,2011, a phone call was received from Nicole Colfax asking for a final
inspection for March 16, 2011, for the re siding permit(10-745). The work was inspected
Derek Beery but the permit was not finaled because it was noted that additional work had been done
Archaeologist that was not part of the permit that would need a permit. The occupants were informed
417-4704 that the additional wall would need to be permitted before a final could be done on the
Jim Lierly entire project.
Building Inspector
417-4816 On August 4, 2011, Jim Lierly visited the site and noted that the new wall construction
Patrick Bartholick enclosing the carport into a garage area had not been removed nor had a permit application
Code Compliance been submitted. The property owner was again informed that such construction work
417-4712 needed a permit.
Heather Catuzo On September 12, 2011, Permit Tech Linda Pangrle phoned the permit holder to remind
Permit Technician them that new construction requires a permit.

On September 14,2011, a permit application(#11-1013)was finally submitted by Nicole
Colfax for the unpermitted work(the additional wall that was built to enclose the carport
into a garage area). However, when the application was routed for review, it was
determined that the work would result in an expansion of the structure in a nonconforming
area of the site and, as such,could not be permitted per Section 17.95.020(B) PAMC.
On October 13, 2011, a formal letter was sent to property owner Mr. Green(Nicole's
father) informing him that a final inspection for the siding issued under permit 10-745
would be done on October 31, 2011,and it was important that the new wall enclosing the
carport be removed by that time as it is in violation of Code.
A building inspection by Pat Bartholick on October 31, 2011 revealed that the wall had not been
removed. The building permit for the siding was not finaled due to the Code issue on the adjacent
walls.
A phone message was left for property owner Green(360-645-2722)on November 1, 2011 to call to
discuss. No response.
A site inspection on March 30, 2012, by Building Inspector Jim Lierly revealed that the wall had not
been removed. Jim spoke to the property owner while on site and believed that he does not intend to
remove the new nonconforming wall.
A variance is unlikely in this matter because the structure already has an attached garage so that use
right is not being denied, and there is adequate area in the north portion of the site to construct an
additional accessory structure if desired. Other residential uses in this area are conforming so this is not
an area where nonconforming structures are prevalent or similar.

Building Permit 10-745
Dear Mr. Greene:
Building Permit#10-745 was issued on July 15, 2010 to re side a structure at 1022 W.
9th Street. An inspection of the site prior to final of the permit indicated that a new wall
had-been constructed along the east side of the carport which is within the required 20-
foot rear yard setback. Section 17.95.020 Nonconforming Uses of the Port Angeles
Municipal Code permits repairs and reconstruction of nonconforming structures, it does
not permit expansion of areas of such structures that are within required setback areas
on a lot. The carport is within a required building setback area and cannot therefore be
expanded (enclosure of a wall is expansion). The carport may only remain a carport
which is defined by the Zoning Code under Section 17.08.020 "C"PAMC as "...an
accessory building or an accessory portion of the main building designed and used primarily
for the shelter or storage of vehicles. It is not an enclosed structure and it does not contain a
door which would allow vehicles to pass into the structure: it is open on Iwo or more sides."
The new wall framing.& siding from the east wall of the carport must be removed prior
to final of the building penult. An inspection will be done 14 days from today (October
31). If you are unable to meet this timeline,please make arrangements with Jim Lierly,
Building Inspector at 417-4816 for an alternative date. Violations of the Port Angeles
Municipal Code are punishable as misdemeanors. However, we would much prefer to
allow you an opportunity to correct this issue voluntarily rather than take a more formal
route to ensure compliance.
