In hybrid meetings, members of the public, Council members, and City staff have the option to attend the meeting in person, in Council chambers at City Hall located at 321 East 5'11 Street, Port Angeles, or remotely via telephone or video link. The Mayor may determine the order of business for a particular City Council meeting. The agenda should be arranged to best serve the needs and/or convenience of the Council and the public. The Mayor will determine time of break. Hearing devices are available for those needing assistance. The items of business for regular Council meetings may include the following: A. Call to Order — Regular Meeting at 6:00 p.m. B. Roll Call, Pledge of Allegiance C. Public Comment The City Council desires to allow the opportunity for Public Comment. However, the business of the City must proceed in an orderly and timely manner. During the "Public Comment" portion of the meeting, individuals may speak to agenda items, except those scheduled for a Public Hearing. The City Council desires to allow the opportunity for Public Comment. However, the business of the City must proceed in an orderly, timely manner. At any time, the presiding officer, in the presiding officer's sole discretion, may set such reasonable limits as are necessary to prevent disruption of other necessary business. At its most restrictive, Public Comment shall be limited to a total of 15 minutes for the first Public Comment period and shall be concluded not later than 9:45 for the second Public Comment period. Individuals may speak for three (3) minutes or less, depending on the number of people wishing to speak. If more than 20 people are signed up to speak each speaker may be allocated two (2) minutes. City Council may set a public hearing in order to receive public input prior to making decisions which impact citizens. Certain matters may be controversial and City Council may choose to seek public opinion through the public hearing process. July 2, 2024 Port Angeles City Council Meeting Page 2 CITY OF PORT ANGELES CITY COUNCIL June 18, 2024 This meeting was conducted as a hybrid meeting. CALL TO ORDER -REGULAR MEETING Deputy Mayor Carr called the regular meeting of the Port Angeles City Council to order at 6:00 p.m. and stated the Mayor had joined the meeting remotely while attending the Association of Washington Cities conference. Deputy Mayor Carr stated she would conduct the meeting due to the Mayor's remote attendance. ROLL CALL Members Present: Mayor Dexter (attending virtually), Deputy Mayor Carr, Council Members Meyer, Miller (attending virtually), Schromen-Wawrin, Schwab, and Suggs (attending virtually). Members Absent: None. Staff Present: City Manager West, Deputy City Manager Goings, Attorney Bloor, Clerk Martinez -Bailey, C. Delikat, B. Smith, S. Carrizosa, D. Sharp, M. Healy, A. Fountain, J. Boehme, and K. Hatton. PLEDGE OF ALLEGIANCE Council member Meyer led the Pledge of Allegiance to the Flag. CEREMONIAL MATTERS, PROCLAMATIONS & EMPLOYEE RECOGNITIONS 1. Proclamation in Recognition of Juneteenth Deputy Mayor Carr read a proclamation in recognition of Juneteenth 2024. Deputy Mayor Carr read from the proclamation and stated the City of Port Angeles has established a Diversity, Equity and Inclusion Committee that embraces and celebrates diversity amongst staff and noted the value it brings to serving the citizens of Port Angeles. LATE ITEMS TO BE PLACED ON THIS OR FUTURE AGENDAS Manager West spoke to Consent Agenda item E-5 Peninsula Area Public Access Extension and removed the matter from the Consent Agenda. There was no objection. Council member Meyer spoke to an upcoming scheduled work session on Neighborhood Associations, and stated the subcommittee needs more time to prepare for the work session and asked that the extension be added to the Consent Agenda for Council approval. PUBLIC COMMENT Gayle Brauner, city resident, spoke about record retention and a police incident report involving a dog. CONSENT AGENDA At the request of Council member Schwab, and after hearing no objection, the Deputy Mayor added J-1 Association of Washington Cities Alternative Response Grant Extension to the Consent Agenda. It was moved by Schwab and seconded by Dexter to approve the Consent Agenda to include: 1. City Council Minutes of June 4, 2024 l Approve 2. Expenditure Report: From May 25, 2024 to June 7, 2024 in the amount of $2, 060, 739. 03 /Approve 3. 2024 Pole Testing, Contract Award (CON-2024-19) / 1) Approve the contract to Pacific Pole Inspection of Kelso, WA, for the 2024 Pole Testing, Contract CON-2024-19, in an amount not to exceed $60, 000.00, including taxes, 2) authorize the City Manager to sign the contract and make minor modifications as necessary 4. International Association of Firefighters (IAFF) Local #656 Collective Bargaining Agreement! 1) Approve the tennis of the IAFF Local 656 collective bargaining agreement as outlined in the nienio and 2) authorize the City Manager to make minor modifications to the agreement as necessary. REMOVED FROM CONSENT AGENDA / Peninsula Area Public Access Extension / 1) Approve Amendment No. 2 to the agreement between the City of Port Angeles and the Peninsula Area Public Access (PAPA) extending July 2, 2024 E - 1 PORT ANGELES CITY COUNCIL MEETING — June 18, 2024 the contract for an additional four (4) years; 2) authorize the City Manager to sign Amendment No. 2 to the Agreement and make minor modifications as necessary. 5. MOVED TO THE CONSENT AGENDA / Association of Washington Cities Alternative Response Grant Extension /Accept the grant offered by AWC in the amount of $234, 000 fog^ enhancement of the Alternative Response Team and authorize the City Manager to sign the grant funding contract, to implement and approve all actions necessary to accomplish the purposes of the grant, and to make minor modifications to the contract if necessary. 6. Neighborhood Subcommittee Extension / Move the meeting fi^on2 June 25 to July 16 /Approve Motion carried 7-0. OTHER CONSIDERATIONS 1. Joint Public Safety Facility Manager West provided background, spoke about a letter sent from the Board of County Commissioners that asked the City to consider removing the west side fire station from the joint project. Manager West spoke about challenges with the fire station, recommend the removal of the fire station from the plan, and provided reasons why this would be feasible, noting reasons, including mention of positive working relationships with Fire District 2 and the 4-minute response time that is currently available to residents. He spoke about infrastructure needs at the location. Before the Council considered the motion on the table, Clallam County Executive Director Todd Mielke and Commissioner Mike French were invited to the lectern to speak to the agenda item. It was moved by Schromen-Wawrin and seconded by Suggs to: Authorize the City Manager to remove the West Side Fire Station from the Site Planning work for the JPSF, contingent that Clallam County commit to jointly fund wastewater utility infrastructure to the site prior to transitioning to the constriction phase of the project. In consideration of the need to move to the public hearing, Deputy Mayor Carr moved to the next item of business, stating the intention was to return to the matter after the public hearing was held. There was no objection from the Council to move to the next item. PUBLIC HEARINGS 1. 2025-2030 Capital Facilities and Transportation Improvement Plan At 6:42 p.m. the Deputy Mayor continued the Public Hearing. Hearing no one in the Council Chambers or individuals attending virtually wished to speak to the public hearing, the Deputy Mayor closed the public hearing. Mayor Dexter conducted the second reading of the resolution by title, entitled, RESOLUTION NO. 07-24 A Resolution of the City Council of the City of Port Angeles, Washington, adopting the City's Capital Facilities Plan for 2025 — 2030, which includes the City's Transportation Improvement Program for the years 2025 -2030. It was moved by Schromen-Wawrin and seconded by Schwab to: Pass a Resolution of the City Council of the City of Port Angeles, Washington, adopting the City's Capital Facilities Plan for 2025 — 2030, which includes the City's Transportation Improvement Program for the years 2025 -2030. Motion carried 7-0. The Deputy Mayor recessed the meeting for a break at 6:56 p.m. The meeting reconvened at 7:03 p.m. OTHER CONSIDERATIONS CONTINUED Deputy Mayor Carr returned to the Joint Public Safety Facility matter. Commissioner French spoke to the matter including approaching deadlines. Public Works and Utilities Director Mike Healy spoke to the Joint Public Safety Facility, clarified his opinion on the matter and supported the Council's motion. Commissioner French spoke to the site needs, project needs, and a separate meeting about infrastructure. CITY COUNCIL REPORTS Council member Schwab spoke about attendance at an Olympic Peninsula Tourism Commission workshop, a Board, Committee, Commission subcommittee meeting, and a City of Port Angeles Comprehensive Plan Kick off meeting with local stakeholders. Council member Schromen-Wawrin spoke about an upcoming Peninsula Regional Transportation Peninsula Organization, and thanked Deputy Mayor Carr for filling in his seat for an upcoming Clallam Transit System meeting. Council member Meyer spoke about a facility tour provided by Director Healy, spoke about the work done by Peninsula Area Public Access and spoke about a name change to North Olympic Community Media, reminded Council about the upcoming Chamber of Commerce Fourth of July community event, and spoke about work being done by the Neighborhood Association subcommittee. Council member Miller spoke about the Habitat for Humanity ribbon cutting, Utility Advisory Board meeting cancellation, shared she has been voted as vice -chair for the Homeless Taskforce committee, spoke to attending the upcoming Clallam Transit System meeting. Council member Suggs spoke to attending an Aqua Culture subcommittee meeting of the Marine Resources Committee meeting, and the Council excused absence from the June 4 City Council meeting in order to attend a cultural event. Mayor Dexter spoke about the Dream Playground ribbon cutting event. Deputy Mayor Carr Dream Playground opening, a reading event, North Olympic Development Council meeting, shared a congratulations for graduates of 2024, invitation to Port Angeles Pride on the Pier festival. No other reports were given. INFORMATION Manager West spoke about the Dream Playground and the volunteers, City departments, and announced there would be no June work session and spoke to an addition of a Strategic Planning meeting in July. SECOND PUBLIC COMMENT Karl Hatton, residing outside the city and a City employee, spoke to the Joint Public Safety Facility discussion. Gayle Brauner, city resident, spoke about police record retention and spoke about a submission into the City Council record that evening. Glen Barbiari, city resident, spoke about his time in the Navy, nuclear reactors, and political discussions. Ileana Murphy, city resident, spoke about challenges at the Senior Center. Jack Carlson, city resident, spoke about Westport, salmon, and fishing. Gary Martin, spoke about challenges at the Senior Center and presented the Council with talking points. Lynn Ilon, city resident, spoke about challenges at the Senior Center. David Brewer, city resident, spoke about challenges at the Senior Center. Abigail Martin, spoke about a package being delivered at the wrong location. After Council approval a dramatic cost increase made the procurement of a fully electric forklift less prudent as opposed to the propane powered model. Through the City's membership with the Washington State Purchasing Cooperative, participating vendor Pape Material Handling of Spokane, WA was selected from the cooperative vendors list, Contract No. 06115, for this recommended procurement. Funding: This equipment replacement is identified in the 2024 budget (501-7630-594-6410) through the approved 2024-2029 Equipment Services Capital Facilities Plan in the amount of $68,200.00. Recommendation: 1. Rescind the action of February 20, 2024, and approve the purchase of a new Light Operations Division forklift that is the functional equivalent of existing vehicle 9148 from Pape Material Handling for an amount not -to -exceed $43,100.33, including tax and accessories. 2. City Council rejected bids on July 18, 2023, for this chip seal project where the low bid was $765,453.00. The City has worked with Clallam County to purchase chip rock under a separate contract and revise project specifications to reduce project costs. Notice of this bid opportunity was advertised through Peninsula Daily News and Builders Exchange of Washington on May 10, 2024, and posted to the City website. On May 30, 2024, one bid was received and opened with Doolittle Construction of Snoqualmie, WA being the lowest responsible bidder, in the base bid amount of $487,032.00. His response was disrespectful and insulting. He told me he wasn't going to use Staff time to talk about my "minutiae" reports, like I did on PSAB. He denied any misconduct or cover up in regards to this incident (P 16-17) [F 61 and told me I was irrational, a telling comment of his perspective - extracted from our 19th century history when women had no rights and were subjected to all manner of put downs and horrific abuse. But then, he's from Forks, growing up believing in Sasquatch and imagining Vampires in the woods, both irrational imprinting. [F 1,2,3,6]]. Thank you for your advocacy to ensure all facts, perspectives, and documentation are included in Police reports and Public Records, and that people who commit crimes are held accountable. I know you understand how important it is for us residents to feel safe living in Port Angeles. You know that when we are harmed by other people, that the Police must treat us equally and in good faith hold the perpetrators responsible. It's essential that Police do not cover up their mistakes. Footnotes. [F- 1 ] I learned in January 2022 that this incident wasn't listed as a `case' and it did not include a usual report narrative. That's when I submitted a Letter on 8/26/2020 to Chief Smith adding my experience in the encounter. 1p�,,12 (P 9-1,0). When I inquired more, I was told that not all incidences included full reports because Police received lots of calls, and that the Police had to witness a speeding incident. According to the law - the facts of this case - ,the assessments made by Officers were deficient. They made mistakes. Further, Police management would not correct these mistakes. Thus justice did not prevail. When residents report dangerous speeding, when a vehicle is used to chase down and intimidate pedestrians, and a road -enraged person commits harassment and verbal abuse, we need fair treatment! Residents should not be expected to be pusillanimous when faced with malicious criminal behavior in our neighborhoods. [F 2] The report erroneously states that the reckless, aggressive driver and I were `mutually at fault.' When I saw him speeding up Vine Street where I was walking, I gave him the general palm down, wave back and forth motion to `slow down' and said `slow down' out loud. This is a normal cautionary gesture used by pedestrians to remind speeders to care about other people and that speeding in residential neighborhoods is dangerous. It was an act of my civic duty. I use this `wave' often while I am walking in town to remind speeders. I did not cause the crimes that this road -enraged, hot-headed driver decided to commit. I did not use his pickup to speed in al mph limited sight hilly neighborhood; nor did I endanger neighbors by gunning his pick up and recklessly driving through right of way intersections; nor did I use his truck to make a screeching u turn in the middle of the road, race downhill to use his vehicle to block my path as I was walking home; nor did I talk through his mouth to start verbally antagonizing, insulting, and trying to intimidate myself and the two witnesses. I did not force him to state, "I'm an EMT and I will never be charged with speeding," nor did I tell him to yell at the two witnesses, "You must be Democrats!" I didn't operate his voice to call me a fucking bitch. He chose to do all these behaviors, these crimes. (P 11-12 ). Did this evidence have any bearing on Police management or Officers? I did assertively defend myself verbally, calling out the perpetrator's nasty behaviors and verbal tirade. I was told by an Officer at one point in conversations that calling me a fucking bitch is not a crime. I assume then that telling the hostile speeder to shut up and flipping him off when he called me the above epithet are also not crimes. I was letting him know that his intimidation tactics and violent behavior were going to be met with equal resolve to defend myself, which is my right! The next time he thinks about running down a woman with his pickup, he might hesitate. Let's hope so. [F 3] It's important to know if Officers had bias and prejudice in this case. I became concerned that some Officers may have had prejudice because of political party and male bias; that experienced Officers influenced rookie Officers in the decision to not fill out a report narrative or charge the perpetrator with crimes. A bias may also have been age related, me a female over 70 (and the witnesses both older women), and the perpetrator, who the Officer called a "young man". The perpetrator declaring himself to be an EMT may have been a factor, as some Officers may have `closed ranks' to support a person they deemed a part of their Police fellowship. Officer Rife, after interviewing the perpetrator, gave me a message from him stating that I should stay out of his neighborhood! I asked Officer Rife if he told the perp to stay out of OUR neighborhood. He did not. I asked Officer Rife to tell the perp he must stay out of our neighborhood. Officer Rife told me that he doesn't deliver messages between people. This is an example of Officer Rife's double standard partiality. [F 5] Now I will comment on why I speculate that these two cases (Case # 2019-00006750 (4/18/2019) — hostile dog owner and vicious dogs off leash — I gave to Council last meeting ) ( AND 2020-00014428—(8/19/2020) Traffic Complaint/Reckless Driving in Neighborhood, harassment by driver) may have contributed to the animosity and insults directed toward me and attempt to expel me during my three-year term on the Public Safety Advisory Board. I include a list of possible contributing factors. 1. The Officer involved in both cases listed above also made decisions which may have affected me and my rights, such as refusal in 2023 and winter 2024 to allow my participation in Police ride -a -longs. The Police Chief told me that a Police supervisor made this decision. No reasons were given to me. 2. My inquiry about Independent Investigative Teams/KCIRT and belief that PSAB is not the correct body from which to select the impartial, non -law enforcement community members to our City's IIT. 3. My concerns expressed to Chief Smith about the display of what Iconsidered a sensationalized video produced by an ex Sheriff in WA State on the Port Angeles Police online page. This Sheriff was involved in a deadly force case resulting in a $2 million settlement to a family from the City of Arlington, WA. He also would not support or enforce the State wide Covid 19 guidelines for State employees in his jurisdiction. 4. My difference of opinion with the Police Chief on some State law enforcement reform bills. 5. The City Clerk pressured me to resign from PSAB and said I wasn't a `good fit,' after I sought assistance to help the Board to become more functional and to follow parliamentary rules/procedures, and generally my proactive involvement to expand the participation of Board members in various ways, 6. My disagreement with how law enforcement in June of 2020 handled the case of the vacationing Spokane family in their white bus when local Forks people menacingly harassed them, committing a hate crime, and causing the vacationers' rights to be violated. I expressed my concerns to Deputy Chief Viada about the investigation, who is from Forks. 7. My involvement during the Covid 19 epidemic as an advocate for two Sequim business owners who were not supported by a County Deputy Sheriff after being violently harassed and threatened by an angry-anti-mask-Covid 19 pandemic -denying customer, and my advocacy to ensure the attacker and the Deputywere held accountable. 8. I'm a liberal Democratic feminist, who is honest, caring, assertive, determined with reasoned stances. This representation is apparently very scary to some people. [F 6] In most cases, Police want to know all the details when investigating incidences/cases, to guarantee they make sound judgments and fill out reports accurately. Council and Staff now also need to know these details. I ask for an investigation to ascertain why this incident was not handled correctly- led by the crime it was - and to clear my name of being `mutually at fault' when I reported it. I have come to the conclusion that there was/is a cover up of this reckless driver incident. [F 6 cont.] I've tried to work through the system, privately. I spoke with Deputy Chief Jason Viada on 6/27/24. He stated he would not meet with me, only speak on the phone; to not take up any more time which would burden Staff with my "minutiae" as I did on PSAB, as he put it. This is the first time I heard this criticism. That statement is revealing, indicating Police scrutiny of my participation on PSAB. It may also indicate the possibility of involvement by Police management to limit my free speech rights and then to try to get me expelled when I expressed opinions and topics of discussion with which they didn't agree. When things got tough on PSAB, I thought it important to document and present to Staff and Council important occurrences and facts for everyone to know. [F 6 cont. ] I felt astounded by Chief Viada's repeated insults during the above phone call. He called me `irrational,' dismissed the facts and tried to discredit me personally rather than to focus on the specific crimes that were committed and the concerns raised about Officers not charging criminals. He said Officers used their discretion to not charge this perpetrator because there were conflicting stories. This was the first time I heard this excuse. When I brought up the witnesses that saw it all, he refused to acknowledge the importance of eye witness accounts that collaborated mine. In the incident report (P 8), two officers stated that there was no crime committed indicating they did not know the laws. I asked Deputy Chief Viada, at the very least, to make sure Officers know the crimes stated in RCWs and City Ordinances related to using one's vehicle to chase a pedestrian down ( P 9-10) and endangering the people in our neighborhoods. [F 6 cont] In my letter to Council about Case# 2019-00006750, in which I was also accused of being at fault, it's reasonable to request an investigation to determine if bias and prejudice have been factors in decisions made by Officers on these cases. If perpetrators are recipients of the benefit of bias and prejudice, then they are emboldened. Laws and accountability are meant to let guilty perpetrators know that their violence will not be tolerated. Needless to say, I am extremely disappointed in Police management's unwillingness to revisit these two incidences and to open them up to transparent scrutiny. Briefly — what happened (most listed below). The guy (name unknown) sp ed up Vine St toward cross street 101h Street. No sidewalks there. I gave him the hand movement of "slow down". He whipped his truck around, came toward me, blocking my way, and angrily and aggressively started shouting at me that he was not speeding. Two of my neighbors approached and confronted him, stating they saw it all. Because he started arguing with them, I was able to get away, get my phone, call 911, giving them his vehicle license plate #, vehicle and personal descriptions. 2. I Called 911 - An officer went out, couldn't find the Pickup, called me and told me. 3. I drove around the neighborhood that day for about a half hour, looking for his truck, and the next morning, finding it at 608 E. Whidby St., a big, yellow house just north of Lauridsen. 4. I called the police station to tell them the vehicle license #. Corporal Right went to the guy's house, talked to him and called me. 5. My conversation with Corporal Right — highlights and my perspective/recollection. a. Corporal Right told me the guy was up set/mad. I told officer "Now you know what he's like". b. Corporal told me I provoked the guy. We discussed who provoked whom. I said the guy provoked MENUS by whirling his vehicle around, speeding down the hill and trying to intimidate me with his truck and loud, aggressive shouting. My response to the guy was "self-defense", to show the guy that he could not intimidate me. He yelled he wasn't speeding. I pointed to a sign of 15 mph, tried to tell him it is a blind hill, but he interrupted, stating it was a school zone and since there is no school, that it didn't apply. (There is no school zone there, and the sign is to alert about limited visibility. It's a gold -yellow sign, not white.) He was shouting a bunch of other stuff which I tuned out, realizing it was fruitless to have a discussion with him. I told him to shut up. The guy called me a f--king b.... and walking, away, I flipped him off. By that time, I had gotten clear of his vehicle and headed to my house to get my phone because 2 neighbors stepped up to him to support me and started talking/arguing with him. I heard them tell him they saw him speeding. c. Corporal Right, calling the guy a "young man", told me the guy asked the officer to tell me to stay away from his house. I was rather stunned, and didn't know what to say, as of course, I wouldn't stalk the guy. Now, I realize that Corporal Ri t didn't, apparently, tell the guy to stay away from Vine Street, or our neighborhood. Did he? If not, I'd like Corporal Right to v back, without sympathy and very firmly, to the guy, and tell him to stay out of our neighborhood. I would also suggest he tell the guy that his anger cannot dictate his inappropriate reaction of harassment towards others, and why. I want to know if Corporal Right or another officer did go back and set these limits and expectations with this guy. d. I think this is an opportune time to educate this guy, to help him see he was wrong to harass; that he needs anger management counseling; that he can be a decent, resp ectful human being if he learns from this mistake and analyzes his behavior. An apology would be nice. I think he shouldn't be an EMT with these issues and also his prejudice against Democrats — (he told my two neighbors he is an EMT and that "you must be Democrats".) Would he not help a Democrat in his position as an EMT (if indeed he IS an EMT)? Does he go around the neighborhood looking at people to see if he thinks they are Democrats and making a point to harass them? Does he do this to people of color, the homeless, or others whom he may not like? e. If he is allowed to get away with this mistake, and thinks he has the sympathy and support of the p olice, I think he may continue to act out in this aggressive, mean, and wrong way. f. The police have ongoing training. The issue of who is a provocateur, how "issues" are triggered, and who is "to blame" for one's angry, hostile, harassing behavior, may need to be developed and/or reviewed. Also, the issue of self-defense and standing up or oneself, whether verbal or physical, may need to be re -visited. Please know, I support those who dedicate their lives to law enforcement. I appreciate you all, so much, and the sacrifices you must make to do this job, the important role you play in our community to keep us all safe and responsible, and the difficult situations you are often placed. KHatton — "Male driver, high rate of speed. RP indicated he should slow down. Subject sped up, drove to top of hill and came down and harassed her ... He said is an EMT and no one can stop him from driving that fast. 8/20 Of. OJohnson — added details and reiterated account to above. Q?—What is the implication "RP admits she got in a verbal dispute with the male". Also, is it typical to use gender identification, as "the male"? Or does this indicate implicit bias? Q — Did Police know the address prior to me giving them it? Did they know his name also? If so, why didn't they visit Robert Falkoski before I called in his address? Etc. 8/21 Of. Rife — I didn't receive the police report of him calling to tell me about his interview with Jalkoski. A report would indicate what he said to me and that he interviewed the "angry" perpetrator. He also relayed a message to me from perpetrator to stay out of his neighborhood. This Jan. when I talked to OF. Rife about this case, I asked why he didn't tell Jalkoski to stay out of our neighborhood. Of. Rife stated that he/Police don't relay messages between people, a direct contradiction. Did Of. Rife NOT file this interaction with me? Or did records accidentally not email it to me with the rest? I believe Of. Rife may have bias — political and towards women, favoring male dominance/privilege. Please see article about emotional labor. I also have a concern that Officers with more experience, older will influence younger, newer officers in a negative way, and may cause the less experienced officers to develop bad habits or attitudes. I think that I have a duty to pursue this particular case, as a common example of malevolent actions directed at members in our community by angry, self-righteous people, and with the intention to protect the culture of our police force from misguided actions. I would like to have an inquiry into the reasons an officer(s) - and which officer(s) - classified this incident as not a crime.. I would like this inquiry to include whether Of. Rife, one of the reporting Officers in this incident, or any other Officer, influenced the decision to classify it as not a crime, the reasons, and to challenge his labeling of it as a "mutually at fault" incident. I want to know the outcome - and remedies taken - of this inquiry. At least 4 crimes were committed by Robert Falkoski in this incident. Rife does not understand that a person may show civic responsibility in her community by reporting speeding or any other crime; and/or he doesn't understand that women have a right to stand up for themselves, even defend themselves, when they are threatened. There isn't a way for me to find out if this person has committed other crimes. Do you know if he has? Occurred on August 19, 2020 — Vine St. residential area Date: March S, 2022 I emailed a concern about the above speeding/reckless driving/harassment case on 2/10/22. I'm following up after discussing it with Chiefs Smith and Viada. I've included Officer Rife in this follow up as I want him to call or meet with me to apologize for stating that both me and the perpetrator, Robert Falkoski, were "mutually at fault," which I consider an irresponsible and unprofessional communication. Officer Rife may have been responsible for the incident to be dropped and the perpetrator not to be charged with any infraction or crime, because Office Rife may have biases which interfere with his duties. He may have influenced other officers involved in this incident to likewise not consider it seriously. To apologize to me, Officer Rife will indicate that he understands that the perpetrator, on his own volition did: speed in a residential area; decide to emotionally overreact to a simple hand gesture to "slow down"; decided to recklessly accelerate speed and erratic driving, endangering anyone who might have been walking or driving on Vine Street; further, he recklessly turned around his Silverado pickup (license *C96443S) and used it to obstruct my path to intimidate/harass me; initiated a verbal conflict with me and two of my neighbors who told him they had seen the whole thing that he did; blamed us for the encounter, stating "you must be Democrats" for asking him not to speed and holding him accountable, showing an unsubstantiated and unreasonable bias and perhaps mental instability; told us that he was an EMT and so the Police wouldn't do anything to him (Did this prove to be true?). Further, after I contacted the Police to give them the perpetrator's address, Officer Rife went there and spoke to him. Officer Rife called me to tell me of this visit. He appeared to take the perpetrator's side. He relayed a message from the perpetrator to me to stay away from his residence/neighborhood. I asked Officer Rife then, and again on a phone call I initiated to him this past winter, why he didn't tell the perpetrator to stay out of our neighborhood, since he is obviously a danger to us. Officer Rife said it was not his job to "relay messages." In our last conversation, Officer Rife told me that he considered us both to be "mutually at fault" and persisted when I challenged the irrationality of his conclusion. Even though afraid, I stood up to the perpetrator AFTER he committed his offenses. Officer Rife appears to think self-defense is a problem. To me, Officer Rife's obvious biases (appear to be against Democrats and not supportive of older people, women who've been victimized) supported and allowed the perpetrator to suffer no consequences for hostile, aggressive, dangerous behavior. What message did this send to the perpetrator? As of February 2022, Robert Falkoski's truck was still parked at the 6o8 E. Whidby Avenue address. I decided to pursue this case after listening to several local people, hearing that in Port Angeles and Clallam County, many illegal, harmful incidents against residents are occurring, but residents feel they are not able to get protection, to feel safe in our own neighborhoods. I understand that incidences are prioritized starting with 911 services and then by Officers' judgement given the limited resources of personnel, time, funding, prosecutor's office limited acceptance of cases, etc. Somehow, we need to find ways to make sure that perpetrators of aggressive, hostile, intimidating and violent behaviors are held accountable and receive consequences. When Officers discount residents' concerns and violations against us, then trust in our legal and police systems are diminished and can be lost, causing disillusionment. Here is a list of some RCW violations (and penalties) and Port Angeles ordinances committed by Robert Falkoski on Aug. 19, 2020, in our neighborhood. 1. Port Angeles Ordinance - 11.18 — Interference with pedestrians on public sidewalks. AND - PENALTIES: (4) A person found to have committed negligent driving in the second degree with a vulnerable user victim shall be required to: (a) Pay a monetary penalty of five thousand dollars, which may not be reduced to an amount less than one thousand dollars; and (b) Have his or her driving privileges suspended for ninety days. AND: (11) For the purposes of this section: (b) "Negligent" has the same meaning as provided in RCW 46.61.525(2). (c) "Vulnerable user of a public way" means: (i) A pedestrian; AND: RCW 46.61.500 Reckless driving —Penalty. (Effective until January 1, 2022.) (1) Any person who drives any vehicle in willful or wanton disregard for the safety of persons or property is guilty of reckless driving. Violation of the provisions of this section is a gross misdemeanor punishable by imprisonment for up to three hundred sixty-four days and by a fine of not more than five thousand dollars. (2)(a) Subject to (b) of this subsection, the license or permit to drive or any nonresident privilege of any person convicted of reckless driving shall be suspended by the department for not less than thirty days. (b) When a reckless driving conviction is a result of a charge that was originally filed as a violation of RCW 46.61.502 or 46.61.504, or an equivalent local ordinance, the department shalt grant credit on a day - for -day basis for any portion of a suspension, revocation, or denial already served under an administrative action arising out of the same incident. During any period of suspension, revocation, or denial due to a conviction for reckless driving as the result of a charge originally filed as a violation of RCW 46.61.502 or 46.61.504, any person who has obtained an ignition interlock driver's license under RCW 46.20.385 may continue to drive a motor vehicle pursuant to the provision of the ignition interlock driver's license without obtaining a separate temporary restricted driver's license under RCW 46.20.391. (3)(a) Except as provided under (b) of this subsection, a person convicted of reckless driving who has one or more prior offenses as defined in RCW 46.6'1.5055(14) within seven years shall be required, under RCW 46.20.720, to install an ignition interlock device on all vehicles operated by the person if the conviction is the result of a charge that was originally filed as a violation of RCW 46.61.5021, 46.61.504, or an equivalent local ordinance. (b) A person convicted of reckless driving shall be required, under RCW 46.20.720, to install an ignition interlock device on all vehicles operated by the person if the conviction is the result of a charge that was originally filed as a violation of RCW 46.61.520 committed while under the influence of intoxicating liquor or any drug or RCW 46.61.522 committed while under the influence of intoxicating liquor or any drug. It's difficult learning how to access and find the RCWs which might apply to cases and incidents. I've covered some of my main concerns with the above ordinances and RCWs which I found after several hours of searching. I hope my effort will lead to future consequences for perpetrators of these types of offenses, no matter who they are, and that victims of these perpetrator's actions are not blamed or ignored. We have been concerned about a simple thing, painting markings on the street and the curb to help people when they are parking their cars in front of our businesses. After we contacted the business owners last week the mutual consent was that it was much needed - long overdue and would help get more cars parked on a regular basis in each block. These marked parking spaces not only help the younger generation like our brand new teenage drivers, but would considerably help our elderly senior citizens. This is not a huge task to paint lines, .but will make a better impact on parking for our local business owners. Plus, it makes our downtown look more attractive. Angeles. In my 2014 letter I stated the alleys were in bad shape up to Race Street. However it extends much further to the East and also North of Front Street — pretty much all of our alleys in Pt. Angeles. While in the city manager's office talking to Kari, I was introduced to Linda Gunderson, as she had just walked in the office for a moment. Linda is Craig Fulton's assistant and since my concerns to the city were regarding our roads, we were introduced. After talking to Linda, I was thankful that Kari has introduced us. Linda gave me a better insight as to why our alleys are in such sad shape. It's all about a lack of money available for that project, she stated. Linda also assured me that our city leaders were very aware and concerned about our town's alleys and had not forgotten about them. Our May 2014 letter to the City Manager stated that we had spoken to the Road Department about our alleys and painting spaces on our downtown streets for parking. In 2012 1 had approached that office regarding these issues. So that was 2 years ago since we first contacted the city with our concerns. I am wondering how much longer before that our alleys were in need of repair. Are alleys classified as roads of travel or are they under another category? We feel that spending our money on beautifying our city should be prioritized to include our neglected alleyways and marked parking spaces. As part of your request you passed along two cases (Ross and Wilkinson) cited by individuals who appear to disagree with the City's implementation of FLS requirements in general. The individuals believe the cases are persuasive evidence against such an implementation. They are not. The FLS requirements and checklist are well within the powers of the Director of CED to create and enforce. The power to do so has been conferred by state law onto the City and further given to the Director of CED by the City Council. The Director through his designee has used appropriate and well -respected authorities to produce those requirements. Opposition to the requirements would have to show the determination was contrary to law and/or arbitrary. They have not done so. The Ross and Wilkinson cases are not relevant to the issue of the City's implementation of FLS requirements. In Ross the suit involved homeowners within a subdivision suing another homeowner over an alleged violation of the subdivision's restrictive covenants relating to short term lodging. The Wilkinson case is a dispute between a Homeowner's Association and individual homeowners following the HoA's amendment of its "community covenants" relating to how long members could rent out their homes to visitors. Besides the obvious fact that neither case concerns issues of FLS, the scope of each case is limited to matters not relevant to a City. Both cases involve the covenants buyers agreed to when purchasing homes within housing developments. Such arrangements are contractual in nature and not related to public safety. Most notably, the covenants at issue in these cases are between private individuals and private entities, not a municipality. Because the City of Port Angeles is a code city of the State of Washington, different considerations apply. As a code city of the State of Washington, Port Angeles retains the right to make laws on any matter that the State legislature has not expressly withdrawn from the City. Additionally, Washington state laws expressly grant to the City "police powers," which are its powers to protect the health, safety and welfare of the people within its boundaries. The FLS requirements codified by the City fall squarely within these police powers. In accord with the authority of the City to make laws protecting the health, safety and welfare of the people, the City has enacted PAMC 17.23.030 and 17.24.030. In section C of each of these chapters, City Council has given the Director of CED (or his/her designee) the authority to "implement, interpret, enforce and make Director's determinations for any section of this chapter and any other applicable PAMC chapters." This allows the Director to determine the requirements of the STR program, so long as those requirements do not violate what already exists in the PAMC or other relevant law. Language allowing such determinations is often included in legislation because a legislative body, like the City Council, cannot possibly legislate every conceivable issue that arises surrounding a topic like STLs. So long as a Director's determination does not violate federal, state or local laws that determination must be followed. In the present case, the Director, via Shannen Cartmel, has determined that in the interest of protecting residents and guests of STLs, an FSL scheme as described in a checklist is necessary. Such a determination is perfectly reasonable and not contrary to law. Authority to create a Director's determination alone may not be sufficient to sustain the determination. As I note above, a determination must also be reasonable, or put another way, it cannot be arbitrary. In the case of the FSL requirements, the City can easily argue its actions were not arbitrary. Besides the previously discussed police powers of the City, under which regulation of FSL issues are clearly implicated, the City has turned to the International Building Code (IBC) and the International Property Maintenance Code (IPMC) for guidance on formulating what items appear on the FLS Checklist. The IBC and IPMC are nationally recognized and followed authorities on all manner of building construction and safety. The IPMC is such a strong authority, the City has expressly adopted it in PAMC 14.09.010. Additionally, in 14.09.020 the City states that it has done so "as an exercise of the City's Police power for the protection of the health, safety and welfare of the general public." As for the IBC, while the City has not expressly adopted it, the City has adopted the Washington State Building Code, RCW 19.27, and that code adopts portions of the IBC while being influenced by the IBC throughout. As such widely recognized, and adopted, authorities, the IBC and IPMC are excellent models for the Director to use in formulation of the FSL requirements. Much like the Director's determination itself, the requirements taken from the IBC and IPMC will withstand a challenge unless the challenger can point to specific requirements that violate the law.
