Based on the site plan submitted by your contractor and revised on November 7 2008, I confirmed this afternoon with
Public Works and Utilities, that your proposal to re orient a proposed garage structure north /south (facing the alley) from the
proposed east/west orientation would resolve setback issues identified in past correspondence. The re orientation will result
in the driveway being at least 25 of a marked or unmarked pedestrian crossing and /or 25' of intersecting right of way lines as
is required per the City's Urban Services and Standards Guidelines (Curbed Street Driveway Location). Per Chapter 3
Transportation, of those same standards, the 'abandoned' driveway access shall be closed. This certainly doesn't preclude
use of the rear of the site, just not through the depressed curb opening. To be sure we are all on the same page, please note
the following issues in your final planning:
1 The interior (west) side setback shall be no less than 3' from the property line, with setback from the north property line
(alley) no less than 10'
2. The driveway to the new structure shall be no less than 25' west of the side property line abutting
Peabody Street. The curb cut from Peabody Street shall be removed and replaced to full curb height prior to final of the
building permit.
Please let me know if you have any questions about this information. I hope that you are now able to continue with your
planning to enjoy your new garage. Once you present a plan identifying these changes, I believe the building permit can be
issued in short order

Dear Sue,
Thank you for your letter dated December 8, 2008, outlining the rationale for discontinuing use
of the driveway that served the parking area on the referenced property When I spoke with Steve
Sperr on December 4, I assured him that I no longer contested this restriction and was
prepared to submit a new site layout for the garage. However, I also told him that in order to
revise my plans I needed a complete list of all the criteria I have to meet for the permit to
be approved, and, since multiple city departments were involved, I thought a coordinated
list of requirements should come from the permitting department. He said he would
communicate that to the Building staff.
As you may recall, I initially came into the Planning Department last Spring to discuss whether I
would need a vanance to construct this garage. At that time you told me if I could locate ten feet
from the alley and twelve feet from the power pole, a variance wouldn't be necessary Based
upon that information, I decided it was do -able and chose not to pursue a variance from the
setback requirements. The first plan we submitted met those setbacks, but the dnveway was an
issue. We submitted an alternate plan showing access from the alley, then someone mentioned to
my contractor at some point that something had to be sited 25 feet from the sidewalk. All of this
permit- related communication from the City has been verbal with nothing spelled out in writing,
which we know can lead to misinterpretation or confusion.
Although your letter responded to my dnveway issue, as yet I still do not have a
comprehensive list of the setbacks and standards I am required to meet and that is what I
really need in order to move this project forward. I want to ensure that the next plan we
submit is the right one and that the permit can be issued without further delay I look forward to
your response. Please do not hesitate to call me if you have any questions or need clarification.

You recently applied for a building .permit to construct a garage at the above noted property
but were informed that access from Peabody Street to the new garage would not be
permitted. As a result of your November 14, 2008, letter regarding the City's review of the
building permit, City Engineer Steve Sperr further reviewed the matter but continues to
require that access to the new garage from Peabody Street be denied because the proposal is
in conflict with the City's development standards and policies, specifically Section
3B.140.A.11 Dnveways and Section 3B.140.B.1. Dnveways on Arterial Streets standards of
the City's Urban Services and Standards (attached for your review) On that note, please be
aware that no one is doubting your word that you have used the curb opening from Peabody
Street for the time you have owned the property However, the garage that prompted use
from Peabody Street was demolished in 1996 (by you), and there remains no structural need
for continuation of that nonconforming access at this time. Your neighbors access rear
property areas from the alley and no physical impediment exists to use of the rear of your
property from the alley It is standard procedure, and good development practice, to
eliminate rather than extend nonconforming uses whenever. possible. In this case, closure of
the curb cut and use of the site from the alley is in align with well established development
standards.
I know that this information is not what you were hoping to hear, but the matter has been
reviewed and found to lack merit for an exception. I hope that you will be able to move
forward with your plans quickly by redesigning the approach to the garage as required to
move forward.

11 Dnveways shall be separated by a minimum of 15 feet and shall be no closer than 7 1/2

In this case the dnveway is adjacent to an alley and closer than 7 1/2 feet.
DRIVEWAYS ON ARTERIAL STREETS
1 Dnveways on artenal streets (which Peabody Street is) shall be no closer than 75 feet
(measured along the artenal) of any other such access, including access on the opposite
side of the street. Artenal access may be located directly opposite each other
In this case the dnveway is adjacent to an alley and closer than 75 feet.
2 Dnveways giving direct access onto artenals may be denied, if alternate non artenal
access is available.

100 feet) the crest of a hill.
Therefore, I do not recommend allowing the dnveway to be used with the construction of the new

During your review, you determined that the existing driveway proposed for ingress/
egress to the new garage was unacceptable and should be restored due to the following
municipal code
11.08.150 Additional Specifications Driveways Restoration
"Whenever an existmg driveway is abandoned, relocated or ceases to be used as a
driveway the curb opening provided shall be restored to normal curb height in a
manner satisfactory to the City Engineer
This driveway served a garage on this property for decades. In 1996, I demolished the
garage for several reasons (proximity to the utility pole, encroachment over property line,
dilapidation, and public safety issues related to runoff) and created a pervious parking
strip in its place. For the fourteen years I have owned this property, I have used that
driveway for left -turn ingress from Peabody Street to both the garage and the
parking strip. I have never abandoned it or ceased to use it. In August of this year, in
preparation for building a garage, I sold the red truck that I had parked on the site, but
even on the last day I owned the truck, I used that driveway Except for the need to
prepare the area for building, it would still be used and my intent has been to
continue using it.
A survey of dnveways on Peabody between Lauridsen Blvd. And 7 St. shows several
similar driveways; some have obviously been improved, some are perhaps abandoned,
and with some it is difficult to tell whether they are being used or not -only the property
owner knows for sure.
The final points I want to try to make with you are these: I want to build a simple garage
to replace the one that I demolished and to access it in a similar manner, and I believe I
have met the City's requirements. It is not a large or complicated project that should
require considerable review or conditioning or variance, except as the City of Port
Angeles is somewhat arbitrarily making it so I should not be required to meet standards
that have not been applied to anyone else on the street, nor should my truthfulness be
questioned. I request that you reconsider and allow the garage to be sited as
originally proposed, with continued use of the Peabody St. driveway

A. GENERAL See the applicable Standard Detail Drawing(s) in the attached Appendix to this Chapter for more
information on requirements for installation of driveways In addition the following shall apply
1 All driveways shall slope upward from the gutter to the back, or property side of the sidewalk at not less
than 1/4 inch to one foot. The curb height at a depressed driveway shall be flush with the gutter
2. All abandoned driveway areas on the same frontage shall be closed by removal of the depressed curb
gutter and sidewalk or the shoulder and ditch section shall be restored to adjacent improvement
conditions.
3. In curbed areas, all driveways shall be constructed of concrete and shall be subject to the same testing
and inspection requirements as curb gutter and sidewalk construction Use of exposed aggregate or
other non standard finish (including colors or dyes) within the public right -of -way shall not be permitted
for driveways
4 In areas without a curb either an asphalt or concrete driveway is permitted subject to the applicable
Standard Detail Drawing(s)
5 Joint -use driveways serving two adjacent parcels may be built on their common boundary upon formal
written agreement by both property owners and approval of the City The agreement shall be a
recorded easement for both parcels of land specifying joint usage.
6 Grade breaks including the tie to the roadway shall be constructed as smooth vertical curves. The
maximum change in driveway grade shall be 8 percent within and 10 feet of distance on a crest and 12
percent within any 10 feet of distance in a sag vertical curve.
7 No commercial driveway shall be approved which requires backing onto the sidewalk or street.
8 No driveway apron shall extend into the street further than the existing or proposed face of the curb
9 Driveways at intersections shall be located as far as practical from the corner In no case shall the
driveway be located closer than twenty -five feet of a regular crosswalk area at an intersection or other
designated crosswalk area.
10 No driveway may be located so as to conflict with power poles street lights, fire hydrants, or other
above ground public facilities
11 Driveways shall be separated by a minimum of 15 feet and shall be no closer than 7Y2 feet from the
property line.
12 Culverts for driveways are required when street is not improved with curb and gutter Culverts shall be
12 inch diameter 30 foot minimum length with 3 1 beveled ends

2. No driveway access shall be allowed to an arterial street within 150 feet of the nearest right -of -way line
of an intersecting street, except where one way streets may be involved
3. Within the limitations set forth above, access to arterials streets within the City shall be limited to one
driveway for each tract of property separately owned Properties contiguous to each other and owned
by the same person are considered to be one tract.
