Hi Dan,
Please see attached letter per our discussion. I searched for, but, could not locate Debbie Rutherford's email address. I
am hoping you can pass the attached PDF on to her.
Since I have not had the opportunity to discuss this with the property owners nor do I have their contact information, I
do have additional information I would like passed along to them.
Specifically, the purpose of my attached letter is to assure the lender of the future developability and legality of the
property as it exists. That said, it is very important that the owners and/or prospective owners take the time to read and
comprehend Port Angeles Municipal Code section 17.95.030- Nonconforming building or structure. If they have
questions they are welcome to contact the Planning Division of my Department at the City.
If for any reason this letter does not work for the lender please let me know.

Dear Ms. Rutherford:
On September 21,2015 I had a conversation with Dan Blevins of Coldwell Banker Uptown Realty
and I wanted to follow up on that conversation clarifying zoning code details as they relate to 138
West 13t'Street. The City has no issue with the current use of the property as a duplex, as it has
been found to be a pre-existing nonconformity.
Considering the pre-existing status of these units,they are considered legally existing non-
confonning structures. The City does not actively seek to bring such structures into conformance
unless the structures are destroyed beyond 75%of their assessed value. In such a circumstance,
redevelopment options are still supportive of a two unit structure on the property. More specifically
the Residential Single Family RS-7 zone in which this property is located is one of the more flexible
City zoning standards. This zoning would allow redevelopment of the structure into a primary and
accessory dwelling unit with a fairly straightforward permitting process.
I hope this helps to clarify the flexibility to development and redevelopment of the subject

Purchased from Pat Murphy in 1977. His wife and her sister were the Audetts who
owned a hotel across from the library on Lincoln Street. After they had sold the hotel
they moved the house up to Oak Street and added the apartment downstairs.At the time
we bought it some Coast Guard Officers were renting the downstairs apartment and Pat
Murphy lived up stairs.
We never lived in the house and all ways rented both the top and bottom floors to other
people. We sold the house in about 1979 to Chip and Judy Tyner(not sure this is the
correct spelling.) After Chip died in about 1990 Judy needed to sell it and my friends
Jan and Judy Jacobson bought it as a tax exchange and continued to rent it as a duplex.
They eventually sold it to Mark DeRousie. I'm believe it was also always used as a
rental duplex during that period.
