To Whom it May Concern,
I am a resident at 1819 West 13th Street and I have liv.ed,here since 1994. I have_
contacted the City Road Department for more then 10 (ten) years now about the unpaved section
of 13th Street, excessive speeding, illegal dumping, and liability issues. We understand the city's
position is you will not fix our road unless we pay for it.
During our discussion last year, it was pointed out that the developers have historically
taken the funds for the road work, etc., of the homeowner and this will not happen anymore. I
hope this is the case. I plan on writing the builder who built this stretch of homes on 13th Street,
Buzz 'and Diana Fisher, and advising them I am aware of this situation and their unethical
actions. '
I really believe if the builder is responsible, as you have stated, there should be a
mechanism in place to fine them and have them pay back the homeowners or city. The bottom
line is it really is stealing from the homeowners and the city and it is that sort of behavior that
should not lack consequences.
It is also outrageous that I have lived here and paid taxes for all these years, yet the
solution you provide is to "pay more". The city could have even chip-sealed at a low cost or
even put up a sign for the speeding problems. I had asked for both the sign and a speed bump
and explained that we should not have to have "our children" playing "in fear" every day from
the excessive speeders.
When I pointed out that the "c' Street Extension had both a sign and a speed bump, I was
advised that it was an "exception" and the only one like it. Despite this apparent discrimination,
[ pointed out that it should not take a potential death or harm to a child or a lawsuit against the
city to make you take notice we have a serious, chronic problem over here that the city refuses to
deal with, This includes the excessive speeders, the illegal dumping, the (4) four-wheeling in the
pit, and the fires that happen every summer in'the field'across the street.
Obviously, the only solution you have given to us is to apply for the LID and ask you
again, to take expedited action on 13th Street. Please send the application for the LID ASAP
and advise how we move this process ahead. We need to attempt to head off the problems that
the warm weather exasperates. Thank you, I appreciate it.

We use Mag. Chloride (same material used in the winter) We are using it on all the gravel roads now. This material takes
water from the air, we will put water down if it becomes dry or the persons came sprinkle the roadway themselves to
"freshen" the material. It should last 1-2 years with out putting down new material. The material needs to be piaced in
graded pre-wet materials before it will work. 1 don't know of any place you can purchase locally. We purchase 35-37 tons
ata time.

West 13th Street would like to keep the dust under control. What is the product that the street division uses? Can an individual

RE: West 13th Street hnprovements and Traffic Safety
Dear Ms. Hildebrand,
Thank you for your letter of concern regarding the need for improvements to West 13th
Street and child safety. You and your neighbors interest in the improving the 1800 block
area is commendable. The original development in this area was permitted to use the
City's gravel street standard in an effort to provide affordable housing. This has been
used by developers in many other areas of the City in the past. Upgrades to paved streets
with concrete curbs and gutters and storm drainage facilities are normally facilitated
through formation of a Local hnprovement District (LID) or Developer Reimbursement
Agreement (ORA). Both are similar in that the road needs to be improved to full current
standards to qualify and the process needs to be supported by a majority of the properties
involved. Formation of an LID is initiated by a petition of those desiring the
improvements in the area.
The LID process is funded by the City and requires a longer time frame due to the need
for multiple hearings to meet State and City requirements for formation, approval, and
assessments. The assessment for the LID becomes a lein against the property, which, if
not paid off initially, is paid annually over a typical period often years. The DRA process
is similar to a LID but is normally funded by the developer and the costs are recovered
from each property (lot) as part of the building fees. Should you wish further information
on the formation of an LID, please call Trenia Funston (417-4807) of my staff and she
can assist you.
Earlier the City attempted to work with others in your area to pave II th, 12th, 13th, and the
alleys west to "M" Street with a 20 foot traveled way with .asphalt (no concrete curbs and
gutters). This would have required up front funding of the paving materials by those
participating in the improvement. The participants would also have to cover the costs of
those choosing not participate. The City's proposed participation was to provide
equipment and labor. Unfortunately due to the project size, City budget constraints, lack
of proper equipment for a project of this size, and lack of sufficient street crew staff are
the City could not support the project this year. The City will continue to pursue future

funding, paving equipment, added staffing and adjusting of the project sizes whic;h would
allow us to assist paving of gravel streets and alleys in a more cost effective manner.
Regarding litter clean up and maintaining of the street I am forwarding a copy of your
letter along and my response to the Street Superintendent for his review. The City has a
limited maintenance budget which only allow grading once a year. We also try to
incol']lorate dust inhibitors when funding allows.
I am also forwarding at copy of your letter and my response to the Police Department
for their review and possible selective speeding enforcement. In regards to the request for
speed bumps and child safety I am enclosing a brochure on traffic safety. The City does
not s,upport speed bumps or local neighborhood "Children at Play" signs for the reasons
stated in the brochure. The City only installs "Children at Play" near City parks which
attract large numbers of children.
I Imow that this has not resolved all the concerns you noted. I do hope, however, that I have been
able to provide some insight into options available to you and your neighbors for the street

Dear Mr. Kenworthy,
I am writing on behalf of myself and my neighbors on the 1800 Block of West 13th Street. I have
spoke with Mr. Malumn at various times over the past five years. Last year he recommended that
I contact you. We have a serious problem with the city street. The final portion of the road is
not paved and as I have discussed with Mr. Malumn, the street has a precedent that attracts both
speeding drivers and litterbugs who dump their garbage across the street. It has been a problem
for many years and our neighborhood believes it is also a liability and a fire hazard.
I explained that I have countless times seen children almost hit by cars that were speeding
excessively and I felt that the city had some liability, both legally and morally to correct this
problem. It is on going in frequency and should be addressed as soon as possible. Both M & R
and Rayonier responded and took action when I contacted them with the problem of children's
safety. The property they own at the end of the street and across the street were both gated and
this resolved part of the problem.
I have lived in my home on this block for over 12 years and I have yet to see the city take any
action, despite nice discussions and an occasional watering and cutting of the side of the street.
We live with excessive dust for several months of the year, along with fire concern. I had thought
that the road may be paved when I had lived here for a few years. 12 years is a along time to wait.
I have asked about a speed bump and signs, as well about paving or chip sealing that small
portion of end road that is so heavily traveled. Most importantly, we are asking the city to please
consider the safety of the many children in the neighborhood. I have a petition that the neighbors
have signed if it is necessary to provide. Weare asking the city to please take action to repair this
roadway, help manage the excessive dust, and make an attempt to control the speed. We hope
you can advise us within a reasonable time frame. We would really appreciate it. Thank you for
your time.
