THAT IN 6 MONTHS HE WILL PLUG THE SEWERLINE THAT GOES ACROSS HIS
PROPERTY TO THE SEWER MAIN. HE OWNES 1406 E. CAROLINE AND THE
SEWER LINE SERVES THE PROPERTY ACROSS THE STREET TO THE NORTH. THE
SIDE SEWER WAS AGREED TO WITH THE PREVIOUS SIDE SEWER OWNER, WHO IS
NOW DEAD AND RAINS WANTS TO FREE UP HIS PROPERTY FOR FUTURE SALE.
HE SAYS THERE IS NO RECORDED EASEMENT. I INFORMED HIM THAT THIS
ISSUE IS A CIVIL MATER WHICH HE ALREADY KNEW. WE COULD EXPECT
DIFFICULTY LATER ON THIS.

Sanitary Sewer Ennis / Caroline
A portion of Caroline Street was vacated by Ordinance 607 in 1918. Mr. Rains and
two other property owners Quit claimed back to the City the right of way in 1953-54.
This tells me Mr. Rains owned the property prior to the installation of the side sewer
lateral (6-22-61) which crosses lot 9 ofPSCC Blk 8. The City considers this lateral
to be a private line once it leaves the city main at the alley. The line was not installed
by the city, we just recorded the construction. The line could be re-routed but at the
owners expense. Cutting san. sewer service off would lead to a health dept issue. I
would suggest you may need to get legal council regarding this.

This letter is to confirm our meeting on February 21, 2002, where we discussed the City's position
regarding the current location ofa sewer line that crosses Lot 9, PSCC 8 and services 401 Ennis and
two other adjacent residences.
Chapter 1, Section 101A.l.3 of the 1997 Uniform Plumbing Code as adopted by the City states"No
provision of this Code shall be deemed to require a change in any portion of a plumbing or drainage
system or any other work regulated by this Code in or on an existing building or lot when such work
was installed and is maintained in accordance with law in effect prior to the effective date of this
Code, except when any such plumbing or drainage system or other work regulated by this Code is
determined by the Administrative Authority to be in fact dangerous, unsafe, insanitary, or a nuisance
and a menace to life, health, or property." This section allows for the line to remain as is unless it were
to be disconnected.
Additionally, Chapter 3, Section 308.1 states "Except as otherwise provided in this code, no plumbing
system, drainage system, building sewer, private sewage disposal system or parts thereof, shall not be
located in any lot other than the lot which is the site of the building, structure, or premises served by
such facilities" therefore if the sewer line were to be disconnected and relocated, It would be
propertvowner's respousibilitv to disconnect and to relocate the sewer line.
