Buildmg OffiCial can extend the time for actIOn by the apphcant up to 180 days upon wntten request by the apphcant (see Section 107.4 of

A minor deviation of the 25-foot Front setback on the above noted property is hereby approved.
The minor deviation is not greater than 10% of the requirement being deviated from and will
result in an 22.5-foot front yard on the RS-9, Residential Single Family zoned lot.

This decision is made under Section 17.94.180 of the Port Angeles Municipal Code and is
supported by the following findings:

The granting of the minor deviation is consistent with the purpose of the RS-9 Zone in
which the property is located and the project is otherwise consistent with the
requirements of the RS-9 Zone. This finding can be made because the purpose of the RS-
9 Zone is create and preserve urban single family residential neighborhoods consisting of
predominantly single family homes on larger than standard Townsite-size lots. The
subject lot is less than the required 9,000 square feet in the RS-9 zone. The lot is a legal
lot of record, being created prior to its annexation into the City. The request for the minor
deviation is to provide a minimal 5.5 foot roof covering for a deck located at the front of
the house. The use on the site is residential and the building fits well in the neighborhood.
Granting a 2.5-foot front setback minor deviation will not result in an inconsistency in
neighborhood character.

2. Because of special circumstance, the strict application of the zoning ordinance results in
an undue hardship upon the applicant.
The subject lot is smaller than the required 9,000 square feet required for the RS-9 zone.
Because of the reduced lot size, a standard sized home on the site does not leave adequate
room for the expansion of the building footprint to cover more than a small 3- foot portion
of the front deck. The applicant would like to be granted a variance to cover a larger
portion of the deck, however, because the lot is substandard in size, a minor deviation to
the setback requirement is all that can be granted.
.3. The minor devzation will not be materially detrimental to the public welfare or injurious
to property or improvements in the vicinity and zone in which the subject property is
located.
The reduction in front setback by 2.5 feet should not place an undue hardship on the
adjoining property. No Department or public comments were received indicating any
objection to the proposed minor deviation.
4. The minor deviation is not greater than 10% of the requirement being deviated from
The rear setback in the RS-9 Zone is 25 feet. A 2.5- foot deviation is 10% of this required
25-foot front setback, leaving a 22.5-foot by 40-foot front yard.
:). The site has been posted and adjacent property owners notifiedfifteen (15) days prior to
approval of the minor deviation.
Public notice was posted on the site on December 23, 2003, and mailed to property
owners within 300 feet of the subject property on December 22,2003. Action on the
minor deviation was not taken before January 7, 2004
This decision may be appealed to the Board of Adjustment per Port Angeles Municipal Code
Section 17.96.080. An appeal shall be submitted to the Planning Department in writing within
fourteen (14) days following the date of the decision. An appeal fee of two hundred (200) dollars
will be charged.

PLAN CHECK FEE: IF a plan check fee is due it must be submitted at the time the building permit application and construction plans are
submitted. All other permit fees are due at the time of permit issuance.
EXPIRATION OF PLAN REVIEW: Ifno permit is issued within 180 days of the date of application, the application will expire. The
Building Official can extend the time for action by the applicant up to 180 days upon written request by the applicant (see Section Rl 05.3.2
of the International Building/Residential Code, 2003). No application can be extended more than once.

A minor deviation of the 25-foot Front setback on the above noted property was previously
approved on June 9,2004. The minor deviation is not greater than 10% ofthe required 25-foot
setback being deviated from and will result in an 22.5-foot front yard on the RS-9, Residential
Single Family zoned lot. The present request is to enclose the area located under the roof created
as a result of this earlier minor deviation.
The June 9, 2004 decision was made under Section 17.94.180 of the Port Angeles Municipal
Code and is supported by the following findings:
1. The granting of the minor deviation is consistent with the purpose of the RS-9 Zone in
which the property is located and the project is otherwise consistent with the
requirements of the RS-9 Zone. This finding can be made because the purpose ofthe RS-
9 Zone is create and preserve urban single family residential neighborhoods consisting of
predominantly single family homes on larger than standard Townsite-size lots. Although
the subj ect lot is less than the required 9,000 square feet in the RS-9 zone, the lot is a legal
lot of record, being created prior to its annexation into the City. The request for the minor
deviation is to enclose the existing 5.5 foot roof covering located at the front ofthe house.
The use on the site is residential and the building fits well in the neighborhood. Granting
a 2.5-foot front setback minor deviation will not result in an inconsistency in
neighborhood character.
2. Because of special circumstance, the strict application of the zoning ordinance results in
an undue hardship upon the applicant.
The subject lot is 4,680 square feet nearly half that required for the RS-9 zone. Because
of the reduced -lot size, a standard sized home onthe site does not leave much room for
the expansion ofthe building footprint. The applicant would like to be granted a minor
variance to enclose the existing roof area previously approved..

3. The minor deviation will not be materially detrimental to the public welfare or injurious
to property or improvements in the vicinity and zone in which the subject property is
located.
The reduction in front setback by 2.5 feet should not place an undue hardship on the
adjoining property. No Department or public comments were received indicating any
objection to the proposed minor deviation.
4. The minor deviation is not greater than 10% of the requirement being deviated from.
The rear setback in the RS-9 Zone is 25 feet. A 2.5-foot deviation is 10% ofthis required
25-foot front setback, leaving a 22.5-foot by 40-foot front yard.
5. The site was posted and adjacent property owners notified fifteen (15) days prior to
approval of the minor deviation.
Public notice was posted on the site on December 23, 2003, and mailed to property
owners within 300 feet of the subject property on December 22,2003. Action on the
minor deviation was not taken before January 7,2004
The request to enclose the front 5' 6" of the house, located under the roof created subject to the
minor deviation, is approved.
