A RESOLUTION of the City Council of the City of Port Angeles, Washington.
WHEREAS, Ediz Hook Beach Erosion Control was authorized under the authority of
Section 4 of the Water Resources Development Act of 1974, Public law 93-251; and
WHEREAS, on June 14, 1976, the City of Port Angeles and the United States of
America entered into an Agreement to constructanEdizHook Erosion Control Project, which
included a cost-sharing agreement with the United State of America; and
WHEREAS, the United States Army Corps of Engineers has proposed additional work
be performed on the Ediz Hook Erosion Control Project; and
WHEREAS, this additional work involves revetment repairs, beach nourishment and
the installation of survey monuments; and
WHEREAS, the cost sharing agreement between the City of Port Angeles and the
United States of America has been removed with the passage of the 2024 Water Resources
Development Act signed January 3,2025; and
WHEREAS, an amendment to the Agreement to delete Section d, paragraph I to remove
the cost-sharing obligation of the agreement, is required; and
WHEREAS, the United States Army Corps of Engineers requires the City of Port
Angeles execute a number of land certification documents for the project to proceed; and
WHEREAS, the completion of the additional work on the Ediz Hook Erosion Control
Project will greatly benefit the City of Port Angeles,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Angeles, Washington, that the City Manager is hereby authorized to approve, sign and administer
all certificates, Agreement amendment(s), and other documents necessary to facilitate the United
States Army Corps of Engineers additional work on the Ediz Hook Erosion Control Project.

Council held on the lst day of July 2025.

Certification of Lands and Authorization for Entry for the
EDIZ HOOK EROSION CONTROL PROJECT
RE: Certification of Lands and Authorization for Entry for the Ediz Hook Erosion Control
Project located on the Ediz Hook located in the City of Port Angeles, Clallam County,
Washington.
The City of Port Angeles (hereinafter referred to as the "Public Sponsor") has
assumed full responsibility to fulfill the requirements of non-federal cooperation
specified in a Local Cooperation Agreement dated the 14th day of June 1976, with the
United States of America for the Ediz Hook Erosion Control project, City of Port Angeles
in Clallam County, Washington.
This is to certify that the Public Sponsor has sufficient title and interest in the lands
hereinafter shown in Enclosure 4 in order to enable the Public Sponsor to comply with
the aforesaid requirements of non-federal cooperation.
Said lands and/or interest therein are owned or have been acquired by the Public
Sponsor, and are to be used for the construction, operation and maintenance of the
above referenced project and may include but are not limited to the specifically
enumerated rights and uses listed in the standard easements document.
The Public Sponsor does hereby grant to the United States of America, its
representatives, agents and contractors, an irrevocable right, privilege and permission
to enter upon the lands hereinbefore mentioned for the purpose of executing the project.
The Public Sponsor certifies to the United States of America that any lands
acquired subsequent to the execution of the Cooperation Agreement that are necessary
for this prolect have been accomplished in compliance with the provisions of the
Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970,
(Public Law 91-646) as amended by Title lV of the Surface Transportation and Uniform
Relocation Assistance Act of 1987 (Public Law 100-17), and the Uniform Regulations
contained in 49 CFR, Parl24.
