RE: Welcome Inn Trailer Park
I write to confirm and supplement our conversations of March 15, concerning the
investigation of the alleged zoning violations at the Welcome Inn Trailer Park. I did speak
with Mr. Ed Watson, who has made two complaints to the City concerning possible zoning
code violations. Mr. Watson did explain that a considerable portion of his concern was
based upon comments that a former assistant planner had made. Mr. Watson stated that he
was left with the impression that his complaint was being given a very low priority. I
explained to Mr. Watson that an investigation was being conducted and that you advised
that you had been in contact with the Public Utilities District, the County Assessor's office
and were currently in the process of making inspections in order to compare current
conditions to photographs and other documentary evidence.
Mr. Watson stated that he was satisfied just so long as he knew that something was being
done and that the matter had not been put on "the back burner" or was simply being
ignored.
Mr. Watson went on to state that one of his primary concerns was that Mr. Hopper had
removed natural growth along the Bean Road which had provided a natural green barrier.
He stated that Mr. Hopper has made no effort to replant the required green barrier. He
also complained about the positioning of the garbage collection trailer in a location which
is in direct view of his house. He stated that this garbage collection trailer is allowed to set
for several days, at times, full of the collected garbage, before transport to the dump.
In accordance with our discussions, I will be happy to review the information you received
from the Public Utilities District and the County Assessor's office, as well as the other
investigation, and work with you on revision of the draft enforcement letter which we
reviewed on March 15.

requested advice on how to proceed with enforcement of matters
brought about by the most recent complaint. Based upon my review
of the materials provided I would make the following
recommendations regarding responding to those complaints.
I think that initially an investigation as to these complaints
should be completed. There are references made to the expansion of
the trailer park, however I do not see any documentation confirming
that expansion I_,would think that documentation could be obtained
through the County Assessor's office as to the number of sites
contained in the trailer -park. The expansion or addition of
electrical services to the trailer park could be obtained through
the PUD. Visual inspection as to the existence, or lack thereof,
of certain other requirements such as green barriers should be
completed.
Should the investigation confirm expansion of the trailer park
clearly a residential trailer park district permit should be
obtained. In addition to the permit it does appear as though a site
plan was previously requested. It does not appear, however, as
though a completed site plan was ever provided by Mr. Hopper. A
request therefore should be made of Mr. Hopper to provide a
completed site plan, within a reasonably short period of time. I
believe that this would be of benefit to both Mr. Hopper and to the
City in establishing a benchmark for conditions as they presently
exist. This, of course, would be a valuable tool for present and
future enforcement issues.
Should the Planning Department be unable to obtain compliance with
the provisions of the Zoning Code alternatives are provided for
Court ordered enforcement. Under XI Section 12 the City Attorney's
office may file an action in the Superior Court to enjoin further

expansion, or may proceed under XIII by instituting a criminal
complaint in the District Court. Based upon my review of the
materials provided it would appear as though the Superior Court
action would probably be the more appropriate method in this
instance.

developments and the need for any additional assistance.

RE: Welcome Inn Trailer Park Zoning Violation
Through the years, the City has received numerous complaints
concerning expansion and operation of the Welcome Inn Trailer Park,
located at 112 Highway 101 West in the City of Port Angeles. Site
investigations of initial complaints were done in early 1984 and
culminated in a memorandum dated August 27, 1984, identifying
zoning violations. Two subsequent letters were sent from the City
Planning Department to the applicant or his representative over the
nine months following the August, 1984, memorandum; however, no
enforcement was completed. These three communications are
attached.
There appears to be about a three -year hiatus before more com-
plaints triggered renewed enforcement of the violations at the
Welcome Inn Trailer Park. Complaints were again received in 1990
and now in 1991 without any conclusive action on the part of the
City to resolve the issues concerned with enlarging a trailer park.
The essential remedy would appear to be accomplished by establish-
ing, through an RTP site plan, the basic elements of the trailer
park.
Please advise the Planning Department on how to proceed with
enforcement of the matters brought about by the most recent
complaints. I have attached copies of the earliest complaint
report and the two most recent complaints which the City has
received.

Dear Mr. Pomeranz:
I regret having to write this letter but I feel it is necessary. I am writing
to request that some action be taken to resolve a long standing issues. I am
in hopes you will be able to resolve the issues. If they can not be resolved
at your level I am requesting that I be given time to address the city council
on Januaryl5th or February 5th of 1991.
One of the main issues is the lack of a barrier or fence that should have been
required when Hopper, owner of the Welcome Inn Trailor Court developed the
north west corner of his property. I understand that there is a city ordinance
that trailor parks have to put up a fence or green barrier when they develope
or expand. Hooper parks the oldest and least attrective trailors and motor
vehicles in front of my living room window. He also dunps the organic waste
from his trailor park where we have it for our main view. He is also parking
cars and trailors on this organic fill. These items are not only an eye sore
to us and travelors on the Bean Road but devaluate the resale value of our property.
Another issue is the trees that are across the street from us. About two years
ago Hopper brought in hundreds of yards of dirt to make the property across
the street from us usable. When he filled in his property for his new
development he buryed three large trees in two to six feet of dirt. Several
trees of the same size were removed when Hopper developed this property.
These trees were rotten in the center about three feet up the tree. At the time
Hopper was developing this property I informed city officials and Hopper of
my concern about these three trees. the trees have died and I am surprized
they did not fall during the last storm. If the trees fall in the direction
the prevaling wind blows they will probably fall on a trailor court resident.
If the fall in my direction the may strike my house or at least tear out my
power and telephone.
I am ver concerned that with the new development Hopper was not required to
move a fire hydrant into the area. I question whether the fire department
could string enough hose fast enough to prevent a fire on Hopper's property
from affecting my home. Trailors on Hoppers property are as close as allowable.
When a vehicle is parked between them each item is within four feet of each
other and a fire would spread quickly from car to trailor etc rather rapidly.
Hopper has been less than truthful in the past. It is my understanding that he
is using more spaces than authorized by the city Permit. It is a concern of
mine that so many vehicles and trailors are bunched together as they are.
It is not my intent to create a problem for you or the city but these issues
are important to me and my family.

Since March 1984, the City Planning Department has received complaints
concerning the installation of new mobile home spaces at the Welcome Inn
Trailer Park', located'at`'112 Highway 101 West, in the City of Port Angeles.
The site investigations were conducted on.April llth and May 17, 1984.
and public records were searched to determine the extent of purported
violations., This preliminary investigation ascertained the following
facts:
1. That the Welcome Inn Trailer Court is in a Residential Trailer Park
District, RIP, as designated by Port Angeles zoning regulations,
Ordinance 1709, Article IV, Section 4, permits mobile homes in trailer
parks, and further requires that 'ho person, company, corporation, shall
establish a new trailer park or mobile hone park, or enlarge an
existing trailer or mobile home park, within the City of Port Angeles,
without first obtaining a permit for a trailer park, from the Port Angeles
Planning Commission This section further provides detailed location
and design standards for trailer parks.
2. That in November 1982, or sometime thereafter, P±. James Hopper,
owner of the Welcome Inn Trailer Park initiated the redevelopment and
enlargement of that trailer park without benefit of an approved trailer
park permit. The County Assessor's records show that in 1971 only 69
permanent trailer sites existed in the Welcome Inn Trailer Park, and by
February 8, 1984, 94 sites existed. A site inspection conducted by the
City Planner and Building Inspector, on May 17, 1984, resulted in the
identification of 107 mobile home sites, identified by the existence
of an electrical meter and pole and a mobile home site number.
3. That specifically three new trailer sites were created adjacent to
the east property line of the park, and a fourth in the northwest corner
of the park. On April 11, 1984, Walt Campbell, the Electrical Inspector,
and Mr. Van Hemert, the Assistant Planner, observed a newly installed
electrical pole and meter where none had existed before, identified as #73,
and, further, that according to the neighbor, Mr. Mike Libera, the mobile
home and site immediately west of the previously mentioned site was
installed a short time prior to the subject site. Mr. Libera has
further stated that a third mobile home site was installed in the past
year, generally to the south of the latter two sites, which site is
identified as #47A. Finally, a City electrical permit was granted on
April 30, 1984 to install a new 200 amp service on a pole near the

I am writing this letter in an effort to understand two things:
1)• Why the owner of the Welcome Inn Trailer Court is parking
trailers and RV vehicles on the northwest corner of his
property;
2) If-the owner of the WITC has obtained proper authority to
develop the northwest corner of his property to place trailers
on, why was he not required to:
A) Move a fire hydrant into the area for fire safety to his
occupants as well as his neighbors who may be affected
by a fire in his trailer court;
B) Place a green barrier or fence between his business and
his neighbors, as I understand would be required by city
ordinance.
About two years ago the owner of the WITC brought onto the northwest corner
of his property about one thousand yards of dirt. Prior to bringing in
this dirt, he removed several 'trees; the stumps and other parts of the trees
are on the north part of this corner. There are at least two trees in the
fill area that are dead or dying as a result of this fill. It is my under-
standing that he claims to have always been using this area and that he
simply improved it. This is not true. This northwest corner of the WITC
has been developed by the placement of power, sewer and water lines in a
buried ditch. I was able to view this ditch before it was covered and as
I believe the sewer and water lines were in the same ditch, I think this
issue needs to be addressed.
I talked to the City fire inspector about a year ago about opening Fort
Watson if my property were annexed into the city. I was informed that I
would have to move a fire hydrant to within so many feet of the building.
I feel this requirement should also apply to the development at the WITC.
Trailers and RV units have propane tnaks. These units also have a tendency
to burn quickly and hot. My home being in such close proximity to this
newly developed area, I am concerned aobut our safety. My house is of wood
and because of no barrier between us, exploding propane tanks would be
projectiles that could come in our direction. Also, because of this short
distance between us and the burnable debris that he has dumped in such
great quantity between his business and us, a fire would be hard to
extinguish. A fire hydrant is essential also because of the close
proximity of the trailers being placed in this new area.
A green barrier or fence should be required for control of the WITC
tenants. Last summer a 15- year -old girl squatted and went to the bathroom
.behind her trailer. My guests who saw this incident with us were not
impressed. There also is garbage being thrown behind trailers that we
should not have to -view. This green barrier should be green year round
and not just in the summer. Because of this lack of green barrier or
fence we have headlights coming into our children's bedroom at all times
of the day and night during the summer. Circulation of cooler air is
important in the summer so the light cannnot be blocked out.
I would appreciate a quick response to this letter as the summer is the time
ofincreased fire danger and the best opportunity for the planting of a
green barrier or building of a fence.

Inn Trailer Park, submitted on January 24, 1985, which was originally

of the City's Zoning Ordinance, #1709, as amended, which was previously
provided to you, the following information must be on the plot plan:
1. Location of sanitary sewers throughout the park
2. Location of water lines including fire hydrants, throughout the park.
3. The dimension of the park and individual mobile home and travel
trailer sites.
4. Existing screening on the periphery of the park.
5. Certification by an authorized individual that the plot plan is an
accurate representation of the existing facilities in the mobile home
park.
The revised plot plan must be submitted to the Planning Department by

RE: Conversation with James Hopper, Owner, Welcome Inn Trailer Park
Mr. James Hopper, owner of the Welcome Inn Trailer Park, came into the
office at approximately 9:00 A.M. April 12, 1984. Mr. Hopper inquired as
to the outcome of the meeting we had at the trailer park yesterday and
further apologized for his conduct on the site. I explained that based on
the recently installed power pole and meter, the grading, etc. on the east
side of the property that there was sufficient indication that significant
changes were occurring in the park to warrant a further investigation.
This would include a search of the public records for the historical number
and location of trailer spaces in the park. I noted that the pole appears
to encroach upon the 10 -foot setback as does the trailer to the south and
that a future trailer may also so encroach. Mr. Hopper contended that no
additional spaces were being established; that if he were forced to make
application for approval of the park he would go out of business. I stated
that unless there was a threat to the health and life to a tenant, the
pre- existing nonconforming portion of the trailer park would probably not
be required to comply with present standards but the new sites would. I
informed him, as I had previously done, that he could utilize the
pre- existing nonconforming trailer spaces by replacing one trailer for
another as it became vacant. However, the City is concerned when major
redevelopment, such as the replacement or extension of the sewer system,
the water system and the electrical services.. When such major facilities
are extended or replaced, a permit may be required. Since the park
pre- exists our present Zoning Ordinance, I told Mr. Hopper that the City
had no detailed schematic of the present or past layout of the park. I
requested that he provide one; otherwise it may be necessary that the City
reconstruct it from historical information. Such a drawing would not be
construed as a mobile home park plan or application, but rather would be
used to determine its past configuration. Mr. Hopper initially stated that
he knows how many sites there are and their location but that he would not
provide a detailed plan.
Mr. Hopper requested the substance of the complaints regarding the trailer
park. I then itemized them, to -wit:
1. Additional mobile home spaces have been created along the east
property line of the park.
2. That mobile homes have been placed and facilities installed (an
electrical pole which encroached upon the 10 -foot setback) on the east
side.

3. That sewer lines have been extended within the park to these new
spaces.
4. That trees had been removed along the east boundary.
Mr. Hopper neither denied nor affirmed these changes. (Yesterday, in a
conversation on the site, he did state that there had been a mobile home
space where the new power pole was now located and he was only replacing
the facility and that he had removed trees along the east property line.)
Mr. Hopper further noted that this situation was similar to one that
occurred in 1978 when a Mr. Gardner had created the RV sites on the north
side of the property and that the City was aware of this. I thanked him
for the information and would check for a file. Mr. Hopper advised me that
he intended to put another mobile home in the contended space adjacent to
the east property line and I advised him that he should not until the
matter is cleared up. I did ask if it was okay to take a picture of the
present situation and if the mobile home is installed a picture of the
mobile home and he said it was okay with him.
Finally, I gave him a copy of the Residential Trailer Park (RTP) provisions
from the Zoning Ordinance. Upon leaving, and apparently after some
thought, he said he may draw up the design of the existing mobile home park
for our information and bring it into the office by Friday. The conversa-
tion ended at approximately 9:55 A.M.

Complaint investigation on Welcome Inn Mobile Home Park.
Acting upon complaints received from Mike and Cindy Libera, 4412 Fairmont
Avenue, the Assistant Planner investigated the Welcome Inn Trailer Park
located on the north side of Highway 101 West. The substance of the
complaints received during the week of March 26th through 30th and again on
April 9th and llth is as follows:
1. James Hopper, the owner of the Welcome Inn Trailer Park, has made
extensive changes in the internal sewage system which connects to the
City sewer, including the extension of the line to a new mobile home
space approximately one year ago.
2. A mobile home space has been installed and a mobile home located on it
less than 10 feet from the common property line between the mobile
home park and the Libera property.
3. Mr. Hopper stated to Mr. Libera that he was intending to add three or
four new spaces inside the park.
4. On the morning of April 11, 1984, at the time of the last complaint
from the Liberas, Mr. Hopper was installing an electrical pole and
junction box adjacent to the Libera property with the intent of
creating an additional mobile home space.
On April 9, 1984, the Assistant Planner had arranged with the Office
Engineer, Ken Ridout, Office Engineer in the Public Works Department, to
jointly investigate the alleged complaints regarding the expansion of the
mobile home park and the extension of sewer service lines within the
facility. On the morning of April llth, at approximately 10:00 A.M., based
upon information provided by the Liberas, the Assistant Planner also
contacted Walt Campbell, City Light Department, regarding the installation
of a power pole on the property. Mr. Campbell indicated that he had no
record of authority to do so nor were there any records of other new
services over the past year within the Welcome Inn Park. Because the
junction box was allegedly being installed at that time, Mr. Campbell and
Mr. VanHemert immediately proceeded to the Welcome Inn Trailer Park. After
driving through the facility and observing that significant work had been
done within the park, Mr. Campbell and Mr. VanHemert found the newly
installed power pole on the east side of the property. Mr. James Hopper,
the park owner, encountered us. I introduced Mr. Campbell and myself to
Mr. Hopper and said that we were investigating possible zoning violations
regarding the expansion of the trailer park. Mr. Campbell noted that the
newly wired control box and pole had not been authorized by the City nor
had other electrical work done on the site been so authorized. Mr. Hopper
stated that the Clallam County PUD, which services the trailer park, had
authorized the various electrical work he had conducted over the past year
and that he had permits in this regard. The site has been inspected by a
State inspector. Mr. Campbell advised that he would look into this and
notify the PUD that City approval may also be required, since the property
was within the City.
Mr. VanHemert pointed out that it had come to the attention of the Planning
Department that addition of new trailer spaces appeared to be occurring
within the park. Mr. Hopper was reminded that he had been told that any
expansion or major alteration of the park would require a plan approval by
the City some year ago in a conversation with the Assistant Planner. Mr.
Hopper corrected me by stating that the con4tion occurred in November,
1982. Mr. Hopper contended that he was only replacing existing facilities,
the spaces already existed. The Assistant Planner said that these were
significant changes in the park and it was not maintenance of existing
facilities to completely replace electrical services, extend sewers, etc.
The Assistant Planner also further pointed out that the space for which the
electrical service had just been prepared was closer than the required 10
feet from the adjacent property owner and that a trailer approximately 100
feet to the north was also too close to the property. The Assistant
Planner advised a plan of both the existing facilities as of one year ago
and the proposed facilties and spaces should be prepared and submitted.
Messrs. Hopper, VanHemert and Campbell then walked through the site,
further discussed the matter. Upon leaving, the Assistant Planner also
noted that there was significant excavation being done on the northwest
corner of the site, which work seemed to be leveling and additional
preparation for mobile home spaces. Messrs. Campbell and VanHemert left
the site at approximately 11:30 A.M.

northwest corner of the park, identified as #50A, and shortly
thereafter, a mobile home was installed.
4. That the installation of new mobile home trailer sites and the
location of trailers violate the provision of minimum yards, which, in
the RTP District require, "that no buildings, trailer, structure, cabana,
carport, shall be permitted closer than 30 feet to the nearest public
right of way, and no closer than 10 feet to any property line of a
trailer park Trailer park site #31A and the mobile home occupying
said site are within 2 feet of the east property line, and the mobile
home to the north is approximately 8 feet from the same property line
(see attached picture taken by the Assistant Planner on April 17, 1984).
5. That in addition to violating the 10 foot side yard adjacent to this
property line, the removal of evergreen trees and shrubs adjacent
to this property line violated the screening requirements of Article TV,
Section 4. Lacking an approved detailed plot plan, other violations
including the unauthorized extension of City sewer and water services,
the minims land -to- trailer ratio of 6000 square feet, the minimum driveway
standards, minimum sanitary facilities and the minimum setback between
trailers have occurred.
The Planning Department has made numerous contacts with Mr. Hopper in order
to secure assurance that he will comply with the Zoning Ordinance. Mr. Hopper
initially conferred with the Assistant Planner and Planning Director
in November 1982, apparently after he acquired the trailer park, and was
informed that any enlargement of the facility would require a trailer
park permit; he was also given a copy of Article IV, Section 4, City
Zoning Ordinance applicable to trailer parks. After complaints began to
arrive, the Planning Department began to investigate alleged violations,
sending Mr. Hopper a letter dated May 30, 1984, prizing the violations
and requesting a detailed plot plan. A followup letter was sent on
June 21, 1984, in response to which Hank Hibbard, Mr. Hopper's attorney,
verbally advised the Assistant Planner that he would recommend to his
client that he prepare a detailed plot plan.
Therefore, the Planning Department requests that the City Attorney
proceed with this violation of the City Zoning Ordinance 1709. This
department will assist you in any way to secure additional information
pertaining to this case.

This is in response to your request for the Planning Department's position
regarding the current status of the zoning violations at the above- referenced
trailer park. The Welcome Inn Trailer Park is owned and operated by your
client, Nr. James Hopper. For same time now, the Planning Department has
been attempting to resolve past violations with the City's zoning code.
The Planning Department is pleased that your client is in the process of
preparing a site plan by a licensed surveyor of the trailer park. This is
an important step in the right direction and is consistent with previous
Planning Department requests. Please provide us with the scheduled completion
date of the site plan.
This is to assure you that the Planning Department will not use the site plan
against Mr. Hopper in pursuing any retroactive enforcement actions. To the
contrary, the intent of the site plan is to establish the current situation
and provide a base from which to assess future additions or changes to the

Thank you for the cooperative effort you have displayed
in the last few months in an attempt to upgrade the electri-
cal facilities within your trailer park. I will make every
effort (allowed to me) to expedite t -he-r- improvements.

As the question of sub metering has been brought up I would
like to make some comments. Port Angeles City Light's "Elec-
tric Service Requirements Guidelines" states in Section
7.10 that sub metering is prohibited. However, since the
intent is to decrease the existing number of existing sub
meters and to improve the electric facility, making a safer
RV park, the utility will allow the existing sub meters
to be relocated and re -used.
Pertaining to our earlier conversation, please note that
the new or relocated equipment will need to meet code
requirements as if it were a new installation. An example
of this is the existing pedistals which are not approved
for feed through of supply wires. If a feed through wiring
method is chosen to supply the pedistals, the existing pedis-
tals will not be useable in the new locations. I have attach-
ed some drawings showing some of the code requirements for
RV parks. These drawings indicate the calculations, power
location for each site and what type of receptacles are
required.
It is also my understanding that a plan to improve the elec-
trical facilities throughout the entire park has been made.
I am very please to hear this as there are several sites
that are in need of attention.

Park
On June 19, 1985, Mike Libera called the Assistant Planner
regarding additional problems at the Welcome Inn Mobile Home
Park. Mr. Libera cited that on two occasions the Fire Department
emergency vehicle was unable to find particular mobile homes in
emergency aid situations. In addition, the aid vehicle had to
back out of the park because of the lack of adequate continuous
road system which is well- marked. He also stated that several
tenants have had problems with their drinking water supply which
was getting "yellow water He finally noted that the mobile
home park{ has expanded to 144 spaces and the travel trailers were
stacked in 5 feet apart. All this, Mr. Libera stated, would
leave the City open for a lawsuit if someone were to die or
become ill or injured.

The City Planning Department has reviewed the plot plan for the Welcome
Inn Trailer Park, submitted on January 24, 1985, which was originally
requested in a letter to you, dated May 30, 1984. Pursuant to Section4
of the City's Zoning Ordinance, #1709, as amended, which was previously
provided to you, the following information must be on the plot plan:
1. Location of sanitary sewers throughout the park.
2. Location of water lines including fire hydrants, throughout the park.
3. The dimension of the park and individual mobile home and travel
trailer sites.
4. Existing screening on the periphery of the park.
5. Certification by an authorized individual that the plot plan is an
accurate representation of the existing facilities in the mobile home
park.
The revised plot plan must be submitted to the Planning Department by
May 17, 1985, to resume review of the purported zoning violations. When the
revised plot plan is submitted, the City will compare this information to that
on the site, for accuracy.

SUBJ Zoning Violation Welcome Inn Trailer Park
DATE: August 27, 1984
Since March 1984, the City Planning Department has received complaints
concerning the installation of new mobile home spaces at the Welcome Inn
Trailer Park, located at 112 Highway 101 West, in the City of Port Angeles.
The site investigations were conducted on April llth and May 17, 1984.
and public records were searched to determine the extent of purported
violations. This preliminary investigation ascertained the following
facts:
1. That the Welcome Inn Trailer Court is in a Residential Trailer Park
District, RIP, as designated by Port Angeles zoning regulations,
Ordinance 1709, Article IV, Section 4, permits mobile hones in trailer
parks, and further requires that "no person, company, corporation, shall
establish a new trailer park or mobile home park, or enlarge an
existing trailer or mobile home park, within the City of Port Angeles,
without first obtaining a permit for a trailer park, from the Port Angeles
Planning Commission This section further provides detailed location
and design standards for trailer parks.
2. That in November 1982, or sometime thereafter, Mr. James Hopper,
owner of the Welcome Inn Trailer Park initiated the redevelopment and
enlargement of that trailer park without benefit of an approved trailer
park permit. The County Assessor's records show that in 1971 only 69
permanent trailer sites existed in the Welcome Inn Trailer Park, and by
February 8, 1984, 94 sites existed. A site inspection conducted by the
City Planner and Building Inspector, on May 17, 1984, resulted in the
identification of 107 mobile hone sites, identified by the existence
of an electrical meter and pole and a mobile home site number.
3. That specifically three new trailer sites were created adjacent to
the east property line of the park, and a fourth in the northwest corner
of the park. On April 11, 1984, Walt Campbell, the Electrical Inspector,
and Mr. Van Hemert, the Assistant Planner, observed a newly installed
electrical pole and meter where none had existed before, identified as #73,
and, further, that according to the neighbor, Mr. Mike Libera, the mobile
home and site immediately west of the previously mentioned site was
installed a short time prior to the subject site. Mr. Libera has
further stated that a third mobile home site was installed in the past
year, generally to the south of the latter two sites, which site is
identified as b47A. Finally, a City electrical permit was granted on
April 30, 1984 to install a new 200 amp service on a pole near the

northwest corner of the park, identified as #50A, and shortly
thereafter, a mobile home was installed.
4. That the installation of new mobile home trailer sites and the
location of trailers violate the provision of minimum yards, which, in
the RIP District require, "that no buildings, trailer, structure, cabana,
carport, shall be permitted closer than 30 feet to the nearest public
right -of -way, and no closer than 10 feet to any property line of a
trailer park Trailer park site i31A and the mobile home occupying
said site are within 2 feet of the east property line, and the mobile
home to the north is approximately 8 feet from the same property line
(see attached picture taken by the Assistant Planner on April 17, 1984).
5. That in addition to violating the 10 foot side yard adjacent to this
property line, the removal of evergreen trees and shrubs adjacent
to this property line violated the screening requirements of Article IV,
Section 4. Lacking an approved detailed plot plan, other violations
including the unauthorized extension of City sewer and water services,
the minimum land -to- trailer ratio of 6000 square feet, the minimum driveway
standards, minimum sanitary facilities and the minimum setback between
trailers have occurred.
The Planning Department has made numerous contacts with Mr. Hopper in order
to secure assurance that he will canply with the Zoning Ordinance. Mr. Hopper
initially conferred with the Assistant Planner and Planning Director
in November 1982, apparently after he acquired the trailer park, and was
informed that any enlargement of the facility would require a trailer
park permit; he was also given a copy of Article IV, Section 4, City
Zoning Ordinance applicable to trailer parks. After complaints began to
arrive, the Planning Department began to investigate alleged violations,
sending Mr. Hopper a letter dated May 30, 1984, summarizing the violations
and requesting a detailed plot plan. A followup letter was sent on
June 21, 1984, in response to which Hank Hibbard, Mr. Hopper's attorney,
verbally advised the Assistant Pla,.uier that he would recommend to his
client that he prepare a detailed plot plan.
Therefore, the Planning Department requests that the City Attorney
proceed with this violation of the City Zoning Ordinance 1709. This
department will assist you in any way to secure additional information
pertaining to this case.

As you are aware, the City, prompted by complaints, has undertaken a review
of the status of the Welcome Inn Trailer Park. Site investigations on
April 11 and May 17, 1984, and public records indicate several violations
of the Port Angeles Zoning Regulations, Ordinance 1709, Article IV, Section
4, Residential Trailer Park District. On May 17, 1984, the City Building
Official and Assistant Planner counted 107 identified mobile home sites in
the Park. The County Assessor's records show that there were 94 sites on
February 8, 1984, and only 69 sites in 1971. It is therefore evident that
the Welcome Inn Trailer Park has expanded without the approval of a plot
plan, required by Article IV, Section 4.
It appears the new sites have occurred along the east property line and in
the northwest corner of the Park where a new electrical service was ap-
proved on April 30, 1984. Other specific violations of the Trailer Park
standards in Article IV, Section 4, observed are as follows: (1) A mobile
home on newly created site 31 -A, is approximately 2 feet from the common
property line to the east, where a 10 -foot setback is required. (2) A new
electrical pole and meter serving a site to the north is approximately 8
feet from the same property line. (3) The removal of trees and shrubs.
particularly along the east side of the Trailer Park over the past year,
has effectively removed visual screening between the Park and abutting
properties to the east. No attempt appears to be underway to replace this
visual screening.
To determine the necessary corrective recourses, we are requesting that you
submit a detailed plot plan showing those elements identified in the en-
closed Zoning Ordinance excerpt and further identifying those mobile home
sites which preceded your ownership and those that have been subsequently
created. The plot plan must be submitted to the Planning Department within
15 days of receipt of this letter. In the meantime, you will also refrain
from any further activities in violation of the Zoning Ordinance.

of the trailer park. Mr. Hopper also commented that he intended
to locate a new mobile home in the space adjacent to the east
property line which allegedly had only been recently constructed.
I advised Mr. Hopper that in putting a mobile home in this space
he ran the risk of having to remove it if a violation of the
Zoning Ordinance was determined. Mr. Hopper further stated that
he planned to locate the mobile home on Friday and that he had a
commitment to the mobile home owner some time ago. Finally, he
mentioned that his neighbor, Mr. Libera, advised that he made a

The Assistant Planner returned a telephone call to Mike Libera at
approximately 10:00 A.M. April 12, 1984. Mr. Libera inquiret what the

outcome of our meeting with Mr. was at the Welcome Inn Trailer Park.
I advised Mr. Libera that there was sufficient evidence that significant
changes had been made on the site and that we would be conducting a more
detailed investigation of potential violations of the Zoning Ordinance.
Mr. Libera contended that he was not actually a complainant to which I
responded that he and his wife had brought it to our attention. I told Mr.
Libera that it would be very helpful since he had the most detailed
information regarding the changes that occurred at the Welcome Inn Trailer
Park, that he prepare a detailed itemized list of his observations and the
approximate times the actions he is concerned about took place. He felt
that he did not want to alienate his neighbor but he would think about it.

Mr. Libera added that Mr. had acquired two additional lots south of
the property at the approximate location of where the newly created trailer
space is now. Mr. has also been filling an extremely low place in
the park which has caused run -off onto the Libera property. I thanked him
for the information and asked him to please put it in a written statement
so that we can have all the information needed to bear on the issue from
both sides. Conversation ended at approximately 10:15 A.M.

RE: Conversation with James Hopper, Owner, Welcome Inn Trailer Park
Mr. James Hopper, owner of the Welcome Inn Trailer Park, came into the
office at approximately 9:00 A.M. April 12, 1984. Mr. Hopper inquired as
to the outcome of the meeting we had at the trailer park yesterday and
further apologized for his conduct on the site. I explained that based on
the recently installed power pole and meter, the grading, etc. on the east
side of the property that there was sufficient indication that significant
changes were occurring in the park to warrant a further investigation.
This would include a search of the public records for the historical number
and location of trailer spaces in the park. I noted that the pole appears
to encroach upon the 10 -foot setback as does the trailer to the south and
that a future trailer may also so encroach. Mr. Hopper contended that no
additional spaces were being established; that if he were forced to make
application for approval of the park he would go out of business. I stated
that unless there was a threat to the health and life to a tenant, the
pre- existing nonconforming portion of the trailer park would probably not
be required to comply with present standards but the new sites would. I
informed him, as I had previously done, that he could utilize the
pre- existing nonconforming trailer spaces by replacing one trailer for
another as it became vacant. However, the City is concerned when major
redevelopment, such as the replacement or extension of the sewer system,
the water system and the electrical services.. When such major facilities
are extended or replaced, a permit may be required. Since the park
pre- exists our present Zoning Ordinance, I told Mr. Hopper that the City
had no detailed schematic of the present or past layout of the park. I
requested that he provide one; otherwise it may be necessary that the City
reconstruct it from historical information. Such a drawing would not be
construed as a mobile home park plan or application, but rather would be
used to determine its past configuration. Mr. Hopper initially stated that
he knows how many sites there are and their location but that he would not
provide a detailed plan.
Mr. Hopper requested the substance of the complaints regarding the trailer
park. I then itemized them, to -wit:
1. Additional mobile home spaces have been created along the east
property line of the park.
2. That mobile homes have been placed and facilities installed (an
electrical pole which encroached upon the 10 -foot setback) on the east
side.

3. That sewer lines have been extended within the park to these new
spaces.
4. That trees had been removed along the east boundary.
Mr. Hopper neither denied nor affirmed these changes. (Yesterday, in a
conversation on the site, he did state that there had been a mobile home
space where the new power pole was now located and he was only replacing
the facility and that he had removed trees along the east property line.)
Mr. Hopper further noted that this situation was similar to one that
occurred in 1978 when a Mr. Gardner had created the RV sites on the north
side of the property and that the City was aware of this. I thanked him
for the information and would check for a file. Mr. Hopper advised me that
he intended to put another mobile home in the contended space adjacent to
the east property line and I advised him that he should not until the
matter is cleared up. I did ask if it was okay to take a picture of the
present situation and if the mobile home is installed a picture of the
mobile home and he said it was okay with him.
Finally, I gave him a copy of the Residential Trailer Park (RTP) provisions
from the Zoning Ordinance. Upon leaving, and apparently after some
thought, he said he may draw up the design of the existing mobile home park
for our information and bring it into the office by Friday. The conversa-
tion ended at approximately 9:55 A.M.

Complaint investigation on Welcome Inn Mobile Home Park.
Acting upon complaints received from Mike and Cindy Libera, 4412 Fairmont
Avenue, the Assistant Planner investigated the Welcome Inn Trailer Park
located on the north side of Highway 101 West. The substance of the
complaints received during the week of March 26th through 30th and again on
April 9th and llth is as follows:
1. James Hopper, the owner of the Welcome Inn Trailer Park, has made
extensive changes in the internal sewage system which connects to the
City sewer, including the extension of the line to a new mobile home
space approximately one year ago.
2. A mobile home space has been installed and a mobile home located on it
less than 10 feet from the common property line between the mobile
home park and the Libera property.
3. Mr. Hopper stated to Mr. Libera that he was intending to add three or
four new spaces inside the park.
4. On the morning of April 11, 1984, at the time of the last complaint
from the Liberas, Mr. Hopper was installing an electrical pole and
junction box adjacent to the Libera property with the intent of
creating an additional mobile home space.
On April 9, 1984, the Assistant Planner had arranged with the Office
Engineer, Ken Ridout, Office Engineer in the Public Works Department, to
jointly investigate the alleged complaints regarding the expansion of the
mobile home park and the extension of sewer service lines within the
facility. On the morning of April llth, at approximately 10:00 A.M., based
upon information provided by the Liberas, the Assistant Planner also
contacted Walt Campbell, City Light Department, regarding the installation
of a power pole on the property. Mr. Campbell indicated that he had no
record of authority to do so nor were there any records of other new
services over the past year within the Welcome Inn Park. Because the
junction box was allegedly being installed at that time, Mr. Campbell and
Mr. VanHemert immediately proceeded to the Welcome Inn Trailer Park. After
driving through the facility and observing that significant work had been
done within the park, Mr. Campbell and Mr. VanHemert found the newly
installed power pole on the east side of the property. Mr. James Hopper,
the park owner, encountered us. I introduced Mr. Campbell and myself to
Mr. Hopper and said that we were investigating possible zoning violations
regarding the expansion of the trailer park. Mr. Campbell noted that the
newly wired control box and pole had not been authorized by the City nor
had other electrical work done on the site been so authorized. Mr. Hopper
stated that the Clallam County PUD, which services the trailer park, had
authorized the various electrical work he had conducted over the past year
and that he had permits in this regard. The site has been inspected by a
State inspector. Mr. Campbell advised that he would look into this and
notify the PUD that City approval may also be required, since the property
was within the City.

Mr. VanHemert pointed out that it had come to the attention of the Planning
Department that addition of new trailer spaces appeared to be occurring
within the park. Mr. Hopper was reminded that he had been told that any
expansion or major alteration of the park would require a plan approval by
the City some year ago in a conversation with he Assistant Planner. Mr.
Hopper corrected me by stating that the con c --tion occurred in November,
1982. Mr. Hopper contended that he was only replacing existing facilities,
the spaces already existed. The Assistant Planner said that these were
significant changes in the park and it was not maintenance of existing
facilities to completely replace electrical services, extend sewers, etc.
The Assistant Planner also further pointed out that the space for which the
electrical service had just been prepared was closer than the required 10
feet from the adjacent property owner and that a trailer approximately 100
feet to the north was also too close to the property. The Assistant
Planner advised a plan of both the existing facilities as of one year ago
and the proposed facilties and spaces should be prepared and submitted.
Messrs. Hopper, VanHemert and Campbell then walked through the site,
further discussed the matter. Upon leaving, the Assistant Planner also
noted that there was significant excavation being done on the northwest
corner of the site, which work seemed to be leveling and additional
preparation for mobile home spaces. Messrs. Campbell and VanHemert left
the site at approximately 11:30 A.M.
