Work within the 6` Street right of way shall be limited to the removal of the Himalayan blackberry bushes, allowing
for regrowth of salmon berry elderberry salal and sword ferns. No planting of non native materials shall be allowed
in the area. Removal of non native plantmg may be removed without a permit.
*If the applicant is considering establishing pathways within the ROW the pathway shall be limited to no
more than a 4' width and is to occupy only a minimum amount of the area. Pathway surface material would
be lmnted to the use of wood chips. Any pathways that may be established within the ROW must remain
open to the public. No earth disturbing work (no bare soil) within 50 feet of the top of the bluff shall be
allowed under any circumstance. Light pruning to enhance views is limited to no more than 1/3 of any live
plant's crown. Any dead or down wood is to be redistributed evenly over the site.

Thank you for your letter of November 7, 2005 regarding the sidewalk
improvements required for your new residence. We had met with you earlier
regarding the extent of frontage improvements that would be required for your
new residence. Normally they would have been required for the full extent of your
frontage of approximately 414 feet. Due to the shape of the lot and the potential
for a boundary adjustment with the property to the north and east the frontage
improvement requirements were reduced to just beyond your proposed building
with a no protest LID agreement for the remainder. With your present driveway
location this reduced your frontage requirements by 174 feet to approximately
240 feet. Using your construction cost estimates ($31.30/L.F.) this reduction will
save you $5,446 plus the cost of pavement widening for 174 feet.

The sidewalk improvements were clearly noted on your building permit. You
could have appealed the requ.irements when the permit was issued, but the
appeal period has passed. The street requirements are from the City's Urban
Services for Street and Access Requirements (PAfy1C 18.08.0400, ordinance
2857 adopted 2/17/95) that states "Development that creates pedestrian traffic
on any arterial streets and other streets identified in the City's transportation plan
as school walking routes shall include pedestrian sidewalks." Milwaukee Drive is
an arterial and the sidewalk improvements are required. In addition Milwaukee
Drive is a part of the waterfront trail system.

Dear Mr. Kenworthy:
I am looking forward to moving in to my new residence at 606 Milwaukee Drive in Port
Angeles. I understand through Treina Funston that along the western 23S feet or so of
my frontage along Milwaukee Drive, I am now being asked to add a sidewalk in
addition to the previous requirements of extending the pavement three to five feet north
and installing a curb and gutter. I am interested in hearing the City's reasoning for this
shift in thinking. I can think of three lines of reasoning: It is the rule, it is necessary for
the future, and it establishes a precedent (i.e. if we let you do it, we have to let
everybody do it).
It is the rule. True. However, there are also provisions explicitly written into the rules
that allow human reasoning to override the default application of the rules. If there ever
was a case that should allow human reasoning to take effect, this is it. I would
essentially be making a 200' island of sidewalk in an area where people don't even use
the sidewalk that
exists on the other
side of the street.
The sidewalk
would run right
over the water,
phone, and cable
connection points,
as illustrated in
the photos. (The
orange rope in the
picture is 46' 6"
from the curb face
on the south side
of the street.) It
would also require
uprooting at least
two cedar trees that appear to be in the 30 to SO year old range. To make the sidewalk
useful by having it actually lead beyond my property, even bigger trees would have to
be cut down, and extensive excavation would have to take place. The mailbox shown is
at 624 Milwaukee Drive, just a few houses west.
It is necessarv for the future. Unquestionably, there is extensive development in this
area. So it is not all that farfetched to reason that although the sidewalk might seem
ridiculous now, in the future it will be seen as good planning. I am not adamantly
opposed to making my contribution to a useful sidewalk for the city. My opposition is
to an orphaned strip of concrete with no connection point to the east or west. If a plan is
established that will link this whole neighborhood, such as an LID agreement, I will be
happy to contribute my fair share. At this time, however, it seems prudent to establish a
clear vision of what Milwaukee Drive should look like, and then act accordingly. I
have heard that the Olympic Discovery Trail will go through here, quite likely making a
.
nonnal sidewalk either inadequate or redundant. My fear is that my island of concrete
remains an island of concrete for decades, and never serves any purpose.
It establishes a precedent. "If we let you do it, we'd have to let everybody do it." In
this case, I am the very last "everybody" on this side of the street. And I would be the
only one that the city required to install a sidewalk. So the precedent has already been
set, and that precedent does not require a sidewalk. I noticed also that even in the new
area of development at the west end of Milwaukee Drive, it appears that there will only
be a sidewalk on the outer edge of the street. So even for new construction, there is
precedent for sidewalks on just one side of the street.
As I mentioned previously, if an overall plan gets established that produces a
meaningful sidewalk linking the Milwaukee Drive neighborhood to N Street and
beyond, I will be happy to contribute my fair share. However, this contribution is quite
substantial, and I do not want to waste my money fruitlessly. Primo Construction has
quoted me a price of $ 14.50Ilin. ft. for the curb and gutter. That extends to $3,408 for
235 ft., and so far does not include the price for extending the pavement 3 to 5 feet to a
40 ft. overall width. The six foot sidewalk would cost $16.80Ilin. ft., which extends to
$3,948. Together those sum to $7,356, and that does not include extending the
pavement. I would guess that everything together would cost more than $10,000.
Please do not make me spend this much money for a piecemeal contribution to an
abstract concept. If we are going to have a sidewalk, let's have a useful sidewalk. If
not, please don't make me create an ugly, useless island of concrete that never leads
anywhere.

As requested, I have reviewed the letter of August 29, 2003, prepared at the request of
Ronald and Jane Floyd to determine the appropriate setback for a structure on the
referenced propsrty. The purpose of my review was to determine if the addition of a
basement to a structure on the site would impact the setback as set forth in the letter or
any of the conditions associated with that recommended setback.
It is my opinion that the addition of a full basement to under a structure will not affect the
recommended setback distance as set forth in the letter. All recommendations provided
in the letter are to remain in effect to allow the recommended setback to be held.

Dear Mr. and Mrs. Floyd:
Zenovic & Associates, Inc. presents herein the results of our geotechnical review of the
referenced property, located on Milwaukee Drive in Port Angeles, Clallam County,
Washington. The property is situated on the top of the marine bluff that forms the south
edge of the Strait of Juan de Fuca. Access to the site is from MilwaUkee Drive, off of "N"
Street.
The property is currently undeveloped. It is our understanding that you intend to market
the property for single-family residential development, consistent with City of Port
Angeles standards and regulations. This report is to be provided to potential purchasers
for their review. The marine bluff on the northerly edge of the property is considered to
be an Environmentally Sensitive Area pursuant to the Port Angeles Municipal Code
(PAMC Chapter 15.20). The bluff is also shown as an unstable area in the State of
Washington Coastal Zone Management Atlas.
PURPOSE AND SCOPE OF SERVICES
The purpose of the geotechnical review is to provide information regarding the soil and
slope stability in order to develop the site in a manner that will not induce soil erosion or
endanger on-site or adjacent off-site properties, consistent with the requirements of the
Port Angeles Municipal Code. The scope of the review included a field inspection of the
site and determination of site and adjacent property slopes using a hand-held
clinometer. In addition, measurements were taken to determine the amount the top of
the bluff had receded based on available surveys. No topographic mapping services
have been provided,
Research of available data included a review of aerial photos on file at the Clallam
County Road Department (DNR, 1971, 1981, 1990, and 1997), the Soil Survey of
Clallam County Area, Washington (USDA/SCS, February, 1987), aerial topographic
mapping completed by David Smith & Associates, Inc. for the City of Port Angeles (Mar
1995), and the map for Short Plat No. 78-5-16, as prepared by Clark & Associates in
September, 1978,

REGIONAL GEOLOGIC AND SOIL CONDTIONS
According to the Soil Survey of Clallam Area, General Soil Map, the City of Port Angeles
area and the surrounding region are comprised of Elwha-Clallam-Catla soil association.
These soils are typically moderately well-drained, nearly level to very steep slopes on
hills, underlain by compact glacial till. Inspection of the soil maps of the site indicate that
the property lies along the north edge of an extensive Elwha soil area that extends from
the Elwha River on the west to the Oungeness River on the east, from the foothills of the
Olympic Mountains on the south to the Strait of Juan de Fuca on the north.
The Elwha-Clallam-Catla soils are derived from weathered glacial till. These soils were
deposited by the ice sheet during the Vashon stade glaciation. The Vashon Glacial Till
consists of a poorly sorted mixture of rock fragments deposited directly by the Vashon-
age ice sheet. Finer portions of the soil consist of clay, silt, and sand. These fine
particles comprise a moderately to highly compact matrix in which the coarser
components (gravel, cobbles, and boulders) are firmly imbedded.
SITE OBSERVATIONS
An engineer from Zenovic & Associates, Inc. conducted a site visit on August 28, 2003
to observe the site slopes, vegetation, surface and immediate subsurface hydrology, and
evaluate in-situ soils for density.
Existing Slopes
The site topography consists of a gently sloping upland area extending from Milwaukee
Drive downhill to the top of the bluff. The bluff face consists of an upper portion that is
essentially vertical (average slope of 3" horizontal to 1 foot vertical for a height of
approximately 90 feet. The lower portion of the bluff is more gently sloped, with an
average slope of 45 degrees (1 horizontal to 1 vertical). This bluff profile is consistent
with marine bluffs that are situated along the Strait of Juan de Fuca. The lower, more
gently sloped material consists of colluvial deposits from the sloughing of the bluff.
The mechanisms that create this bluff profile consist of a combination of the removal of
the colluvial material at the base of the bluff by wave and tidal action of the marine
waters and the relatively loose formation of the upland soils. As the colluvial soil is
transported from the beach area by longshore drift during periods of extreme high tides
and winter storms, the buttressing effect of these soils on the face of the bluff is reduced.
Once enough of the colluvial soil is removed, the weight of the overlying soil at the top of
the bluff causes the face of the bluff to shear off. The sheared off material becomes the
next layer of colluvial material; the top of the bluff recedes due to the shearing of the soil

soil formation, and beach topography.

Soil Conditions
The Soil Survey maps show the soil in the vicinity of the site to be a Hoypus gravelly
sandy loam, 0 to 15 percent slopes. This is consistent with the site observation
completed by this office. These soils are generally excessively drained and have a low
available water capacity. As a result, the sutiace soil does not absorb significant water
from incident rainfall during the winter months. Generally, incident rainfall percolates
through the soil to depths well below the ground sutiace. These soils are highly erosive,
however, and site development must be done in such a manner that impacts to the bluff
are avoided.
Vegetation
The site is undeveloped and is covered with dense brush (blackberry vines, salal, etc.)
and perennial grasses. There are no significant trees on the site. It appears, based on
the surrounding properties, that the site was once Wooded, but that all trees have been
harvested and the site cleared at some time in the past.
Hydrology and Drainage
No sutiace depressions or runoff channels were observed on the property. The site has
minimal upgradient tributary area and moderately well-drained soils. No groundwater
seepage was observed on the property or on the face of the bluff.
CONCLUSIONS
Based on the available historic data, it appears that this property is unique for a high
bluff site on the Strait of Juan de Fuca. The loss of property along the bluff is incidental,
probably due to the quality of the beach formation at the base and the fact that the area
is protected from a significant part of the longshore drift by the presence of the rock
revetment that protects the City of Port Angeles Industrial Water Line at the base of the
bluff.
Review of the aerial photographs and the measurements comparing the existing
conditions with those in shown on the 1970 survey indicate that the rate of recession of
the top of the bluff in this area is very minimal, with a total recession distance of less
than 5 feet since 1978. Any recession is not typically a yearly occurrence, but rather
tends to happen less frequently but with a larger impact (see attached information).
RECOMMENDATIONS
While minimal loss of property has Occurred on this site over the last 25 years, the fact
that the bluff is susceptible to sloughage and erosion must still be recognized. Proper
maintenance of the existing marine bluff is critical to the continued safety of the site and
for minimizing damage to the bluff. No organic material, including grass clippings and
tree or brush trimmings should be thrown over the top of the bluff These matcmals may
help hold water on the slope, thereby reducing slope stability.

The minimum recommended setback for a new single-family residence on the site is 60
feet; no disturbance of the site and vegetation should occur within 50 feet from the edge
of the bluff. Any disturbed area between the structure and the bluff should be replanted
with native vegetation.
General
All site improvement work on the property shall be constructed in conformance with all
requirements of the City of Port Angeles including, but not limited to, the Uniform
Building Code and applicable clearing, grading, drainage, and erosion control
requirements.
Excavation and Grading
Excavation for any proposed dwelling and associated foundation components shall be
carried to firm, substantial, unyielding material. All excavations shall be kept free of
standing water.
Temporary excavation slopes in excess of four feet in height shall be sloped at not less
than 1 horizontal to 1 vertical. Permanent excavation and embankment (cut and fill)
slopes shall be no steeper than 2 horizontal to 1 vertical.
Excavation work shall occur not earlier than April 1, and all slopes shall be complete to
their permanent condition before November 1. Temporary excavation slopes steeper
than 2 horizontal to 1 vertical shall be protected with an impervious covering (visquene)
during any rainfall periods.
Drainage and Erosion Control
A siltation fence shall be installed at the 50-foot buffer line to prevent access to the
buffer area and to also prevent any silt-laden soils from entering the buffer area. Site
clearing should be limited to those areas where actual construction is occurring or where
adequate construction access is needed. The contractor should establish a single point
of access to the site (preferably from the south), and should maintain the access
roadway in a clean, stable condition. Any areas where vegetation is removed shall be
revegetated at the conclusion of construction, but not later than November 1.
Drainage facilities shall be provided at the time of site development to direct the runoff
from all new and existing impervious surfaces to the existing City of Port Angeles storm
sewer system in Milwaukee Drive Site grading shall be completed in a manner that will
assure that all runoff from developed impervious areas will be discharged into the storm
sewer system. No discharge over the face of the bluff is permitted, and subsurface
disposal (infiltration) of stormwaler is not recommended.

Slope Maintenance
Finished slopes should be adequately vegetated to prevent surficial runoff. No organic
material, including grass clippings and tree or brush trimmings should be placed on any
slopes steeper than 3 horizontal to 1 vertical. These materials may help hold water on
the slope, thereby reducing slope stability.

Shoreline retreat is the rate at which the toe of the bluff
moves landward and must be documented over a long
enough period SO as not to be influenced by short-term
variations. Short-term erosion typically refers to slope
failures such as landslides, slumps, or simply the
sloughing of a layer of soil and vegetation. In the case
of slope failures, it is useful to know the frequency and
the maximum extent of such an evenl.

Elevation is 50 to 1,000 feet. The average annual
precipitation is 18 to 30 inches, the average annual air
temperature is about 49 degrees F, and Ihe average
growing season (at 28 degrees) is 220 to 260 days.
Typically, the surface is covered with a mat of organic
material 1 inch thick. The surface layer is very dark
grayish brown gravelly sandy loam 3 inches thick. The
upper 7 inches of the subsoil is dark brown gravelly
sandy loam, and the lower 21 inches is dark yellowish
brown very gravelly loamy sand. The upper 14 inches of
the substratum is dark brown very gravelly sand, and the
lower part to a depth of 60 inches or more is dark
yellowish brown gravelly sand. In some areas of similar
included soils, the surface layer is gravelly loamy sand,
very gravelly sandy loam, or gravelly loamy fine sand.
Included in this unit are small areas of Dick, Carlsborg,
Casso/ary, Calla, and Clallam soils. Also included are
small areas of Hoypus soils that have slopes of more
than 15 percent and soils that have a gravelly sandy
loam surface layer more than 10 Inches thick. Included
areas make up about 20 percent of the total acreage.
The percentage varies from one area to another.
Permeability of this Hoypus soil Is rapid. Available
water capacity Is very low. Effective rooting depth is 60
inches or more. Runoff is slow, and the hazard of water
erosion Is slight.
This unit is used mainly as woodland. It is also used
as home sites.
This unit Is suited to the production of Douglas-fir. On
the basis of a 1 DO-year site curve, the estimated mean
site index tor Douglas-fir is 134, and on the basis at a
50-year site curve, the estimated mean site Index is 101.
At the culmination of the mean annual increment (CMAI),
the production of Douglas-fir at age 70 is 136 cubic feet
per acre per year. The trees of limited extent are
western hemlock, western redcedar, bigleaf maple, and
Pacific madrone. Among the common forest understory
plants are salal, Oregon-grape, red huckleberry, western
brackenfern, blackberry, western swordfern, and deer
fern. Floral use of salal and western swordfern is
common on this unit.
This unit is suited to year-round logging operations.
Disturbance of the protective layer at duff can be
reduced with the careful use of wheeled and tracked
equipment. Logging roads require suitable surfacing for
year-round use. Rounded gravel for road construction is
readily available in areas of this uniL
Seedling establishment is the main concern In the
production at timber. The low precipitation during the
growing season and the droughtiness of the surface
layer contribute to seedling mortality. Reforestation can

Dear Jim:
We have reviewed some of your concerns on the Halberg residence with the
contractor, Cliff Smith.
The first item Cliff talked with us was the straps between the upper floor shear
wall and the lower level shear walls. We have instructed him to use Simpson
MSTC 52 traps replacing the Simpson PHD2 hold downs. At the Simpson
PHD8 hold downs we need to use two Simpson MSTC 52 straps. ','
We also talked with Cliff about the placement of the plywood sheeting at the front
corners of the house. We have told him to install the 4'_0" x 8'-0" vertical starting
at the bottom of the mud sill and up the full 8'-0" height. At the top of the 8'-0"
plywood sheeting we are having him install double 2x blocking and splicing in ,
with anew sheet of plywood.

Dear Mr. Kenworthy:
Thank you for your letter of November 9,2005. That letter addressed four key items: that the
City is already reducing the frontage improvement requirements, that the need for a sidewalk
was listed on the building permit (and that I could have appealed but the deadline has passed),
that as of February 17, 1995 all city arterials (including Milwaukee Drive) need to have
sidewalks, and that Milwaukee Drive is part of the waterfront trail system.
F or reducing the frontage improvement requirements, I say thank you. I am glad to see that
there is some acknowledgement that the application of ordinances does not have to be entirely
black and white. Please realize, though, that a no-contest LID does not really "save" me $5,446
as it states in your letter, Ijust get to postpone that payment until such time that the City decides
it wants me to complete the improvements. Although I am grateful for the opportunity to
postpone that portion of the payment, there is still an excess of $20,000 associated with
improving the lot. My understanding at the time I purchased the lot was that it would cost a total
of roughly $10,000, half of which would be required immediately. This understanding was
based on a meeting my father and I had with you approximately two years ago. We have the
notes from that meeting. Part of the justification for reducing the building requirements was a
realization that the economics do not make sense. The lot had been sitting vacant for ten years,
largely because the improvement costs added 20% to the cost of acquisition. With assurance that
these would be reduced, I went ahead with the purchase.
Thank you for pointing out that the sidewalk requirement was included on the building
permit. Since my contractor picked up the building permit and is responsible for building the
house to code, I never looked through it until now. I did not expect it to contain any information
that would be news to me. Since most residents do not have an encyclopedic knowledge of the
city ordinances, a letter from the City to the homeowner that contained a copy of the building
permit and outlined the appeal process would have been very much appreciated. Could you
please provide information at this time on how this process works?
Your letter states that Milwaukee Drive is part of the waterfront trail system. While this is
true, I have learned from the County that the plan for the Olympic Discovery Trail in this
neighborhood is to use an eight foot bike lane on the south shoulder of the street. So if anything,
Milwaukee Drive being part of the waterfront trail system reduces the need for a sidewalk on the
north side of the street, since there is going to be capacity for substantial pedestrian traffic on the
south side of the street.
Although I appreciate the clarification on some of the ordinances relative to this case, I was
frustrated that there was no mention of what I consider to be the real issue here: the sidewalk
would not go anywhere. More importantly, it can not go any further west without extensive
excavation. Even on my own property there are at least two cedar trees that would have to be

uprooted, and the City placed the water connection, the phone connection, and the cahle
connection right where the sidewalk would go. The edge of my property, where they are
supposed to put it, is at least 24 feet further north. While I am perfectly willing to contribute my
share to a useful sidewalk that links the Milwaukee Drive neighborhood to N Street and beyond,
it is extremely frustrating to be singled out to contribute so heavily for a project with so little
benefit.
I can see that further discussion is going to be required. I would be happy to meet with you
any time after 4:00 pm on any day of the week, preferably at the construction site so that you can
get a feel for the context of this project. Alternatively I can be reached at 461-4379 (cell) or
452-5095 (work). My employer has a loosely-enforced business-only calling policy, so although
I can talk briefly at work, I would prefer to wait until after 4:00. My father, John, is also very

When roof gutters are installed, drains will located in dry

NFPA 13D will be required.
2nd ~ption is to install an out side alarm bell that is
eletronicly connected to the residence's smoke detectors.
The alarm bell will be painted red in color and identified

required.
