Bilateral Compliance Agreement
between
Washington State Department of Health
and
City of Port Angeles
For Covering of Uncovered Finished Water Supply Reservoirs and
Installation of Corrosion Control
Docket # 7207
The following is hereby agreed to between the Washington State Department of
Health, (hereinafter DOH), and the City of Port Angeles (hereinafter the City)
regarding the City of Port Angeles Water System, ID #68550M, a Group A
Community Water System, Clallam County.
1. Whereas:
1 . 1 . The City has completed sampling for lead and copper at the
consumers' taps and has found that the sampling exceeds the 90th
percentile action level for copper but not for lead.
1.2. The USEPA has established time frames for installation of corrosion
control. Systems of the size of the City are required to have corrosion
control in place by January 1998.
1.3. The City has requested approval to delay implementation of corrosion
control because of uncertainties of the status of their water source
due to the federal Elwha River Restoration Project.
1 .4. The City has proposed to pursue implementation of other projects at
an accelerated schedule as a mitigation for delayed implementation of
corrosion control. Specifically these projects are the covering of three
uncovered distribution reservoirs which are:
1.4.1. Jones Street Reservoir, 2.0 MG, 1961
1.4.2. Black Diamond Reservoir, 7.0 MG, .1961
1.4.3. Peabody Heights Reservoir, 7.0 MG, 1925

1.5. The City has also agreed to implement a public awareness and
education program on corrosion byproducts and the corrosivity of the
City's water with respect to copper.
1.6. DOH believes that covering the City's uncovered water reservoirs
should be a higher public health priority than corrosion control due to a
copper only action level exceedence.
1.7. DOH believes that the schedule proposed by the City is r:easonable.
1.8. The DOH recognizes that the compliance schedule for Task Items 2.5
through 2.14 are based on successfully obtaining a Public Works Trust
Fund (PWTF) loan to fund the three covering projects. The PWTF loan
will be applied for in the Spring of 1998 and funds are expected to be
available for use by July 1999. If the City of Port Angeles is
unsuccessful in obtaining a PWTF loan for this reservoir covering
project from its Spring 1998 PWTF loan application, the compliance
schedule presented herein for Task Items 2.5 through 2.14 will be
delayed by 1 2 months and the City of Port Angeles will reapply for a
PWTF loan in the Spring of 1999. In any event, the compliance
schedule for completing the Jones Street Reservoir Cover project will
be unaffected by the City of Port Angeles success or lack thereof in
obtaining a PWTF loan.
2. Therefore DOH and the City hereby agree to the following:
2.1. Engineering Report: By March 31, 1998, the City shall submit to DOH
for approval an engineering report evaluating alternatives and
recommending covering plans for all three uncovered reservoirs.
2.2. Public Awareness: By November 1, 1998, the City shall submit to
DOH a Public Awareness/Education Program plan including sample bill
stuffers and newspaper advertisements, and a date and agenda for a
public meeting and open house. Implementation of the public
awareness program shall begin by December 31, 1998.
2.3. Jones Street Reservoir Cover Construction Documents: By December
31, 1998, the City shall submit to DOH construction documents for
the Jones Street reservoir cover.
2.4. Jones Street Reservoir Cover Completion: By December 31, 1999,
the City shall complete construction of and submit to DOH a
construction report for the Jones Street reservoir cover.

2.5. Black Diamond Reservoir Cover Construction Documents: By February
28, 2000, the City submit to DOH a construction documents for the
Black Diamond reservoir cover.
2.6. Black Diamond Reservoir Cover Completion: By December 31, 2000,
the City shall complete construction of and submit to DOH a
construction report for the Black Diamond reservoir cover.
2.7. Peabody Heights Reservoir Cover Construction Documents: By
February 28, 2001, the City shall submit to DOH construction
documents for the Peabody He.ghts reservoir cover.
2.8. Peabody Heights Reservoir Cover Completion: By December 31,
2001, the City shall complete construction of and submit to DOH a
construction report for the Peabody Heights reservoir cover.
2.9. Lead and Copper Sampling 1: By June 30, 2002, the City shall
complete a full round of lead and copper compliance sampling and
submit to DOH a report of findings.
2.10. Lead and Copper Sampling 2: If no action level is exceeded in item
2.9 above then by December 31, 2002, the City shall complete a
second full round of lead and copper compliance sampling and submit
to DOH a report of findings.
2.11. Corros,ion Control Report: If an action level is exceeded in either item
2.9 or 2.10 above then the City shall submit a Corrosion Control
Report to DOH within six months from the date of determination of
the exceedence.
2.12. System-Wide Testing: If recommended in the Corrosion Control
Report, system-wide testing of the impacts of the corrosion testing
shall be completed within nine months from date of approval of the
Corrosion Control Report.
2.13. Final Design: Final design shall be included in the Corrosion Control
Report unless system-wide testing is recommended, in which case the
City shall submit a final design for corrosion control within 3 months
of the completion of the system-wide testing.
2.14. Construct Corrosion Control System: Within one year from the date of
approval of the final design, the City shall complete construction of
and submit to DOH a construction report for the completion of all
required corrosion control facility improvements.
