RE. Storm drainage easement
Dear David and Wyndi.
Thanks for coming in to share your good news on the recent purchase of the lot off 'C' Street Extension.
This letter is for the purpose of establishing mutual relations between yourself and the City regarding the storm
drainage issues impacting your property on Newell Road. In order to resolve the storm drainage issues, with your
permission the City would like to again propose the installation of an additional 300' of 18" drain pipe adjacent
to the existmg 12 culvert previously installed by Michael Grooms in 1993 And as previously discussed, an
easement would be necessary for the installation and maintenance of the drainage facility
If you would be amendable to the granting of an underground utility easement and the installation of a new drainage
facility the City would be responsible for the installation, restoration and maintenance costs associated with this
request. The City has received an estimate of $15,500 for costs associated with the installation of the 18' drainage
facility In addition to the costs associated with the installation, the City would like to offer you monetary
compensation for the dramage easement. Based on the Clallam County's Assessor's records, the assessed property
value of adjacent land that falls withm the same zoning is roughly $0.37 per square foot. The square footage of the
easement is approximately 6000' Using the County's $0.37sf assessed land value figure, this would make the
assessed value of the proposed easement $2,220 00
The City's real estate committee meets once a month. I would like to place this on the September agenda. If you

Building Official can extend the time for action by the applicant up to 180 days upon written request by the applicant (see Section
R105.3.2 of the International Building/Residential Code, 2003) No application can be extended more than once.

RE: Storm drainage easement
Dear David and Wyndi:
Thanks for coming in to share your good news on the recent purchase of the lot off "c" Street Extension.
This letter is for the purpose of establishing mutual relations between yourself and the City regarding the storm
drainage issues impacting your property on Newell Road. In order to resolve the storm drainage issues, with your
permission the City would like to again propose the installation of an additional 300' of 18" drain pipe adjacent
to the existing 12" culvert previously installed by Michael Grooms in 1993. And as previously discussed, an
easement would be necessary for the installation and maintenance of the drainage facility.
If you would be amendable to the granting of an underground utility easement and the installation of a new drainage
facility, the City would be responsible for the installation, restoration and maintenance costs associated with this
request. The City has received an estimate of$15,500 for costs associated with the installation of the 18" drainage
facility. In addition to the costs associated with the installation, the City would like to offer you monetary
compensation for the drainage easement. Based on the Clallam County's Assessor's records, the assessed property
value of adjacent land that falls within the same zoning is roughly $0.37 per square foot. The square footage of the
easement is approximately 6000'. Using the County's $0.37sf assessed land value figure, this would make the
assessed value of the proposed easement $2,220.00.
The City's real estate committee meets once a month. I would like to place this on the September agenda. If you

Per our recent conservation, the City continues to be interested in obtaining an easement resolve to the storm
drainage issues on your Newell Road property. The existing 12" culvert (along the northerly portion of your
property) was installed in 1993 by Michael Grooms. As installed this system collected drainage from the
Wildwood Terrace apartment complex and other adjacent properties to the north and west. Prior to the installation
of the culvert, the natural surface drainage flow from adjacent properties crossed onto (Lot 4 of Short Plat
82-9-2 ) the open field via a swale.
Due to the increased building construction activity within the general area, it appears that additional surface
drainage has created a situation where the existing 12" drainage facility has become over burdened.
With your permission the City is proposing installing approximately 300' of 18" drain pipe adjacent to the existing
12" culvert. In order to accomplish this, a 20' wide stQrm drainage easement would need to be established. The
easement would be for the installation and maintenance of the drainage facility.
At sometime in the future if you choose to subdivide your property, the dedication of the easement would not
restrict you from using the property, in that the proposed easement would lie within the zoning building setback
requirement.
The City has received an estimate for costs associated with the installation of the 18" drainage facility. In order to
proceed toward a resolve for the drainage concerns, would you be amendable to granting an easement and the
installation of the drainage facility? The City would be responsible for the installation, restoration and maintenance
costs associated with this request.

To Whom It May Concern:
Thank you for the letter regarding the City of Port Angeles' interest in obtaining an
easement on our 4122 Newell Road property. This letter is to advise of our feelings
concerning the proposed easement as well the history of development on the property
directly to the west of us on C Street Extension. We will first discuss the development of
the property to the west of us, as it has direct bearing on the city's request for an
easement to our property.
When Da',jd Briggs and 1, Wyndi Cole, purchased the property on 4122 Newell Road
there was no issue with water damaging our property or the property of our neighbors to
the North. The natural lay of the land was adequate to contain water where it was
inappropriate to build and allowed water to flow towards proper drainage in areas already
developed. Unfortunately, the natural lay of the land was disturbed by the development of
the property to the west of 4122 Newell. David and I, along with our neighbors to the
north, were concerned when we began to see signs of construction. We began to see
machines tearing up trees and pushing dirt and debris (consisting oflarge pieces of
concrete and tree parts) down the hill behind us. What was once a large depression in the
ground, a natural containment pond, was being filled in. David and I called the city to
find out why the work was being done and the drainage potentially altered to all
properties east and north of the property on C Street Extension that is owned by Josh
Armstrong. The city engineer told us that they were only doing "vegetation clreaing" and
were not grading and had no permits to build. We explained to the engineer that was not
the case, they had already raised the level of the land by 2 to 3 feet, and they were
pushing dirty material right up to our property line. We explained to the engineer that
they filled in a containment pond and we were concerned that it would affect our
property. I was very clear in not wanting the dirty material they were pushing around to
come onto my property and that I did not want my drainage compromised by what they
were doing. David and I suggested that we get things resolved before the project went
further and monetary involvement increased. The work ceased for the year and nothing
was resolved.
The following year work began again on the C Street Extension property. We contacted
the city again and wanted to know what was happening with the property. We wanted to
know if our concern had been addressed: Why had they been allowed to fill in the
containment pond and push dirty material up to our property line? These issues were
never satisfied for us. We still do not know if they ever had a permit or why they were
granted a building permit on such sensitive land. Pretty soon there were 2 manufactured
homes sitting at the west end of the C Street Property and the issues were not resolved
down below. A driveway had been created to the lower property, which allowed more
water do\vn than ever before. Our neighbor to the north, Stella Connelly, began calling
and asking how to go about getting the water issue resolved as the water was destroying
her landscaping. We assured her we were working with the city to resolve the issue, but
we had'not heard back anything for certain. Meanwhile, the construction crew dug a hole
all the way down the driveway they put in and laid drainage pipe. They stubbed the pipe
out approximately 10 feet away from our property line. They had decided to use our
property for their catch basin. We were assured by the city that the property owner would
have to have an engineered drainage plan BEFORE building was permitted. We called
the city and said the stub out was not going to work for us. It caused water to come up
over our property and pushed that dirty material onto us and our neighbors. We were
assured that permission was not given to create a stub out. We are still waiting for action
to be taken on that stub out. Nothing has happened in that regard. The only improvement
we've seen is that the property owner was required to put a silt fence up around where his
property touches ours so that the dirty material cannot reach our property as easily.
Our neighbor, Stella, has suffered as well. She had nice landscaping along the south
border of her property, which touches ours. This last heavy rainfall was horrible for her.
The water drained from the top of C Street Extension down through the stub out, across
the comer of our property, directly through Bud Little's property, and straight into
Stella's. It washed away her bark and water stained her carport. Our ditch is now plugged
up with her beauty bark, which she paid for and cared for. She requested city officials to
come look at the damage caused. She has recently turned in a request for reimbursement.
She is worried about the water ruining the wood in her carport and getting under her
house. She is worried about damage being done to her property that she cannot see and
therefore, cannot ask the property owner or city to reimburse. We have discussed who is
responsible for what damage: The property owner who caused the damage by
irresponsible building or the City that issued inappropriate permits and allowed the
damage to occur.
This is where we come to the issue of our granting an easement to our property on
Newell Road. Currently, the city does not have an easement to our property nor does the
city have control of the draimige through our property. It appears that the city would like
to address everyone's concerns by attaining an easement through our property and
connecting the C Street Extension property to our existing drainage plan and course.
David and I feel offended by this plan. We feel that our rights and concerns as citizens of
this community have been ignored time and time again. Now we are being asked to be
the solution to a problem we did not create and, in fact, tried repeatedly to avoid by
requesting the proper attention being paid in a timely manner. We are not happy at being
put in this position. We are still not satisfied that a permit should have been issued for
building on that piece of land. We request that proper attention be given to our concern
before speaking of a solution to the drainage that was created by Mr. Armstrong's
manipulation of the land. We request to know if an engineered drainage plan was, in fact,
submitted and signed off on for the two homes already located on the C Street property.
We request to know if the lower property can be taken back to the condition prior to the
destructive building and construction work. We know that it is unlawful to change the
flow of water or drainage from one property to another. We know that this has occurred
on our property and our neighboring properties as a direct result of Mr. Armstrong
building on his property. We wish for this matter to be resolved regardless of whether or
not we will grant an easement to the city.
We are open to ideas from all parties regarding how we might be able to accomplish this.
For example, Mr. Armstrong can install a surface water retention pond on his property to
contain water caused by his alterations to the natural lay of the land, much like the one
they buried with concrete and debris. Alternatively, Mr. Armstrong can install a pump
station to move his water back up to C Street Extension and hook to existing drainage
pipes. These are just two solutions we can imagine. We would like to restate our firm
belief that it is not our responsibility to fix a problem we tried to avoid and had no part in
creating. At this time, we are not willing to grant an easement to the City of Port Angeles
for our property at 4122 Newell Road. It is our hope that we can work together in
resolving these property issues to our mutual satisfaction. Thank you for your time and

Newell Rd storm drainage
I received a call from Wendy Cole about the storm drainage issue on Newell Rd. With this latest rain it is
causing problems again. Also the neighbor to the north, Stella Connley has water running down her
driveway. I spoke with Stella last month and said we would look into her concern. She has a gated
driveway so needs to be called before going out to the site. I was going to have someone go out, but I
forgot. Anyway where do we go from here? I know that Wendy and her husband will be down to let us
know how things aren't working.

Trenia: I checked the files and Cole and Briggs never filed a claim form but were part of a complaint of water run off.
Connelly filed a claim but did not list any damage. She said there was a steady stream of water running across her
property. I have photo. Her damage appears to be lost beauty bark. The drainage issue was reported to Bill Beverford
who had no record of any problems in the area. The adjustor may have talked to Connelly and walked the area, but no
action since that time. Because the City indicated we did not have any known water ieaks in the area nothing more was
done and none of the people pursued the matter. We consider the claim inactive at this time. The drainage problem in the
photos look like it has been going on for some time, but Bill does not believe it is a city issue. The weather at that time was
also very wet. You can see the photos if it helps. But that is all I have on these claims. Bob

This storm line was installed by the former property owner Michael Grooms. We are trying to obtain an easement for additional
drainage improvements from Ms Cole and Mr. Briggs. This morning Wendy called asking what was determined by the Evergreen
Claims Adjustment lady. Since I didn't know anything about it, I said I would make an inquiry with human resources. Wendy
indicated that the claim may have come from her neighbor Stella Connley at 4108 Newell Rd for damage to her landscape.
There has been an ongoing effort by Public Works to obtain an easement from Ms. Cole and Mr. Briggs so if I could have some
insite to what was determined, it would be helpful. Wendy also indicated that the lady from Evergreen had a copy of my letter to
Wendi and David dated March 13th.
