RE: Construction within Milwaukee Heights utility easement

Mr. Rauch:
It has been brought to our attention that the utility easements adjacent to lots 4 and 5 Milwukee Heights has building
and retaining wall encroachment.
The utility easements as shown on the Milwaukee Height Subdivision plat are 12.5 feet on either side of the common
4/5 lot line. The existing utilities lying within this easement are water, sanitary sewer and storm drainage mains.
The 607 Milwaukee Drive single family residence constructed in 1997 appears to encroach approximately 4 or feet
into the utility easement along with a storage shed. The 609 Milwaukee Drive single family residence recently
constructed appears to encroach approximately 0.5 feet into the utility easement along with A.C. unit. It also
appears that a 2-4 foot tall concrete retaining wall has been recently constructed between the 2 properties.
These structural encroachments within the utility easement should not have been allowed. This letter is to put the
property owner(s) of 607 and 609 Milwaukee Drive on notice that should a problem or an
emergency arise accessing the facilities within this corridor, the City has the right of ingress and egress to and over
the premises for repair or maintenance of the facilities and due to the nature of the encroachment any costs for
restoration of the encroachment would be at the property owners expense. In addition any damage to the utilities
arising from the encroachments will be repaired at the property owners expense.
Per the Port Angeles Municipal Code ]4.01.050 Construction Near City Utilities and Easements. No new
construction or remodeling of existing structures shall encroach upon or interfere with City utilities or easements,
either above ground or below the ground, nor shall such construction violate applicable construction codes. Any
cost incurred by the City in modifying or relocating utilities brought about by such construction, except for an
increase in service, shaH be payable to the City by the owner of the property on which such construction takes place.

RE: Easement, Utilities, and other Concerns
Dear Mr. Nelson:
The following is in response to your request for a written reply following our
phone discussion yesterday.
In our first phone conversation several weeks ago you raised several concerns. I
stated that I would check into the concerns and get back to you. That was the
basis for my call yesterday. During our initial phone conversation I did respond to
you concern that excavation on the lots to the north of you may erode and
damage your property. I note that this would be a private matter between you
and your neighbors and that the City would not be involved.
The other issues that I checked into, with my response in italics, are as follows:
1. The dumping of excavated materials into the 6th Street right of way
north of Milwaukee Drive during construction activities at 607 and 609
Milwaukee Drive. May be harming the habitat
The material is being placed on private property with the owner's
permission. There is no material being placed in the 6th Street right of way.
The placement of no dumping signs would serve no purpose since they
would be hidden in the vegetation.
2. The 3 to 4 feet of grading in the utility easement between 607 and 609
Milwaukee Drive may be impacting the underground utility cover.
The fill covers for the utilities remain within the requirements. There are 3
feet of cover the water main, 6 feet for the sewer main, and 4 feet for the
storm line.

3. There appears to be intrusions into the utility easement between 607
and 609 Milwaukee and did the City allow it. If so, can I also intrude?
We did check and did verify your concems that there has been an
intrusion into the easements of 4.5 feet on 607 and 0.5 feet on 609
Milwaukee. There is also a low retaining wall constructed on the property
, line. These facilities were constructed in the easement without City
approval and were apparently overlooked during plan reviews and
inspections. In these situations the owners risk having the intruding
facilities damaged or removed without restoration and/or compensation
should repairs to the utilities be required. The owners would also be liable
for any damages to the utilities resulting from the construction within the
easement. .

Hopefully this answers your concerns: As noted above the construction of
facilities beyond landscaping and minor fencinglwalls is not allowed in the right of
ways. When re'pairsare required the City tries to work with the owners to
minimize the disruptions.
In response to your later inquiry regarding the possible sale of the 6th Street right
of way it is the City's policy not to sell or vacate right of ways located at the
marine bluffs. A boundary line adjustment (Land Swap) had been discussed with I
the property owners on each side of the 6th Street right of way in the past. This
was to square up the properties and provide a public view area. As noted in our
discussion the sale or vacation of street right of ways are normally to the
adjacent property owners only. .

I was completing a Public Works Final Inspection at 609 Milwaukee Dr. on this date at
about 2pm. Mr. Nelson saw me and asked if! was trying to locate the sewer clean-out.
He stated that it was in his back yard and I was welcome to come and take a look at it.
As I was making a note of the location of the sewer clean-out, Mr. Nelson stated that the
house at 609 Milwaukee was built onto the utility easement and ifit isn't it was very
close and an official survey should be performed. He also stated that the Heat Pump was
installed onto the easement as well.
I informed him that the City was looking at his concerns and someone was sure to contact
him soon.

On June 30th, I was asked by Trenia to take a few pictures of some work (excavating)
being done at 609 Milwaukec Dr.
As I was about to leave the site, Jeff and Pat Nelson that live at 706 Estes Court
approached me. (457-0292) There where a number of concerns about the house that was
being built at 609 Milwaukee Dr.
a. The house was being built into the utility easement between lot #4 and #5.
b. It appears that there will be a retaining wall of some kind being built into the
utility easement, and maybe some type of concrete coverage into the utility
easement.
c. The contractor was excavating to close to their fence.
d. The contractor was working on the house at 6 I I Milwaukee Dr. with out
permIssIon.

1. His first issue was construction in the easements to the north of him between 607 and 609 Milwaukee Drive. Please check on
weather constuction did encroach on the easement. If so, did we allow it?
2. His second issue was the grading (3' +/-) that lowered the utility cover in the easement. There are several utilities (water, sewer,
and storm) in the easement. The 6" water line should maintain 3' min. cover. Please check to see if the grading has created a
problem.
3. Another concern was the crews dumping debris in the 6th street right of way accross the street. Jim Mahlum and I did notice the
dumping. Not sure if in 6th street right of way. I did ask Jim to have Neil place some no dumping signs. Eric may have to assist in
location of the right of way.
4. He also complained that the grading to the north of him could erode and affect his property. I told him that this issue was a private
issue between him and the adjacent owner,

Response to Gary Kenworthy RE: Mr. Nelson
Utility easement between 607 and 609 Milwaukee Drive.
Easement is 12.5' either side of lot 4 and 5, 22 and 23 Milwaukee Hts. Phase I and II
Existing utilities within this easement are:
Per Doyle's inspection of the site on 8-11-06
6" pvc water main.
This water main appears to be 4' east of the 4/5 lot line. It also appears to be approximately 4' west of
607 Milwaukee Drive ( house constructed in 1997). Cover over water main 3' +/-.
8" pvc sanitary sewer main.
This sanitary sewer main appears to be 6' west of the 4/5 lot line.
Location of clean out on this line appears to be 17 . south of the common point for lots 4,5 . 23 and 23.
8-16-06 Doyle measured down for the sanitary sewer depth @ the clean out. It was 8' to the fiow line.
Per the inspection sheet for 609 Milwaukee Drive 4-18-06 the 4" lateral line was 6' deep 48' south of the
manhole at Milwaukee Drive. Cover over sanitary sewer 6' +/-.
12" pvc storm drain main.
Per Doyle's inspection on 8~ 11-06
Main appears to be 4.2 ' +/- deep as shown on city records
Per the site plan submitted for the 1 997 building permit @ 607 Milwaukee Drive it appears that the
structure does encroach into the 12.5 utility easement by 4.5 '.
Per the site plan submitted for the 2005 building permit @ 601 Milwaukee Drive it appears that the
structure may encroach into the 12.5 utility easement by 0.5'. at the NW corner.
There appears to be a concrete retaining wall constructed between lots 4 & 5. Height varies from 2' to 4'.
Regarding the grading on the north side of Milwaukee Drive, the dumping was for Sean Halberg at his
request.
I will forward onto Gary if this information is correct. Feei free to change whatever needs to be done.
