AN ORDINANCE of the City of Port Angeles, Washington, vacating
approximately 5,000 sqlrare feet olunimproved and undeveloped City right-
of-way located between Marine Drive and W. 4th Street, adjoining Potl-
or,vned industrial properly within Block 105, Townsite oFPort Angeles.
WHE,REAS, the Porl of Port Angeles filed Street Vacation Petition No. STV 26-0045 requesting
vacation of r,rnimproved and uncleveloped City right-of-way located between Vlarine Drive and W.4th
Street, adjoining Porl-owned industrial property within Blocks 105 and I 10 of the Tor'vnsite of Port
Angeles, as shown in Exhibit A; and
WHERAS, upon further review of the original application, City staf,f are recorrmending a
reduction olthe proposal provided to the Hearing Examiner by removing all parcels in Block 110'
Townsite of Porl Angeles and "C" Street fiom vacation considet'ation.
WHEREAS, the proposed street vacation is categorically exempt from review under the State
Environmental Policy Act pursuant to WAC 197- 1 1-800(2Xi); and
WHEREAS, public notice was provided pursuant to Chapter 35.79 RCW, and the Hearing
E,xaminer held an open record pr,rblic hearing on April 10,2026; and
WHEREAS, the Hearing Examiner issLred Findings, Conclusions, and Recommendations on
April22,2026. recommending approval of Street Vacation Petition No. STV 26-0045 subject to
conditions; and
WHERAS, the Hearing E,xaminer conclrrs that as long as the Lrpdated street vacation legal
description does not exceed that which was ar-rthorized by their recommendation. there is no need to
amend or revisit the hearing record.
WHEREAS. the City Council finds that the proposed vacation is consistent with Chapter 35.79
RCW, the Porl Angeles MLrnicipal Code. and the Porl Angeles Comprehensive Plan;
NOW. THEREFORE, THE CITY COLI]\ICIL OF THE CITY OF PORT ANGELES DO HEREBY
ORDAIN as follows:
Section t. - Findinss and Adonfion of Exhihits. The recitals set forth above are hereby adopted as the
City Cor.rncil's findings olflact. The Ciry CoLrncil approves and adopts the Hearing
Conclusions. and Recommettclation lor Street Vacation Petition No. STV 26-0045,
Examiner's Findings,
r,vhich are
incorporatecl by this relerence. Exhibit A, inclLrcling the Lrpdated legal description and map of the vacation
area. is incorporated by ret-erence as ilset forlh in full.
Section 2. - Vacation. Subject to the terrns anci conclitions of this Ordinance, the approrimately 5'000
rq** f*t "l *t"rp-vecl and undeveloped City right-of-way located between Marine Drive and W. 4th
Sireet, adjoining Port-or,vnecl inclr-rstrial propefiy within Block 105 of the Tor'vnsite of Porl Angeles' and
legally described and shown in Exhibit A. is hereby'vacated.

Section 3. - Conditions of Vacation. Vacation of the right-of-way described and shown in Exhibit A is
conditioned on fulfillment of all of the following:
l. The petitioner shall pay compensation to the City representing the full appraised valr"re of the
vacation area as determined by Deer Park Appraisal, LLC.
2. The City shall retain necessary easement rights for the construction, operation, repair, replacement,
and maintenance of public utilities and services, including the existing 42-inch stormwater
conveyance located within the vacation area.
3. The petitioner shall prepare and provide a qLrit claim deed or equivalent conveyance instrument
acceptable to the City.
4. The petitioner shall provide a final legal description and exhibit map of the vacation area, subject to
City review and approval.
5. The petitioner shall be responsible for all recording fees. document preparation, and implementation
steps required to finalize the vacation.
6. The final ordinance and associated conveyance documents shall be recorded with the Clallam
Cor"rnty Auditor.
1. Approval of this street vacation does not authorize development and does not waive compliance with
any other applicable local, state, or federal regr-rlations. All future development activities remain
subject to separate permit review and approval.
Section 4. - Severabilitv. If any provision of this Ordinance, or its application to any person or
circumstance, is held invalid, the remainder of the Ordinance, or application of the provisions of the
Ordinance to other persons or circumstances, is not affected.
Section 5. - Effective Date. This Ordinance is an exercise of power specifically delegated to the City
legislative body and is not sr-rbject to referendum. This Ordinance shall take effect five days after the City
provides written notice that the conditions stated in Section 3 have been futfilled. The Director of
Community and Economic Development or their designee shall prepare all necessary documents for
transmittal to the County. The City Clerk is directed to then ftte certified copies with the Clallam County
ALrditor and the Clallam Cor,Lntv Assessor.

subject to referendum. This ordinance shall take effect five (5) days after passage and publication of an
approved summary thereof consisting of the title.
