Dear Ms Woods:
This letter is in regards to your request for connection to the City of Port Angeles sanitary sewer to serve the
above referenced property. With the passing ofCiry Ordinance No. 3082 and the allowance for Urban Growth
Area utility service extensions, Public Works & Utilities is now able to anow the utility connections outside the
city limits.
Connection to the sauitary sewer at Hwy 101 and Gakin Rd will need to be preformed by your licensed utility
contractor. The installation wlll be subject to the following conditions:

Return both agreements to Public Works & Utilities for the Director of Public Works and Cit'j
Clerk signatures. Documents will then be returned to you.
Record both agreements with Clallam County Auditors. Original recorded documents to be
returned to City Clerk
The monthly (outside) utility billing rate is 1.5 times the City's rate for residential service.

utilities for your property. Your contractor will be resjOonsible for underground locates, subrmtting the required
constrUction and traffic control plans and contacting me for inspection scheduling. We require a 24 hour nollce

Road jurisdiction
When the City annexed properties as part of the WUGA project, was there any determination as to who
has the roadway jurisdiction as far as right of way issues? I have a contractor that is requesting a permit
to install a sewer connection to a single family residence at 21 Gakin Rd. The property is on the south
side Hwy 101 across from Fairmount Ave. Since a portion of Gakin Road falls within the Hwy 101 right.of
way, would this be under the City's jurisdiction for road repairs thru the permit processing for the sewer
connect? A portion of Gaikin Rd is also county right of way.
When the contractor excavates to install the sewer line to the dwelling, they were proposing to connect to
the sewer main on the west side of Gakin Rd then excavate to the east across Gakin Rd. The work would
be within that portion of the Gakin Rd right of way belonging to the State Hwy.
My question is, who has jurisdiction for this work in the State Hwy right of way?
The county is saying they do because they maintain Gakin Road. If the county has the jurisdiction then
the contractor would have to pay the county the right of way fee of $180.00 plus the $60.00 .per LF cost for
crossing Gakin Rd. Which would cost $1000.00 +/-. The City does not charge a LF fee for work in the
right of way, but requires the contractor to repair the trench to our specs.
This is a grey area as to who collects the right of way fees and to what specs the road way excavation
repairs would made. Should this be a county fee or a city? Reconstruct Gakin Rd to City, County or
WSDOT standards?
Comments and directions please.
A traffic control plan has been submitted to Public Works and will be reviewed by the Traffic Engineer and
Traffic Control Street Division.
Bill, does WSDOT want to review traffic control plans with regards to work along the Hwy?

COVENANT CONSENTING TO THE FORMATION
OF A LOCAL IMPROVEMENT DISTRICT
The undersigned, owners in fee simple of the real property herein described, consent to the formation of a
Local Improvement District (LID) in the CITY OF PORT ANGELES, Washington, including said property, for
the purpose of installing the public facilities required to improve Gakin Rd to City design standards, including
grading, drainage, pavement, curb, gutter, sidewalk, sanitary sewer, water mains, and other necessary
improvements as authorized by RCW 35.43.040 as now or hereafter amended, and shall be binding on the
owners, their heirs, assigns and successors in interest.
By signing this Covenant, the undersigned, their heirs, assigns and successors, shall be deemed to have
signed a petition initiating an LID including said property, under RCW 35.43.120 as now or hereafter amended,
and shall be precluded from having their signatures counted as part of a protest to divest the City's jurisdiction

The CITY OF PORT ANGELES, a municipal corporation of the State of Washington

consideration of the mutual covenants set forth herein, agree as follows:
WHEREAS, the Property Owner is the recorded owner of property located within Clallam
County, Washington described below; and
WHEREAS, it is the desire of the Property Owner that said property be served with sewer
from the City of Port Angeles and hereby makes application therefore; and

WHEREAS, it is appropriate that the Property Owner grant to the City of Port Angeles
Property Owner's permission to annex the property when it becomes eligible for annexation into the
City of Port Angeles.
NOW THEREFORE IT IS AGREED BETWEEN THE PARTIES as follows:

I. PURPOSE: The Port Angeles City Council has authorized the extension of City sewer
services into the Western Urban Growth Area, and the Property Owner will be using City
sewer service. The approval to use the City's sewer system is subject to conditions, and this
Agreement is entered into to describe some of those conditions.
2. PROPERTY SERVED: The property that is the subject ofthis Agreement is described as
follows:
21 Gakin Road, Port Angeles, located m Clallam County, State of Washington,.
(hereinafter "the Property").
The City of Port Angeles hereby agrees to provide sewer service to the above described
property.
3. AGREEMENT NOT TO PROTEST ANNEXATION: The Property Owner understands
that the City contemplates annexing the property served herein. In consideration of the City
of Port Angeles providing said utility service, the Property Owner hereby grants and conveys
to the City of Port Angeles a Special Power of Attorney to exercise any and all rights said
Property Owner, heirs or assigns and any successors in interest to said Property Owner,
including any purchasers, mortgage holders, lien holders or other persons who may claim an
interest in said property, hereinafter referred to as "Successors in Interest," to accomplish the
following:
(a) To petition to the City of Port Angeles for annexation of any part or all of the
property described above, which petition shall conform to the provisions of paragraph (b)
below.
(b) To accomplish all steps necessary or proper for the annexation of said property
under RCW 35A.l4 and the ordinances and regulations of the City of Port. Angeles for
annexation of property to the City of Port Angeles with zoning consistent with the ordinances.

This Power of Attorney shall be considered a power coupled with an interest and may not be
terminated except at such time as the above described property is no longer served by sewer
facilities by the City of Port Angeles.

The Property Owner agrees to sign any and all notices, petitions and other documents
requested at any time by the City leading to the annexation of the property.to the City of Port
Angeles. The Property Owner does not waive any applicable right to vote in an annexa'i;on
election or to participate in any annexation review procedures provided by statute.
4. GOVERNING LAW: This agreement is subject to all statutes and regulations ofthe United
States and the State of Washington and ordinances and policies of the City of Port Angeles,
relating to the provision of utility service by a municipal provider.
If the City of Port Angeles resolves to annex the above-described property pursuant to RCW
35A.14, the Property Owner and Successor in Interest covenant not to challenge same by
referendum or other methods.
This Agreement and Power of Attorney touches and concerilS the real property described
above and so long as the said property is served by sewer service from the City of Port
Angeles, shall run with the land, binding the Property Owner, Property Owner's assigns,
heirs, transferees, Successors in Interest and all who derive an interest therein.
THIS AGREEMENT shall be recorded in the Clallam County Auditor's Office and shall be
referenced upon any or other instruments conveying an interest in said property.

has been borne by the City and its sewer system users. Pursuant to RCW 35.97..025, since such sewer
system will be utilized by newly connecting properties, it is appropriate to establish a reasonable

B. The City Council further determines that beginning January 1,2006, $870.00 per

$1,000.00 per equivalent water meter represents a reasonable basis for a fair sewer system
