SUBJECT: Agreement with American Red Cross for
Use of Vern Burton Center as Mass Care Shelter
In view of current discussions underway on the matter of emergency response, I thought you should
have a copy of the agreement for reference purposes. I am uncertain as to whether there are
duplicating commitments for the use of the Vern Burton Center, or whether one can work
cooperatively with the other.
By copy of this memorandum, I am also informing Marc Connelly of the existence of the agreement
with the Red Cross.

At this morning's staff meeting, reference was made to the use of the Vern Burton Center for the
families of City employees in the event of some type of disaster. I recalled the existence of the
attached agreement, dated March 21, 1995, with the Clallam County Chapter of the American Red
Cross. This agreement authorizes Red Cross the use of the Vern Burton Center as a mass care shelter.

FACILITIES AS MASS CARE SHELTERS

This Agreement is made and entered into between the
governing board of City of Port Angeles of Clallam
County, state of Washington, and the Clallam County Chapter
of the American Red Cross.
Pursuant to the terms of federal statutes, the Red Cross
provides emergency services in behalf of individuals and
families who are victims of disaster. City of_Port_Angeles- is
authorized to permit the Red Cross to use Vern Burton 's
buildings, ground, and equipment for mass care shelters
required in the conduct of Red Cross Disaster Services
activities, and wishes to cooperate with the Red Cross for
such purposes.
The parties hereto mutually desire to reach an understanding
that will result in making the aforesaid facilities of
Vern Burton Corrrnunity Centeravailable to the Red Cross for the
aforesaid use. Now, therefore, it is mutually agreed
between the parties as follows:
1. City of Port Angeles agrees that, after meeting its
responsibilities to pupils /parishioners /members /clients, it
will permit, to the extent of its ability and upon request
by the Red Cross, the use of its physical facilities by the
Red Cross as mass shelters'for the victims of disasters.
2. The American Red Cross agrees that it shall exercise
reasonable care in the conduct of its activities in such
facilities and further agrees to replace or reimburse
City of Port Angeles for any foods or supplies that may
be used by the Red Cross in the conduct of its relief
activities in said mass shelters.
3. Notwithstanding any other agreements, the Clallam County
Chapter of the American National Red Cross agrees to defend,
hold harmless, and indemnify the City of Port Angeles
against any legal liability in respect to bodily injury,
death, and property damage, arising from the negligence of
the said chapter during its use of the property belonging to
the said City of Port Angeles

In witness thereof, the governing board of the
City of Port Angeles has caused this agreement to be executed
by the Mayor of its governing board, and the American
Red Cross has caused this agreement to be executed by the
Clallam County Chapter, said agreement to become effective
and opera ive upon the fixing of the last signature hereto.
