THIS AGREEMENT, entered this 27th day of Septemher , 1994, by
and between the National Park Service, United states Department of
the Interior, represented by the Superintendent, Olympic National
Park, and the Port Angeles Police Department, represented by the
Chief of Police of Port Angeles, Clallam County Sheriff's Office,
represented by the Sheriff of Clallam County, Washington State
Patrol, represented by the , United States
Custom Service, represented by the Resident Agent in Charge, United
States Border Patrol, represented by the CHIEF PATROL AGENT
Uni ted States Coast Guard, represented by the ,
Washington State Department of Fish and Wildlife, represented by
the , Lower Elwha Tribal Police, represented
by the Chief of Police of the Lower Elwha S'Klallam Tribe, and the
Sequim Police Department, represented by the Chief of Police of
Sequim.
WITNESSETH:
WHEREAS, it is recognized that the Port Angeles Police
Department, (herein referred to as PAPD), Clallam County Sheriff's
Office, (herein referred to as the CCSO), Washington State Patrol
(herein referred to as WSP), United States Custom Service, (herein
referred to as USCS), United States Border Patrol, (herein referred
to as USBP), Washington State Department of Fish and Wildlife,
(herein referred to as WSDFW), Olympic National Park, (herein
referred to as the NPS), Lower Elwha S'Klallam Tribal POlice,
(herein referred to as the Lower Elwha S'Klallam Tribal Police) are
responsible for their various areas of jurisdiction for the protec-
tion of public and apprehension of violators of the law: and,
WHEREAS, it is further recognized that in order to dispatch
their enforcement responsibilities that each of the above depart-
ments (herein referred to as the agencies) must maintain a firearms
training program to insure the proficiency and safety of their law
enforcement personnel: and,
WHEREAS, it is the desire of the agencies to insure that any
firearms training program does a minimal amount of damage to the
environment and be as safe and cost effective as possible: and,

WHEREAS, it is recognized that by pooling their resources,
each agency might enj oy the benefits of a safer, more cost
effective and environmentally considerate facility; and,
WHEREAS, the City of Port Angeles has a parcel of land, which
has been previously disturbed adjacent to the Port Angeles Landfill
site that the city of Port Angeles is willing to manage as the City
of Port Angeles Law Enforcement Regional Training Center which will
include a law enforcement training firearms range; and,
WHEREAS, the National Park Service has an existing request for
assistance from the U.S. Military for the construction of the fire-
arms range:
NOW, THEREFORE, the agencies, agree as follows:
a. The City of Port Angeles has or will:
1. As the sole owner, provide the above
parcel of land for the construction
of a regional law enforcement train-
ing firearms range and administer
that range for the use and benefit
of the agencies involved in this
agreement and any additional
agencies as agreed to by the
participants to this agreement.

5. Provide guidance on issues of safety
to the agencies involved in the
project.
b. Olympic National Park has or will:
1. Generate any request for assistance
from the military units involved in
construction and support during the
construction phase.

2. Assist, as requested, in the
development and writing of any SEPA
compliance documents and obtain the
required NEPA approval prior to
construction.
3. Prepare plans for materials and cost
estimates for the construction of a
24 by 20 foot building to be con-
structed on site.
4. Construct a 24 by 20 foot building
upon the site upon completion of the
firearms range construction, on a
concrete slab provided by the
military.
c. Each participating agency will:
1. Hold the City of Port Angeles, its
officers, agents and employees and
any other participating agency, its
officers, agents and employees,
harmless for any injuries or damages
sustained during participation in
any activity at the City of Port
Angles Law Enforcement Regional
Training Center.
2. Pay any costs incurred by the City
of Port Angeles for maintenance and
any improvements which are agreed
upon in advance.
3. Provide a certified range officer to
supervise all range activities and
insure range safety at all times
agency employees are using the law
enforcement training firearms range
at the regional training center for
live fire exercises. Insure that
the range safety plan is followed.
4. Return all facilities to a safe and
serviceable state upon the comple-
tion of the training activity. This
includes the collection and disposal
of any brass or refuse and immediate
correction of any hazardous condi-
tions which are correctable onsite
and the immediate notification to
the City of Port Angeles of hazards
which require mitigation beyond the
capabilities of the range officer in
charge.

5. Provide a representative to a
working group that will develop and
oversee a safety plan for the site.
This group will meet bi-annually and
additionally as needed. The plan
created by this group will be sub-
mitted for approval to the Police of
Chief of the City of Port Angeles
and to its liability carrier. The
safety plan will be included as
Appendix A to this document and
could be modified by the agencies as
needed, upon approval of the City of
Port Angeles.
6. Agree that this use agreement may be
amended or revised as deemed
necessary.
7. Agree that the use agreement may be
amended to allow participation by
additional qualified law enforcement
agencies from the Olympic Peninsula
region.

WITNESSETH:
WHEREAS, it is recognized that the Port Angeles Police

Agency, in the manner and to the
extent provided by the Federal Tort
Claims Act, as amended (28 USC 1346,
2671-2680), shall be liable for, and
shall hold the City of Port Angeles
harmless from, claims for damage or
loss of property, personal injury or
death caused by the negligent or
wrongful acts or omissions of any
employee of the Federal government
while act1ng within the scope of his
office or employment in the per-
formance of this agreement;
Provided, That in the event that the

oversee a safety plan for the site.
This group will meet bi-annually and
additionally as needed. The plan
created by this group will be sub-
mitted for approval to the Chief of

could be modified by the agenc1es as
needed, upon approval of the City of

WITNESSETH:
WHEREAS, it is recognizp.d that the Port Angeles Police
Department, (herein referred to as PAPD), Clallam County Sheriff's
Office, (herein referred to as the CCSO), Washington State Patrol
(herein referred to as WSP), United States Custom Service, (herein
referred to as USCS), United States Border Patrol, (herein referred
to as USBP), Washington State Department of Fish and Wildlife,
(herein referred to as WSDFW), Olympic National Park, (herein
referred to as the NPS), Lower Elwha S'Klallam Tribal Police,
(herein referred to as the Lower Elwha S'Klallam Tribal Police) are
responsible for their various areas of jurisdiction for the protec-
tion of public and apprehension of violators of the law; and,
WHEREAS, it is further recognized that in order to dispatch
their enforcement responsibilities that each of the above depart-
ments (herein referred to as the agencies) must maintain a firearms
training program to insure the proficiency and safety of their law
enforcement personnel; and,
WHEREAS, it is the desire of the agencies to insure that any
firearms training program does a minimal amount of damage to the
environment and be as safe and cost effective as possible; and,

WHEREAS, it is recognized that by pooling their resources,
each agency might enjoy the benefits of a safer, more cost
effective and environmentally considerate facility; and,
I WHEREAS, the City of Port Angeles has a parcel of land, which
h~s been previously disturbed adjacent to the Port Angeles Landfill
sfte that the City of Port Angeles is willing to manage as the City
of Port Angeles Law Enforcement Regional Training Center which will
i~clude a law enforcement training firearms range; and,
WHEREAS, the National Park Service has an existing request for
assistance from the U.S. Military for the construction of the fire-

NOW, THEREFORE, the agencies, agree as follows:
a. The City of Port Angeles has or will:

firearms range construction, on a
concrete slab provided by the
military.
c. Each participating agency will:

while acting within the scope of his
office or employment in the
