On Wed. February 27, 2008, our fiel.d crew took shots on the top of the form for
the concrete stem wall for the foundation of the house that was moved to lot 25
of Rolling Hills Subdivision.
The results of our survey are as follows:
Elevation of top of form = 173_12.
Height of peak of roof above the sill plate of the house = 26.33.
Elevation of peak of roof after house is placed on stem wall will be 199.45.

Findings:
Based on the information provided in the Community Development Staff Report for V AR 07-04
dated November 5, 2007, including all information in the public record file, comments and
testimony presented during the public hearing, and the Board of Adjustment's discussion and
deliberation, the City of Port Angeles Board of Adjustment hereby finds that:
1. The applicant, Paul Cronauer, applied for a variance to increase the building height 4.5
feet above the maximum 30 feet allowed for property located at 2507 Rolling Hills Court
on July 30,2007. The applicant's submittal (identified as Attachment B to the November
5,2007, Staff Report for V AR 07-04) indicates that justification for the variance is due to
the steep grade that would be caused by placement of the structure in the proposed
location on the site no more than 30 feet above the pre alteration grade elevation.
2. Notice ofthe requested action was published in the Peninsula Daily News on October 14,
2007, with notices mailed to surrounding property owners on October 10, 2007. The site
was posted on October 11,2007. No written comments were received during the public
comment period.
3. The property is desIgnated Low Density Residential (LDR) by the Comprehensive Plan
Land Use Map. Property directly west and south of the site is designated Medium
Density Residential (MDR). With the exception of properties designated MDR, west and
south of the subject area, the general area is zoned Residential Single Family RS-9.
Properties designated MDR are zoned Residential Medium Density RMD.
4. The 12,011 square foot site is trapezoidal in shape with a 20 foot wide by 61 foot long
(average) "flag" strip providing access from Rolling Hills Court. The site elevation is
lower than surrounding building sites in the same subdivision. Adjacent building sites to
the north are at a lower elevation than the subject site due to gently sloping topography in
the area.
5. The land uses adjacent to the site consist of single family residences to the south and east,
with four-plex multi-family dwelling units to the west. Properties to the north are
currently undeveloped. No structures in the vicinity exceed the allowed height limit for
the zones in which they are located.
6. The site is located in an area of sloping topography. It is not expected that in an area of
sloping topography that each lot will exist on the same topographical plane. Lots in the
subdivision were graded to complement the existing topography. Initial leveling of the
building pads during subdivision development did not significantly alter the site
elevations, however, it did result in terraces and steepened slopes between lots at the
property lines. The entire Rolling Hills Subdivision SIte slopes downward from the
southeast to the northwest. Leveling building sites created a desired stair stepped
topography.
7. Reviewing City departments had no objection to the variance.
8. The City Public Works and Utilities Department does not prescribe an acceptable
driveway grade. Driveway grade is determined on the practicability of use and is the
responsibility of the developer/property owner.

9. Other locations on the site have not been considered in the application analysis.
Alternative placement on the site or minimal on site fill could provide a reduced
driveway slope.
10. In accordance with Sections 197-11-800 (6) (b) and 197-11-908 of the Washington
Administrative Code, and Chapter 15.04 of the Port Angeles Municipal Code, the
proposed variance is categorically exempt from State Environmental Protection Act
threshold determination and environmental impact statement requirements.
Conclusions:
Based on the information provided in the Community Development Staff Report for V AR 07-04
dated November 5,2007, including all information in the public record file, comments and
testimony presented during the public hearing, and the Board of Adjustment's discussion and
deliberation, the City of Port Angeles Board of Adjustment hereby concludes that:
1. The subject property's shape, size, and/or topography does not limit the amount of
buildable area on the site. All placement options have not been considered in the
placement of the structure on the site. The structure can be placed in a manner that will
alter the finish driveway grade.
2. Given the sloping topography of the general area, the subject structure would be
significantly taller than future structures to the north resulting in loss of solar access to
properties north ofthe site. The variance as proposed will be detrimental to other
properties m the general area north of the site.
3. No other structures in the vicinity have been granted a variance for a height increase and
would result in a grant of special privilege.
4. The proposed variance to allow an increase in building height does not meet the criteria
for granting a variance and is not m the public interest.
The motion was seconded by Board Member Smith and passed 4 - 1 with Board Member
Rinehart abstaining.
Board Member Beckett asked how changes in maximum height standards could be
considered. Planner Johns responded that the matter would be one that would require public
heanngs and would be considered by the Planning Commission with action by the City Council.
Mr. Johns noted that such a change would be wide sweeping and would affect nearly everyone in
the community as the existmg standards have been in place for tens of years.

Dear Paul,
I wanted to send a quick note to explain the circumstances regarding the house located a~ 2507,
Rolling Hills Court.
When the permit was issued to move this house onto a new lot within that subdivision, there
was a clear requirement that the house be equipped with.a residential sprinkler system, Port
Angeles Municipal Code requires that all new homes in subdivisions outside of the fire
department four-minute response zone be spri~lered.
We were called for a final last week and-found that the home did not have asprinkler system,
installed. I co?tacted Tom and advised him that a sprinkler system was required bas~c:l upon:;
the municipal code. Tom reviewed the .permit and agreed that the permit did in fact indicate,
the sprinkler requirement. Tom asked for a copy of the municipal code'section and I provided
it.
Tom contacted me and pointed out that there appears to be~a section of the code t~at exempts,
this particular house becau.se it is not a "newly'constructed residential building." I am quite
certain'that this provision was not intended to exempt stru~tures that are moved onto lots in
new subdivisions, however- a literal read of .the' code indicates otherwise,

It is clear to me that this section of the code needs_to be clarified, howevyr as it stands now, the
exemption will be allowed in this instance, for this particular structure orily.
