In early April, 2008, City Building Inspector Jim Lierly noted that construction activity
resulting in the conversion of an accessory structure on property owned by you at 618 East
Tenth Street was occurnng without required permits. A Stop Work Order was affixed to the
structure on April 9, 2008 You applied for a building permit on April 10, 2008, to remodel
the structure to a working business office and general storage A building permit has
not been issued.
During your subsequent visit to this office, you said that the site is occupied by renters The
remodel included electric service changes that require an electric permit, which was not
obtained; and that use of the accessory structure as a separate office would be in conflict
with activities permitted in the RS -7 Residential Single Family zone in which the site is
located. Use of an accessory structure as other than an extension of a permitted residential
use would only be permitted per. Section 17 17 (Home Occupations) of the Port Angeles
Municipal Code. The City's Home Occupations Chapter of the Municipal Code only allow
use of accessory residential structures as an extension of the residential occupancy The
proposed office use would then be a violation of the City's Zoning Ordinance
State law requires that electrical permits be obtained for revision of electrical work per WAC
296 -46B -900. and RCW 19.28.261 Because the residence is not your primary residence, you
are not permitted to perform the work and must have an electrical contractor perform such
work.
Several weeks have passed since posting of the Stop Work Order, and discussion with you in
the office, without action on your part or word as to what you plan to do to remedy the
situation. The site was posted.on May 22, 2008, by the Electrical Inspector noting that
electric service will be disconnected unless required permits have been obtained and site
inspection has been made to ensure that the use is in compliance with development
requirements

PLEASE,NOTE Service interruption to the accessory unit will cause an interruption in
service to the residential unit due to the manner in which the service was extended to the
accessory structure.
In your Apnl 14 letter, you asked that the City keep you informed in venting as to: legal rights
you may have in this matter You noted that you were conferring with legal counsel. Your
legal counsel should be consulted as to your legal rights. Having said that, please note the
following citations
International Builditm Code R.104.6 Rwht of entry Where it is necessary to.make an inspection to
enforce -the provisions of this code, or where the building official has reasonable cause to believe
that there. exists in a structure or upon a .premises a.condition which is :contrary to or in violation of
this code which makes the structure or premises' unsafe,, dangerous or hazardous, the building
official or designee is authorized to enter the structure Or premises at reasonable. times to inspect or
to perform the duties imposed by this-code, provided that if such structure or premises be occupied
that credentials be presented to the 'occupant and entry requested. If such structure. or premises_be
unoccupied, the building official shall first make a. reasonable effort to locate the owner. or other
person having charge or control of the, structure or premises and request entry If entry is refused, the
building official shall.have recourse to the remedies provided bylaw. to secure entry.
Port Angeles Municipal Code (Zonma)..17.96.130 Entry Upon Private Property The Building
Official, members of the Planning Commission, and Planning or Engineering staff, in the
performance of their functions and duties, may on notification, except in an emergency, enter upon
any land and make examinations and. surveys. Provided, that such entries and examinations do not
damage or mterfer-ewith the use of the land by those persons lawfully entitled to the possession
thereof.
In summary Any 'use .of the subject property for uses other than those expected in the
City's single family residential zone occurring on the site is not permitted. As previously
stated, utility service to the site will be disconnected without further notice unless an
electric permit is .obtained by a licensed electric contractor and a site inspection
indicates, no nonconforming use of the site no later than 8 a.m., June 9, 2008.

I am sending you a copy of the letter that was
faxed yesterday to Mr Jim Lierly. In it I explain what
I did to remedy the electrical violation that was
posted on the auxiliary building at 618 East 10
Street. Smce I don't know where all this is headed I
would like to address any further questions or
concerns you may have m writing.
It is my intent to have a private electrical company
inspect the wiring mside the buildmg m question and
have them report to your institution.

building is used for a working business office (C.B.I.) and
general storage. The building was improved about a decade
ago by my mother. The building is a good functional
building and well maintained. I take pride in my property
as I am sure you do with yours.
Recently I have removed the plywood shutters which were
required due to vandalism of the glass windows on the
alley side. Lexan. a UL listed glazing material was used
to repair the broken windows and improve security I wish
to promote my building application to side approximately
40 feet of this building to improve its appearance and
energy efficiency see attached application) There is no
plan to expand the building or it's use.

The electrical outlet box which required a GFCI on the
East side of the building has been removed, electrical wire
taped and plate cover installed and sealed NEC 210 8 I
have called the Public Works and Utilities Dept. and
informed them also
After discussion with my legal council they have mformed
me that no entry may be made on private property except
by legal search warrant. Please keep me mformed in
writing as to any legal rights I may have if this is incorrect.
I don't fully understand my legal rights in these matters
and would appreciate your patience.
