This letter represents the City's formal discontinuance of the contract of services with
you for the provision of radio announcing services for station 1610 AM operated by the
Port Angeles Police Department.
City Council approved this action at their December 2, 2008 meeting. Thank you for
providing this service to the community and please feel free to contact me with any

CONTRACT FOR SERVICES
THIS CONTRACT is made this `day of
between the City of Port Angeles, Washington, hereinafter called
"City and David Brewer, hereinafter referred to as "Contractor
In consideration of payments, covenants, and agreements
hereinafter mentioned, to be made and performed by the parties
hereto, the parties covenant and agree as follows:
1. Scone of Services.
A. The Contractor shall provide radio announcing
services in the form of information and updates to the travelers
information radio station 1610 AM that is operated by the City.
Said services shall include providing tourist information such as
ferry schedules, ferry interruptions, historical sites, park
information, major local attractions, and emergency road
information. The Contractor shall also be available to assist in
emergency disaster situations by providing information to the
general public as disseminated by the City's emergency management
organization.
B. The amount of services provided by the Contractor
shall be at least ten hours per month; provided, however, that
during emergency disaster situations, the Contractor shall be
available to provide radio announcing services on an extended basis
as required by the City in order to provide emergency information
to the public.
2. Compensation for Services. The City shall pay the
Contractor $100 per month for services rendered in accordance with
paragraph 1 above.
3. Term of Contract. The term of this Contract shall be
indefinite and shall be terminable upon thirty days' written notice
by either party to the other.
4. Independent Contractor Status. The relation created by
this Contract is that of independent contracting entities. The
Contractor is not an employee of the City and is not entitled to
the benefits provided by the City to its employees. The City does
not have sufficient, available manpower to perform the services
being provided under this Contract, and without Contractor's

availability, said work could not otherwise be accomplished. The
Contractor, as an independent contractor, has the authority to
control and direct the performance of the details of the services
to be provided. The Contractor shall provide whatever materials
are necessary to perform said services, provided that the City
shall provide the radio transmission facilities and may provide
extra materials in the event circumstances justify. The Contractor
shall assume full responsibility for payment of all Federal, State,
and local taxes or contributions imposed or required, including,
but not limited to, unemployment insurance, Social Security, and
income tax.
5. Breach. In the event of either party's material breach
of the terms or conditions of this Contract, the non breaching
party reserves the right to withhold payments or services until
corrective action has been taken or completed. However, the party
shall not exercise this right until it has given written notice of
such material breach to the breaching party and ten days have
passed since the receipt of such notice. This option is in
addition to and not in lieu of the any other right which State law
offers for breach of contract.
6. Assignment. The Contractor shall not assign or
subcontract any of the work covered by this Contract without the
written consent of the City.
7. Modification. Any modification of this Contract shall be
in writing and signed by both parties.
IN WITNESS WHEREOF, the parties hereto caused this Contract to
be executed the day and year first hereinabove written.
