AGREEMENT FOR SHARING STORM DRAINAGE IMPROVEMENT COSTS
THIS CONTRACT is entered into by and between the CITY OF PORT ANGELES and
SAFEWAY INC., for the purpose of sharing the cost of storm drainage improvements on Lincoln
Street between Fourth Street and the alley between First and Second Streets.
WHEREAS, the construction of a new Safeway food center in the City of Port Angeles
will cause a direct impact on surface water drainage in the Lincoln Street area, and
WHEREAS, the City Engineer has determined that storm drainage improvements can be
designed and constructed to efficiently address the needs of the Safeway project while also
accommodating future growth in the area,. and
WHEREAS, Safeway will be entitled to enter into a developer reimbursement agreement
with the City pursuant to Ch 13.68 PAMC in order to recover a pro -rata share of the costs from
subsequent users of the storm drainage improvements, and
WHEREAS, Safeway is required by Ordinance 2845 to pay the City $126,000 as
compensation for vacating a portion of Fourth Street at the site of the new store; and
WHEREAS, the City Council has previously recognized the public policy benefits of
applying street vacation proceeds to necessary improvements in the City rights -of -way, and
WHEREAS, due to the factors mentioned above, the parties have determined that it is fair
and appropriate for the City to offset the cost of the storm drainage improvements by $40,000 as
a credit against the compensation owed by Safeway to the City for vacation of a City street with
Safeway paying the remainder;
NOW, THEREFORE, in consideration of the above representations and the agreement set
forth herein, the parties hereby agree as follows
1. Safeway Inc. will install storm drainage improvements in accordance with the
requirements of the City's Public Works Department and State and City regulations in the Lincoln
Street area of the City of Port Angeles and will pay all costs thereof except as set forth in
Paragraph 2 below. The agreed scope of work for such project is described in the letter to Mr.
Mitchell Johnson from Bush, Roed and Hitchings, Inc., dated February 16, 1995 These
improvements will be constructed under private contract by Safeway and, upon completion,
dedicated to the City of Port Angeles. This is not a "public works" project
2. The City of Port Angeles will offset the cost of installing said storm drainage
improvements by granting Safeway a $40,000 credit against the compensation owed by Safeway
to the City for vacation of a portion of Fourth Street.
3. Pending completion of these storm drainage improvements, Safeway will be
permitted to make temporary storm connections for its new store to the existing combined

system. Safeway's installation of these improvements will eliminate the need for detention and
biofiltration facilities for its proposed new store.
4. Safeway may enter into a developer reimbursement agreement with the City in
order to recover a pro -rata share of the total cost of the improvements from subsequent users of
the system, provided that no costs in addition to the $40,000 contributed by the City under this
Agreement shall be recovered from the City pursuant to a developer reimbursement agreement.
5. The parties represent that the undersigned signatories have full and complete authority
to execute this contract.

This letter is to inform you of our understanding of the scope and design issues for the Lincoln Street
storm drainage improvement project. This letter incorporates review comments by Mr. John Keegan.
The proposed project will help to alleviate combined sewer overflows into the receiving creek during
peak rain fall events. The criteria that generally controls the costs and layout of the storm drain line
are the length of the line, size, depth, locations of inlets for collection of street drainage, and surface
restoration requirements. Each of these items is discussed below. Also attached is an exhibit of the
proposed Lincoln Street storm drainage project.
Length:
The Lincoln Street storm drain will be constructed between the alley north of 2nd Street to the south
side of 4th Street. A stub will be provided at the final manhole in 4th Street for future extension to
the south.
Size:
A basin analysis, which has yet to be approved by city personnel, has been developed. Sizing of the
pipe follows the generally accepted method for modeling of storm water peak flow rates, the rational
method. The design storm return frequency used for sizing of the pipes is the 25 -year storm. Based
on these criteria a 24 -inch diameter pipe size has been selected. Concrete or high density
polyethylene pipe with watertight connections will be used throughout the project.
Depth:
The depth of the storm drain line effects the ability of surrounding properties to connect their storm
drains to the line. Throughout the length of the project we have selected an invert depth of 8 feet for
two reasons. First, at 8 feet deep it will allow surrounding property owners to connect to the line
from both sides of the street. Second, these connections will not conflict with the existing 24 -inch
sewer below it which has an invert of 12 to 16 feet deep. Based on the City's preliminary review, the
selected depth is acceptable.

Inlets:
Sixteen inlets for storm drainage have been located as specified by Mr. Gary Kenworthy, with the city
of Port Angeles. The inlets conform to the WSDOT standard type 1 catch basin with a modification
such that water flows through a curb opening to enter the structure. However, in 2 locations, 48 -inch
diameter manholes are required due to conflicts with other utilities. The locations of the inlets, as
specified by Gary Kenworthy, are as follows:
(2) alley between 2nd 1st Street
(4) 2nd Street
(2) alley between 2nd 3rd Street
(5) 3rd Street
(3) 4th Street (2 will be 48 inch manholes)
Sizing of connecting pipes for the inlets is as follows:

12 -inch diameter for pipes that cross a right -of -way centerline,
8 -inch for any other interconnecting pipes.
Improvements to existing utilities other than storm drains water and sewer lines) which are
discovered during construction will be the responsibility of the City.*
Sidewalk:
The installation of the inlets in the street will require a limited amount of sidewalk restoration
associated with the through curb installation. The limits of sidewalk restoration are shown on the
plan.
Manholes:
A total of five 54 -inch diameter manholes will be required for installation of the 24 -inch storm drain.
The location of these manholes has been reviewed by Mr. Kenworthy.
Traffic Control:
It will be the responsibility of the contractor to maintain adequate traffic flow throughout the duration
of the construction project. The contractor will meet with the City to develop an acceptable traffic
control plan.
Pavement Markings:
Any pavement markings or paint striping which is impacted by the construction project will be
restored to its original condition by the contractor.
*It is the contractor's responsibility to relocate any existing
utilities that are in the way of the new storm drain, but it is
not the contractor's reseonsibility to ungrade or improve the
onalmty of any such relocated utilities.

Pavement Restoration:
The City requires that the storm drain trench be backfilled with control density fill (CDF). This is a
cement slurry that sets hard and fast so traffic can use the surface soon thereafter. This will amount
to a depth of about 5 feet of CDF for the length of the 24 -inch storm drain line and 3 feet for
connecting pipes. In addition, pavement patching to match the existing pavement thickness is
required for the final wearing surface. A pavement overlay of the entire street will not be required.
Timing:
Based on a conversation with Mr. Kenworthy, the city would prefer that construction of the storm
dram be completed prior to October 1, 1995. In fact, the "temporary" connection to the existing 24
inch sanitary sewer is only approved until October 1, 1995. Therefore, the 24 inch storm drain will
need to be completed prior to October 1, 1995, if the on -site storm drain is constructed and
temporarily hooked up to the sanitary sewer.
Permits:
The only permit required for construction of the Lincoln Street storm drain is a Right -of -way Use
Permit. Mr. Kenworthy pointed out that one of the conditions of the permit will be the development
of a traffic control plan. As mentioned earlier, this plan will be provided by the contractor.
