subdivision may purchase goods and services covered by the contract on the same terms and conditions as tie Sate of Washington. Such a pur-
chase by the political subdivision may be effected by a purchase order directed by the political subdivision to the vendor or other party con-
tacting to furnish goods or services to the State. The Sate Purdasing Division accepts no responsibility for the performanea of any purchasing
contracts by the vendor and the State Purdasing Division accepts no responsibility for the payment of the purchase price by the political sub.
division.
(4) The political subdivision reserves the right to contract independently for the purchase of any particular doss of goods or acmes*, with or without
notice to the State Purchasing Division.
(5) The Sate Purchasing Division reserves the right to exclude the undersigned political subdivision, or any dam oontaWng the utdenigned politiat
subdivision, or politic subdivisions in general, from any particular purchasing contract, with or without notice to the politic subdivides.
(6) This Agreement shall continue in force until cancelled by either party, which canceWdon may be effected with or without notice to the other

RE: Intergovernmental Purchasing Agreement
Shall the City Council authorize the Mayor to enter into an agreement
with the State of Washington for intergovernmental purchasing?
From time to time, the City of Port Angeles has the opportunity to
purchase items from the State, pursuant to RCW 39.34.030. However,
if we wish to use State contracts, we must sign a formal agreement
with the Office of State Procurement.
RECOMMENDATION
The City Council authorize the Mayor to sign the agreement with the
State of Washington for Intergovernmental Cooperative Purchasing.

SUBJECT: PROCEDURE FOR REGISTRATION FOR POLITICAL SUBDIVISIONS FOR
PARTICIPATION IN STATE PURCHASING RCW 39.34
Under RCW 39.34.030, public agencies wishing to use State Contracts must sign
a formal agreement with the Office of State Procurement.
The Attorney General's Office has prepared the attached form, INTERGOVERNMENTAL
COOPERATIVE PURCHASING AGREEMENT, for this purpose.
The attached forms must be completed and signed by a representative of the
agency's governing body, i.e., Mayor, City Manager, County Commissioner, etc.
The agreement shall be returned to the Office of State Procurement for
countersigning, assignment of identification number and filing with the State
Division of Archives. Three (3) countersigned and number- identified copies will
be returned for you local distribution. This procedure is in accordance with
RCW 34.34.040.
To properly register for this PROGRAM you must do the following:
1. Complete an INTERLOCAL COOPERATIVE PURCHASING AGREEMENT (attached).
2. Complete the REGISTRATION /RENEWAL FORM (attached.
3. Return the AGREEMENT and the REGISTRATION /RENEWAL /ORDER FORM, together
with your check or purchase order for the amount of the ANNUAL (once -a-
year) FEE of $50.00.
Please note that the INTERLOCAL COOPERATIVE PURCHASING AGREEMENT has a section
to indicate if you wish to purchase from State Central Stores. Do not overlook
this opportunity.
By registering in this program you will receive the same service and
accessibility to Office of State Procurement services that state agencies
currently enjoy. The CONTRACT PARTICIPATION PROGRAM will insure automatic
receipt not only of established contracts and contract changes, but of
replacement and new contracts as they are published. Your registration also

INTERGOVERNMENTAL COOPERATIVE PURCHASING AGREEMENT
Pursuant to Chapter 39.34 RCW and to other provisions of State law,
the City of Port Angeles and Klickitat County hereby agree to a

the payment of the purchase by Klickitat County.

of goods or services, with or without notice to City of
Port Angeles.

ISSUE
Shall the City enter into an inter governmental cooperation agreement
with Klickitat County to purchase goods and services under the City's
contract?
BACKGROUND /ANALYSIS
Earlier this year, the City called for bids on a wheel -type loader
for the Public Works (Street) Department. The bid was awarded to
NC Machinery.
Mr. Ed Hoyle, Public Works Director for the Klickitat County Public
Works Department, has contacted the City with a request to allow
Klickitat County to purchase a wheel -type loader under the City's
bid and award to NC Machinery. An inter governmental cooperation
purchase agreeemnt for this purpose is attached.
RECOMMENDATION
We recommend the Council approve the inter governmental agreement
with Klickitat County and authorize the Mayor to sign the agreement.

Steve and Bill Moore from N.C. Machinery have been discussing Klickitat
County's purchasing a Cat 926 Loader under your bid.
Enclosed is a copy of an Intergovernmental Purchasing Agreement we have
used with other agencies. If you have any questions, or want to make changes,

BACKGROUND /ANALYSIS
Earlier this year, the City called for bids on a tractor /mower for
the Public Works (Street) Department. The bid was awarded to Coast-
line Ford Tractor.
Mr. John Easley, Fleet Operators Manager for the Thurston County
Public Works Department, has contacted the City with a request to
allow Thurston County to purchase a tractor /mower under the City's
bid and award to Coastline Ford. An inter governmental cooperation
purchase agreement for this purpose is attached.
RECOMMENDATION
We recommend the Council approve the inter governmental agreement
with Thurston County and authorize the Mayor to sign the agreement.

INTERGOVERNMENTAL COOPERATIVE PURCHASING AGREEMENT
THIS AGREEMENT, is made pursuant to Chapter 39.34 RCW
between the City of Port Angeles, hereinafter "City and
Thurston County, hereinafter "County."
The parties hereto agree to the terms and conditions of
this Agreement as follows:
1. DURATION.
This Agreement shall commence when approved by
both the City and the County and shall continue in
force until cancelled by either party.
2. PURPOSE.
The parties enter into this agreement to extend to
the County the right to purchase goods and services under
the City's contracts.
3. TERMINATION.
Either party may terminate this Agreement upon ten
(10) days written notice to the other party.
4. LEGAL /ADMINISTRATIVE ENTITY.
No separate or administrative entity is intended
to be created under this Agreement.
5. GENERAL CONDITIONS.
AGREEMENT 1
A. The City, in contracting for the purchase of
goods and services for the City, agrees to extend
said contracts to the County. The County shall
have the ability to purchase goods and services
under these contracts.
B. The County will be responsible for complying
with the laws and regulations governing purchases.
The County is to submit its purchase order for
goods and /or services under the City's contracts
directly to the vendor or other party contracting
under the City's contracts and the vendor or other
party shall deliver the goods and /or services
directly to the County.
C. The County shall be responsible for payment
of goods and /or services directly to the vendor or
other party under the City's contracts. The City
shall not be responsible for the payment or the
performance of the contracts entered into by the
County under the City's contracts.

D. The County shall have the right to contract
independently for the purchase of any goods or
services outside of the City's contracts with or
without notice to the City.
E. The City reserves the right to exclude the
County from any particular purchasing contract
with or without notice to the County.
F. The City Engineer /Public Works Director shall
be the City's representative for carrying out the
terms of this Agreement. The County's Engineer/
Public Works Director shall be the County's
representative for carrying out the terms of this
Agreement.
G. No real or personal property shall be jointly
acquired nor jointly used in this cooperative
undertaking.
