The Sate Purdasing Division accepts no responsibility for the performanea of any purchasing contracts by the vendor and the State Purdasing Division accepts no responsibility for the payment of the purchase price by the political sub. division. (4) The political subdivision reserves the right to contract independently for the purchase of any particular doss of goods or acmes*, with or without notice to the State Purchasing Division. From time to time, the City of Port Angeles has the opportunity to purchase items from the State, pursuant to RCW 39.34.030. However, if we wish to use State contracts, we must sign a formal agreement with the Office of State Procurement. RECOMMENDATION The City Council authorize the Mayor to sign the agreement with the State of Washington for Intergovernmental Cooperative Purchasing. Michelle M. The Attorney General's Office has prepared the attached form, INTERGOVERNMENTAL COOPERATIVE PURCHASING AGREEMENT, for this purpose. The attached forms must be completed and signed by a representative of the agency's governing body, i.e., Mayor, City Manager, County Commissioner, etc. The agreement shall be returned to the Office of State Procurement for countersigning, assignment of identification number and filing with the State Division of Archives. Three (3) countersigned and number- identified copies will be returned for you local distribution. This procedure is in accordance with RCW 34.34.040. BACKGROUND /ANALYSIS Earlier this year, the City called for bids on a wheel -type loader for the Public Works (Street) Department. The bid was awarded to NC Machinery. Mr. Ed Hoyle, Public Works Director for the Klickitat County Public Works Department, has contacted the City with a request to allow Klickitat County to purchase a wheel -type loader under the City's bid and award to NC Machinery. An inter governmental cooperation purchase agreeemnt for this purpose is attached. Mr. John Easley, Fleet Operators Manager for the Thurston County Public Works Department, has contacted the City with a request to allow Thurston County to purchase a tractor /mower under the City's bid and award to Coastline Ford. An inter governmental cooperation purchase agreement for this purpose is attached. This Agreement shall commence when approved by both the City and the County and shall continue in force until cancelled by either party. 2. PURPOSE. The parties enter into this agreement to extend to the County the right to purchase goods and services under the City's contracts. 3. TERMINATION. Either party may terminate this Agreement upon ten (10) days written notice to the other party. 4. LEGAL /ADMINISTRATIVE ENTITY. No separate or administrative entity is intended to be created under this Agreement. 5. GENERAL CONDITIONS. AGREEMENT 1 A. The City, in contracting for the purchase of goods and services for the City, agrees to extend said contracts to the County. The County shall have the ability to purchase goods and services under these contracts. B. The County will be responsible for complying with the laws and regulations governing purchases. The County is to submit its purchase order for goods and /or services under the City's contracts directly to the vendor or other party contracting under the City's contracts and the vendor or other party shall deliver the goods and /or services directly to the County. C. The County shall be responsible for payment of goods and /or services directly to the vendor or other party under the City's contracts. The City shall not be responsible for the payment or the performance of the contracts entered into by the County under the City's contracts.
